22 Guidelines for NCBA Pro Bono Projects Statement of Support for Pro Bono Projects: The North Carolina State Bar, in R.P.C. 6.1, states that: Every lawyer has a professional responsibility to provide legal services to those unable to pay. A lawyer should aspire to render at least (50) hours of pro bono publico legal services per year. In fulfilling this responsibility, the lawyer should: (a) Provide a substantial majority of the (50) hours of legal services without fee or expectation of fee to: 1. Persons of limited means; 2. Charitable, religious, civic, community, governmental and educational organizations in matters that are designed primarily to address the needs of persons of limited means; or 3. Individuals, groups or organizations seeking to secure or protect civil rights, civil liberties or public rights, or charitable, religious, civic, community, governmental and educational organizations in matters in furtherance of their organizational purposes, where the payment of standard legal fees would significantly deplete the organization s economic resources or would be otherwise inappropriate. (b) Provide any additional services through: 1. The delivery of legal services described in paragraph (a) at a substantially reduced fee; or 2. Participation in activities for improving the law, the legal system, or the legal profession. In addition, every lawyer should voluntarily contribute financial support to organizations that provide legal services to persons of limited means. The North Carolina Bar Association, in support of its members who seek to fulfill their ethical duty under Rule 6.1, encourages all members to participate in pro bono service. Pro Bono efforts that are undertaken through the Association and its Committees, Sections, and Divisions should be focused on those individuals and groups highlighted in Rule 6.1(a). The Association is an umbrella association representing many viewpoints. As such, all projects should further the mission of the NCBA. NCBA pro bono projects should be non-discriminatory in scope, and open to those in the greatest need. { DOCX}

23 Purpose and Considerations: The purpose of these guidelines is to provide guidance for pro bono efforts undertaken by NCBA Committees, Sections, and Divisions. It is crucial that the pro bono work we undertake not devalue the work currently being done by pro bono legal services providers across North Carolina. As a membership organization, the NCBA is mindful that pro bono service should also not take paying clients away from the lawyers who may serve these clients. With those factors in mind, pro bono projects in which NCBA Committees, Sections, or Divisions participate should generally limit client participation to the following types of clients: Persons of limited means. o The NCBA has identified those being in the greatest need as those households earning no more than 300% of the federal poverty guidelines, though NCBA Committees, Sections, or Divisions may choose to limit client participation to any amount less than 300% of the federal poverty guidelines. Organizations addressing the needs of persons of limited means; or Individuals, groups, or organizations seeking to secure or protect civil rights, civil liberties, or public rights, where payment of standard legal fees would significantly deplete the organization s economic resources or would be otherwise inappropriate. The Pro Bono Activities Committee will serve as the NCBA s pro bono project clearinghouse. Each new project should be submitted on the form (available at TBD website location) as soon as practicable before the date of the pro bono event or project s launch date. The Committee will consider all proposals received in a given calendar month during the first two weeks of the following month, with approval or concerns shared with the submitting group during this time frame. This review process ensures that all NCBA pro bono projects conform to the same guidelines, and comply with these guidelines as adopted by the NCBA Board of Governors. Project planners are encouraged to discuss their proposal with staff prior to submission if there are concerns about a project s suitability. Those projects approved by the Pro Bono Activities Committee will receive the support of NCBA staff and resources, including potential eligibility for malpractice insurance as an NCBA pro bono project. Volunteers providing pro bono legal services to clients through an NCBA-supported pro bono project must be covered by malpractice insurance. The NCBA offers malpractice insurance for members participating in these projects, and volunteers may also elect coverage under privately-held policies. There may come a time during any pro bono project where a client who initially appeared eligible for help through the project is found to be ineligible, because of income, project criteria, or other factors. If this occurs, the client s pro bono case through the relevant NCBA pro bono project should be closed, including written notification to the client. Should a volunteer wish to continue representation, they may do so. If a volunteer wishes to continue representation of the client, this representation must be outside the umbrella of the NCBA s pro bono project in all regards, including malpractice insurance coverage. { DOCX}

24 Every NCBA Committee, Section, or Division is encouraged to identify a pro bono project and set their own pro bono service priorities each year. Each project planning team should consider the following when determining the specifics for their project: Whether a client or household asset limit is needed for the project in addition to limiting individual participation to those households earning less than 300% of the federal poverty guidelines maximum; Is this project serving a population with a great need? Considerations should be made in subject matter, physical location, vulnerable populations, and other population considerations. Is this project appropriate for a volunteer-based project? Are adequate numbers of competent volunteers available? If not, is it a subject matter in which training can be provided? How will the success of the project be measured? Who will be responsible for measuring the project s success? Are other groups already serving the same or a similar client population? If so, the projects should be coordinated to prevent duplication of efforts before submitting a project proposal. Are volunteers needed? All NCBA member types should be included in consideration of which volunteers are needed. For example, consider if there are activities not considered the practice of law for which law students, legal staff, and attorneys with special circumstances (such as corporate counsel licensed in other states and government attorneys limited in their pro bono practices) can provide assistance. Who will prepare any necessary disclaimers or disclosures for the project? These documents will need to be submitted as part of the project proposal process. Publicity is an important part of any NCBA project. Who will prepare press release and other information about this project, so that NCBA staff can circulate as appropriate? This information will need to be submitted as part of the project proposal process. Consider how to transition clients who become ineligible for pro bono help during the course of representation. NCBA staff look forward to helping with planning and execution of any pro bono project undertaken by a Section, Division, or NCBA Committee. However, each Section, Division, or Committee will need to identify the members who will be organizing, implementing and leading each project so that roles can be clearly defined during the planning process.
