The applicant was requesting approval for the following: 1. Demolition of a garage which is a contributing structure located in the rear yard of the property. HERITAGE PRESERVATION BOARD ACTION The Heritage Preservation Board reviewed and denied the application on January 14, The Board stated that they were not convinced, based on the evidence provided, that this contributing structure could not be repaired. The draft minutes of the January 14, 2019 Heritage Preservation Board and staff analysis are attached to this report. APPLICANT APPEAL The applicant is requesting to appeal the decision of the Heritage Preservation Board to the Board of Commissioners for re-consideration. The applicant has stated that the garage is beyond repair. The applicant s appeal is attached. STAFF ADDITIONAL INFORMATION Staff has attached copies of pages 64 and 65 of the Design Review Guideline Manual (DRGM) covering Demolition and Relocation. This property is currently the subject of an active Code Enforcement case (# ) that specifically cites the structure in the rear (the garage) requiring removal or demolition due to failure to maintain the property. QUASI-JUDICIAL ANNOUNCEMENT AND SWEARING IN OF SPEAKERS Ms. Augello made the quasi-judicial announcement and swore in all who wished to testify. Mrs. Tarapani indicated that she was aware of a possible notice issue with Item Number 11, Application Number She wanted to address the issue of whether or not the applicant planned for the Board to hear the item today or continue it to the next meeting. Mrs. Tarapani s intent was to find out now, so that the applicant and his representatives didn t have to wait through several other items to find out that their item could not be heard. Ms. Augello explained that items that were not noticed on the post card notice for tonight s hearing could not be heard tonight. Therefore the applicant would have to return at a future hearing date, in order to allow for proper notice for all of the changes he wished to make to the historic structure. Ed Hoffman, 29 West Orange Street, Tarpon Springs, was given permission to act as agent verbally by the applicant Mr. Clark. APPLICATION 18-93; DEMOLITION OF OUTBUILDING ONE CAR WOOD FRAMED GARAGE IN REAR; CONTRIBUTING STRUCTURE (CONTINUED FROM MEETING OF DECEMBER 3, 2018); ADDRESS: 58 READ STREET; PARCEL NUMBER: ; APPLICANT: KONGER-DIAZ Staff: Mrs. McNeese gave background information and indicated that the applicant did not provide the information requested during the November 2018 meeting and the applicant did not contact Staff. She also noted that Staff continued to recommend approval of the application for complete demolition and removal of a contributing detached garage structure that was accessory to the primary residence on the subject property, based on the original letter from the contractor, which was provided in the packet subject to the following condition. 1. The applicant was responsible for obtaining all required permits. Applicant Anastasia Konger, 7121 Arboretum Way, New Port Richey, and Ella Hurley, 5116 Beacon Hill Drive, New Port Richey, and Stevette Larscheid, 4042 Marchmont Blvd, Land O Lakes, indicated that they were not able to get an estimate for the restoration of the garage. Mrs. Tarapani asked how the garage got into its current condition. Ms. Konger noted that they never paid attention to the garage. She indicated that the garage was in the same state as she remembered from growing up. Ms. Cornell announced that it appeared to her that the garage was beyond repair. Mrs. Tarapani indicated that the garage was neglected and that she didn t approve of Demolition by Neglect. MOTION: Ms. Page SECOND: Ms. Johnson To deny the application as presented. Mrs. Tarapani indicated that if the structure was not historic or contributing, she would not be concerned about it being demolished. Ms. Page indicated that she was not a professional but that parts of the garage appeared to be salvageable but without an expert s opinion, she was not comfortable with approving demolition. 8 7. APPLICATION ; DRIVEWAY RELOCATION, BRICK SURFACING OF DRIVEWAY AND WALKWAYS, INSTALL PICKET FENCE; ADDRESS: 101 N. GROSSE ST.; PARCEL NUMBER: ; APPLICANT: WOOD Staff: Mrs. McNeese gave background information and indicated that Staff recommended approval of the application to install brick walkways and driveway/parking, and, picket fence, as described in the staff report, subject to the following conditions: 1. Applicant was responsible for obtaining all required permits. Applicant: Mr. and Mrs. Wood indicated that they loved the historic home but that they needed parking. Mr. Wood noted that they wanted to make changes that would contribute to the historic nature of the home. Mr. Wood asked about railings on the porch deck stairs and wanted to know if they had so specifically ask for that as part of a Certificate Approval. Board: Mrs. Tarapani noted that it appeared as