3 CALL TO ORDER The Elevator Safety Technical Advisory Council meeting was called to order at approximately 9:03 a.m. by John Antona, Chair. 4 Chair Antona called for acceptance of minutes. MOTION: Mr. Snyder made a motion to accept the minutes of the last meeting. SECOND: Mr. Wooldridge seconded the motion and it passed unanimously. Review and Discussion of Draft Proposed Statutory Amendment Chief Comingore presented the Division s proposed language for Florida Statute, Chapter Definitions (attachment B). Bill Snyder presented his own version of the proposed language (attached). Members discussed the industry difficulties obtaining employment because of the 4 year work experience verification requirements, specifically who can verify work experience. Further, they discussed allowing apprenticeships and National Labor Unions to verify the required work experience. Mr. Snyder asked for clarification as to whether a Florida Registered Elevator Company could verify work experience for an applicant if the work was performed in another state under the employment of a different company. Chief Comingore confirmed and offered to clarify that position in Rule. After discussion, the following action was taken: MOTION: Mr. Yohn made a motion to remove the term vertical from Definitions (16). SECOND: Mr. Snyder seconded the motion and it passed unanimously. After further discussion, the following action was taken: MOTION: Mr. Antona made a motion to accept the language for work experience as written by the Division. SECOND: Mr. Snyder seconded the motion and it passed unanimously. After further discussion, the following action was taken: MOTION: Mr. Antona made a motion to add language for apprenticeships Proof of completion of an apprenticeship program for elevator mechanics which has standards substantially equivalent to those found in a national training program for elevator mechanics and is registered with the Bureau of Apprenticeship and Training of the United States Department of Labor or a state apprenticeship authority or proof of passage from a nationally recognized training program for the elevator industry SECOND: Mr. Snyder seconded the motion and it passed unanimously. 4

8 THE MEETING WAS OPENED WITH A ROLL CALL BUT NO QUORUM WAS ESTABLISHED. Bureau Report - Michelle Comingore, Bureau Chief Administrative Update: Chief Comingore presented an update on the implementation of ipad based inspection reports. Deputy Chief Love demonstrated to the Council what the e-form will look like and how it would be used by state inspectors. Chief Comingore reported the promotion and available vacancies for the Division s State Inspectors. Chief Comingore presented the delinquent reports update. She stated that as of June 7, 2017, the division has 1,814 delinquent elevators, the compliance rate is 96.7 percent, and 1,267 citations were issued for delinquent licenses. The division issued 38 administrative complaints for failure to comply or obtain permits and 16 administrative complaints to CEIs who failed to respond to notices of monitoring. Chief Comingore reported the division has performed 31 accident inspections this fiscal year, an increase from the annual average of six accident inspections. The council discussed the importance of accident follow-up inspections. Legislative Session: Chief Comingore reminded everyone that the council previously voted for proposed bills to remove the residential elevator exemption, remove the two-stop exemption, create building code consistency between the elevator permit and building code permit, and to require elevators to accommodate an 84 by 24 stretcher. A proposal for building code consistency was put forward, but did not become a bill. The legislature passed one elevator-related bill, SB1634, which changes the residential elevator statute adopted last year to require electronic monitoring of the hoistway door locking device, rather than pressure plate on the underside of the car. For the 2018 session, the bureau plans to propose conforming elevator and building code permits, eliminating the two-stop exemption, stretcher size, and acceptable employment verification for the CC license. The division is considering proposing an exemption for marine elevators, mine elevators, wind turbine tower elevators, and outside emergency elevators from statute. Rule Report: Chief Comingore provided a copy of the Rule Status report and reminded the council that the report is posted on the division s website. 8

