Approve 2. Consideration of the introduction of Ordinance #809 to amend the Zoning Map of the City of Alma as it appears in Section of the Ordinances of the City of Alma. This Ordinance is to rezone the property at 313 N. State Street, from B-1, Central Business District to BMR, Business Multi-Family Zoning District subject to the conditions set forth in the Conditional Rezoning Agreement. Approve 3. Consideration of the introduction of Ordinance #810 to amend the Zoning Map of the City of Alma as it appears in Section of the Ordinances of the City of Alma. This Ordinance is to rezone the property at 524 N. State Street, from R-1, Single Family Residential to R-3, Multi-Family Zoning District, subject to the conditions set forth in the Conditional Rezoning Agreement. Approve I. Agreements: 1. Consideration of adopting a resolution to approve the Agreement Regarding Athletic Facility Use of the Euclid Street Baseball Fields between the City of Alma and the Alma Little League commencing on March 1, 2019 and ending on August 1, Approve 2. Consideration of adopting a resolution to approve the Lease Agreement between the City of Alma and GYM 247 Fitness, LLC for the rental space in the State Street Plaza, 217 N State St. for a term of three years. Work Session began at 5:30 p.m. Alma, Michigan February 26, 2019 City Manager Schooley presented the February 22, 2019 Newsletter for discussion: Informational Tour of Water and Wastewater Plants Thanks so much to all of you for attending the tour last week. It was very meaningful to the water and wastewater plants to have you visit. I hope you have a better understanding of how much goes into making these plants operate. Nice to see our employees are making efforts to become better at what they do on a daily basis. GAWA: City of St. Louis Finance Responsibility At the February 15 th Gratiot Area Water Authority meeting the board signed a resolution assigning the duties of accounting and finance to the City of St. Louis. I have attached the Amendment to the Water Service Agreement that will be brought before you at the first March meeting. Airport Authority The Gratiot Community Airport Authority met on Thursday February 21 st. The major agenda item was the request from both Pine River and Arcada Township to be released from the authority. The agreement that established the authority allows for an entity to be released from the agreement upon a resolution of their own board and a 2/3 vote of the authority board. Current members of the authority board are Alma, St. Louis, Ithaca, Gratiot County, Pine River Township, and Arcada Township. After a lengthy discussion, the agenda item was tabled, and a committee was formed by the board to look into some possible funding alternatives for the airport. I will chair the committee that consists of Ithaca City Manager Chris Yonker, St. Louis City Manager Kurt Giles, Gratiot County Commissioner Tim Lambrecht and Greater Gratiot Development Director Jim Wheeler. The next full authority board meeting was set for March 21 st. Joint Session of Alma School Board and Alma City Commission Just a reminder that we have set a joint meeting of both the Alma Public Schools Board of Education and the Alma City Commission for March 19 th at 5:30 pm at Alma High School to discuss the development of the old Alma Middle School site on Downie Street. Leadership Conference The City, Alma College, Greater Gratiot Development, Alma Public Schools, Mid-Michigan Medical Center, and Masonic Pathways have been working on the development of a Community Leadership Day hosted by Alma College where invited community leaders in our community get together to begin a conversation on the future of Alma. We are shooting for a date in early June to hold the conference. That should be finalized in the next week or so. I meet with the leaders of these organizations monthly to discuss city issues and the community in general. I am impressed with their enthusiasm and commitment to making Alma an even better place to live. As stated in the 2019 Goal Setting session, community visioning is a priority for the upcoming year. My hope is that this leadership day will be the springboard to an enthusiastic beginning of that process. More information to come in the upcoming weeks. An additional item is being added to the Newsletter. Aeric has been speaking to an interested party that would like to lease the open space in the State Street Plaza. The rent would be $1200 per month with the lessee

