Bradford Sears, Jr., City Attorney DATE: May 15, 2018 RE: 2018 Special Election for Election District 1 Post A MEMORANDUM At your request, this is to provide you with the information and time schedules for the Special Election for Election District 1 Post A in conjunction with November 6, 2018, General Election. O.C.G.A. Section provides that each candidate or his designee shall file a notice of his or her candidacy at the office of the Assistant Election Superintendent during the qualifying period of 2 ½ days to start on Monday, August 6, 2018 at 8:30 a.m. and closing on Wednesday, August 8, 2018 at 12:00 noon. In keeping with City custom, the above dates are for the three (3) day period as authorized by law. O.C.G.A. Section provides that the registration books be closed on the 5 th Monday prior to the election unless the Monday is a recognized holiday, then on the next Tuesday. This year that will be Tuesday, October 9, 2018 at 4:30 p.m. I call your attention to O.C.G.A. Section (a)(1) providing for the setting of qualification fees. The fees are set by law at three percent (3%) of the annual salary of the office, in the case of Councilmembers said fees shall be $ I am enclosing herewith a resolution setting the opening and closing dates of the qualification of candidates and a copy of the Notice of Call of Election for the Special Election for Election District 1 Post A. Please note that the resolution authorized the voting by those electors registered to vote in Election District 1 Post A to vote at their normal polling place(s) for the County, State and Federal November 6, 2018 Election.

10 NOTICE OF CALL OF SPECIAL ELECTION AND QUALIFYING REQUIREMENTS Notice is hereby given that the City of Newnan, Georgia, will hold a Special Election Tuesday, November 6, 2018 to elect a Councilmember for Election District 1, Post A, for the City of Newnan to fill the unexpired term of said Councilmember who has resigned his seat, which term expires at the first meeting in January 2020 for which the qualifying fee will be One Hundred Sixty Five and No/100 Dollars ($165.00). Candidates desiring to qualify may do so from Monday, August 6, 2018 at 8:30 a.m. to 4:30 p.m. through Wednesday August 8, 2018 at 12:00 noon by filing a notice of his or her candidacy and paying the qualifying fee to Della Hill, City Clerk and Assistant Election Superintendent, in the Office of the Assistant Election Superintendent (the Office of the City Clerk), Newnan City Hall, 25 LaGrange Street, in the City of Newnan, Georgia. 11 SPECIAL ELECTION RESOLUTION WHEREAS, due to the resignation of the Councilmember representing Election District 1 Post A, a vacancy has occurred for the office of the Councilmember representing Election District 1 Post A; and WHEREAS, the Charter of the City of Newnan, Georgia, provides for a Special Election to be held to fill the unexpired term of a Councilmember whose office becomes vacant; and WHEREAS, O.C.G.A designates that the Special Election be held on certain dates to elect a Councilmember for Election District 1 Post A for the City of Newnan to fill the unexpired term, which term ends at the time of the first meeting in January Due to 2018 being an even numbered year and there being a general election on November 6, 2018, at which time a Special Election may be held in conjunction with the November 6, 2018, General Election; and WHEREAS, the County Elections Office has notified the City that it would be able to hold the City s Special Election in conjunction with the November 6, 2018 General Election. The General Fund Expense budget is being amended by $2,775,359. Additionally, the Confiscated Assets Fund, Hotel/Motel Tax Fund and Rental Motor Vehicle Fund Budgets require an amendment for 2017, as shown by the attached Budget Amendment Request. Background: This Budget Amendment will not change the actual expenditures for This is a requirement of GASB - to ensure that Council has approved all appropriations for the year indicated, regardless of the funding source. The General Fund Expense Budget amendments total $2,775,359 and include the expenditure of funds reserved for the Municipal Auditorium building renovations, repayment of the UWG debt, and various other expenditures related to operations and council approved projects during the year. The special revenue fund budgets being amended include revenue and expenditure amendments due to actual operations and revenue collections during the year, which increased for Funding: N/A. 47 City of Newnan, Georgia - Mayor and Council Date: May 22, 2018 Agenda Item: Consideration of Resolution Dedicating SPLOST 2013 Funds, Impact Fees and Unassigned Fund Balance for Use to Construct LINC Section #4 Prepared and Presented by: Hasco Craver, Assistant City Manager Purpose: Newnan City Council may consider a resolution dedicating SPLOST 2013, Impact Fees and Unassigned Fund Balance to LINC Section #4 project. Background: Newnan City Council, at the May 7, 2018 Capital Projects Work Session, suggested that City Staff present a project budget to construct LINC Section #4 utilizing SPLOST 2013 (Street, Intersection, Sidewalk & Parking Improvements), Impact Fees (East Side Park) and Unassigned Fund Balance, in addition to certain funds already allocated to the project. The City of Newnan released a Request for Proposals for the Construction of LINC #4 on February 26, The City of Newnan received five (5) proposals from qualified firms. The lowest qualified and reliable bidder was Lewallen Construction Company, Inc. Lewallen Construction Company, Inc s proposal set a base bid of $2,889, Newnan City Council, at the May 7, 2018 meeting, awarded the LINC Section #4 Construction Contract to Lewallen Construction Company, Inc. City staff, in preparing a project budget included additional expense activities such as design and construction management, legal, acquisition, appraisal services and owner contingency. The following table represents a total project budget: Project Budget Construction (Base Bid Amount) $ 2,889, Legal $ 20, Design & Const. Management $ 179, Acquisition $ 210, Appraisal Services $ 8, Owner Contingency $ 50, Total $ 3,357, In June 2017, Newnan City Council assigned Impact Fees (East Side Park) as a source of funds for the construction of LINC Section #4. Newnan City Council, at the May 7, 2018 Capital Projects Work Session, directed City staff to prepare a project budget and accompanying resolution dedicating certain SPLOST 2013 (Street, Intersection, Sidewalk & Parking Improvements), Impact Fees (East Side Park) and Unassigned Fund Balance appropriations towards the construction of LINC Section #4. The tables below illustrate a project budget utilizing certain funding sources as directed by Newnan City Council: Currently Available Funds 2017 Impact Fees Available $ 1,608, Total Estimated Outstanding Project Cost $ 3,166, DEFICIT $ (1,557,536.73) Additional Sources of Funds 2018 Impact Fees $ 330, SPLOST 2013 $ 758, Unassigned Fund Balance $ 469, Total $ 1,558, City Staff believes that the above-listed allocation of additional funding sources will not adversely affect the City of Newnan, its infrastructure or its ability to provide quality services to residents and visitors. Please note that the use of Impact Fees (East Side Park) will require a modification of the Capital Improvements Element (portion of the City of Newnan Comprehensive Plan) at a future meeting (City staff annually presents the CIE for consideration and adoption). City staff encourages Newnan City Council to consider renaming certain items within the Capital Improvement Element (CIE) to reflect its desire to continue utilizing recreation impact fees for the construction of a Linear Park (LINC). Funding: SPLOST 2013, Impact Fees, Unassigned Fund Balance

49 Recommendation: In an effort to allow for the timely construction of LINC Section #4, City staff recommends that the Newnan City Council authorize the execution of the resolution dedicating SPLOST 2013 (Street, Intersection, Sidewalk & Parking Improvements), Impact Fees (East Side Park) and Unassigned Fund Balance towards the project. Attachments: 1. Resolution to Authorize the Commitment of Funds from SPLOST 2013, Impact Fees, Unassigned Fund Balance for the Construction of LINC Section #4 Previous Discussions with Council: Newnan City Council, beginning in 2016, discussed their desire to fund, locate and construct a multiuse path system within the City of Newnan. Numerous additional meetings have taken place over time to actualize the construction of the LINC.

50 A RESOLUTION TO AUTHORIZE THE COMMITMENT OF FUNDS FROM SPLOST 2013, IMPACT FEES AND GENERAL FUND UNASSIGNED BALANCE FOR THE CONSTRUCTION OF THE LINC SECTION #4 WHEREAS, the City of Newnan Mayor and Council and the City Manager have discussed the prioritization of capital projects and project funding for the construction of LINC Section #4; and WHEREAS, the City of Newnan is in an excellent financial position to consider committing a specific portion of SPLOST 2013 (Street, Intersection, Sidewalk & Parking Improvements), Impact Fees (East Side Park) and General Fund Unassigned Balance to the General Fund Committed Balance to fund said prioritized capital project; and WHEREAS, the City of Newnan has in the past, only when beneficial to the community and without creating financial hardship for necessary operational funding, committed fund balance for capital projects; and WHEREAS, the said project construction estimates require $758, in SPLOST 2013 (Street, Intersection, Sidewalk & Parking Improvements) funds, $330, in Impact Fee (East Side Park) funds and $469, of the General Fund Unassigned Balance to cover the funding deficit; and NOW, THEREFORE BE IT RESOLVED that the Mayor & Council of the City of Newnan hereby authorize the Finance Director to commit funds in the amount of $758, in SPLOST 2013 (Street, Intersection, Sidewalk & Parking Improvements) funds, $330, in Impact Fee (East Side Park) funds and $469, of the General Fund Unassigned Balance to fund the deficit of the prioritized project (LINC Section #4); and DONE, RATIFIED AND PASSED in regular session, this the day of, ATTEST: Della Hill, City Clerk REVIEWED AS TO FORM: Keith Brady, Mayor Cynthia Jenkins, Mayor Pro Tem C. 51 