1 Bills Affecting the Delaware State Education Association th General Assembly Bill Number HCR 5 HB 111 Title Synopsis Prime Sponsors CALLING FOR AN ARTICLE V CONVENTION TO AMEND THE UNITED STATES CONSTITUTION. AN ACT TO AMEND TITLE 21 OF TO SCHOOL BUS SAFETY CAMERAS. This resolution places Delaware alongside sister states, including Vermont, California, Illinois, New Jersey, and Rhode Island, in calling for an Article V convention to reverse the decision by the United States Supreme Court in Citizens United v. Federal Election Commission, 558 U.S. 310 (2010) ( Citizens United ) and related cases and events. The Citizens United decision has permitted money to play an unduly influential role in the context of political campaigns. The convention will have the sole purpose of crafting an amendment to the Constitution of the United States to address this situation, based upon data and experiences that have arisen in the wake of these decisions. This bill allows school districts and charter schools in Delaware to utilize external camera systems on school buses to catch motorists that illegally pass school buses and punishes these motorist by issuing them a civil penalty. The purpose of this bill is to protect children as they are in the process of boarding and exiting the school bus and to spread awareness of school bus traffic safety. At least 16 states have implemented similar legislation, including Pennsylvania in This is a discretionary program that is not required, but is encouraged to be used by the Delaware school districts and charter schools. 2 HB 101 AN ACT TO AMEND TITLE 14 OF TO EDUCATION. This Act requires high needs elementary schools, including high needs elementary charter schools, to have school-based health centers. The State will pay the startup costs for each school-based health center at 2 centers per year until each high needs elementary school has a center. High needs elementary schools are defined as any elementary school in the top quartile of 3 or more in percentage of low-income students, percentage of English learners, percentage of students with disabilities, percentage of minority students, or having 90% of its students classified as lowincome, English learners, or minority. This act also allows high needs elementary schools having pre-existing school-based health centers to apply for reimbursement of previously expended funds necessary to establish said health center. This Act establishes a mental health services unit for Delaware elementary schools. The unit is at a ratio of 250 full-time equivalent students grades K-5 for a fulltime school counselor, school social worker, or licensed clinical social worker. Additionally a unit ratio of 700 full time equivalent students for grades K-5 for employment of a full-time school psychologist. This Act defines mental health services as prevention, response, and coordination services delivered to students in elementary schools. Mental Health disorders are the most common health problem for school aged youth. According to the National Institute of Mental Health (NIMH), one in five youth are affected by a mental health disorder. Additionally, 50% of lifetime mental illnesses Rep. 3 HB 92 AN ACT TO AMEND TITLE 14 OF TO FREE PUBLIC SCHOOLS. begin by age 14. Untreated mental illness leads to negative outcomes including increased risk of dropout, homelessness, substance abuse, other chronic illnesses, incarceration, and possibly suicide. According to the National Alliance on Mental Health, ninety percent of people who have taken their own life have had an underlying mental health condition, and suicides are on the rise. According to the Center for Disease Control and Prevention, suicides are now the second leading cause of death for youth ages Delaware schools need trained and experienced mental health professionals to provide prevention and support programs and services to students. Currently, as reported by Delaware school districts, 86% of elementary schools do not employ a school social worker, and ratios of students to school counselors and school psychologists far exceed national best practices. This bill will lower ratios and increase access to mental health services for elementary school students. This bill creates an Expanded Learning Opportunities Council to provide research, recommendations, and coordination regarding before and after school programs and summer learning opportunities for school-age children. The Chair of the Council is also added to the Interagency Resource Management as a non-voting member. The creation of an Expanded Learning Opportunities Council was one of the primary recommendations of the Statewide Afterschool Initiative Task Force, which was created by the 148th General Assembly. 4 tracking developments across the country and in the State, with a view towards encouraging the development of programs and funding models that maximize positive outcomes. HB 85 HB 80 HB 73 AN ACT PROPOSING AN AMENDMENT TO ARTICLE XV OF THE DELAWARE CONSTITUTION RELATING TO THE RESIGNATION OF ELECTED OFFICERS SEEKING ANOTHER OFFICE. AN ACT TO AMEND TITLE 30 OF TO TAXES ON PERSONAL INCOME. AN ACT PROPOSING AN AMENDMENT TO ARTICLE V OF THE DELAWARE CONSTITUTION RELATING TO VOTING. This Act is the first leg of an amendment to the Delaware Constitution requiring an individual elected to an office of this State, or one of its political subdivisions, to resign from the officer's current elected office if the officer seeks to be a candidate for another office of this State, or one of its political subdivisions, if the term of the office sought runs concurrently with the term of the office held Sections 1 and 2 of this Act raise the eligibility age, from 60 to 65 