5 paying all utilities. Once the party has agreed to the terms, we will bring the lease agreement to the Commission to approve. FY2018 Audit: Ali Barnes, Yeo and Yeo The FY2018 independent Auditor s Report and Matters for Management s Consideration will be presented by Ali Barnes of Yeo and Yeo CPAs and Business Consultants during the commission work session prior to the meeting this Tuesday at 5:30 pm. Ms. Barnes presented an Unmodified Financial Statement Opinion on the General, Wastewater, Water and Internal Service funds. All are positive and healthy. There are weaknesses in having to perform audit adjustments, prior period adjustments and in written procedures. There were difficulties encountered in performing the audit, which resulted in the audit process taking longer than it should. Adjustments to material misstatements needed to be corrected. The BS&A software conversion was scheduled at the same time as the audit, which took Finance personnel time away from the audit concerns. A number of items have been listed for Management Consideration. There is a systemic problem with the Finance department in correcting Material Weaknesses of Audit adjustments, prior period adjustments and written procedures. Manager Schooley stated that we need to move forward, these problems have existed for a while. The prior years are done. We have to get better with our jobs. It is important to use the Audit as a tool to correct our weaknesses. Commissioner Mott asked where do we get help? Manager Schooley suggested we bring in someone to look at the Finance department and personnel. Commissioner Pitts stated that moving forward things have to be corrected. We need reports to make the Commission accountable. Mayor Mapes agreed. The February 26, 2019, City Commission work session concluded at 6:14 p.m. Alma, Michigan February 26, 2019 Mayor Mapes called a regular meeting of the Alma City Commission to order at 6:15 p.m. at the Alma Municipal Building. Present: Allman, Harrington, Mapes, Nyman, Piccolo & Pitts. Absent: Stahl. Mayor Mapes asked the City Commission and members of the audience to stand and recite the Pledge of Allegiance to the Flag. Motion by Commissioner Piccolo as supported by Commissioner Allman to approve the minutes of the February 12, 2019 regular meeting. Yes: No: Allman, Harrington, Mapes, Nyman, Piccolo & Pitts. None. Motion by Vice-Mayor Harrington as supported by Commissioner Mott to set a public hearing for Tuesday, March 26 at 6:00 p.m. to review and consider submission of a Michigan Department of Natural Resources, Michigan Natural Resources Trust Grant application for the replacement and rehab of park restrooms located in Wright, Riverside, and Pine River/Conservation Park. Yes: No: Allman, Harrington, Mapes, Mott, Piccolo & Pitts. None.

6 Motion by Commissioner Allman as supported by Commissioner Piccolo to approve a resolution adopting five year software support and maintenance agreement with Frontier Communications of America, Inc. for a total cost of $25, Yes: No: Allman, Harrington, Mapes, Mott, Piccolo & Pitts. None. Motion by Commissioner Allman as supported by Commissioner Piccolo to receive the Code Enforcement January 2019 Report. Yes: No: Allman, Harrington, Mapes, Mott, Piccolo & Pitts. None. Motion by Commissioner Piccolo as supported by Commissioner Allman to add the Finance Committee report to the Agenda. Yes: No: Allman, Harrington, Mapes, Mott, Piccolo & Pitts. None. Vice-Mayor Harrington gave the Finance Committee report that at the last City Commission meeting the Commission appointed a Sub-Committee to review the policies and processes of the Finance Department. Matt, Nick, Greg and I have met twice to review the current financial operations in light of the recent audit. We will continue working to address the audit findings with the goal of strengthening our internal systems to then move toward a more robust analytical projection framework. Motion by Commissioner Mott as supported by Commissioner Allman as to receive the Finance Committee report. Yes: No: Allman, Harrington, Mapes, Mott, Piccolo & Pitts. None. Motion by Commissioner Allman as supported by Commissioner Piccolo to appoint Heather Therrien to the Alma Planning Commission