though Staff could approve the stair railing if the applicant provided proof that one existed in the past. Nancy Subic, 334 E Orange Street, indicated that she was in support of the application for the fence but wanted to make sure that the applicant was going to use bricks and not some other kind of brick paver. Stephanie Wood, 412 E Tarpon Ave, indicated that she was in support of the application. Mr. Wood went on record indicating that they planned to use actual bricks. MOTION: Ms. Milford SECOND: Ms. Cornell To approve application for a picket fence as proposed, constructed of vinyl or wood and the driveway or walkway to be constructed using bricks or something similar in appearance. APPLICATION ; REPLACE NINE (9) WINDOWS AND ONE (1) DOOR ON RESIDENCE; ADDRESS: 230 HIBISCUS STREET: PARCEL NUMBER: ; APPLICANT: FLANNERY Staff: Mrs. McNeese gave background information regarding the application and indicated that Staff recommended approval of the application to replace nine (9) windows and one door (front door) subject to the following conditions: 1. Applicant was responsible for obtaining all required permits. 2. All existing trim, sills and thresholds shall be retained and shall not be disturbed beyond normal maintenance. Applicant: Kelly Flannery, 230 Hibiscus Street, indicated that the windows were the original windows and were extremely old, one had a bullet hole in it and the glass was very weak. Mrs. Tarapani asked if the applicant considered repairing the windows and replacing the door with a wood door. Ms. Flannery indicated that she had not inquired about repairing the windows because of the expense and that she had not considered a wood door because of the humidity in Florida. Joe Kozech, Clearwater Beach, noted that he was in support of the application and felt that the windows and doors needed to be replaced for the occupant s safety. Board: Mrs. Tarapani noted that the building was very old and that she didn t believe that the windows should be replaced unless there was proof showing that more than half of the windows needed to be replaced. She also did not believe that the wood door should be replaced with a steel door and that weather should not affect the door since there was a porch roof to protect it. She gave the applicant the option to continue the application to the February 4 th, meeting so she could provide pictures as proof that over half of the windows needed to be replaced. Ms. Flannery indicated that she wanted to continue the application and provide additional documentation. MOTION: Ms. Johnson SECOND: Ms. Cornell To continue application to the February 4, 2019 meeting, to allow the applicant to provide additional documentation of the condition of the windows. TARPON AVE.; PARCEL NUMBER: ; APPLICANT: WOOD Staff: Mrs. McNeese gave background information and indicated that Staff recommended approval of the application for a second single family residence located at the rear of the property. 1. Applicant was responsible for obtaining all required land use approvals and permits. Applicant: Stephanie Wood, 412 E Tarpon Ave, indicated that they wanted the additional house to allow for an aging parent to live close to her husband and her. She indicated that the siding would be wood, and a wood door would be installed if allowed by building code. The roof would be metal and the windows would be vinyl. Board: Mrs. Tarapani asked whether the new building would comply with the setbacks for the district. Mrs. McNeese noted that the setbacks could be met by the applicant. Mrs. Tarapani asked if there was enough parking to allow for an additional unit. Mrs. McNeese confirmed that there was enough parking to allow for an additional unit. MOTION: Ms. Cornell SECOND: Ms. Johnson To approve application with wood siding, a wood door if allowed by Florida Building Code, a metal roof, and vinyl windows. 11 10. APPLICATION ; REPLACE TWO WOOD DOORS ON RESIDENCE; ADDRESS: 36 N. SPRING BLVD.; PARCEL NUMBER: ; APPLICANT: RYAN Staff: Mrs. McNeese gave background information and indicated that Staff recommended approval of the application to replace one set of double doors on the rear side of the structure subject to the following conditions: 1. Applicant was responsible for obtaining all required permits. Applicant: Michelle Ryan, 36 N Spring Blvd, indicated that the current doors were the second set that were placed in that doorway since June of She indicated that they tried to alter the gutters and avoid issues with water but they were not successful. Board: Mrs. Tarapani explained that the applicant was her neighbor and that the proposed doors faced her house and were not going to be seen from any street. She also noted that there was no overhang to protect wood doors from the weather. MOTION: Ms. Johnson SECOND: Ms. Cornell To approve application as proposed. APPLICATION ; INSTALL NEW WINDOWS, REPLACE DOORS, INSTALL NEW RAMP, INSTALL NEW WALKWAY AND