1 South Carolina Board of Cosmetology Board Meeting 9:00 a.m., November 20, 2017 Synergy Business Park Kingstree Building 110 Centerview Drive, Conference Room 108 Columbia, South Carolina Meeting Called to Order a. Public notice of this meeting was properly posted at the S. C. Board of Cosmetology office, Synergy Business Park, Kingstree Building and provided to all requesting persons, organizations, and news media in compliance with Section of the South Carolina Freedom of Information Act. b. Rules of the Meeting c. Pledge of Allegiance 2. Introduction of Board Members and All Other Persons Attending Vice Chairperson Laquita Clark-Horton called the meeting of the S.C. Board of Cosmetology to order. Approval of Excused Absences Ms. Marcia Delaney made a motion to excuse the absences of Chairperson Melanie Thompson and Ms. Selena Brown. The motion was seconded by Mr. Eddie Jones and it carried. 4. Approval of Agenda Ms. Stephanie Nye made a motion to approve the agenda with any deviations deemed necessary. The motion was seconded by Ms. Delaney and Mr. Jones and it carried. Page 1 of 13

2 5. Approval of Meeting Minutes September 19, 2017 Mr. Jones made a motion to approve the meeting minutes from the September 19, 2017, meeting. The motion was seconded by Ms. Delaney and it carried. 6. Chair Remarks Melanie Thompson N/A 7. Administrator s Remarks Theresa Brown a. Budget/Drawdowns For Information b. OIE Report For Information - Sharon Wolfe So far this year through November 17 th, a total of 257 complaints have been received. 183 cases have been closed. c. IRC Report For Approval - Sharon Wolfe Ms. Walters made a motion to approve the IRC report and it was seconded by Mr. Jones. The motion carried. d. ODC Report For Information - Kyle Tennis There are currently 41 open cases. 9 (pending attorney review) 1 (pending drafting of consent agreement) 5 (pending response agreement) 8 (pending drafting by a law clerk) 2 (pending board action) 2 (pending scheduling for final order hearings) 1 (appeal at ALC) 1 (pending IRC) 3 (pending scheduling) 8 (pending citation hearings) 1 (case on hold) e. Inspection Report/Citation Report For Approval Eric Thompson For the month of September, there were 380 inspections, whereas 6 of those inspections were schools. For the month of October, there were 580 inspections, whereas 11 of those were schools. Between June and October, there were a total of 2,704 inspections with 40 of the inspections being schools. Currently, there are 6,244 active salons. 8. Old Business In September, there were 21 citations written that consisted of allowing unlicensed practice, expired licenses, and failure to follow sanitation rules. In October, there were 15 citations written that consisted of allowing unlicensed practice, failure to follow sanitation rules, and, and expired licenses. Ms. Delaney made a motion to approve the inspection and citation reports. The motion was seconded by Mr. Jones and Ms. Walters. The motion carried. There was no old business. 9. New Business f. Consideration of CE Packets i. GATE ASSOCIATION LLC There was no representative present as they were informed that their attendance was not needed. This was based on their continuing education packet submission not being received by the deadline. Mr. Jones made a motion to deny the approval of GATE Association to offer CE courses for 2018 and the motion was seconded by Ms. Delaney. The motion carried. Page 2 of 13

3 ii. BEAUTY BUZZ LLC There was no representative present as they were informed that their attendance was not needed. This was based on their continuing education packet submission not being received by the deadline. Ms. Delaney made a motion to deny the approval of Beauty Buzz LLC offering CE courses for The motion was seconded by Mr. Jones and it carried. iii. SC ESTHETICS ASSOCIATION, LLC Ms. Colleen Large represented SC Esthetics Association, LLC. Ms. Delaney made the comment to thank Ms. Large for the inclusion of stating that there is no such thing as a medical esthetician in the state of South Carolina. There were no corrections needed for the submission. Mr. Jones made a motion to approve SC Esthetics Association, LLC, to offer CE courses for The motion was seconded by Ms. Delaney and it carried. iv. Q & A COSMETOLOGY ASSOCIATION LLC There was no representative present as they were informed that their presence was not needed. Ms. Patricia Walters made a motion for the approval of Q & A Cosmetology Association, LLC, to offer CE courses for The motion was seconded by Ms. Nye and it carried. v. A BETTER YOU COSMETOLOGY ASSOCIATION Ms. Debora Geigher represented A Better You Cosmetology Association. Ms. Walters made a motion for the approval of A Better You Cosmetology Association to offer CE courses for The motion was seconded by Mr. Jones and it carried. vi. A BUT'Y'FUL "U" COSMETOLOGY ASSOCIATION "LLC" There was no representation present. Ms. Walters made a motion for the approval of A But y ful U Cosmetology Association, LLC, to offer CE courses for The motion was seconded by Mr. Jones and it carried. vii. ADVANCED ASSOCIATION OF COSMETOLOGY OF SC LLC Ms. Christine Howell represented Advanced Association of Cosmetology of SC, LLC. Page 3 of 13