in one-year increments over a five-year period, for the up to $12,500 retirement income exclusion and the extra $110 age-based personal credit. Anyone eligible for these age-based benefits in the year of enactment would remain eligible under this legislation and eligibility for an up to $2,000 pension exclusion would be extended to persons under age 65. Section 3 of this Act modifies Delaware s Earned Income Tax Credit (EITC) to allow recipients to choose between a non-refundable credit of up to 20% of the value of the corresponding federal EITC or a refundable EITC credit of up to 4.5% of the value of the corresponding federal EITC to be applied against their Delaware Personal Income Taxes. This Act is a first leg of a constitutional amendment that would eliminate from the Delaware Constitution the limitations as to when an individual may vote by absentee ballot. Constitution provides that the General Assembly shall enact general laws providing the circumstances, rules, and procedures for absentee voting. This Act includes the dollar amount of an Educational Support Professional of the Year award received by a State employee when determining the final average compensation used to compute the State employee's pension. 6 HB 50 HB 48 AN ACT MAKING APPROPRIATIONS FOR THE EXPENSE OF THE STATE GOVERNMENT FOR THE FISCAL YEAR ENDING JUNE 30, 2020; SPECIFYING CERTAIN PROCEDURES, CONDITIONS AND LIMITATIONS FOR THE EXPENDITURE OF SUCH FUNDS; AND AMENDING CERTAIN PERTINENT STATUTORY PROVISIONS. AN ACT TO AMEND TITLE 14 OF TO PUBLIC SCHOOLS This Bill is the Fiscal Year 2020 Appropriations Act. This bill provides State funding to kindergarten through third grade for basic special education. State funding already occurs for intensive and complex special education during these grades. Currently the basic special education funding runs from fourth through twelfth grade. This bill is an effort to promote earlier identification and assistance for basic special education needs which should then mitigate costs over the long term. Section 1 of this bill moves the date of primary elections for statewide office, county office, and municipal office to the fourth Tuesday in April, which is the date of the presidential primary (in presidential election years). The dates for submitting and withdrawing notification of candidacy have been adjusted accordingly. Section 2 of the bill changes the deadline for a minor political party selecting its candidate at the party s convention. Section 3 of the bill changes the deadline for filing certificates of nomination from September 1st to April 1st. Section 4 changes the closed period in which a voter is not allowed to change his or her political affiliation to match the 60-day limit in 15 Del. C for presidential primaries. Commerce Rep. This bill provides for election day registration for presidential primary, primary, special, and general elections whereas currently the deadline is the fourth Saturday prior to the date of the election. This Act establishes in-person early voting in Delaware beginning January 1, Registered voters will be allowed to vote inperson during at least 10 days before an election, up to and including the Saturday and Sunday immediately before the election at locations determined by the State Election Commissioner. This Act also charges the State Election Commissioner with determining whether such voting should occur by voting machine or paper ballot. All other procedures relating to conducting voting are the same as for general election voting. Further, this Act requires that for statewide elections there must be at least 1 in-person polling place in each county, and an additional location in the City of Wilmington. Rep. AN ACT PROPOSING AN AMENDMENT TO ARTICLE II OF THE DELAWARE CONSTITUTION RELATING TO THE LEGISLATURE AND VOTING ON THE BUDGET APPROPRIATION ACT, BOND AND CAPITAL IMPROVEMENT ACT, AND ACT MAKING APPROPRIATIONS FOR CERTAIN GRANTS-IN-AID. This Act authorizes a county or municipality to treat an unpaid lien as a tax lien against the property subject to the lien and collect the lien in the same manner as other tax liens, including a proceeding under a writ of monition. This Act also makes technical corrections to conform existing law to the standards of the Delaware Legislative Drafting Manual. This Act decreases by 1% the rate of realty transfer tax to be received by the State, thereby returning to the rate that was applicable prior to August 1, This bill allows real property tax itemized deductions to continue in Delaware notwithstanding recently enacted changes to federal income tax laws. This Act is the first leg of a constitutional amendment that requires the General Assembly to wait 48 hours from the introduction of the budget appropriation bill, bond and capital improvement act, and act making appropriations for certain grants-inaid bill, or any substantive amendment or substitute bill to such bills before voting on such legislation unless the General Assembly by a three-fourths vote waives this requirement. 