1 NATIONAL ELEVATOR INDUSTRY, INC. AND IUEC LOCAL NO. 16, NEW ORLEANS, LA LOCAL TRAVEL AND EXPENSE AGREEMENT SECTION 1. PARTIES TO THE AGREEMENT This agreement is made by and between the National Elevator Industry, Inc. (hereinafter referred to as "NEII" and its members as the "Employer") and the International Union of Elevator Constructors Local No. 16 (hereinafter referred to as the "Union" or the "Local"). SECTION II. JURISDICTION The Primaries of the Local shall include the following areas: New Orleans, LA Primary Baton Rouge, LA Primary Jackson, MS Primary The area within a circle of fifteen (15) mile Radius using the New Orleans City Hall as the center. The area within a circle of twelve (12) mile Radius using the Louisiana State Capitol Building as the center. The area within a circle of thirteen (13) mile Radius using the Masonic Temple as the center. The secondary jurisdiction shall include the following parishes and counties: in Louisiana and in Mississippi, LOUISIANA - Acadia, Ascension, Assumption, Avoyelles, Baton Rouge East, Baton Rouge West, Concordia East, Concordia West, Evangeline, Plaquemines, Pointe Coupee, St. Benard, St. Charles, St. Helena, St. James East, St. James West, St. John the Baptist, St. Landry, Feliciana East, Feliciana West, Iberia,Iberville, Jefferson East, Jefferson West, Lafayette, Lafourche, Livingston, St. Martin North, St. Martin South, St. Mary, St. Tammany, Tangipahoa, Terrebonne, Vermillion, Washington. MISSISSIPPI - Adams, Amite, Hancock, Harrison, Pearl River, Pike, Wilkinson, and that area which falls within a thirty-five (35) mile radius of the Masonic Temple in Jackson, MS. SECTION III. TRAVEL ALLOWANCE Two zones are established around the New Orleans primary and the Jackson primary, and one zone around the Baton Rouge primary for the purpose of determining travel allowance:
2 ZONE A This zone shall include that area outside of the respective primary and within a radius of twenty-five (25) miles from the New Orleans City Hall, twenty-five miles (25) miles from the Masonic Temple in Jackson, MS. and twenty (20) miles from the Louisiana State Capitol in Baton Rouge. A travel allowance of $16.99 per day shall be paid for New Orleans and Baton Rouge and $15.60 per day shall be paid for Jackson to elevator mechanics and helpers reporting to a job site in Zone A at the regular starting time, working eight (8) hours and leaving the job at the regular quitting time. When the Local receives the next wage increase, the total increase per hour of the mechanic and helper shall be combined and fifty percent (50%) of that total shall be added to the prevailing travel allowance in Zone A. ZONE B This zone shall include the area outside of Zone A and within a radius of thirty-five (35) miles from the New Orleans City Hall, and thirty-five (35) miles from the Masonic Temple in Jackson, MS. There is no Zone B for Baton Rouge. A travel allowance of $30.15 per day shall be paid for New Orleans and $27.88 per day shall be paid for Jackson to elevator mechanics and helpers reporting to a job site in Zone B at the regular starting time, working eight (8) hours, and leaving the job at the regular quitting time. When the Local receives the next wage increase, the total increase per hour of the mechanic and helper shall be combined and shall be added to the prevailing travel allowance in Zone B. SECTION IV. PER DIEM Employees working beyond Zone B from New Orleans or Jackson, or beyond Zone A from Baton Rouge, shall be paid per diem and shall have the option of selecting from one of the following options: OPTION A An employee shall be paid $35.00 per day for each day worked and for paid holidays which fall during the normal work week. Where work continues on the job site during the following week the employee will receive the per diem for Saturday and Sunday. OPTION B The employee may elect to stay out of town at or near the job site. Under these circumstances, the employee shall receive a meal allowance of $21.00 per day and will be reimbursed for reasonable lodging expenses based upon receipts. Where work continues on the same job site during the following week, the employee will receive $21.00 per day as a meal allowance for Saturday and Sunday. PER DIEM DOES NOT APPLY TO ONE DAY JOBS. No per diem shall be paid to employees who are assigned to jobs that do not exceed one (1) day. Travel time shall be paid in accordance with Article XIII, Paragraph 1 of the Standard Agreement. When adequate lodging facilities are not available within (15) miles of the job site, employees will lodge at the nearest available adequate place and receive travel expenses in addition to the applicable expenses above.