City of Newnan, Georgia - Mayor and Council Date: May 22, 2018 Agenda Item: Contract Award Consideration for Construction of Fire Station #4 Prepared and Presented by: Hasco Craver, Assistance City Manager Purpose: Newnan City Council may consider and award a contract for a qualified firm to construct Fire Station #4. Background: Identified as a priority on the 2013 SPLOST project list, the construction of Fire Station #4 is designed to enable the City of Newnan Fire Department to better serve its citizenry, visitors and commercial investors with enhanced fire services. Relieving pressure from existing stations as well as providing an opportunity for the deployment of additional fire service and associated emergency services, Fire Station #4 will undoubtedly create an environment of increased safety and fire protection. A comprehensive study led by a member of the Newnan Fire Department determined that the preferred location of Fire Station #4 was north of the historic commercial downtown area. Thereafter, Newnan City Council instructed staff to identify and prepare for the acquisition of an adequate facility site. The current site, 2.2+/- acres located at 3 Farmer Commercial Park Drive, was acquired in May On April 28, 2015 the City of Newnan entered into a contract with Goodwin Mills Cawood for professional services related to the design of Fire Station #4. Upon program confirmation with Newnan Fire Department officials, a final design was prepared. The City of Newnan, on February 26, 2018, released a request for Competitive Sealed Proposals for Professional Firm Fire Station #4 Construction. As with similar projects of type and size, addendums were issued in order to provide clarification to interested firms. Providing additional information to all interested firms through an addendum is a common practice utilized by local governments interested in confirming a project s scope as well as unique owner requirements (i.e. alternate items, schedule, warranty, proposal format, State and Federal requirements, bonding requirements, etc.). Please find a copy of the City of Newnan s Addendum #1, #2, #3 attached herein. The City of Newnan received proposals from five (5) firms. 52 Sunbelt Builders, Inc Highway 36 Covington, Georgia SG Contracting 1760 Peachtree Street, Suite 100 Atlanta, Georgia Upon receipt of proposals, City staff performed a detailed investigation of each firm s wherewithal, project understanding, and previous and similar project experience and proposal responsiveness. In addition, City staff solicited the assistance of project architect, Goodwin Mills Cawood. While carefully considering all proposals, an irregularity appeared. More specifically, responding firms were unclear as to how they should show pricing for Alternate 1 (storage building, generator, trash and pad) within their proposal. The apparent conflict is a result of a lack of clarity between design documents and an answer given as a part of addendum #3. Essentially, the design documents show the need for a generator as part of the project. However, an answer given in addendum #3 states that the generator should be considered as an alternate. It is the opinion of the project team addendum #3 clearly stated that the costs associated with the installation of a generator and accompanying architecture was to be included as an alternate. Newnan City Council, at the April 24, 2018 meeting, entered into a contract with Comprehensive Program Services for the purposes of providing program management services in support of the Fire Station #4 construction project. Comprehensive Program Services was engaged to assist City staff with developing a recommendation for contract award. In an effort to provide greater clarity in advance of recommending contract award, Comprehensive Program Services, as well as certain members of the design team and City staff, hosted interviews with the two lowest bidders (J & R Construction & Development, Inc. and Headley Construction). Interviews were conducted on Wednesday, May 9, Newnan City Council, at the May 7, 2018 Capital Project Work Session, was presented with an estimated project budget of $2,890,000. Additionally, City staff mentioned that there currently exists $1,860,000 in available funds (SPLOST 2013 and Impact Fees). Please note that there exists a funding challenge. Discussed during the May 7, 2018 Capital Projects Work Session, City staff recommended that a contractor be selected and the project team would then perform an exercise that may include a modification of scope that may identify potential costs savings. Thereafter, It is anticipated that the project team will present a final project design and budget as well as any necessary funding recommendations. Funding: Impact Fees and SPLOST 2013 Please note that City staff, including members of the design team and program managers, will conduct a thorough investigation of potential project and construction activities that may result in cost savings. Newnan City Council, at a future meeting, will be presented with a recommendation to utilize certain funding sources for the completion of Fire Station #4.