PATIO, INSTALL/REPLACE PORCH AND DECK HANDRAILS, INSTALL NEW IRON FENCE, ALL AT THE FRONT (NORTH SIDE) AND WEST SIDE OF THE PRIMARY STRUCTURE; ADDRESS: 310 E. TARPON AVE., PARCEL NUMBER: ; APPLICANT: CLARK Staff: Mrs. McNeese wanted to know if the applicant wanted to hear just the three items that were noticed, given the fact that those three items were dependent on other items that needed to be approved at the February 2019 meeting. Applicant: Ed Hoffman, Hoffman Architects, 29 W Orange Street, noted that he was frustrated that the entire application could not be heard tonight. Mrs. Augello explained that although the Board could hear all of the changes that the applicant wanted to hear, she recommended against it. She also asked the applicant to limit his presentation to the items that were noticed. Mr. Hoffman wanted the Board to hear their proposal tonight so that they could explain what changes they wanted to make to the commercial building. Board: Mrs. Tarapani declared that the changes were too extensive for the Board to hear and that it was not fair for the applicant to ask that of the Board to hear items that were not noticed. Mr. Hoffman specified that the applicant wanted to make the business more visible and that he wanted to correct some of the mistakes that were made during previous renovations. Mrs. Tarapani maintained that the request the applicant was proposing was far different from the application before them so she didn t believe they should hear any of the application tonight. The applicant agreed to have the application continued to the February 4 th meeting. MOTION: Ms. Cornell SECOND: Ms. Page To continue application to the February 4, 2019 meeting. 13 12. STAFF COMMENTS There were no staff comments at this time. 13. BOARD COMMENTS Mrs. Tarapani wanted to discuss the fact that for this Board, the only decision that could be appealed was a denial. She asked that the section of code that pertained to appeals be added to the February 4 th 2019 Heritage Preservation Board meeting agenda for a discussion under Board Comments. Ms. Page asked about the ability of the Heritage Preservation Board to call a special meeting for cases such as Application Mrs. Augello indicated that a special meeting was allowed but in this case, given the fact that the application had to be noticed, a special meeting would not be much sooner than the February 4 th, meeting. Ms. Page wanted the Board to consider special meetings in cases where there was a staff error or if the applicant needed to expedite the hearing process because of issues with funding or other such conditions. The Board discussed the 2019 Public Hearing Schedule and determined that it was acceptable. 14. 16 CITY OF TARPON SPRINGS Staff Report January 9, 2019 TO: FROM: HERITAGE PRESERVATION BOARD PLANNING & ZONING DEPARTMENT HEARING DATE: JANUARY 14, 2019 (continued from December 3, 2019) SUBJECT: CA #18-93, 58 READ STREET, DEMOLISH DETACHED GARAGE; PRIMARY RESIDENCE: CONTRIBUTING-ALTERED STRUCTURE GARAGE: CONTRIBUTING STRUCTURE CERTIFICATE OF APPROVAL I. APPLICATION The applicant is requesting a Certificate of Approval to completely demolish a detached garage. II. GENERAL INFORMATION A. Location: 58 Read Street B. Tax Parcel #s: C. Architectural Style: Frame Vernacular D. Zoning/Future Land Use: RM-15 (Residential Multi-Family) / RM (Residential Medium) E. Owner: Anastasia M. Konger Diaz, Stevette D. Larshceid and Ella D. Hurley F. Applicant: Same as above. III. SUMMARY REPORT The applicant is seeking a Certificate of Approval to completely demolish a detached garage located in the rear yard of the property. The residence on the property is a contributing-altered structure. The garage is listed as a contributing structure on the Florida Master Site File (FMSF) Historical Structure Form for Site #8PI1590. The applicant has stated that the garage is in poor condition and is structurally unsafe. The Pinellas County Property Appraiser lists the year built for the principal residence as The garage is listed with a year built of UPDATE, JANUARY 9, 2019: At their regular meeting of October 1, 2018, the Heritage Preservation Board (HPB) continued this item to their regular meeting of December 3, 2018, requesting that the applicant supply cost estimates for rehabilitation of the building and for demolition of the building. The applicant then requested that the item be continued from the December 3, 2018 HPB meeting to the January 14, 2019 HPB meeting. The HPB granted this request (see attached letter to the applicant). The applicant was given until December 28,

