1 At a Town Board meeting of the Waterford Town Board held on Tuesday, September 5, 2017 at 7 P.M. at Town Hall, 65 Broad Street, Waterford, NY the following transpired: There were present: Councilman Ball Councilman marble Councilman McClement Supervisor Lawler There were absent: Councilman Boudreau A public hearing was held and the enclosed public hearing notice was read for the approval of a cable television agreement between time Warner Cable Northeast LLC and the Town of Waterford. Supervisor Lawler explained the purpose of the hearing after the Town Clerk read the public hearing notice as published according to law. Chris Connelll asked about the proposed Cohoes community broadband and whether the Town was looking into the same option. The Supervisor explained that he would speak to the Mayor of Cohoes regarding this issue but at this time it doesn t seem feasible for us due to the infrastructure costs alone. But it is something he will look into if the economic curve and technology make it more approachable. ACTION ON MINUTES OF PREVIOUS MEETINGS AS FOLLOWS; Town Board minutes of the meetings of August 1 st and August 29 th were presented to the Board for review. A motion was made by Councilman Ball and seconded by Councilman McClement to adopt the minutes as presented. All in favor. COMMITTEE REPORTS FINANCIAL REPORTS AND SUBMISSION OF BILLS AND PETTY CASH THE Supervisor read the Supervisor s cash report for the month of august. The petty cash report totaled $ The audited abstracts for the month totaled $188, and the payments in advance of audit totaled $54, A motion was made by Councilman Ball to accept the cash report, reimburse petty cash and pay the bills. Seconded by Councilman Marble. All in favor. COMMITTEE ON SENIORS, HIGHWAY, WASTEWATER TREATMENT, WATER AUTHORITY AND CEMETERY. Councilman McClement read the Waterford Senior van report as submitted by Neil Quantock. He further read the Senior Citizens report as submitted by Mike Mahoney. The Wastewater Treatment Plant summary for the month of August was read. A thank you to Craig Falcone for the great job in handling the plant after Rich Thyrring retired. The highway report was read as submitted by Harold Martel. COMMITTEE ON PUBLIC SAFETY AND EMERGENCY SERVICES

2 Councilman Ball noted the recent losses of Ken Smith who was active in Ford Hose and Frenchie Hebert who was active in Peck Hose Fire Department. He read the Police Department activity report for the month of August 2017 as submitted by Sgt Mike Shudt. He further reminded everyone of the upcoming Tug Boat Round Up and that there are no open containers allowed. COMMITTEE ON VETERANS, GRANTS AND PROGRAM FUNDING, AND SPECIAL PROJECTS Councilman McClement read the August report of the Waterford Harbor Center with a summary of the boats and volunteer hours. A thank-you to MaryAnn Kelts and Paul Terry for the report. He further reported on the Tugboat Round Up this upcoming weekend with fireworks on Saturday night and the Tug Chug on Sunday morning. Councilman McClement then reported on upcoming Veterans Programs through Saratoga County. You may call the Veterans Service agency at for more information. He also read a thank you from a family member of Caine Goyette thanking everyone for the beautiful memorial service. COMMITTEE ON YOUTH, PLAYGROUNDS, POOL, FESTIVALS, LIAISON TO VILLAGE, MUSEUM, LIBRARY AND WHCS Waterford Night out was a great time again this year. Many thanks to Art Riley for cooking up some good food, the rescue squad, Waterford p d, Northside fire for doing fire demonstrations, the library for giving away books and raffles, Pastor Paul and the Wesleyan church, and the highway dept for getting the park ready, The weather was great and the crowd was bigger than last year. Thanks to Georgia and Summer for putting it together. The Library: The library will be sponsoring some events in the upcoming months starting with Sept 21 st. Mission to Antarctica is about 109 th Air Lift Wing from Stratton Air base s flights to supply and support the scientific expeditions in Antarctica. 6:30 pm free Sept 28 th workshop on Eldercare planning and Navigating Medicare. 6:30 pm free Oct 17 th the friends of the Library will be taking part in Boscov s Friends helping friend s promotion. Selling shopping passes for $5. Users will get 25% off their purchases that day. Will be available at the library and the bake sale at the farmer s market. The library was excited to be invited to the night out and had a wonderful time. Regular weekend hours will resume this week on Saturdays and 12-4 on Sundays. Weekday hours remain the same. News from the museum: The museum will have a booth at the tugboat roundup Golf tournament Sept 18 th at 2 pm scramble, shotgun start at the Van Schaick country club in Cohoes $75 for golf and clambake. Rsvp to museum by sept 11 th. The annual mtg/volunteer appreciation event is Oct 1 11:30 am to 1 pm at the Waterford Harbor visitor center,

