This Lease agreement allows Ms. Leiter to remain living at the property for a term of 12 months at the rate of $ per month.) Approve 2. 4 Alma, Michigan June 28, 2016 Mayor Nyman called a regular meeting of the Alma City Commission to order at 6:15 p.m. at the Alma Municipal Building. Present: Allman, Ayers, Harrington, Mapes, Mott, Nyman & Piccolo Absent: None. Mayor Nyman asked the City Commission and members of the audience to stand and recite the Pledge of Allegiance. Motion by Vice-Mayor Mapes as supported by Commissioner Allman to approve the minutes of the June 14, 2016 regular meeting. Yes: No: Allman, Ayers, Harrington, Mapes, Mott, Nyman & Piccolo None. A public hearing was held at 6:16 p.m. to consider the final Special Assessment District Roll #4 for 2014 for the construction of sanitary sewer leads on Argyle Rd. Mr. Ron Turner, Public Services Director presented a brief report to the City Commission concerning the completed project. The final costs for this construction of sanitary sewer leads on Argyle Rd. was $23, of which $11, is assessed to the City of Alma and $11, is assessed to adjoins property owners. The original costs were based on the previous year s costs for the sewer lead project. The final costs came in lower than the original estimate. The determination of each property owners share is based on the amount of linear feet needed of pipe to install the leads. Property Owners who were found to have plastic service leads were removed from the district. There being no further questions or comments, the public hearing was closed. Motion by Commissioner Allman as supported by Commissioner Piccolo to close the public hearing at 6:18 p.m. Yes: No: Allman, Ayers, Harrington, Mapes, Mott, Nyman & Piccolo. None. Now, Therefore Be It Resolved: 1. Mr. Ron Turner, Public Services Director presented a brief report to the City Commission concerning the completed project. The final costs for this construction of sidewalks on Orchard Street was $4, of which $2, is assessed to the City of Alma and $2, is assessed to adjoins property owners. The original costs were based on the previous year s costs for project. The cost for this project came in 50% lower then estimated. The cost for this project were based on the final construction costs of $10.14 per linear foot of front footage. There being no further questions or comments, the public hearing was closed. The final costs for this construction of sanitary sewer leads on Slater was $4, of which $2, is assessed to the City of Alma and $2, assessed to adjoins property owners. The original costs were based on the previous year s costs for the sewer lead project. The final costs came in lower than the original estimate. The determination of each property owners share is based on the amount of linear feet needed of pipe to install the leads. Property Owners who were found to have plastic service leads were removed from the district. There being no further questions or comments, the public hearing was closed.

The following preamble and resolution were offered by Commissioner Allman as supported by Commissioner Ayers: Whereas, the Commission has met for the purpose of reviewing the special assessment roll prepared for the purpose of defraying the private properties share of the cost of acquiring and constructing a public improvement in Special Assessment District No. 7 for 2014 of the City, and Whereas, the Commission has heard all persons interested in said special assessment roll and has carefully reviewed the same and is satisfied that said special assessment roll results in the assessments against each lot and parcel of land in the special assessment district being in accordance with the benefits to be derived. Now, Therefore Be It Resolved: 1. Said special assessment roll for the Slater Street Sewer Leads Construction Project, which is hereby designated Special Assessment District No. 7 for 2014, is hereby confirmed and ratified as prepared by the City Assessor. 2. Said Special Assessment District No. 7 for 2014 shall be divided into five equal annual installments, the first installment to be due on October 1, 2016 and the subsequent installments to be due and payable on the 1 st day of December of each and every year thereafter. The whole of said special assessment, or any part thereof, may be paid at any time after the date of confirmation until October 1, 2016, without interest or penalty. Unless paid within the aforesaid time, the deferred installments on said special assessment roll shall bear interest at the rate of 2.19% from the date of confirmation of said special assessment roll. A public hearing was held at 6:24 p.m. to consider the final Special Assessment District Roll #1 for 2015 for the construction of sanitary sewer leads on Michigan Avenue. Mr. Ron Turner, Public Services Director presented a brief report to the City Commission concerning the completed project. The final costs for this construction of sanitary sewer leads on Michigan Avenue was $8, of which $4,200 is assessed to the City of Alma and $4,200 is assessed to adjoins property owners. The original costs were based on the contractor s bid costs for sewer lead project. The cost for this project came in lower than was original estimated by 30 percent. The determination of each property owners share is based on the amount of linear feet needed of pipe to install the leads. Property Owners who were found to have plastic service leads were removed from the district. Linda Earl of 1314 Michigan asked what her costs will be. Mr. Turner informed her that the cost would be $ Ms. Earl said that she couldn t afford that. Mr. Turner explained that the cost could be paid all at once or spread out over 5 years. She understood how the payment plan worked and had no further comments. There being no further questions or comments, the public hearing was closed. Motion by Vice-Mayor Mapes as supported by Commissioner Allman to close the public hearing at 6:26 p.m. Yes: No: Allman, Ayers, Harrington, Mapes, Mott, Nyman & Piccolo. None.