to fulfill the unexpired term of Ryan Pellerito ending May 1, Yes: No: Allman, Harrington, Mapes, Mott, Piccolo & Pitts. None. Received a presentation from Aeric Ripley, Assistant City Manager/DDA Director on the Michigan Department of Natural Resources, Michigan Natural Resources Trust Grant application for the replacement and rehab of park restrooms located in Wright, Riverside, and Pine River/Conservation Park. Mr. Ripley with the support of the Parks and Recreation Committee to again apply for this trust grant for the Park Restrooms. This application will be the same as last year s application for the three Park restrooms. At the last Parks and Rec meeting it was discussed how to increase the point total awarded to an application. Priority #1 is the Wright Park Bathroom. The Committee recommends replacement of the whole structure with a new facility, to provide 4 universal designed, single occupancy restrooms. The plan is to model after the new restroom on Charles Avenue. The estimated cost would be $200,000. An additional project is to update the electrical to the pavilions and do needed sewer work. Priority #2 is the rehab of Pine River/Conservation Park bathroom. This structure also houses a wastewater lift station. Wastewater Funds will be used to do repairs on the

7 roof and brick in the amount of $40,500. Another $50,000 est. will be used to rehab the bathroom into 5 universal designed single occupancy restrooms. Priority #3 is to rehab Riverside Park bathroom into 2 universal designed single occupancy restrooms and to paint the roof and exterior at a cost of $45,000. Last year we were very close in the point score in obtaining the grant, in this application we hope to score additional points in Renovation 20 more points (document when the building were built) Use Environmentally friendly features 20 more points (add $6000 to the overall budget for plantings, and lighting) Provide a marketing plan for the Universal Designed Restrooms 20 more points. Increase the City s match from 35% to 40% - 10 more points. We have been encouraged to reapply for the grant. The goal is to be in the top 30 Communities applying for the grant. The total cost for the three bathroom facilities will be $301,000 adding the engineering cost of an additional $45,150 will bring the total to $346,150. Requesting 60% from MDNR in the amount of $207,690. The remaining 40% will need to come from the General fund grants, etc. in the amount of $138,460. A Public Hearing is scheduled for March 26, 2019 and the application is due April 1, Mr. Ripley also noted that the cost for outfitting the parks with portable restrooms would cost the City, for the useful life of a restroom structure 40 years, $102,000. per park. The Spring of 2020 is the estimated time line for completion of this rehab and reconstruction of Park bathrooms. Commissioner Mott asked if applying only for Wright Park would make a difference? Aeric responded that it would not. Commissioner Mott asked if there was a way to spruce up Wright Park in the interim of getting the grant. It was agreed that this could be attempted. Motion by Commissioner Piccolo as supported by Commissioner Allman to approve Warrant No and to authorize the City Treasurer to issue checks in payment of all claims. Yes: No: Allman, Harrington, Mapes, Mott, Piccolo & Pitts. None. Mayor Mapes asked for Commissioner comments. Vice-Mayor Harrington stated that after this meeting she will be attending the Alma High School Band concert. Commissioner Allman congratulated the AHS band on obtaining new uniforms. He also enjoyed the Water and Wastewater plant tours. They were very enlightening. Commissioner Pitts wanted to congratulate the Alma High School athletes that made it to the State Finals. She will be working on creating a Panther Day for all Alma Students to acknowledge them. City Attorney Costanzo congratulated the Alma Wrestlers for being Regional champs. Mayor Mapes announced that the Play is still on at the Strand Theatre and he congratulated the school students and Ms. Therrien on her appointment to the Planning Commission. Several people applied for the appointment. Mayor Mapes opened the floor for Public Comments. Laurie Wilson, 517 Michigan, St Louis wanted to than the St Louis Firefighters for showing their appreciation to a Firefighter who retired after 42 years of service.