56 City of Newnan, Georgia - Mayor and Council Date: May 22, 2018 Agenda Item: Consideration of Contract Award for Construction of Human Resources Department Office Suite at Newnan City Hall Prepared and Presented by: Hasco Craver, Assistance City Manager Purpose: Newnan City Council may consider and award a contract for a qualified firm for construction of a Human Resources Department Office Suite and Newnan City Hall. Background: The construction of a Human Resources Office Suite in the ground floor of Newnan City Hall has been identified as a worthwhile use of existing SPLOST 2007 funds, which were originally dedicated to making improvements to Newnan City Hall. The numerous functions and activities managed within the Human Resources Department oftentimes require dedicated and isolated work space. City staff, working in consultation with an architect, developed a set a design documents that were released in an Invitation to Bid on Wednesday, April 11, Four (4) proposals were received from qualified firms. Please see the list of responding firms below: Lewis General Contracting P.O. An interview was held with Lewis General Contracting to confirm the project s scope. Funding: SPLOST 2007 Recommendation: As a result of reviewing the submitted proposals, including all additional supportive information, City Staff is recommending that the Newnan City Council award a contract to Lewis General

57 Contracting in the amount of $75,375 for the construction of a Human Resources Office Suite at Newnan City Hall. The recommendation herein is primarily based upon the following elements: Firm s responsiveness; and Firm s experience constructing similar facilities; and Firms submitted price Attachments: 1. Prepared and Present by: Hasco Craver, Assistant City Manager Purpose: Newnan City Council may consider an amendment to Chapter 2, Administration, Article VI Purchasing, Division 5 Contracting Requirements, Section Performance and Payment Bonds of the Code of Ordinances of the City of Newnan, Georgia to provide regulations for the requirement of performance and payment bonds for certain public works and construction projects. Background: Newnan City Council, at the May 7, 2018 Meeting, waived the performance and payment bond requirement for a construction project to be performed at the CAFI building due to a conflict with State regulations. The subject contract was valued at $ The Code of Ordinances of the City of Newnan requires a performance and payment bond for all public works and construction projects when the contract award exceeds $50,000. City staff was made aware of a conflict between State law governing certain requirements for public works and construction projects. In particular, similar State regulations require that performance and payment bonds need only by required for public works and construction projects when the contract award exceeds $100,000. The current Code of Ordinance of the City of Newnan outlines the following: Sec Performance and payment bonds. Prior to execution of a contract for public works or construction projects, performance and payment bonds shall be delivered to the city as set forth below: (1) When required. Performance and payment bonds shall be required for all public works and construction projects when the contract award exceeds $50, Performance bonds shall be conditioned upon the bidder's faithful performance of the terms of the bid or proposal and the contract executed in connection therewith. Payment bonds shall be executed for the benefit of all persons supplying labor, materials, machinery and equipment in the prosecution of the work provided for in the contract. All sureties must be licensed to do business in the State of Georgia and listed in the Department of the Treasury's publication of companies holding certificates of authority as acceptable reinsuring companies, Circular 570. (2) Amount of performance and payment bonds. Both performance and payment bonds shall be in an amount equal to at least 100 percent of the total contract price. (3) Authority to require additional bonds. Nothing in this section shall be construed to limit the authority of the city to require a performance bond or other security in addition to those bonds, or in circumstances other than specified in subsection (a) of this section. 111 AN ORDINANCE TO AMEND SECTION PERFORMANCE AND PAYMENT BONDS OF CHAPTER 2, PURCHASING, ARTICLE VI, DIVISION 5 CONTRACTING REQUIREMENTS; OF THECODE OF ORDINANCES OF THE CITY OF NEWNAN; AND FOR OTHER PURPOSES WHEREAS, the City Manager of the City of Newnan has determined that an amendment to Chapter 2, Article VI, Purchasing, Division 5 Contracting Requirements, of the Code of Ordinances is desirable to provide for the orderly management of the City s contracts; and WHEREAS, the City s current ordinance required performance and payment bonds on all public works and construction project contracts exceeding $50,000.00; and WHEREAS, State law has been amended raising the threshold on public works and construction project contracts for which performance and payment bonds are required to $100,000.00; and WHEREAS, the City Council of the City of Newnan, upon recommendation of the City Manager, has determined that said amendment to the City s ordinance is in the best interest of the health and welfare of the City s residents and orderly management of the City s public works and construction project contracts to raise the amount on which performance and payment bonds are required for public works and construction project contracts to $100, NOW THEREFORE BE IT ORDAINED by the Mayor and Council of the City of Newnan and it is hereby ordained by authority of the same that Section of Chapter 2, Purchasing, Article VI, Division 5 Contracting Requirements, be and is hereby amended to read as follows: 1
