Invocation Invocation was given by Chairman Smith. Notification of Location of Rules Chairman Smith indicated the location of the rules governing the meeting. AWARDS AND PRESENTATIONS Presentation of Awards Associated with the Five Points Intersection Improvement Project County Engineer Tod Handley introduced Mr. Tom Fravel, Design Consultant with American Engineers and Project Manager for the Five Points Intersection Improvement Project. Mr. Handley stated that the project has been a great benefit to the County. Mr. Fravel thanked the Board for continuing to utilize American Engineers on County projects. He presented a display and two (2) awards to the Board recognizing the Five Points Intersection Improvement project as the State Award Winner in the Small Projects Category and as recipient of an Honorable Mention on the national level by the American Council of Engineering Consultants (ACEC). Chairman Smith read each of the awards which recognized the engineering excellence made by the Coweta County Transportation and Engineering Department and American Engineers. 2 very proud of the project. RESULT: PRESENTED PUBLIC HEARING Motion To: Public Hearing Regarding Petition # Filed by CRG Bridgeport, LLC Requesting to Amend Conditions # 20 and # 23 of Previous Petition # for Property Located at South Hwy 29/27A Zoning Administrator White presented Petition # filed by CRG Bridgeport, LLC requesting to amend conditions # 20 and # 23 of previous Petition # (approved by the Board on February 3, 2015 and clarified on February 17, 2015) for property located at Hwy 29/27A and I-85. She explained that the Board rezoned the subject property from RC (Rural Conservation), C (Old Commercial), LM (Light Industrial), and M (Industrial) to M (Industrial) subject to twenty seven (27) conditions. She stated that the applicant is requesting to amend Conditions # 20 and # 23 to remove the Quality Development Corridor District (QDCD) requirements and replace them with proposed Design Guidelines in the development of the Bridgeport Commerce Center. Bridgeport is an Industrial Park consisting of ± acres and because of the size of the proposed warehouse buildings, the QDCD requirements are not feasible. Ms. White noted that Petition # is not a request to rezone the property, but to amend two existing conditions to include the proposed Design Guidelines. She further stated that staff is requesting the addition of condition # 28 to maintain the integrity and flow of the community by providing a tree canopy and incorporating buffers and landscaping such to provide screening along 29/27A and I-85. Ms. White fielded questions from the Board regarding the necessity for changing the exterior wall design from brick to precast concrete, the conformance of the proposed buildings with other large warehouse structures along the I-85 corridor, the appearance of the building(s) by citizens arriving at the airport, whether or not the rendering is the actual building design, and the process for reviewing the final site plans for construction. Commissioner Lassetter commended Ms. White on her presentation, for making it clear that Petition # does not involve zoning changes, and that the fact that the design guidelines will provide screening to citizens passing by the industrial park. Ms. Melissa Griffis, representative for the applicant, thanked staff for their time and efforts over the past several months of working with the applicant on Design Guidelines and coming up with a process to benefit everyone in the County. She stated that the applicant consents to and is pleased with the conditions, including condition # 28, and intends to be a good neighbor. She explained that the applicant is requesting two (2) edits to the proposed Design Guidelines. Mr. Dave Moses, Principal for CRG-Clayco, discussed two (2) potential edits to the Design Guidelines that he felt needed further clarification in order to avoid any misunderstanding. He stated that on page 4, Section III. Site Development Standards, Site Planning, he would like it changed to read "Site planning shall respect the existing natural features/topography of the area where practical as determined by the Developer. It should be noted, that Master Planning a significant industrial development like Bridgeport, will require large amounts of dirt/rock to be excavated and moved to deliver the proper finished floor elevations to achieve the desired results at the most cost effective pricing." He also requested an edit to page 8, Service Areas, paragraph four to read "Outdoor storage, exclusive of parked trailers, shall be screened by chain link fencing with "vision Coweta County Board of Commissioners Page 2 Printed 7/28/2017