8 Chuck Murphy, County Commissioner thanked the Commission for having the tours of the Water and Wastewater plants. He also informed the Commission that Seville Township is experiencing sewer problems. He was hoping that this Commission could look into the matter. Mayor Mapes answered that Seville Township would need to ask us officially to consider the situation. Being no further Public comment, Mayor Mapes asked for a motion to adjourn. 15 I-2 LEASE AGREEMENT THIS LEASE AGREEMENT made and entered into this 13 th day of March, 2019, by and between the City of Alma, a municipal corporation of Gratiot County, Michigan, hereinafter referred to as Lessor, and GYM 247 FITNESS LLC hereinafter referred to as Lessee, WITNESSETH: Lessor does hereby let and lease to Lessee that part of the premises (6,500 square feet) known as State Street Plaza (MESC) 217 N State Street, Alma, Michigan, for the term and under the conditions hereinafter set forth. 1. TERM: The term of this lease shall commence on the 13 th day of March 2019 and shall continue for a term of three years ending on the March 13, RENTAL: Lessee shall pay to Lessor, as rental for said premises, the sum of $1, per month commencing March 13, Payment of rent as follows: Shall be full payment commencing on the 1 st day of each month and total $14,400 per year. 3. Not later than 30 days before the end of each calendar year the Lessor will notify Lessee in writing whether it will continue with the lease, with the terms outlined. Lessee shall respond, in writing, within ten (10) days of the date of such notice indicating both parties are in agreement with continuing the lease set forth above. Should Lessee elect not to notify, or fail to respond, the term shall terminate. 4. OCCUPANCY: Lessee will be entitled to occupy the State Street Plaza designated space consisting of 6,500 square feet. 5. UTILITIES, ETC: Lessee shall be responsible for and pay as due, all utility bills, including, but not limited to, heat, water, electricity, etc. The Lessor shall provide an invoice to the Lessee for gas, electricity, and water monthly. Lessee is responsible for trash removal. 6. TAXES & INSURANCE: Lessee shall be responsible for the payment of real estate taxes assessments on said premises. Lessee shall be responsible for all Personal Property Taxes. Lessee shall maintain a policy of public liability insurance with Lessor as a named insured with combined single limits of not less than $500, Lessee shall be solely responsible for insuring its contents located within the building. Lessor will insure the premises against loss by fire or other hazard. 7. WAVIVER OF SUBROGATION: The Lessor and the Lessee and all parties claiming under them hereby mutually release and discharge each other from all claims and liabilities arising from or caused by any hazard or peril covered by insurance on the premises or covered by insurance in connection with the premises on or activities conducted on the premises, regardless of the cause of the damage or loss. In addition, the Lessee, if it obtains insurance policies as required pursuant to this lease, shall obtain clauses in their insurance policies whereby the insurance carriers waive all rights of subrogation against Lessor. 8. INDEMNIFICATION AND LIABILITY INSURANCE: Lessor and Lessee hereby agree to defend and hold harmless each other, save for their own negligence, from and against any and all loss, cost, damage or expense, including attorney s fees, of any nature whatsoever arising out of or

16 I-2 connected with the use or occupancy in or on the demised premises, or arising or alleged to have arisen out of the acts or omissions of each party s officers, agents, employees, and contractors. Lessee shall maintain its own liability insurance policy with respect to the premises, which are the subject of this lease. Lessor assumes no responsibility to insure against the loss, through fire or other hazard, of the contents of the premises belonging to Lessee. 9. USE OF PREMISES: Lessee covenants and agrees that said premises will be used and occupied by GYM 247 FITNESS LLC and that said premises shall be used and occupied only by GYM 247 FITNESS LLC and for no other purpose without the written consent of Lessor; and the Lessee will comply with all laws, ordinances and lawful order and regulations affecting the premises and the use thereof. 10. MAINTENANCE AND REPAIR: Lessee agrees, at its own cost and expense during the term hereof, to keep the interior of the building upon the demised premises in good repair and in a good and safe condition, and to deliver up the premises at the expiration of the term of this lease in as good a state of repair as when taken, reasonable use and wear thereof and damage by the elements excepted. Replacement of light bulbs in as light fixtures shall be the responsibility of the Lessee further agrees, at its own expense, to replace all plate glass or other glass of said building which may be destroyed or broken. Lessee will also be responsible for snow removal of the portion of the sidewalk abutting the premises. In the event Lessee fails to make any of the repairs, which they are obligated to make with reasonable dispatch, Lessor, shall be entitled to enter the premises and make the same. Alternatively, cause them to be made, and the amount or amounts expended by and for said repairs shall be due and payable by Lessee onto Lessor as additional rent hereunder. Lessor agrees to keep and maintain the outer walls and roof of the building in good repair and to provide repairs to the basic plumbing, electrical and heating systems during the term hereof. 11. ALTERATIONS: Except as set forth in this paragraph, no alterations and improvements to the interior of the premises, provided that all such alterations or improvements shall comply with all Lessor s applicable building codes and ordinances and further provide that all such alterations and improvements shall be approved in advance by Lessor s staff. Lessee may install a shower facility, at Lessee s expense, subject to Lessor s prior approval as to plans and materials. Any alterations or improvements shall remain to property of the Lessor upon termination or expiration of Lessee s tenancy. 12. SIGNS: Subject to prior written approval of Lessor as to size, type and location upon the building, the lessee may install and maintain such exterior signs as it may desire, provided, however, that no sign shall be installed which shall be prohibited by any applicable stature, ordinance or regulation. 13. RIGHT TO EXAMINE PREMISES: Lessee agrees to allow Lessor free access to the premises during reasonable hours for the purpose of examining same. 14. RIGHT OF INGRESS AND EGRESS: Lessee and its customers shall have the right to the use of and for ingress and egress across the hard surface parking lot adjacent to the premises from State Street or Prospect Avenue and Lessor shall be responsible for the maintenance, repairs and snow removal of the adjacent parking lot.