3 On the last day out, elevator constructors shall be entitled to full per diem, if they complete eight hours on the job. If the job is completed before the end of the regular work day and they travel home on company time during regular working hours, fifty percent (50%) of the per diem shall be paid. When a job is in a resort or boom city, receipts for expenses incurred shall be used as a guide to determine what if any additional expenses are necessary. Any dispute as to what is reasonable shall be discussed and resolved between the Superintendent and the Local Business Representative. Every consideration should be given to arriving at additional expenses prior to sending an employee into a resort or boom area. SECTION V. USE OF PERSONAL VEHICLES When employees are authorized to furnish their own transportation, they shall be reimbursed at the "Standard Mileage Rate" published by the Internal revenue Service, currently thirty-two and one half cents per mile. Future changes in the mileage reimbursement rate shall be based upon this index and shall become effective at the beginning of the pay period following the Company's receipt of notice of the change. After the first stop, employees using their personal vehicles for company business shall be reimbursed for necessary parking and tolls. Contract service personnel, after the first stop, shall receive a minimum of four (4) miles per move and will receive two dollars and fifty cents $2.50 within each twenty-four (24) hour period their vehicles are used for company business,. Should the employee be authorized to use other means of transportation (public), he shall be paid the necessary time involved plus all the transportation charges. Where free parking is not available within four (4) blocks of the job site for construction, modernization and major repair crew employees assigned to a job in the Central Business District (Howard Ave. to Canal St.; Claiborne Ave. to the Miss. River) or the French Quarter (Canal St. to Esplanade Ave.: N. Rampart and the Miss. River), parking will be reimbursed at the rate of up to $6.00 per day worked based upon a stamped/validated or certified receipt presented to the company. Hand written receipts will not be accepted. The employer and employee may mutually agree, ahead of time, on a parking facility where receipts are unavailable. SECTION VI. CARTAGE After the first stop, contract service employees using their personal vehicles for company business, including carrying company materials such as small parts (for example: brushes, relay contacts, leads, coils, fuses, PC boards, lubricants, etc.), meters, small company tools, cleaning accessories and materials, etc, shall be reimbursed at $2.50 per day (24 hour period). Mechanics or helpers who are authorized to transport heavy company materials or parts shall be paid cartage or drayage. The amount of cartage shall be reasonable as to weight and distance. Any disputes as to what is reasonable will be resolved by the superintendent/supervisor and the local business representative.
4 SECTION VII. TRANSFER AGREEMENT It is agreed that the Company may move or transfer an employee on a permanent basis between the primaries provided the following conditions are complied with: A. The transfer of an employee from one primary to another shall be with the consent of the employee. The Local shall have ten (10) days notice in writing prior to the transfer of the employee in order to establish a letter of transfer. B. The Company shall pay the employee the prevailing per diem rate for a period of eight (8) weeks and the Company shall pay reasonable moving expenses for the employee's household effects. C. The Company shall provide work for a period of one (1) year in the primary to which the employee is transferred. If work is not provided for a period of one (1) year, the Company shall pay retroactive per diem to the employee for all time spent in the new primary, plus moving the employee back to the original primary under the conditions in paragraph B above. If the employee fails to move during the one year period, and a physical household move was a condition of the transfer he may be transferred back to his original primary at no additional cost or expense to the employer, upon presentation of a transfer letter to the Business Agent. D. Employees assigned to one of the three primaries may temporarily work in either of the other primaries provided they receive expenses in accordance with the relevant provisions of this agreement. E. New employees shall not be hired in the Baton Rouge primary if experienced employees are available in New Orleans, or vice-versa. The current Mechanics and Helpers form the permanent bench in each sub-primary and primary. SECTION VIII. OTHER PROVISIONS In addition to the paid holidays provided for in Article VI, Par. 1 of the National Agreement, the following local unpaid holidays will be observed: Carnival Day, Good Friday, and All Saints Day. This will affect the New Orleans primary only; Baton Rouge and Jackson primaries are excluded. SECTION IX. LENGTH OF AGREEMENT This agreement shall be effective on APRIL 20, 2000 and will continue as long as satisfactory to both parties, but no change shall be made in less than twelve (12) months. Sixty (60) days notice shall be given by either party of a desire to change this agreement and such written notice shall constitute cause for a meeting of the parties. The IUEC will recognize those contracts or outstanding proposals that precede this agreement and will honor the current expense agreement until April 20, 2001.
5 A map showing the primaries and zones shall be mutually agreed upon by the parties. This agreement shall constitute the entire travel and expense agreement between the parties. Should any item contained in this agreement be found to be contrary to any provision(s) of the National Elevator Industry, Inc. agreement with the International Union of Elevator Constructors, such item shall be null and void.