3 Day trip to Hyde museum and Warrensburg museum on Oct 4 th RSVP to Emily Wilson cost includes admission to museums and tours, transportation and lunch at log jam restaurant. Museum is hosting an art show presented by artist Dana Hatchett on Nov 17 th 6-9 pm his work is on Images of the Erie Canal, Champlain canal and barge canal. Admission is $10 The museum would like to thank Senator Kathy Marchione for securing $ to help with the museum s collection management, programs and events, general maintenance of the building and other projects. School starts tomorrow and watch for fordian weekend toward the end of September. SUPERVISOR S REPORT Supervisor Lawler reported that the fireworks would be on Saturday and again mentioned the no alcohol policy. Check the website for any weather changes for the fireworks. He further explained that property owners would be receiving mail from GAR Associates for the continuing assessment update. Homeowners will receive letters with a questionnaire in the next few weeks with an 800 number for questions. The Supervisor further reminded the residents that the Dispatch of services has gone to Saratoga County. 911 services had been going to the County for the last three years. All the Towns in the county have already switched over as well as many of our Town emergency service departments such as Peck Hose and the Rescue Squad. The transition has gone smoothly and will save the Town up to $200, per year. It is working out very well and thank you to the Police Department for stepping up and making the transition a smooth one. With part of the savings, the Police Department salaries will be adjusted making them more competitive and attractive to attract new officers and to retain the officers we have. We did it in a way to benefit the Town and the Police Department agreed with the changes. All of the Full Time dispatchers have found new positions. GENERAL ORDERS RESOLUTION NO. 88 RESOLVED, that the annual estimate of funds needed to be raised and levied for calendar year 2018 to pay principal and interest on obligations issued for capital expenses for sewer District No. 1 is determined to be $108,725.00, and be it further RESOLVED, that the amount of the estimate of funds needed for calendar year 2018 as above determined shall be assessed on the properties in the district benefitted by the sewer improvement in accord with the laws governing such assessments, and it further, RESOLVED, that the assessment roll for Sewer District No. 1 for 2018 benefit assessments shall be comprised of an assessment for the year for each property based on

4 (a) a so-called benefit charge to consist of an ad-valorem assessment upon which each $ of assessed value of each property at a rate of $.0 per thousand, and (b) a so-called basic benefit charge of $25.00 which shall be levied against all property in the district having access to an operating sewer line and which basic benefit charge shall be computed as follows: 1. For residential property there shall be one charge for each family unit, and 2. For non-residential property there shall be one charge for each estimated flow equivalent to a single family dwelling unit. The ordinary measure of an estimated sewage flow equivalent of a single family dwelling unit shall be water consumption in the 12 months computation of 80,000 gallons or any portion thereof, provided however, that in its discretion the Town Board in computing assessments may use an alternate estimated flow equivalent of a single family dwelling, if, in its judgment, (a) the users ration of a sewage contribution in water consumption is substantially different from that of a domestic household, or (b) the user has not been a consumer of public water for the entire 12 month period preceding its assessment, it being understood any such alternative measure shall be calculated to equitably reflect the user s benefit in relation to the benefit to a single family unit. RESOLVED, that the proposed assessment roll for Sewer District No. 1 for the calendar year 2018 to pay principal and interest on obligations issued and capital improvements to cover financing of the district improvements in the amount of the estimate for funds needed for such year, which has been reviewed at this meeting is considered complete and the same having been prepared by the Board shall be filed with the Town Clerk, and be it further RESOLVED, that the Board shall meet to consider objections to the assessment roll for Sewer District No. 1 filed with the Town Clerk this date at 6:55 P.M. on the 3rd day of October, 2017 at the Town Hall, and be it further RESOLVED, that the Town Clerk is directed to cause notice of completion of said assessment roll and of the date of hearing, etc. to hear objections, etc., to be published in the Troy Record Newspaper and in the Saratogian Newspaper, the latter being published in Saratoga County, in accord with the requirements of section 239 of the Town law and other applicable statutes, such notice shall be published at least 10 days and not more than twenty days before the date of hearing, and it is further RESOLVED, that Notice to the Comptroller of the State of New York before with provided the comptroller and be provided at least three weeks prior to October 3, 2016, the date of hearing. 6 RESOLUTION # 93 RESOLVED, that the Supervisor be and he is hereby authorized to sign an agreement with Saratoga County for Youth Recreation in an amount of $ RESOLUTION # 94 RESOLVED, that the Supervisor be and he is hereby authorized to sign the Civil Rights Certification form for the Town of Waterford Housing Choice Voucher Program. Seconded by Councilman Marble RESOLUTION # 95 WHEREAS, the Town Board of the Town of Waterford by public notice duly published according to law, invited sealed proposals for paving services of certain roads in the Town of Waterford; and WHEREAS, all such proposals received were considered publicly at Town Hall, on the 29 th day of August, 2017 at 11 AM, the time and place specified in said public notice, and WHEREAS, said Town Board has determined that New Castle Paving, LLC is the lowest responsible formal bidder for the work as detailed in the specifications, with a bid of $49, for location 1 (one) as set forth below in the bid specifications; THEREFORE, NOW BE IT RESOLVED, that the said proposal of New Castle Paving, LLC, be accepted, subject to the following, and be it

7 FURTHER RESOLVED, that the Town Board enter into a contract with said successful bidder for paving services related of certain roads in the Town of Waterford, in accordance with the specifications for said bid project, to be approved by the attorney for the Town and further subject to the receipt and approval by the attorney for the Town of the required bonding documents for performance, labor and materials.