3 slats" or landscaped berms, as determined by the Developer and approved by the ARB (Architectural Review Board)." He explained the reasoning for the requested edits and their concerns regarding the esthetics of the park. Mr. Moses fielded questions from the Board regarding working in concert with the Planning and Building departments on future changes, the number of berms planned in the project, the makeup of the ARB, and the reasons they intend to police themselves with an ARB on architectural items and not by County staff. Attorney Nathan Lee stated that the proposed changes would not allow the County to have any power to enforce placement of berms unless it is made a condition of zoning. Ms. White stated that in reviewing the Mr. Moses' requested changes, staff would ask consideration to change page 8, Service Areas, paragraph four to read "Outdoor storage, exclusive of parked trailers, shall be screened by black vinyl coated fencing, landscaped berms, or landscape materials as determined by the Developer and approved by the ARB (Architectural Review Board) and the Planning Director." Secondly, she stated that if the developer chooses to begin grading all of the sites situated along Hwy 29/27A, that Condition # 28 would be required at that time and the Design Guidelines must be followed. Previously, the Design Guidelines would be followed when construction of the buildings begin. Commissioner Poole expressed concerns regarding the number of berms included in the process. Ms. White fielded questions regarding screening the buildings from public view and being able to mandate placement of berms. County Engineer Tod Handley stated that he did not have any concerns regarding the requested changes made by the applicant. Ms. Griffis stated that the applicant is agreeable to the changes suggested by Ms. White. Chairman Smith called for any comments in support of Petition # There were none. Chairman Smith called for any comments in opposition to Petition # Ms. Noria Speissegger Rutherford, Teasley Trail, expressed concerns regarding increased traffic and accidents, signalization, loss of property, and flooding of her property by the new development. Commissioner Smith stated that the development will have to comply with the federal, state, and local stormwater regulations. County Engineer Handley stated that the stream and drainages that cross Ms. Rutherford's property come from the east side of the airport and that none of the runoff from the development will affect her property, as it drains to a separate basin. Ms. White stated that to address Commissioner Poole s concerns regarding berms, staff is suggesting editing the Design Guidelines, page 10 paragraph two to read Exact size, spacing and species with the incorporation of berms, will follow the guidelines set forth in the Coweta County Zoning and Development Ordinance., and paragraph three to read Each phase of the Bridgeport development (infrastructure and individual buildings) will submit specific landscape and/or berm plans for that work, designed by a licensed landscape architect in the State of Georgia, for final County review and approval, based on the concept submitted and approved with this application. Ms. Griffis stated that the applicant is agreeable with the changes suggested by Ms. Coweta County Board of Commissioners Page 3 Printed 7/28/2017

The Board voted to close the Public Hearing regarding Petition # filed by CRG Bridgeport, LLC requesting to amend conditions # 20 and # 23 of previous Petition # associated with property located at S. Hwy 29/S. Hwy 27A. RESULT: PUBLIC HEARING CLOSED [UNANIMOUS] MOVER: Bob Blackburn, District 3 SECONDER: Rodney Brooks, District Public Hearing Regarding Petition # Filed by CRG Bridgeport, LLC Requesting to Amend Conditions # 20 and # 23 of Previous Petition # for Property Located at South Hwy 29/27A Commissioner Lassetter stated that he wanted to clarify that the developers would have been able to build the same buildings without coming to Board and that some of the requirements of how they build them can be done differently with Board approval. Secondly, he stated that most of the concerns from citizens and elected officials from Moreland are regarding increased traffic. He stated that the Board and the developer do not want to do anything to negatively affect the nearby residents and the Town of Moreland, and that access for most of the traffic will be through the northern most portion of the development. Lastly, he thanked staff for working with the developers to ensure that projects like this can be done in Coweta County in addition to protecting the interests of the citizens. The Board voted to approve Petition # filed by filed by CRG Bridgeport, LLC requesting to amend conditions # 20 and # 23 of previous Petition # (approved by the Board on February 3, 2015 and clarified on February 17, 2015) associated with property located at S. Hwy 29/S. Hwy 27A, subject to the following conditions: 1. Development of the Property shall be in accordance with the development agreement(s) between Coweta County and P & L Bridgeport I, L.P. and P & L Bridgeport II, L. P., or their successors and assigns, to the extent it applies to the Property and is consistent herewith and is executed prior to proper development permitting. 