ALLEGIANCE COSMETOLOGY ASSOCIATION LLC There was no representation present. Ms. Delaney made a motion for the approval of Allegiance Cosmetology Association, LLC, to offer CE courses for The motion was seconded by Ms. Walters and it carried. ix. ALPHA COSMETOLOGY ASSOCIATES, LLC Ms. Dana Williams notified staff via that she wanted to withdraw her CE submission for 2018 and will reapply on next year. Mr. Jones made a motion to receive the withdrawal of the CE submission for Alpha Cosmetology Associates, LLC. The motion was seconded by Ms. Delaney and Ms. Walters. x. ASSOCIATION FOR COSMETOLOGY EXCELLENCE INC (ACE) Ms. Angie Shuler represented ACE. Mr. Jones made a motion for the approval of ACE to offer CE courses for The motion was seconded by Ms. Nye and it carried. xi. ACSP (Association of Cosmetology Salon Professionals) Ms. Debbie Stabler represented ACSP. Ms. Walters made a motion for the approval of ACSP to offer CE courses for The motion was seconded by Ms. Delaney and it carried. xii. ASSOCIATION OF COSMETOLOGY TEACHERS IN VOCATIONAL EDUCATION (ACTIVE) Ms. Selena Tomlin and Mr. Randy Evans represented ACTIVE. Ms. Walters made a motion for the approval of ACTIVE to offer CE courses for The motion was seconded by Ms. Jones and it carried. xiii. BELLAS TOUCH ASSOCIATION LLC Ms. Angela Chambers-Lee represented Bellas Touch Association, LLC. WILLIAMS CEU TRAINING ASSOCIATION Ms. Sheila Williams represented C. Williams CEU Training Association. Ms. Delaney made a motion for the approval of C. Williams CEU Training Association to offer CE courses for The motion was seconded by Ms. Walters and it carried. xvii. CE TRAINING COURSES, INC Mr. Jayson Lacy represented CE Training Courses, Inc. Ms. Walters made a motion for the approval of CE Training Courses, Inc. to offer CE courses for The approval is for onsite and online courses. The motion was seconded by Mr. Jones and it carried. xviii. CE VSKI / LOWCOUNTRY STYLISTS, INC Ms. April Godwin represented CE Vski/Lowcountry Stylists, Inc. Mr. Jones made a motion for the approval of CE Vski/Lowcountry Stylists, Inc. to offer CE courses for The approval is for onsite and online courses. The motion was seconded by Ms. Nye and it carried. xix. COASTAL ADVANCE ESTHETIC EDUCATION Ms. Lillian Smalls represented Coastal Advance Esthetic Education. A motion was made by Mr. Jones to defer her submission until after lunch as there was no electronic copy and it was seconded by Ms. Nye. The motion carried. Page 5 of 13

CORNERSTONE CONTINUING EDUCATION ASSOCIATION LLC The following persons represented Cornerstone Continuing Education Association, LLC: Tiffany Singleton Crystal Calhoun Jacqueline McCullough Dolores Watkins It was stated that sanitation and safety would be conducted at the very beginning of the course. Ms. Walters made a motion for the approval of Cornerstone Continuing Education Association, LLC, to offer CE courses for The motion was seconded by Ms. Delaney and it carried. A ten minute comfort break was then taken. xxi. COSMETIC ARTS INSTITUTE II Ms. Nanette Saheb represented the Cosmetic Arts Institute II. Ms. Walters made a motion for the approval of Cosmetic Arts Institute II to offer CE courses for The motion was seconded by Mr. Jones and it carried. xxii. COSMETOLOGY PROFESSIONALS OF THE UPSTATE Ms. Soletha Jones and Ms. Lakisha Sullivan represented Cosmetology Professionals of the Upstate. Ms. Delaney made a motion for the approval of Cosmetology Professionals of the Upstate to offer CE courses for The motion was seconded by Mr. Jones and it carried. xxiii. EDUCATE INSPIRE MOTIVATE COSMETOLOGY ASSOCIATION LLC Ms. Jessica Gibson-Ford and Ms. Adeline Ketchen represented Educate Inspire Motivate Cosmetology Association, LLC. There was no lesson content turned in. Ms. Ketchen stated that the PowerPoint was her lesson content and that she was specifically told by staff (Shalon Genwright) that placing her lesson content in her PowerPoint would be fine. The s were obtained and Ms. Ketchen read them aloud, whereas she inquired about the lesson plans being in PowerPoint form or did she have to write out a separate lesson plan. The response stated that that would be fine as long as it was legible after being printed. She is still missing lesson content, as her specifically referenced lesson plans. Page 6 of 13

