NO. ACTION BY DATE 1. OPENING AND WELCOME Chairperson The Chair opened the meeting and welcomed all present that took time off their busy schedules to contribute to the activities of this STC. 2. 2 3. SIGNING OF ATTENDANCE REGISTER Members were requested to update their contact details if required and sign the attendance register and the confidentiality statement therein. STC Members STC members are formally appointed and need to complete form F 20 - Areas of Expertise on an annual/2-yearly basis will forward the forms to Committee members 4. FINALISATION OF AGENDA Agenda finalized with the following items added to the agenda Clause List of MHI sites 7.3 P 19 - STC process Chairperson 5. APPROVAL OF MINUTES FROM THE PREVIOUS MEETING 06 July 2011 The minutes were accepted as a true reflection of the meeting with no corrections and signed by the Chair. 6. MATTERS ARISING FROM PREVIOUS MEETING 6.1 (6.1) MHI Regulations - DRAFT Amendment DoL gave general feedback on the work done and status of the MHI Review Committee (MHI-RC) at DoL. The draft regulation is planned to be publish for comment during the 1 st half of and legislated end of. The new MHI regulation will be based on COMAH (UK) The MHI-RC plan to keep industry informed of the changes between the old and the new regulations The MHI SANS Technical Committee (TC) was established at the SABS to develop standards for MHI activities such as emergency plan. Debbie Mitchell (ISHECON) is taking the lead on this and the next SANS TC Committee meeting is planned for Friday, 09 December 2011 at the SABS Pretoria. DoL highlighted the role of the MHI RC (DoL activity) and the MHI SANS TC (SABS activity). It should be seen as separate activities that will complement each other in the end; as the two initiatives is currently running in parallel but will come together with the publication of the revised MHI regulations. 3 Once the MHI regulations are published and the SANS MHI standards are ready for publication will have a training session/workshop for the MHI Assessor to ensure a uniform approach in understanding and applying the new documents during assessments. 6.2 (6.2) R 54 Qualifications Standing over. The matter will be looked at once greater clarity is available for the MHI RC and SANS TC. MHI RC SANS TC 6.3 (6.3) ISO/IEC Review The Final Draft International Standard (FDIS) ISO/IEC FDIS 17020: General criteria for the operation of various types of bodies performing inspection was published on 17 November 2011 for a 2-months voting period (17 Nov 2011 to 17 Jan ) South Africa will vote through its ISO member body, SABS. Publication of the International Standard (IS) is expected in the 1 st half of. Once published a phase-in period will be announced, normally 2- years, by ILAC. plan to use the 2-year transition period for a Gap Analysis in the 1 st year and confirming Full Compliance in the 2 nd year. The process will be communicated to Accredited Inspection Bodies shorty Assessor training is planned in December 2011 and early on the FDIS (6.4) MHI Standard Scoping The issue of MHI Scope of Accreditation is in process of being finalised with the periodic review of R 54 and DoL s guidance on the application of SABS/ISO/IEC 17020: 1998 in the regulatory assessment of Major Hazard Risk Installations Assessment Bodies Assessors 05 & 07 December (6.5) Approval of MHI Technical Signatories The accreditation of MHI facilities with no local technical signatories but residing outside of South Africa was raised as a concern. The issue regarding the presence of Technical Signatories at assessment visits was discussed at Executive level and it was decided that as a matter of principle these individuals shall to Page 3 of 5

4 be present at every assessment. to include the above requirement with the review of R 54 and communicate to all AIA s 7. NEW ITEMS : 1998 Clause The inspection body shall use the methods and procedures for inspection which are defined in the requirements, against which conformity is to be determined. [ISO/IEC 17020: ] RISCOM expressed their concern over the clause requirement and the interpretation by lawyers of the term methods and procedures against which conformity is to be determined After some discussion the Committee decided to look at the issue again after the MHI RC and SANS TC has completed their work STC 21 Sept 7.2 List of MHI sites When MHI work is done, it is not always possible to get information of the surrounding (existing) MHI sites as the information is not always freely available and in some cases very little/no cooperation is experienced by customers and neighbours in this regard. The information is important when compiling an MHI report. DoL is in process of establishing a data base of MHI sites with the input of the Accredited MHI Bodies. DoL will discuss and decide on the access by Accredited MHI Bodies at the next DOL MHI workshop planned for Monday, 05 December 2011 DoL 7.3 P 19 - STC process briefly presented P 19 Terms of Reference, Registration and Responsibilities of Specialist Technical Committees to highlight the STC process. Additional members needs to be invited to the ATC to ensure a balance of interest and members are encouraged to send nominations to, Eben Smit ebens@sanas.co.za will send a copy of P 19 to STC members for their perusal Page 4 of 5