2. The applicant/developer shall adhere to the conditions set forth in Attachments A and B of the Revised Notice of Decision for DRI #2449 issued by GRTA and dated December 5, The developer shall design and construct a flyover bridge over US 27 Alt/US 29 and the CSX Railroad accessing the DRI Plan Tract A from US 27Alt/US 29, subject to review and approval from the Georgia Department of Transportation s (GDOT) Chief Engineer and the Bridge Design Office prior to the issuance of permits as applicable for DRI Plan Tract A. A copy of the preliminary plan for the flyover bridge shall be submitted to the GDOT Bridge Design Office for review. 4. All access points and proposed construction on State right-of-way will require permits from the GDOT. 5. All access points and proposed construction on County right-of-way will require permits from Coweta County. 6. All access points and proposed construction on Railroad right-of-way will require permits from the CSX Railroad. 5 resolve all concerns and issues related to the development's impact to railroad crossings, if any, with the Railroad on the subject property to alleviate any potential problems. 7. Per GDOT, a traffic engineering study with signal warrant analysis in accordance with GDOT methodology must be submitted for any intersections where a traffic signal is proposed. 8. Left and right turn lanes shall be constructed at all affected and proposed intersections pursuant to the DRI Revised Notice of Decision dated December 5, 2014 and will determine permits from GDOT and Coweta County as required. The number and length of these lanes shall be determined from analysis of projected traffic as required by GDOT methodology. 9. Improvements to the intersection of US 29 at East Camp Street and West Camp Street (either traffic signalization or a roundabout) shall be required to meet 2024 build-out phase. 10. If a traffic signal is warranted prior to construction of the GDOT roundabout PI# and approved by GDOT for the US 27 Alt/US 29 at SR 14 intersection, signalization shall be designed and constructed at the developer s expense. There is a programmed project by GDOT to construct a new roundabout at this location. (PI# ). If the GDOT roundabout is constructed, signalization for the intersection shall not be required. This condition expires (1) one year after the issuance of the final certificates of occupancy for the 10,112,000 square feet of developed property. 11. Signalization on US 27 Alt/US 29 at Airport Road, Alex Stephens Road, and/or Camp Road shall be designed and constructed at the developer s expense, when or if warranted. This condition expires one year after the issuance of the final certificates of occupancy for the 10,112,000 square feet of developed property. All traffic signal design and construction shall be approved and permitted by GDOT. 12. The developer shall address the driveways in the southern portion of Tract A from US 27 Alt/US 29 at Railroad crossing # 2 that appear to be in close proximity to each other. 13. Driveway # 1 is located in the clear zone of the Newnan-Coweta County Airport and will require clearance from the Federal Aviation Administration (FAA) prior to construction. 14. West Aviation Way is not a County road, but an airport-owned thru the fence roadway. No access will be allowed onto West Aviation Way from the adjacent Tract C properties without permission from the Newnan- Coweta County Airport Authority. 15. The requirements of Coweta County s Soil Erosion and Sedimentation Control Ordinance, Wetlands Protection Ordinance, and Watershed Protection District Ordinance shall be satisfied. 16. Stormwater management shall meet the requirements of the Coweta County Stormwater Management Ordinances. 17. Developer shall provide reasonable internal connectivity within the development. 18. 6 Fire Marshals. 19. Lighting shall be established so adjacent properties and roadways are not adversely affected, and to preclude glare onto or direct illumination of adjacent properties and streets. 