7 Ms. Walters made a motion for the conditional approval of Educate Inspire Motivate Cosmetology Association, LLC, to offer CE courses for 2018 upon acceptable content being provided to the Board Administrator, to be reviewed and approved by Ms. Walters. This must be submitted as soon as possible. The motion was seconded by Mr. Jones and it carried. The leniency was based on the miscommunication between the provider and staff. xxiv. EXPERTEASE CONSULTING EDU CORP Ms. Ciara Gordon represented Expertease Consulting Edu Corp. It was stated that for future references, the user ID and password must be given to prevent delays. Mr. Jones made a motion for the approval of Expertease Consulting Edu Corp. to offer CE courses for The approval is for onsite and online courses. The motion was seconded by Ms. Nye and it carried. xxv. FABULOUS HAIR ASSOCIATION LLC Ms. Felicia Wallace represented Fabulous Hair Association LLC. Mr. Corey Durham will be teaching the cosmetology section. Additional nail content is needed. A motion was made by Mr. Jones to go into an executive session to garner legal advice and it was seconded by Ms. Nye. The motion carried. Mr. Jones made a motion to come out of the executive session and it was seconded by Ms. Nye. The motion carried. There were no motions made or votes taken during the executive session. A motion was made by Ms. Walters to approve the cosmetology portion of Fabulous Hair s 2018 courses, deferring the nail courses until the content is received and reviewed. This motion was seconded by Mr. Jones and it carried. xxvi. HAIR HEIRS, LLC Ms. Sherrie Todd and Ms. Amy Davis represented Hair Heirs. Content is needed for the instructor course. They want to know what is elaborated on. A motion was made by Ms. Walters to approve Hair Heirs submission to offer CE courses for 2018, deferring the approval of the instructor courses until content is received. Ms. Delaney and Mr. Jones seconded the motion and it carried. xxvii. HAIR MATTERS, LLC Ms. Cynthia Blocker represented Hair Matters, LLC. Mr. Jones made a motion for the approval of Hair Matters to offer CE courses for The motion was seconded by Ms. Walters and it carried. Page 7 of 13