10 HB 22 AN ACT TO AMEND TITLE 14 OF TO POWERS AND DUTIES. including legislators, a reasonable amount of time to review the three significant financial legislative acts before voting on such legislation. This restriction can be waived if three-fourths of each of the General Assembly agrees to act in a shorter time period. This bill is a companion bill to Bill No. 21 and provides the authority for the Department of Education to prescribe the rules and regulations necessary to implement the prison education program which provides educational services to the Department of Correction. The language set forth in this statute would remove barriers for inmates who are students with disabilities and who have an Individualized Education Program (IEP) under state and federal law, when being considered for parole or a sentence modification. Requiring an inmate with an IEP to complete a GED or State of Delaware High School Diploma is counterproductive to the treatment and programming of this segment of the prison population and prohibits them from seeking the same benefits of parole or sentence modification afforded to those inmates who do not have an IEP. This amendment to the law allows an inmate the opportunity to earn a State of Delaware Diploma of Alternate Achievement Standards upon successful completion of the inmate's IEP Rep. 11 HB 19 HB 17 AN ACT TO AMEND TITLE 14 OF TO SCHOOL NURSES. AN ACT TO AMEND TITLE 30 OF TO STATE TAXES AND PRIORITY OF CLAIMS TO INTERCEPT OR REDUCE FUNDS. This Act seeks to ensure that every public school in the State has a school nurse. This Act provides a mechanism to allow a district or a charter school that currently does not have a school nurse to receive State funds. This Act also permits a district to levy a tax under 1902(b), Title 14, known as a "match tax", to assist those districts that hire a school nurse as a result of this Act to pay for the local share of that school nurse. 12 HB 11 AN ACT TO AMEND TITLE 14 OF TO HOURS OF SCHOOL DISTRICT ELECTIONS Bill No. 363, as amended by Amendment No. 1, of the 149th General Assembly changed the time that polls open for school board and school referendum elections to 7:00 a.m from prior time of 10:00 a.m. There are several sections of Title 14 that govern the hours that polls are open for elections under Title 14 and Bill No. 363 did not include a revision to the hours listed in 1907 of Title 14. This Act makes the technical correction to 1907 of Title 14 so that it is consistent with the sections of Title 14 that were revised by Bill No 363. This Act also makes technical corrections to conform existing law to the standards of the Delaware Legislative Drafting Manual. Rep. 13 Constitution. While Congress passed the Amendment in 1972, it was not ratified by the requisite number of states by the 1982 deadline. Delaware, however, was one of the first states to ratify the Amendment. About half of the states across the country have passed Equal Rights Amendments to their state constitutions in order to provide protection against discrimination based on sex. Without an Equal Rights amendment, women's rights and protections are limited. This Amendment is necessary to correct a constitutional shortcoming, reduce sexbased disparities and to codify our State's value of equality. This Act establishes the Focus on Alternative Skills Training Program ("FAST"). FAST will provide tuition, up to $9,000, to Delaware residents who have obtained a high school diploma, Diploma of Alternate Achievement Standards, or a Delaware secondary credential, which includes earning a GED, and have enrolled in an approved non-degree credit certificate program. 14 SB 62 AN ACT TO AMEND TITLE 29 OF TO THE STATE EMPLOYEES' PENSION PLAN AND COST OF LIVING ADJUSTMENT. This bill provides an annual cost of living adjustment for qualified state pensioners equal to the cost of living adjustment provided by the National Consumer Price Index, which also serves as the annual adjustment for Social Security benefits. This Act gives the College s Board of Trustees the authority to issue bonds to finance the cost of major and minor capital improvements, deferred maintenance, and the acquisition of related equipment and educational technology and establishes the Community College Infrastructure Fund ( the Fund ) to pay the principal and interest on such bonds. Any promissory notes or bonds must be approved separately prior to issuance by the General Assembly in a bond and capital improvement act. This Act is a substitute for and differs from Bill No. 50 by deleting the property tax component and instead provides that it is the intent of the General Assembly to appropriate at least $10 million for deferred maintenance for the next 5 years to be deposited to the Fund together with such Sen. This Act also provides a mechanism, but not an obligation, for the state to provide matching funds for minor capital improvement projects consistent with existing matching provisions for public education. This Act also makes technical corrections. Delaware's statewide community college system, operated by Delaware Technical and Community College ( the College ), plays a critical role in the State's economy by providing workforce development, vocational training and transfer education that connects Delawareans with good paying jobs within the State and region. This Act gives the College s Board of Trustees the authority to issue bonds to finance the cost of major and minor capital improvements, deferred maintenance, and the acquisition of related equipment and educational technology and establishes the Community College Infrastructure Fund ( the Fund ) to pay the principal and interest on such bonds. SB 50 AN ACT TO AMEND TITLE 14 AND TITLE 29 OF THE DELAWARE CODE RELATING TO THE ESTABLISHMENT OF A COMMUNITY COLLEGE INFRASTRUCTURE FUND. Delaware's statewide community college system, operated by Delaware Technical and Community College ( the College ), plays a critical role in the State's economy by providing workforce development, vocational training and transfer education that connects Delawareans with good paying jobs within the State and region. This Act gives the College s Board of Trustees the authority to issue bonds to finance the cost of major and minor capital improvements, deferred maintenance, and the acquisition of related equipment and educational technology and establishes the Community College Infrastructure Fund ( the Fund ) to pay the principal and interest on such bonds. This Act adopts the county Vo-Tech structure to finance the Fund by authorizing the College's Board of Trustees to collect a local property tax, subject to a cap. All money raised in a county must be placed in a segregated account and spent exclusively on projects in that county, thereby eliminating any possibility of applying this Act in an unconstitutional manner. This Act also provides a mechanism, but not an obligation, for the state to provide matching funds for minor capital improvement projects consistent with existing matching provisions for public education. 