20. All applicable Development Requirements of the Coweta County Zoning and Development Ordinance are to be incorporated into site development unless a variance is granted through normal variance procedures. Applicant continues to work in good faith with the Camp family to allow access to their property and access to the improved infrastructure associated with the development. 28. In areas where there is not at least 50 feet in width of preserved trees along the zoning site perimeter, there shall be a row of trees. Canopy trees shall be spaced at a minimum of 80 feet, with three evergreen trees in between. Plant materials shall be as follows: Canopy Trees: o Size - Minimum of 2 inch caliper 8 feet in height at planting o Type - Chosen from the Large Category list in Article 26, Section 261 of the Coweta County Zoning and Development Ordinance o Located Every 80 feet Evergreen Trees: o Size - Minimum 7 gallon and 3 feet in height at planting o Type - Leland Cypress, Carolina Cherry Laurel, Magnolias, Eastern Red, Atlantic White Cedar or other variety, if approved by Planning Director. RESULT: NO ACTION TAKEN NEW BUSINESS Bids and Contracts Request Approval/Execution of a Project Framework Agreement Associated with the Madras Connector, Phase 1 Project - 3rd District Administrator Fouts explained that the first phase of the Madras Connector project currently includes federal and state funding for portions of the engineering and construction. This project is the first leg of the roadway that will connect US 29 with the future Amalajack Interchange at I-85. A proposed Project Framework Agreement (PFA) establishes project responsibilities and levels of participation for the different phases of the project. Based on the terms of the agreement, the County would be responsible for an estimated $213, for preliminary engineering with $593, from state funding. The estimated right-of-way acquisition would total $4,052, and utility relocation would total $64, Construction costs would total $5, from the County, $802, from state funding and $3,211, federal. He stated that there are no direct costs associated with this agreement and that costs will be incurred on specific phases of the project such as design, right-of-way, and construction. The Board voted to execute a Project Framework Agreement (PFA) with the Georgia Department of Transportation along with all other documents associated with the Madras Connector, Phase 1. 10 Additional Action Items Request Approval of a Provision of Access Associated with a Proposed Development on Cedar Creek Road - 3rd District **Commissioner Blackburn recused himself from any discussion or decision regarding a provision of access associated with a proposed development on Cedar Creek Road, and exited the meeting.** Administrator Fouts explained that during the August 2, 2016 Commission meeting, the Board heard a proposal concerning the development of a ninety-three (93) lot residential subdivision development located on Cedar Creek Road. The issue with the proposed development was the number of entrances or access points that could be provided to satisfy the intent of the County ordinance, which states that developments with only one (1) entrance shall be limited to forty-nine (49) lots. Although two (2) entrances were proposed for this development, their intersections with Cedar Creek Road were close together and the majority of the lots were only accessible by one (1) street which included two (2) stream crossings. As an added measure of protection, the developer had proposed to build the portions of the roadway crossing these streams as a two (2) lane divided section to reduce the likelihood of the access being blocked to the lots beyond the stream crossing. He stated that the proposal, as submitted, was denied by the Board. Further discussion of this proposed development, provision of access, and public safety considerations followed with the consensus of the Board being that the development would be limited to forty-nine (49) lots unless an emergency access could be provided from the rear portion of the property because of the potential access limitations of the proposed layout, and secondly, with the provision that an emergency access from the rear portion of the property, only one (1) entrance would be required on Cedar Creek Road Since the proposal presented at the August 2, 2016 meeting was officially denied, the developer is now proposing to provide an emergency access to the rear portion of the property and requests the Board s consideration of the revised access proposal with one (1) primary entrance to Cedar Creek Road and one (1) emergency access from the rear of the property to a subdivision street within an existing adjacent subdivision. Administrator Fouts fielded questions regarding maintenance of the property for emergency access at any time and whether or not the property will be deed restricted. The Board voted to approve a proposal to provide one (1) primary entrance to/from Cedar Creek Road and one (1) emergency access point from the rear portion of property associated with a development on Cedar Creek Road, subject to the following conditions: 1. The provision of an emergency access driveway through adjoining property beyond the second stream crossing would allow the development of up to 93 lots. 2. An existing adjoining subdivision lot could be acquired to provide a location for the emergency access driveway. 3. The emergency access driveway must be graded and graveled to provide all- Coweta County Board of Commissioners Page 10 Printed 7/28/2017

