1 Structure & other important issues of Panchayats in West Bengal: by Dipyaman Majumder, Faculty Member, SIPRD, Kalyani, Nadia Training Material The West Bengal Panchayati Raj system is governed by the West Bengal Panchayat Act, 1973 (last amended in 2015) and many other rules and one another Act [the West Bengal Panchayat (Election) Act, 2003] made under the act mentioned. As per the act the three tier structure is prevailed in the West Bengal. The structure is given below: Zilla Parishad 18 Siliguri Mahakuma Parishad 1 Department of Panchayat & RD, WB Panchayat 333 Gram Panchayat 3347 Members and office bearers For each tier of PRI [Gram Panchayat/ Panchayat / Zilla Parishad] in West Bengal the following features have been incorporated through diverse provisos of Acts, Rules, Orders, etc., a) Calculation of numbers of members according to the number of electors. b) Delimitation of Constituencies according to assembly constituency part number & geographical boundary. c) Mandate of proportionate & term wise alternate reservation for members and apex office bearers of each tier (like Pradhan & Upa- Pradhan [GP]/ & Sahakari [PS]/ Sabhadhipati & Sahakari Sabhadhipati [ZP]). Reservation by caste [SC, ST, & BC] and Gender [Women] are prescribed. Two terms of election roster is followed. d) There are provisos of whole timer office bearer at least one in each tier [GP Pradhan, PS & Sahakari, ZP Sabhadhipati, Sahakari Sabhadhipati & other 9 s]. Gram Panchayat: Every Gram Panchayat consists of following types of members: a) Directly Elected Member: For each 900 electors [in case of hill area the number of electors is 250] of Gram Panchayat one member will be elected. Fraction if any one extra member will be elected [maximum number-30 & minimum number-5]. The constituency where from the requisite numbers of members elected is called Sansad. The Sansad jurisdiction and number is fixed prior to every Panchayat General Election for a five year term. Only the directly elected members have the power to involve in the process of election/ removal by no confidence of Pradhan and Upa-Pradhan. b) Ex-Officio Member: The members (1 to 3 depending upon the numbers of electors in the GP) of Panchayat elected from the Gram Panchayat jurisdiction other than the or the Sahakari of Panchayat will be the ex-officio members of Gram Panchayat. Pradhan & Upa-Pradhan are the office bearer of the Gram Panchayat. Pradhan must be a wholetime functionary of the office and during that period; s/he will not hold any office of profit. Beside the post of Pradhan & Upa-Pradhan there are Member & Sanchalak of Upa- at the GP level. Page 1 of 16
2 Panchayat : Every Panchayat consists of following members: a) Directly Elected Member: The no. of members of PS to be elected from the GP will be ONE [no. of electors of GP<=4500], or TWO [4501>=no. of electors of GP<=9000], or THREE [no. of electors of GP>9001] For hill areas the calculation will be done as per the following norms: ONE [no. of electors of GP<=1200], or TWO [1201>=no. of electors of GP<=2000], or THREE [no. of electors of GP>2001] Only the directly elected members have the power--- to involve in the process of election/ removal by no confidence of the & Sahakari. to become of a Sthayee [other than Artha, ] if elected as a member of Sthayee. [ex-officio members may be elected as member of Sthayee, but they can t be elected as ] b) Ex-Officio member: i. Pradhan of all Gram Panchayats in the Block Jurisdiction, ii. Member elected from Block (1 to 3 depending upon the numbers of electors in the Block) to Zilla Parishad other than Sabhadhipati and Sahakari Sabhadhipati, iii. MLA elected from Block not being the minister, iv. MP elected from the Block not being the minister, v. Elector of Block jurisdiction, Member of Rajya Sabha not being minister. Zilla Parishad: Every Zilla Parishad consists of following members: a) Directly Elected Member: The no. of members of ZP/ SMP to be elected from the Block will be a. ONE [no. of electors of Block<=60000], or b. TWO [60001>=no. of electors of GP<=120000], or c. THREE [no. of electors of GP>120001] b) Ex-Officio member: i. of all Panchayat in the District Jurisdiction, ii. MLA