Elevator Service Companies: Represented by Tim Mowrey. Mr. Mowrey read rule 61C-5.008, Item Number 7, direct supervision. Council discussed the interpretation of the wording and decided to table the discussion until the next meeting. Labor: Represented by James Yohn. Not present. Local Government: Represented by John Barnott. Not present. Manufacturing: Represented by Tim Newton. Nothing additional to discuss. Private Inspections: Represented by Bill Snyder. Nothing additional to discuss. Public: Represented by John Antona. Not present. Old Business Proposed rule language for code adoption and exclusions: Chief Comingore reported that 61C-5.001, Safety Standards, is being amended to adopt the ASME A17.1, 2013 code and specifically exempt certain parts. The other codes, A17.3 and A18.1, are not changing. This rule is currently being routed for signatures for approval to submit as a proposed rule, so it will be publishing very soon. The council will be notified as soon as that happens. After it is published as a proposed rule, comments will be welcome. Maintenance control program: Chief Comingore informed the Council of the draft language regarding the onsite documentation requirement that is in A The bureau is looking into having a phase-in requirement for the onsite documentation for the MCP to be maintained onsite. After discussion, no action was taken. Alternative Test Methods: Chief Comingore presented draft rule relating to Alternative Test Methods, explained the rule, and requested a discussion regarding alternative testing training requirements. After discussion, no action was taken. 9
10 General Discussion/ Open Forum Mr. Snyder: Proposed taking a new vote for the Council Chair position and developing procedures for rotating chairmanship. Council will address at next meeting. Upcoming Meetings The Council discussed the date of the next meeting: Tentative dates to be held in Tallahassee. 11 Attachment C Proposed language for rule development. 61C-5.NEW Alternative Test Methods. (1) Effective January 1, 2019, alternative test methods without load utilizing electronic tools are permitted for Category 5 testing of car and counterweight safeties, oil buffers, driving-machine brakes, and braking system, traction, and traction limits per Rule , ASME A , as adopted by reference in Rule 61C-5.001, F.A.C., when performed by a registered elevator company. The electronic tools utilized must be designed to measure and record car weight and deceleration, calculate stopping distances based on measurements obtained, and provide a report clearly identifying test results and if each component passed or failed the tests. (2) Notwithstanding the foregoing, alternative test methods without load are not permitted for acceptance tests, which must be performed with full load. (3) The registered elevator company is responsible for ensuring: (a) The methodology, tools, procedures, and report for alternative test methods without load comply with Rule , ASME A , as adopted by reference in Rule 61C-5.001, F.A.C. The tools are maintained in proper working order and calibrated at least once per year or as otherwise required by the manufacturer. (b) The certified elevator technician or certified elevator inspector performing the alternative test has completed the continuing education required by this rule and the specific training necessary to operate the specific measuring devices or tools to accurately perform alternative tests without load. (c) The certified elevator inspector witnessing the alternative test has completed the continuing education required by this rule. (4) Alternative test method procedures shall be developed in compliance with Rule , ASME A , as adopted by reference in Rule 61C-5.001, F.A.C., and maintained as part of the maintenance control program. (5) Baseline measures shall be maintained in the machine room. A copy of the alternative test method report for each Category 5 test completed via alternative test methods shall be maintained in the machine room for 10 years from the date of the test. (6) Continuing education required. (a) Certified elevator technicians or certified elevator inspectors performing alternative tests and certified elevator inspectors witnessing alternative tests must complete four (4) hours of approved continuing education 11
12 relating to alternative test methods, procedures, measuring device or tool calibration and use, results evaluation and report interpretation. The continuing education course and provider must comply with rule 61C , F.A.C. (b) Upon receipt of proof of successful completion of an approved continuing education course on alternative test methods, the division shall identify completion of the continuing education specified herein on the certified elevator technician or certified elevator inspector license issued by the division. If proof of alternative test training continuing education is received by the division outside of the license renewal period, the division will issue a duplicate license indicating completion of the continuing education. 1. A continuing education course completed on or before January 1, 2019, shall be valid until December 31, A continuing education course completed after January 1, 2019, shall be valid until December 31 of the third year after completion. 2. Alternative test training continuing education hours shall not apply toward license renewal. (7) A Category 5 test that is completed using alternative test methods without load and is performed by a certified elevator technician or certified elevator inspector or witnessed by a certified elevator inspector who does not have proof of successful completion of the required training on file with the division shall not be accepted as a valid Category 5 test for the purpose of obtaining a satisfactory inspection.
