AN ACT MAKING A ONE-TIME SUPPLEMENTAL APPROPRIATION FOR THE FISCAL YEAR ENDING JUNE 30, 2020 TO THE OFFICE OF MANAGEMENT AND BUDGET AN ACT MAKING APPROPRIATIONS FOR THE EXPENSE OF THE STATE GOVERNMENT FOR THE FISCAL YEAR ENDING JUNE 30, 2020; SPECIFYING CERTAIN PROCEDURES, CONDITIONS AND LIMITATIONS FOR THE EXPENDITURE OF SUCH FUNDS; AND AMENDING CERTAIN This resolution places Delaware alongside sister states, including Vermont, California, Illinois, New Jersey, and Rhode Island, in calling for an Article V convention to reverse the decision by the United States Supreme Court in Citizens United v. Federal Election Commission, 558 U.S. 310 (2010) ( Citizens United ) and related cases and events. The Citizens United decision has permitted money to play an unduly influential role in the context of political campaigns. The convention will have the sole purpose of crafting an amendment to the Constitution of the United States to address this situation, based upon data and experiences that have arisen in the wake of these decisions. 2 HB 48 HB 47 HB 41 PERTINENT STATUTORY PROVISIONS. AN ACT TO AMEND TITLE 14 OF TO PUBLIC SCHOOLS AN ACT TO AMEND TITLE 19 OF TO MINIMUM WAGE AN ACT TO AMEND TITLE 15 OF TO PRIMARY ELECTIONS. This bill provides State funding to kindergarten through third grade for basic special education. State funding already occurs for intensive and complex special education during these grades. Currently the basic special education funding runs from fourth through twelfth grade. This bill is an effort to promote earlier identification and assistance for basic special education needs which should then mitigate costs over the long term. Pursuant to its terms, funding for K-3 special education will be phased in gradually over 4 years. This bill removes the training minimum wage, which takes effect 90 days after enactment, and youth minimum wage, which takes effect January 1, Section 1 of this bill moves the date of primary elections for statewide office, county office, and municipal office to the fourth Tuesday in April, which is the date of the presidential primary (in presidential election years). The dates for submitting and withdrawing notification of candidacy have been adjusted accordingly. Section 2 of the bill changes the deadline for a minor political party selecting its candidate at the party s convention. Section 3 of the bill changes the deadline for filing certificates of nomination from September 1st to April 1st. Section 4 changes the closed period in which a voter Rep. AN ACT TO AMEND TITLE 15 OF TO EARLY VOTING. This bill provides for election day registration for presidential primary, primary, special, and general elections whereas currently the deadline is the fourth Saturday prior to the date of the election. Moreover, same day registration at polling places will be permitted with submission of valid government issued identification or other generally accepted proof of identification. This Act establishes in-person early voting in Delaware beginning January 1, Registered voters will be allowed to vote inperson during at least 10 days before an election, up to and including the Saturday and Sunday immediately before the election at locations determined by the State Election Commissioner. This Act also charges the State Election Commissioner with determining whether such voting should occur by voting machine or paper ballot. All other procedures relating to conducting voting are the same as for general election voting. Further, this Act requires that for statewide elections there must be at least 1 in-person polling place in each county, and an additional location in the City of Wilmington. AN ACT PROPOSING AN AMENDMENT TO ARTICLE II OF THE DELAWARE CONSTITUTION RELATING TO THE LEGISLATURE AND VOTING ON THE BUDGET APPROPRIATION ACT, BOND AND CAPITAL IMPROVEMENT ACT, AND This act restores the $500 senior real property tax credit. This Act authorizes a county or municipality to treat an unpaid lien as a tax lien against the property subject to the lien and collect the lien in the same manner as other tax liens, including a proceeding under a writ of monition. This Act also makes technical corrections to conform existing law to the standards of the Delaware Legislative Drafting Manual. This Act decreases by 1% the rate of realty transfer tax to be received by the State, thereby returning to the rate that was applicable prior to August 1, This bill allows real property tax itemized deductions to continue in Delaware notwithstanding recently enacted changes to federal income tax laws. 5 HB 22 HB 21 ACT MAKING APPROPRIATIONS FOR CERTAIN GRANTS-IN-AID. AN ACT TO AMEND TITLE 14 OF TO POWERS AND DUTIES. AN ACT TO AMEND TITLE 11 OF TO CLASSIFICATION AND EMPLOYMENT. substitute bill to such bills before voting on such legislation unless the General Assembly by a three-fourths vote waives this requirement. The purpose of this provision is to allow all interested persons, including legislators, a reasonable amount of time to review the three significant financial legislative acts before voting on such legislation. This restriction can be waived if three-fourths of each of the General Assembly agrees to act in a shorter time period. This bill