8 xxviii. HANDS ON BEAUTY ASSOCIATION LLC Ms. Tisha Evans represented Hands on Beauty Association LLC. The lesson plans and agendas had been updated, but the content was still basic. Updated information needs to be added to the lesson content as there is no meat or substance on what will be taught. More content is needed on pedicures and wet hair designs. A motion was made by Ms. Walters to defer the approval of Hands on Beauty until the content is received. The motion was seconded by Ms. Delaney and it carried. xxix. HEAVENLY TOUCH EDUCATIONAL SERVICES LLC Ms. Shelley James and Ms. Wendy Blair represented Heavenly Touch Educational Services LLC. Guest speakers can speak no more than one hour. Salon locations must have a 1:15 ratio for courses. Ms. Walters made a motion to approve Heavenly Touch Educational Services LLC to offer CE courses for The motion was seconded by Ms. Delaney and it carried. xxx. HIGHER EDGE COSMETOLOGY PA Higher Edge Cosmetology PA was represented by Ms. Atara Davis. Ms. Delaney made a motion for the approval of Higher Edge Cosmetology PA to offer CE courses for The motion was seconded by Ms. Walters and it carried. xxxi. INSTITUTE OF BEAUTY ARTISTRY, LLC Ms. Beatriz Hernandez represented Institute of Beauty Artistry, LLC. Mr. Jones made a motion for the approval of Institute of Beauty Artistry, LLC. The motion was seconded by Ms. Delaney and it carried. xxxii. JOLEI'S HAIR INSTITUTE LLC Ms. Lennie Battle represented Jolei s Hair Institute LLC. Ms. Walters made a motion for the approval of Institute of Jolei s Hair Institute LLC. The motion was seconded by Mr. Jones and it carried. xxxiii. JOYFUL EXPRESSIONS LLC Ms. Jayme Morant represented Joyful Expressions LLC. A motion was made to defer the approval of Joyful Expressions until more content is submitted for each agenda. 9 xxxiv. KEEP CALM & RENEW Ms. Kayla Shands and Ms. Jacqueline Graham represented Keep Calm & Renew. Ms. Delaney made a motion for the approval of Keep Calm & Renew. The motion was seconded by Mr. Jones and it carried. xxxv. LENNIE B & CO. LLC Ms. Lennie Battle represented Lennie B & Co. LLC. It was stated that for future references, the login information must be given to prevent delays. Mr. Jones made a motion for the approval of Institute of Lennie B & Co. LLC. The approval is for onsite and online courses. The motion was seconded by Ms. Walters and it carried. xxxvi. MEDICAL HAIR RESTORATION LLC Ms. Cassandra Risher represented Medical Hair Restoration LLC. Ms. Walters made a motion for the approval of Medical Hair Restoration LLC. The motion was seconded by Mr. Jones and it carried. A lunch break was then taken. xxxvii. P. PRICE EDUCATION LLC Ms. Pamela Price represented P. Price Education LLC. Ms. Walters made a motion for the approval of P. Price Education LLC. The motion was seconded by Ms. Nye and it carried. xxxviii. PAMPERED BEAUTY LC Ms. Ke yona Joseph and Ms. Doreshea Dye represented Pampered Beauty LC. Ms. Walters made a motion for the approval of Pampered Beauty LC. The motion was seconded by Mr. Jones and it carried. xxxix. PROFESSIONAL CONTINUING EDUCATION SERVICES, LLC (PCES) Mr. John Ray represented PCES. All online information must contain the same information, just as much as onsite courses. There were a lot of comments from the University of South Carolina evaluations, such as questions not matching the materials or pertinent to the state of South Carolina. The online content must be edited. They also had trouble with pop-up questions, amongst other technical issues. Mr. Ray stated that they have a brand new system now. Page 9 of 13

10 A motion was made by Mr. Jones to approve PCES to offer courses for 2018 and it was seconded by Ms. Nye. This approval is for online and onsite courses. The motion carried. xl. PROJECT I.C.O.N., LLC There was no representative present for Project I.C.O.N., LLC, but they were notified of the meeting. Ms. Walters made a motion for the approval of Project I.C.O.N., LLC. The motion was seconded by Mr. Jones and it carried. xli. PROVISION CEU IN ADVANCE TRAINING LLC There was no representative present for Provision CEU in Advance Training LLC, but they were notified of the meeting. Content is needed for all segments. Ms. Walters made a motion to defer the approval of Provision CEU in Advance Training LLC until additional content has been submitted and reviewed. The motion was seconded by Mr. Jones and it carried. xlii. SC PROFESSIONAL BARBER AND COSMETOLOGY ASSOCIATION (SCPBCA) Ms. Jacqueline Golden represented SCPBCA. There was an extended discussion over lesson content and the clarification needed by the board. A motion was made by Mr. Jones to approve SCPBCA and it was seconded by Ms. Nye. The motion carried. xliii. SC STATE COSMETOLOGY ASSOCIATION OF THE NATIONAL BEAUTY CULTURIST LEAGUE, INC. (SCSCA) Dr. Cindy Collins represented SCSCA. Ms. Walters made a motion for the approval of SCSCA to offer courses for The motion was seconded by Mr. Jones and it carried. xliv. SC TECHNICAL COLLEGE SYSTEM (CE ASSOCATION) Mr. Christopher Rico represented SC Technical College System. Guest speakers can only teach for one hour segments. Ms. Moser is teaching three segments. Mr. Roderick Samuels is not an approved educator. A motion was made by Mr. Jones to go into an executive session for legal advice. The motion was seconded by Ms. Nye and it carried. Page 10 of 13