8 The following preamble and resolution were offered by Vice-Mayor Mapes as supported by Commissioner Harrington: Whereas, the Commission has met for the purpose of reviewing the special assessment roll prepared for the purpose of defraying the private properties share of the cost of acquiring and constructing a public improvement in Special Assessment District No. 1 for 2015 of the City, and Whereas, the Commission has heard all persons interested in said special assessment roll and has carefully reviewed the same and is satisfied that said special assessment roll results in the assessments against each lot and parcel of land in the special assessment district being in accordance with the benefits to be derived. Now, Therefore Be It Resolved: 1. Said special assessment roll for the Michigan Avenue Sewer Leads Construction Project, which is hereby designated Special Assessment District No. 1 for 2015, is hereby confirmed and ratified as prepared by the City Assessor. 2. Said Special Assessment District No. 1 for 2015 shall be divided into five equal annual installments, the first installment to be due on October 1, 2016 and the subsequent installments to be due and payable on the 1 st day of December of each and every year thereafter. The whole of said special assessment, or any part thereof, may be paid at any time after the date of confirmation until October 1, 2016, without interest or penalty. Unless paid within the aforesaid time, the deferred installments on said special assessment roll shall bear interest at the rate of 2.19% from the date of confirmation of said special assessment roll. A public hearing was held at 6:26 p.m. to consider the final Special Assessment District Roll #2 for 2015 for the construction of sanitary sewer leads on W. Superior Street. Mr. Ron Turner, Public Services Director presented a brief report to the City Commission concerning the completed project. The final costs for this construction of sanitary sewer leads on W. Superior Street was $29, of which $14,700 is assessed to the City of Alma and $14,700 is assessed to adjoins property owners. The original costs were based on the contractor s bid costs for sewer lead project. The cost for this project came in lower than was original estimated by 20 percent. The determination of each property owners share is based on the amount of linear feet needed of pipe to install the leads. Property Owners who were found to have plastic service leads were removed from the district. Two property owners, John Lang and Mark Bartholomew at 904 and 1002 W. Superior respectively asked why they were on the Roll when they knew they had plastic service leads. Mr. Turner explained that the properties were placed on the Roll per the project engineers notes on the project. He would have to check with the project engineer. Commissioner Allman asked that this item from tonight s agenda be tabled and brought back to the Commission when the corrections have been made to the Roll. There being no further questions or comments, the public hearing was closed. Motion by Commissioner Allman as supported by Vice-Mayor Mapes to close the public hearing at 6:36 p.m. Yes: No: Allman, Ayers, Harrington, Mapes, Mott, Nyman & Piccolo. None. 9 A public hearing was held at 6:36 p.m. to consider a resolution approving a Commercial Facilities Exemption Certificate Application for Norman & Susan Woerle Revocable Trust, located at 321 E Superior St., Alma, MI. Aeric Ripley, Assistant City Manager/Downtown Development Director addressed the Commission stating that a Commercial Facilities Exemption District was established on May 10, 2016 for the only remaining building left after the fire on March 2, Issuing a Commercial Facilities Exemption Certificate would be the next step. Notification was sent to all affected property owners within 300 feet. No comments either for or against were received. The Commercial Facilities Exemption Certificate will be for a term of twelve years which allows for a tax reduction to help property owners off set the costs of the repairs to the property. If approved by Commission, the Woerles will be asking the State of Michigan for relief also on the State School Millage. City Manager, Phillip Moore added that the staff of the City of Alma is in full support of granting this Commercial Facilities Exemption Certificate. Mr. Norman Woerle then addressed the Commission he wanted to thank the City for all the help they have given to this project. He reported that there was extensive smoke and water damage. The west wall was a shared wall with the adjacent building and had to be torn down. The process of obtaining an insurance adjustment took two months. The west wall is now replaced. A new roof, heating and cooling, bathrooms and repainting are in the process now. The plans call for the creation of a brand new building, a great entrance to the downtown district. Vice-Mayor Mapes and the rest of the Commissioners wanted to express their appreciation on how the property is moving ahead. Mr. Woerle feels that this project is a good investment on their part in the development of the Downtown. With no further comment, Mayor Nyman entertained a motion to close the public hearing. Motion by Commissioner Allman as supported by Commissioner Piccolo to close the public hearing at 6:42 p.m. Yes: No: Allman, Ayers, Harrington, Mapes, Mott, Nyman & Piccolo None. The following preamble and resolution were offered by Commissioner Mott, and supported by Commissioner Harrington. Resolution Approving Commercial Facilities Exemption Certificate Application for Norman & Susan Woerle Revocable Trust, located at 321 E Superior St., Alma, MI. WHEREAS, the Alma City Commission legally established the Commercial Redevelopment District: 321 E Superior Commercial Redevelopment District No. 3 on Tuesday, May 10, 2016, after a public hearing held on May 10, 2016; and WHEREAS, the state equalized value of the property proposed to be exempt plus the aggregate state equalized value of property previously exempt and currently in force under Public Act 255 of 1978 and under Public Act 198 of 1974 (IFT's) does not exceed 5% of the total state equalized value of the City of Alma; and WHEREAS, the application was approved at a public hearing as provided by section 6(2) of Public Act 255 of 1978 on June 28, 2016; and