11 weather access for emergency vehicles. 4. Any existing home or structures on the adjoining property utilized for the emergency access drive must be removed and the property would no longer be considered a buildable lot. 5. The emergency access drive must be gated to prevent use of the drive by vehicular traffic except in time of emergency. RESULT: APPROVED [4 TO 0] MOVER: Tim Lassetter, District 2 SECONDER: Paul Poole, District 1 - Vice Chairman AYES: Paul Poole, Tim Lassetter, Rodney Brooks, Al Smith RECUSED: Bob Blackburn Request Approval of the Superior Court Public Defender's FY2018 Budget **Commissioner Blackburn rejoined the meeting.** Administrator Fouts explained that staff has received the Public Defender s FY 2018 budget from Circuit Public Defender Maryellen Simmons. For FY 2018, the Public Defender s office has requested $661,728.17, including one (1) additional attorney ($86,948.51) and funding to match the salary increases approved by the General Assembly for the State s FY 2018 budget ($11,150.39). Staff proposes that the Board approve an appropriation of $561, (same amount as FY 2017). This amount does not include the additional attorney or the salary increases approved by the General Assembly. Staff recommends that the request for one (1) additional attorney and salary increases made by the Public Defender s office be evaluated during the County s FY2018 budget process. Ms. Maryellen Simmons, from the Superior Court Circuit Public Defender, gave a short synopsis regarding the five (5) county circuit including the Coweta County Public Defender s office. She explained that she is requesting an additional attorney along with salary increases as approved by the General Assembly. Ms. Simmons fielded questions from the Board regarding the difference between misdemeanor and felony charges, the breakdown of the five (5) county circuit by caseload numbers, and the rank of Coweta County in that number. Commissioner Lassetter thanked Ms. Simmons for the job that she and her staff perform. The Board voted to approve the Public Defender s FY 2018 budget in the amount of $561, and to evaluate a request for one (1) additional attorney and salary increases as part of the County s FY 2018 budget process. MOVER: Rodney Brooks, District 4 SECONDER: Tim Lassetter, District Request Approval of the District Attorney's FY2018 Budget Administrator Fouts explained that staff has received the FY 2018 budget request from District Attorney Pete Skandalakis for Coweta County. The District Attorney s office has requested $1,182,993, including three (3) additional employees and funding to match salary increases approved by the General Assembly for the State s FY 2018 budget ($198,898). Staff proposes that the Board approve an appropriation of $984,095 (same amount as FY 2017), which includes the Victim s Assistance Coweta County Board of Commissioners Page 11 Printed 7/28/2017

MOVER: Tim Lassetter, District Request Approval of the Board of Health's FY Budget Administrator Fouts explained that staff has received the FY 2018 budget request from the Board of Health. The Board of Health has requested $197,500, along with cleaning, landscaping, building repair and maintenance services totaling approximately $45,000. This request for funding is the same amount as last year. He stated that during review of the Health Department s budget, staff noted an accumulation of unexpended County funds. Staff recommends reducing the appropriation to the Health Department to the required minimum of $68,132 and request that the Health Department spend down the accumulated County funds as necessary for operations prior to requesting additional funds from the County. Staff also recommends that the County continue to provide cleaning, landscaping, building repair and maintenance services. The Board voted to approve an appropriation to the Health Department of the required minimum of $68,132 and to continue to provide cleaning, landscaping, building repair and maintenance services Presentation of