1 GPI State Legislation Update February 9, 2015 Health and Packaging Legislation New York Assembly Bill 386 Author: Rosenthal, Introduced 1/6/2015 Summary: This bill would prohibit the manufacture, distribution and sale of certain toys and child care products containing phthalates. STATUS: 1/7/ Referred to the Assembly Committee on Consumer Affairs and Protection Washington House Bill 1984 Author: Pollet, Introduced 2/4/2015 Summary: This bill would prohibit manufacturers, wholesalers, and retailers from manufacturing, selling, offering for sale, or distributing for use in this state, bottles, cups, or reusable food and beverage containers that contain phthalates individually or in combination at more than 0.10 percent by weight or one thousand parts per million or bisphenol-a (BPA). STATUS: 2/4/2015 Referred to House Committee on the Environment Legislation for the Establishment of New Beverage Container Recycling Refund Programs Indiana Senate Bill 142 Author: Randolph, Introduced 1/6/2015 Summary: This bill would create a beverage container recycling refund program for the state. It would establish a 10-cent deposit and exempt deposits from sales taxes. Included beverages include beer, liquor, wine, spirits and any other liquid regulated or licensed by the Alcohol Beverage Control Commissioner. It would also include water, tea and coffee drinks. Dairy products and other drinks with nutritional value are exempt. Metal, glass and plastic containers would be included, if containing the beverage and one gallon or less. The legislation provides for both redemption centers and the use of reverse vending machines (RVMs). 2 Proposed Beverage Container Recycling Refund Program Modifications Hawaii House Bill 167 Author: Kong, Introduced 1/23/2015 Summary: This bill would repeal the state s beverage container recycling refund program, aka bottle bill. Any remaining balance in the container deposit fund would be transmitted to the state s General Fund. No subsequent recycling plan for the state is outlined in the repeal. STATUS: 1/29/2015 Referred to the House Committees on Energy, Environment and Finance Hawaii Senate Bill 1260 Author: Ruderman, Introduced 1/29/2015 Summary: This bill would mandate the recommendations made by the office of the auditor to the department of health regarding advance disposal fee glass containers and glass recycling. It would also require the department of health to report on its implementation of the recommendations to the legislature. STATUS: 2/6/2015 Passed First Reading, to Senate Committees on Energy, Health, Ways and Means Hawaii House Bill 1246 Author: Har Introduced 1/28/2015 Summary: This bill would require the Department of Health to pay recycling redemption centers based upon the weight of containers the redemption centers submit for recycling and not the numbers of containers the redemption centers report as redeemed by consumers. STATUS: 1/15/2015 Bill Filed New York Assembly Bill 495 Author: Engelbright, Introduced 1/1/2015 Summary: This bill would expand the state s container deposit refund program to include fruit juices, ice tea beverages, milk, wine and liquor. It would also require refillable beverage containers to be refilled and resold no less than twenty-five times. STATUS: 1/7/0215 Referred to the Assembly Committee on Environmental Conservation New York Senate Bill 136 Author: Gallivan, Introduced 1/7/2015 Summary: This bill would require any beverage container dealer to redeem a consumer s covered container, if they sell the same brand, type and size, regardless of where the container was purchased in state. The dealer s place of business must be larger than 2,000 square feet. STATUS: 1/7/0215 Referred to the Senate Committee on Environmental Conservation New York Assembly Bill 485 Author: Engelbright, Introduced 1/1/2015 Summary: This legislation would add wine and liquor beverage containers to the state s container deposit refund program. It would also require that all unredeemed deposits be placed into the state s environmental protection and state park infrastructure fund. STATUS: 1/7/2015 Referred to the Assembly Committee on Environmental Conservation Vermont House Bill 104 Author: Yantachka, Introduced 2/3/2015 Summary: This bill would require all distributors and submit 80 of the abandoned deposits on covered beverage containers to the state. The money would be used to further recycling initiatives in-state. Funds from the fee would establish the obesity and chronic disease prevention special fund and the Hawaii interagency obesity prevention council to support obesity prevention programs. STATUS: 1/21/2015 Passed House To Senate Genetically Modified Organism (GMO) Labeling Connecticut House Bill 5276 Author: Steinberg, Introduced 1/21/2015 Summary: This bill would require labeling of genetically modified organisms in food products. STATUS: 1/12/ Referred to Joint Committee on Environment Hawaii Senate Bill 610 Author: Nishihara, Introduced 1/23/2015 Summary: This bill would prevent any county within the state to implement separate and distinct labeling, banning or other requirements pertaining to GMOs. STATUS: 2/3/2015 Referred to the Senate Committees on Ways and Means and Consumer Protection Illinois Senate Bill 734 Author: Koehler, Introduced 2/3/2015 Summary: This bill would create the Genetically Engineered Food Labeling Act. Any food offered for retail sale in the state would be misbranded if it is entirely or partially produced with genetic engineering and that fact is not disclosed in a certain manner on the package. STATUS: 2/6/2015 Referred to Senate Committee on Assignments Minnesota Senate File 335 Author: Marty, Introduced 1/26/2015 Summary: This bill would provide standards for labeling foods produced using genetic engineering and require disclosure of genetically engineered food. 5 New York Senate Bill 485 Author: Lavalle, Introduced 1/1/2015 Summary: This bill would require labeling