11 Mr. Jones made a motion to come out of the executive session and it was seconded by Ms. Nye. The motion carried. There were no motions made or votes taken during the executive session. Mr. Rico requested to defer the program as it won t be offered until December of Ms. Nye made a motion to defer the approval of SC Technical College System to offer CE courses for 2018 until the content is submitted with an appropriate instructor. The motion was seconded by Mr. Jones and it carried. xlv. SOUTH CAROLINA ASSOCIATION OF COSMETIC ARTS (SCACA) Dr. Frances Archer represented SCACA. For the review, completed information is needed, whereas there was no voiceover on the online content. Dr. Archer did not want to set up the voiceover until it was approved by the board because of costliness. Everything must be set up for the review in October as it causes a delay in approval. Ms. Walters made a motion to approve SCACA to offer CE courses for 2018 and it was seconded by Mr. Jones and Ms. Nye. The approval is for onsite and online courses. The motion carried. xlvi. SOUTH CAROLINA ASSOCIATION OF COSMETOLOGY SCHOOL (SCACS) Ms. Gloria Smith represented SCACS. The online content warrants the same materials as the onsite content. A list of resources for the online content would be needed. The online content must match the onsite content as well. It must be as clear as possible. Ms. Walters made a motion to approve SCACS to offer CE courses for The motion was seconded by Ms. Nye and it carried. xlvii. SOUTH CAROLINA VISION ASSOCIATION OF COSMETOLOGY Mr. John T. Elliott represented South Carolina Vision Association of Cosmetology. His out-of-state instructor may only teach for one hour. A motion was made by Mr. Jones to approve South Carolina Vision Association of Cosmetology. The motion was seconded by Ms. Walters and it carried. xlviii. SOUTHEASTERN ESTHETICS INSTITUTE, LLC Ms. Erin Peters represented Southeastern Esthetics Institute, LLC. Ms. Walters made a motion to approve Southeastern Esthetics Institute, LLC and it was seconded by Mr. Jones. The motion carried. xlix. SOUTHERN COSMETOLOGY ASSOCIATION OF LICENSED PROFESSIONALS, LLC (SCALP) Ms. Michelle Williams represented SCALP. The lesson plans state 4.5 hours and there is no content. The lesson plans must be elaborated on. Page 11 of 13

12 A motion was made by Ms. Walters to defer the approval of SCALP until they can resubmit and add content to the lesson plans and to clarify the timeframe of the courses. The motion was seconded by Mr. Jones and it carried. l. TOUCH OF JOY ORGANIZATION Touch of Joy was represented by Mr. Houston Harris. Ms. Walters made a motion to approve Touch of Joy to offer CE courses for The motion was seconded by Ms. Nye and it carried. li. UPSTATE HAIR SKIN AND NAILS L.P Upstate Hair Skin and Nails L.P. was represented by Ms. Lynn James and Ms. Sherri Dunlap. Their social media and domestic violence courses will have guest speakers. All corrections requested were given. Ms. Nye made a motion to approve Upstate Hair Skin and Nails L.P. and it was seconded by Mr. Jones. The motion carried. lii. UPSTATE OF SC BEAUTY & BARBER ASSOCIATION Ms. Amanda Wilson and Mr. Samuel Crosby represented Upstate of SC Beauty & Barber Association. It was stated that you cannot reuse razor blades on every person. It must be new razor blade for each person. The razor blades must be disposed of in a sharps container as well. Ms. Walters made a motion to approve Upstate of SC Beauty & Barber Association to offer CE courses for The motion was seconded by Ms. Nye and it carried. liii. VONTAE'S ADVANCE TRAINING Ms. Michelle Hampton-Furtick represented Vontae s Advance Training. There was an extended discussion on out-of-state instructors and guest speakers. Ms. Nye made a motion to go into an executive session to garner legal advice. The motion was seconded by Mr. Jones and it carried. Ms. Nye made a motion to come out of the executive session and it was seconded by Ms. Walters. The motion carried. The instructors for Vontae s will be able to teach as long as they like. The board members will get together to gain clarification and to create some frequently asked questions for CE based on the meeting s discussions, which will give more guidance for next year. Ms. Hampton-Furtick will need to list each instructor on her agendas. Ms. Nye made a motion to approve Vontae s Advance Training to offer CE courses for 2018 and it was seconded by Mr. Jones. WORLD EDUCATORS OF COSMETOLOGY LLC There was no representative present, but they were given notice. Ms. Walters made a motion for the approval of World Educators of Cosmetology LLC to offer CE courses for The motion was seconded by Ms. Nye and it carried. 10. Discussion There was no discussion. 11. Public Comments Mr. John T. Elliott thanked everyone as this is new to him being a first year CE provider. It is unfair to the providers that are upholding the rules and regulations, which causes their business to suffer. She does not want to compromise her integrity to make money. As a serious licensee, it is worth it to her to provide exceptional service. Board members can only do what they can at this time. Ms. Gloria Smith thanked everyone and thought that it was great that they allowed the back and forth discussions. More Ce providers should attend board meetings and there should be one required meeting for providers. 12.