17 to supply the additional information originally requested by the HPB at their October meeting. That information has not been submitted and the applicant has not communicated with the City.. IV. REVIEW CRITERIA AND ANALYSIS 110.0(A) A request to demolish a designated landmark site or any contributing structure within a designated historic or cultural preservation district shall require the issuance of a Certificate of Approval by the Heritage Preservation Board (B) When authorizing a Certificate of Approval for the issuance of a demolition permit, the Board shall consider the following criteria: (1) The historic, architectural or cultural significance of the building or structure; ANALYSIS: The FMSF Historical Structure Form describes this structure as a one car wood framed garage to rear (contributing). The building is of wood frame construction with board siding and a roof of corrugated metal over plywood. There are no doors or windows on the structure. Plywood has been used to cover the doorway openings and some window openings. There are holes in the siding as well, mostly near the ground. This is an accessory outbuilding on the parcel and is not readily visible from the road due to the distance at which it is set back. Its construction materials and scale are factors that lend to its status as contributing. However, it is not a significant building with respect to history, architecture or culture. (2) The importance of the building or structure to the ambiance of a district or to the patterns of land uses reflecting cultural traditions of the community or local ethnic group; ANALYSIS: The building is not readily visible from the road and does not directly contribute to the ambiance of the district. It has no cultural or ethnic significance. Many times, these types of buildings may be noted as they can contribute to the general feeling or charm of the overall historic area. However, there are other such structures in the district, and the subject structure is beyond repair. (3) The difficulty or impossibility of reproducing such a building or structure because of its design, texture, material, detail, or unique location; ANALYSIS: The building is a simple wood frame structure with no remarkable or unusual architectural features. It can easily be reproduced both in form and in material. (4) Whether the building or structure is one of the last remaining examples of its kind in the district or in the city; ANALYSIS: This building does not display a distinctive architectural type, nor is it unusual with respect to form, scale or use. In any event, there are other properties in the district with wellmaintained garages and outbuildings that display an equal or greater level of architectural charm and contribute to the overall character of the district. (5) The future utilization of the site and / or group occupancy of the structure; ANALYSIS: The building is a garage (outbuilding) in a rear yard. The property will remain as part of the rear yard of the principal structure once the garage is demolished. The structure cannot be occupied as it is unsafe and, in the opinion of the applicant s contractor, it cannot be made safe 2

18 to occupy. If the owner wishes to construct any new accessory structure, a separate review and approval would be needed. (6) Whether reasonable measures can be taken to save the building, structure or traditional cultural property; and, ANALYSIS: The applicant s contractor has provided a letter stating that the building is beyond repair and is unsafe. He identifies demolition as the best option for this building. (7) Whether the building, structure or traditional cultural property is capable of earning a reasonable economic return on its value and whether the perpetuation of the building or structure, considering its physical condition, its location and the anticipated expense of rehabilitation would be economically feasible. ANALYSIS: The building is valued by the Pinellas County Property Appraiser s office at $1, Total Value as New without listing a depreciated value. The structure is currently unsafe, presumably requiring significant structural renovation to even allow its basic use as a garage. All of the windows and doors appear to be gone, the corrugated metal roof is rusted, and portions of the wood siding are missing. The property owner has actually been cited by the City of Tarpon Springs Code Enforcement Officer identifying the garage as a dilapidated structure that should be removed. The perpetuation of this building, considering its poor physical condition and its location in the rear yard of the property would make rehabilitation economically infeasible. V. RECOMMENDATIONS Staff recommends approval of the application for complete demolition and removal of a contributing detached garage structure that is accessory to the primary residence on the subject property. 1. The applicant is responsible for obtaining all required permits. VI. TIME LIMITATION ON APPROVAL Pursuant to Section , a Certificate of Approval shall be valid for a period of three (3) years from the date of approval by the Heritage Preservation Board. VII. PUBLIC NOTIFICATION Property owners within 200 feet were sent written notification of this application. No responses to these notices have been received. VIII.