10 WHEREAS, the Norman & Susan Woerle Revocable Trust is not delinquent in any taxes related to the facility; and WHEREAS, the application is for commercial property as defined in section 3(3) of Public Act 255 of 1978; and WHEREAS, the applicant Norman & Susan Woerle Revocable Trust has provided answers to all required questions under Section 6(1) of PA 255 of 1978 to the City of Alma; and WHEREAS, the City of Alma requires that the construction, restoration or replacement of the facility shall be completed by September 2016; and WHEREAS, the commencement of the construction, restoration or replacement of the facility did not occur more than 45 days prior to the filing of the application for exemption; and WHEREAS, the commencement of the construction, restoration or replacement of the facility did not occur prior to the establishment of the Commercial Redevelopment District; and WHEREAS, the application relates to a construction, restoration or replacement program which, when completed, constitutes a new, replacement or restored facility within the meaning of Public Act 255 of 1978 and that is situated within a Commercial Redevelopment District established under Public Act 255 of 1978; and WHEREAS, completion of the facility is calculated to, and will at the time of issuance of the certificate, have the reasonable likelihood to increase commercial activity, create employment, retain employment or prevent a loss of employment, and the loss of tax base in the downtown where the facility is situated; and WHEREAS, the restoration includes improvements aggregating 10% or more of the true cash value of the property at commencement of the restoration as provided by section 4(6) of Public Act 255 of NOW, THEREFORE, BE IT RESOLVED by the Alma City Commission of the City of Alma: Norman & Susan Woerle Revocable Trust located at 321 E Superior St., Alma, MI. Be and hereby is granted a Commercial Facilities Exemption for the real property, excluding land, located in Commercial Redevelopment District; 321 E Superior Commercial Redevelopment District No. 3, located at 321 E Superior Street for a period of Twelve years, beginning December 31, 2016, and ending December 30, 2028, pursuant to the provisions of PA 255 of 1978, as amended. Yes: No: Allman, Ayers, Harrington, Mapes, Mott, Nyman & Piccolo. None. Resolution Declared Adopted. A public hearing was held at 6:42 p.m. to consider FY 2015 year-end budget adjustments resolution. City Manager, Phillip Moore explained the proposed adjustments. There being no further questions or any comments, a motion to close the public hearing was entertained. 11 The following preamble and resolution was offered by Commissioner Harrington as supported by Commissioner Allman: Whereas, the City Manager prepared and submitted his recommendation for the Fiscal annual budget and capital improvement plan to the Alma City Commission on April 14, 2015; and Whereas, the Alma City Commission reviewed the recommended budget and capital improvement plan in detail during numerous work sessions; and Whereas, the Alma City Commission did give notice of a public Hearing held May 12, 2015 at 6:00 p.m. at the Alma Municipal Building. In conformity with the provisions of Section 6.3 Article VI of the City Charter, proof of publication is now on file, and which Public Hearing was duly held pursuant to said notice and in conformity therewith. Mayor Nyman opened the floor to public comments. Doug Yarnell of 805 N. River addressed the Commission on the disgraceful and embarrassing conditions of the City's park bathrooms. He held a birthday party at Wright Park and was very upset to have his family use the bathroom. He would like to see the City spend money on restoring the bathrooms rather than spend money on building walk bridges. Aeric Ripley explained that the money that was used to build the walk bridge was earmarked from the Kahn Grant from the State of Michigan. Mr. Ripley also stated that renovations or new construction of bathrooms in the parks is one of the highest priorities of the Parks and Recreation Committee. Chuck Sandro of the Healthy Pine River Committee thanked the Commission for their consideration of a donation for the Healthy Pine River Group s proposed Sedimentation Study. When the study is done, it will provide needed information on the health of the Pine River. Lori Wilson of 1575 Wright asked the Commission if any decision had been made on allowing chickens in the City limits.

Butcher to purchase and remove the 40 x 60 pole barn located at 465 W Hoffman Road. The City of Alma has agreed to permitting Mr. Mark Butcher to purchase the pole barn for $500. Agreement Details: Mr. Butcher agrees to remove the pole barn by December 31, 2016 at his cost. Provide the City of Alma insurance and make the City of Alma co-insured during the removal of the pole bar. Mr. Butcher agrees to restore the surface, so the area can be maintained, such as mowing. Mr. Butcher may begin work once this letter of agreement has been signed, the $500 payment, and insurance is provided to the City of Alma. Mr. Butcher may request additional time to remove the structure. To request the extra time Mr. Butcher must make the request one month prior to December 31, 2016 termination date of this letter of agreement.