17 SB 22 AN ACT TO AMEND TITLE 15 OF THE AGREEMENT AMONG THE STATES TO ELECT THE PRESIDENT BY NATIONAL POPULAR VOTE. Act enacts the National Popular Vote compact, which changes the Electoral College from an institution that reflects the voters state-by-state choices into a body that reflects the voters nationwide choice. Currently, state statutes require that electoral votes are controlled by the plurality of the voters in the state but this system is not required by the U.S. Constitution or federal law. The National Popular Vote compact requires that each member state award its electoral votes to the presidential candidate who received the largest number of popular votes in all 50 states and the District of Columbia. The National Popular Vote compact becomes effective when it is enacted by states collectively possessing a majority of the electoral votes. When the National Popular Vote compact takes effect, the presidential candidate receiving the most popular votes in all 50 states and the District of Columbia would be guaranteed enough electoral votes in the Electoral College to be elected to the Presidency. Specifically, this Act does the following: Section 1. Adopts The Agreement Among the States to Elect the President by National Popular Vote ("National Popular Vote compact") and provides for notice regarding when the National Popular Vote compact is in effect and governs a presidential election. Section 2. Revises the wording of 4303(b) so that it correctly addresses how electors must vote in any presidential election. This is not a substantive change to current law, which governs when the National Popular Vote compact is not applicable to an election, because the electors nominated by the political party that received the plurality of vote of the voters of this State are the Sen. Section 3. Corrects a typographical error in Section 4. Revises 5711 to govern when the National Popular Vote compact governs a presidential election. Both versions of 5711 will appear in the Delaware Code with a note at the top of each version stating if that version governs the next presidential election. Section 5. Revises 7704 of Title 15 regarding the election of delegates to a state constitutional convention to ratify proposed amendments to the U.S. Constitution so that it remains unchanged by the National Popular Vote compact. The statute currently provides that delegates are elected "in the same manner as in the case of the election for electors for President and Vice President." Because the National Popular Vote compact changes how electors are selected, 7704 is revised so that delegates to a national constitutional convention are nominated and elected in the current manner, regardless of whether the National Popular Vote compact governs the next presidential election. 21 which they can agree for purposes of collective bargaining. It also eliminates the requirement that exclusive bargaining representatives of exclusive bargaining units form a coalition for collective bargaining. The Act eliminates the provision allowing for an employee organization to seek to be certified for unrepresented employees. The Act provides that parties may engage in collective bargaining for compensation in conjunction with or separately from collective bargaining for terms and conditions. It requires that the negotiation of collective bargaining agreements be staggered over time while providing that collective bargaining agreements currently in place remain in place until they expire by their own terms. While the Act allows for exclusive representatives to bargain for different pay rate increases, it prohibits the compensation of bargaining units from exceeding the pay ranges for each pay grade as established each year in the appropriations act. In addition, it retains the existing scope of bargaining contained in 19 Del.C. Section 1311A(a). Finally, this Act makes technical revisions to conform with the Delaware Legislative Drafting Manual. 22 SB 7 AN ACT TO AMEND TITLE 29 OF TO THE DELAWARE POPULATION CONSORTIUM. the Fiscal Year 2019 Budget Act, that pertains to the collective bargaining process repealed by Section 2 of this Act. Since 1975, the Delaware Population Consortium has prepared a unified set of statewide population projections each year. These projections are used for a variety of purposes including capital planning, policy analysis, comprehensive planning, and transportation planning. All 3 counties are required by State law to utilize these projections to prepare their required comprehensive plans. However, the Delaware Population Consortium does not exist in State law. This Act formally creates the Delaware Population Consortium, identifies its membership and work products, and requires that all counties, municipalities, school districts, and State agencies use the Consortium s projections for planning and policy purpose SA 1 - This Amendment adds the Sussex County Association of Towns to the Delaware Population Consortium and correspondingly revises the quorum requirement.