the SPLOST Projects List Administrator Fouts explained that in preparation for the 2019 SPLOST referendum which will be presented on November 7, 2017, staff has developed a project list based on input from citizens, elected officials, staff, and the general public. This input was gathered through internal staff meetings, town halls, SPLOST input forms, and s. He stated that based on projected SPLOST collections, it is estimated that $140 million will be collected countywide during the six (6) year period. In accordance with the allocation of the SPLOST proceeds in the Intergovernmental Agreement that will be proposed before the Board, it s estimated that Coweta County will receive $89.2 million. It was the consensus of the Board to direct staff to revise the Parks and Recreation category to include a multipurpose covered facility at the Fairgrounds. 13 The Board voted to execute an agreement with Stalwart Films for the temporary closure of Crook Road, as needed, from June 12 to November 17, 2017 for the purposes of filming Season 8 of The Walking Dead. RESULT: EXECUTED [UNANIMOUS] Request Approval to Surplus and Donate Spotlights Previously Utilized by the Coweta County Fire Department Administrator Fouts explained that staff is requesting to surplus and donate eleven (11) handheld spotlights that were removed from previously surplused Fire Department apparatus and are no longer being utilized. Meriwether County Fire Chief Phynenburg has requested a donation of the spotlights (estimated value $450) for use by their Volunteer Fire Department. The Board voted to surplus eleven (11) handheld spotlights previously utilized by the Fire Department valued at approximately $ and to allow staff to donate such to the Meriwether Volunteer Fire Department. He stated that the Bradshaw Farms Homeowner s Association (HOA) is requesting that the Board of Commissioners waive the interest charges totaling $ This request would reduce the amount due to $ and enable the HOA to acquire the property. The property ownership will be conveyed to Bradshaw Farms HOA and the property value would remain at a value that would not create any future tax liability. MOVER: Tim Lassetter, District 2 SECONDER: Paul Poole, District 1 - Vice Chairman PUBLIC COMMENT (Items Not on the Agenda) Public Comments Regarding Items Not on the Agenda Chairman Smith called for comments regarding any items not on the agenda. Mr. Danny Cunningham, Deer Creek Run, expressed concerns regarding violations of the Coweta County Code of Ordinances committed by a current County Commissioner. He stated that he has filed complaints with Code Enforcement Officers and that they are having a hard time enforcing the code because the violation is a sitting Commissioner. He asked the Board to look into the issue and to provide help to his neighborhood. Mr. Hendrik Vatel, Hazelridge Lane, stated that he owns the property mentioned by the previous speaker and is vexed because he feels his property rights have been violated. He stated that Code Enforcement Officers have entered his property without notification, and without permission being granted. He stated he wanted to be on the record to warn the persons coming to his property unannounced and without permission that he will seek criminal prosecution. Chairman Smith stated that County Administration would look into both sides of the complaint and that it would be dealt with in an equitable manner. Sheriff Yeager addressed the Board regarding two (2) recent law enforcement incidents. The Sheriff s Office assisted the Drug Enforcement Agency (DEA) with the seizure of 300 pounds of suspected methamphetamine being produced at a residence located on Shell Road. He stated that his office continues to work with the DEA and that the case is being handled by the Department of Justice and the US Attorney s Office. Secondly, the Sheriff s Office participated in a search of patrons at Hoops Bar located on Corinth Road in conjunction with the Newnan Police Department, Department of Community Supervision (DCS), Homeland Security and the Carrollton Police Department. He stated that fourteen (14) new calls have been received this year regarding patrons doing drugs openly, fights in the parking lot, etc. Illegal narcotic activity was verified from inside prior to obtaining a search warrant and it was witnessed that the owner/staff of the bar did nothing to stop the illegal activity. Twenty-seven (27) arrests were made by DCS associated with violations of probation or parole. Sheriff Yeager stated that the information is being forwarded to the Business License Department and the Department of Revenue, and the recommendation is being made to the Commissioners to revoke the Bar s license.