elected from District not being the minister, iii. MP elected from the District not being the minister, iv. Elector of District jurisdiction, Member of Rajya Sabha not being minister. Office Bearers of Zilla Parishad: Sabhadhipati & Sahakari Sabhadhipati are the office bearer of the Zilla Parishad. Beside the post of & Sahakari there are Member & of Sthayee at the ZP level. These are called Upa-. a) Artha O Parikalpana Upa- b) Krishi O Prani Sampad Bikas Upa- c) Siksha O Janasasthya Upa- d) Nari, Sishu Unnayan O Samaj Kalyan Upa- e) Shilpa O Parikathama Upa- Member and Office Bearer of Upa-: Each Upa- (except serial no (a) of the above list) consists of following members.. Pradhan and Upa-Pradhan (ex-officio) 1 to 3 members elected from the members of Gram Panchayat depending upon the total no. of members of GP (directly elected + ex-officio) [if no of GP member <10, 1 Upa- member, no of GP member=11 to 20, 2 Upa- member and no of GP member> 20, 3 Upa- member] Members of Upa- elect one member as Sanchalak. There is no provision of election for Artha O Parikalpana Upa-; 4 Sanchalak, Pradhan, Upa-Pradhan and Leader of recognized political party in the GP will be the ex-officio member of Artha O Parikalpana Upa- and Pradhan will be the ex-officio Sanchalak of that Upa-. Sanchalak of Nari, Sishu Unnayan O Samaj Kalyan Upa- will be elected among the women members of the Upa-. All Upa- have members from the Government Official and other related with the functions of Upa-; but these types of members have no right to vote in decision making of the Upa-. Secretary of the Upa- is elected from the official members of the Upa- by the GP in its meeting. Secretary Gram Panchayat acts as the secretary of Artha O Parikalpana Upa-. Standing Committees at Panchayat : There are ten standing committees at the Panchayat. These standing committees are called Sthayee. (i) [Artha, Sanstha, Unnayan O Parikalpana] Sthayee. (ii) Janasasthya [O Paribesh] Sthayee. (iii) Purta Karya [O Paribahan] Sthayee, (iv) Krishi Sech O -Samabaya Sthayee, (v) [Shiksha, Sanskriti, Tathya O Krira] Sthayee, (vi) [Sishu O Nari Unnayan, Janakalyan O Tran] Sthayee, (vii) Ban O Bhumi Sanskar Sthayee, (viii) Matsya O Prani Sampad Bikash Sthayee, (ix) Khadya 0 Sarbaraha Sthayee, (x) [Khudra Shilpa, Bidyut O Achiracharit Shakti Sthayee, Zilla Parishad also has the same types of Standing Committees. 4 Members and Office Bearers of Sthayee : Each Sthayee (except serial no (i) of above list) consists of following members: a) and Sahakari (ex-officio) b) Depending upon the numbers of members (directly elected + ex-officio) 3 to 5 members are elected among the members of Panchayat [up to 15 3 SS members, 16 to 30 4 SS members and 31 & above 5 SS members] c) One Member from opposition will be nominated by the them. Member of Sthayee elect among themselves one person as. Ex-officio members can be the members of Sthayee, but they can t be elected as. There is no provision of election regarding members of Artha, Sanstha, Unnyan O Parikalpana Sthayee ;, Sahakari and other 9 s and Leader of Recognized Political party in opposition in the Panchayat are the members of this Sthayee. is the ex-officio of the Artha, Sanstha, Unnyan O Parikalpana Sthayee. of Sishu O Nari Unnayan, Janakalyan O Tran Sthayee is elected among the women members of the Sthayee. All the Sthayee have members among the Government Official and other related with the functions of Sthayee ; but these types of members have no right to vote in decision making of the Sthayee. Secretary of the Sthayee is elected from the Official member of the concerned Sthayee. Panchayat Development being the ex-officio secretary of Panchayat acts as the secretary of the Artha, Sanstha, Unnyan O Parikalpana Sthayee. Meeting Meeting is an important instrument in the democratic system of governance. In the Panchayats of West Bengal different types of meeting with due process law have been incorporated to make the system need based, purposive, and transparent. Decisions are taken based on consensus of majority in a meeting. Through the process of meeting members feel ownership about the decision, execution and maintenance of work.