of genetically modified foods Including raw agricultural commodities, processed foods, seed, and seed stock produced with genetic engineering. STATUS: 1/7/2015 Referred to the Assembly Committee on Agriculture North Dakota Senate Concurrent Resolution Author: Miller, Introduced 1/29/2015 Summary: This resolution urges the U.S. Congress to establish food labeling standards, direct the clarification of voluntary food labeling standards, and provide for a review of foods derived through the use of biotechnology. Rhode Island House Bill 5078 Author: Hull, Introduced 1/15/2015 Summary: This bill would require all food produced with GMOs to be labeled with the following statement Produced with Genetic Engineering. STATUS: 1/15/2015 Referred to the House Committee on Health Tennessee Senate Bill 394 Author: Niceley, Introduced 2/6/2015 Summary: The purpose of this legislation is to create a Non-GMO Project s product verification program for the state. The program would work to verify that a participant s systems and procedures ensure the delivery of products from working Tennessee farms that are not genetically engineered. STATUS: 2/6/2015 Filed for Introduction General Recycling Legislation Colorado House Bill 1206 Author: Singer, introduced 2/3/2015 Summary: This bill would permit, for each of the calendar years 2015 through 2019, the ability to apply for a refund of any state sales tax or use tax paid for machinery or equipment used directly and primarily in the recycling or reprocessing of waste products. 6 not limited to, hypodermic, intravenous, or other medical needles or syringes or other medical household waste containing used or unused sharps, with any other material intended for collection as a recyclable material by a residential hauler. STATUS: 2/5/2015 Referred to the Senate Committee on Assignments Illinois Senate Bill 797 Author: Holmes, Introduced 2/5/2015 Summary: This bill would amend the Electronic Products Recycling and Reuse Act. It would permit to count the total weight of a cathode ray tube device, prior to processing, towards its goal under this Section if all recyclable components are removed from the device and the cathode ray tube glass is managed in a manner that complies with all Illinois Environmental Protection Agency regulations for handling, treatment, and disposition of cathode ray tubes. STATUS: 2/5/2015 Referred to the Senate Committee on Assignments Oregon Senate Bill 263 Sponsor: Dept. of Environmental Quality Introduced 1/12/2015 Summary: This bill would update statewide goals for recovery of materials from general solid waste stream for calendar years 2020 and 2025 and subsequent years. It would also establish specific statewide recovery goals for certain materials. STATUS: 1/19/2015 Referred to the Senate Committee on the Environment and Natural Resources Connecticut House Bill 5714 Author: Alexander, Introduced 1/21/2015 Summary: This bill would reward bars and restaurants for properly recycling bottles and for helping to maintain a clean environment. Specific details on how bars and restaurants would be rewarded are not explained in the legislation, nor are whether or not the initiative would be mandatory. STATUS: 1/21/ Referred to Joint Committee on Environment Licensing and Permitting Legislation for Alcoholic Beverages New Hampshire Senate Bill 93 Author: Sanborn, Introduced 1/8/2015 Summary: This bill would increase the alcohol percentage used to distinguish liquor from other alcoholic beverages. Specifically, ABV for beer would be raised from 6 to 8. STATUS: 2/5/2015 Senate Commerce Committee Recommends the Legislation for Passage Energy and Emissions Legislation California Assembly Bill 21 Author: Perea, Introduced 1/12/2015 Summary: The California Global Warming Solutions Act of 2006 establishes the State Air Resources Board as the state agency responsible for monitoring and regulating sources emitting greenhouse gases. 7 to adopt a statewide greenhouse gas emissions limit, as defined, to be achieved by 2020, equivalent to the statewide greenhouse gas emissions levels in This bill would require the state board to make recommendations to the Governor and the Legislature on how to continue the reduction of greenhouse gas emissions beyond This bill would also require the state board to prepare and approve a scoping plan for achieving the maximum technologically feasible and cost-effective reductions in greenhouse gas emissions. This bill would require the state board, no later than January 1, 2018, to recommend to the Governor and the Legislature a specific target of statewide emissions reductions for 2030 to be accomplished in a cost-effective manner. STATUS: 1/16/2015 Referred to the Assembly Committee on Natural Resources California Senate Bill 32 Author: Pavley, Introduced 1/12/2015 Summary: The California Global Warming Solutions Act of 2006 (AB 32) designates the State Air Resources Board as the state agency charged with monitoring and regulating sources of emissions of greenhouse gases. The state board is required to adopt a statewide greenhouse gas emissions limit equivalent to the statewide greenhouse gas emissions level in 1990 to be achieved by 2020 and to adopt rules and regulations in an open public process to achieve the maximum, technologically feasible, and cost-effective greenhouse gas emissions reductions. This bill would require the state board to approve a statewide greenhouse gas emission limit that is equivalent to 80 below the 1990 level to be achieved by 2050, as specified. The bill would authorize the state board to adopt interim greenhouse gas emissions level targets to be achieved by 2030 and The bill also would state the intent of the Legislature for the Legislature and appropriate agencies to adopt complementary policies that ensure long-term emissions reductions advance specified criteria. It would increase the allotted credit from 10 of the purchase price to 20 of the purchase price.