is a companion bill to Bill No. 21 and provides the authority for the Department of Education to prescribe the rules and regulations necessary to implement the prison education program which provides educational services to the Department of Correction. The language set forth in this statute would remove barriers for inmates who are students with disabilities and who have an Individualized Education Program (IEP) under state and federal law, when being considered for parole or a sentence modification. Requiring an inmate with an IEP to complete a GED or State of Delaware High School Diploma is counterproductive to the treatment and programming of this segment of the prison population and prohibits them from seeking the same benefits of parole or sentence modification afforded to those inmates who do not have an IEP. This amendment to the law allows an inmate the opportunity to earn a State of Delaware Diploma of Alternate Achievement Standards upon successful completion of the inmate's IEP Rep. Briggs King Rep. AN ACT TO AMEND TITLE 14 OF TO HOURS OF SCHOOL DISTRICT ELECTIONS This Act seeks to ensure that every public school in the State has a school nurse. This Act provides a mechanism to allow a district or a charter school that currently does not have a school nurse to receive State funds. This Act also permits a district to levy a tax under 1902(b), Title 14, known as a "match tax", to assist those districts that hire a school nurse as a result of this Act to pay for the local share of that school nurse. This bill gives school and local government property taxes priority collection status over other claimant agencies when the collection is made by tax intercept reducing refunds. This Act creates the following new tax brackets: at $125,000, with a rate of 7.10% and at $250,000, with a rate of 7.85 This Act creates the following new tax brackets: 1. This Act makes the technical correction to 1907 of Title 14 so that it is consistent with the sections of Title 14 that were revised by Bill No 363. Delaware's statewide community college system, operated by Delaware Technical and Community College ( the College ), plays a critical role in the State's economy by providing workforce development, vocational training and transfer education that connects Delawareans with good paying jobs within the State and region. This Act gives the College s Board of Trustees the authority to issue bonds to finance the cost of major and minor capital improvements, deferred maintenance, and the acquisition of related equipment and educational technology and establishes the Community College Infrastructure Fund ( the Fund ) to pay the principal and interest on such bonds. This Act adopts the county Vo-Tech structure to finance the Fund by authorizing the College's Board of Trustees to collect a local property tax, subject to a cap. All money raised in a county must be placed in a segregated account and spent exclusively on projects in that county, thereby eliminating any possibility of Sen. 10 This Act corrects an inadvertent error in Delaware law that has permitted people younger than 18 years of age to vote in final-stage elections. People must be 18 years of age or older to be eligible to vote in a final-stage election such as general elections, special elections, school board elections, and school district referendums. However, people younger than 18 years of age can vote in any preliminary election, such as primary elections, if they will be 18 years of age at the time of the final-stage election. 11 SB 8 SB 7 AN ACT TO AMEND TITLE 19 AND TITLE 29 OF THE DELAWARE CODE AND CHAPTER 280, VOLUME 81 OF THE LAWS OF DELAWARE RELATING TO COLLECTIVE BARGAINING FOR STATE EMPLOYEES. AN ACT TO AMEND TITLE 29 OF TO THE DELAWARE POPULATION CONSORTIUM. Center Facilities and Georgetown Readiness Center; and (7) authorize the conveyance of property between the Appoquinimink School District and the Town of Middletown. This Act makes compensation a mandatory subject of bargaining for any group of employees who have joined together for purposes of collective bargaining and certified a labor organization to serve as the group's exclusive collective bargaining representative. This Act also eliminates any deadline for reaching an agreement pertaining to compensation. Finally, this Act repeals a portion of Section 8 of Chapter 280 of Volume 81 of the Laws of Delaware, the Fiscal Year 2019 Budget Act, that pertains to the collective bargaining process repealed by Section 2 of this Act. Since 1975, the Delaware Population Consortium has prepared a unified set of statewide population projections each year. These projections are used for a variety of purposes including capital planning, policy analysis, comprehensive planning, and transportation planning. All 3 counties are required by State law to utilize these projections to prepare their required comprehensive plans. However, the Delaware Population Consortium does not exist in State law. This Act formally creates the Delaware Population Consortium, identifies its membership and work products, and requires that all counties, municipalities, school districts, and State agencies use the Consortium s projections for planning and policy purpose Sen.