17 I PEACEFUL POSSESSION: Lessor agrees that Lessee, on paying the previously mentioned installments and performing all of the covenants aforesaid, shall and may, peacefully and quietly have, hold and enjoy the demised premises for the term aforementioned. 16. ASSIGNMENT: Lessee covenants that it will not assign nor transfer this lease or sublet said premises or any part thereof, without the written consent of Lessor. Lessor shall not unreasonably withhold consent. 17. HOLDING OVER: If Lessee should remain in possession after expiration of the term hereof, it shall be deemed to be a tenant from month to month. 18. BINDING EFFECT: This Agreement shall bind and benefit the parties hereto and their respective successors and assigns. 19. ENTIRE AGREEMENT: This agreement constitutes the entire agreement of the parties, superseding all other agreements and representations, whether written or oral. This Agreement may not be modified or amended except by written agreement of the parties. This location is further described by parcel numbers & The zoning for this parcel is B-2, General Business. B-2 zoning districts allow outdoor sales with the issuance of a special use permit. Staff provided comments to the site plan, the developer Anthony Cocca of Cocca Development discussed the project, and the future opportunities in the remainder of the building. A request was received from the owners of property at 601 Woodworth Ave ( ) and 119 Hastings St ( ) to conditionally rezone these two parcels of land from the current R-1, Single Family Residential, and to conditionally allow the home and empty lot to be used for office professional, as defined by the OS, Office Services zoning district, with the conditions outlined within the conditional rezoning agreement. This is the second submission for this request. The first one was submitted by the buyer and is required to be submitted by the owner. Ripley held a neighborhood meeting to discuss the rezoning. Ms. McPherson offered part of the vacant lot to be sold to either the Turks or Adams for $1.83/sq. ft. This offer must be accepted prior to the closing of Ms. McPherson s purchase. 601 Woodworth and 119 Hastings would need to be combined. Public Comments: Deb McLaughlin stated that she would like to wait for the possibility of another Church to buy the building. Jeff Turk stated he purchased his home knowing there was a vacant residential lot behind him, and a Church next door. He stated that there are so many vacant buildings available downtown that could be used for this type of business. He doesn t feel the parking lot and commercial business fits into this neighborhood. He feels the vacant lot would be well suited for a modular home. He is worried about the sale of his property and commercial encompassing his home. He is also concerned with drainage. Terry Klein stated his intent was to build a home on the vacant parcel and that is why he has never listed it for sale in the past. He stated that the realtor set the price and he felt it was the current market value. Tim Keeton stated that the buyer initiated this parking plan and feels the buyer wants to work with everyone. He feels the community needs to be ready for change. Must deal with realities and be proactive. Matt Schooley stated that we are at a cross roads in this community. He remembers a grocery store in that neighborhood. He feels it is unrealistic to think we can wait for another church, etc. Deborah Wright, Scientist Church, stated she loved Ms. McPherson s ideas. The Church has been for sale for two-years. Their funds are low. She feels the buyer is being very kind to the neighbors. Dottie Wassenaar stated she feels the former Church would make good apartments. She remembers a library being in a house on her street, then it changed back to a house. Mary Ann McPherson stated that she would be proud to operate her business there. She feels that Mr. Turk is failing to see what could happen to that property. None Public Hearing Conditional Rezoning of 534 N State Street The Public Hearing was opened at 5:35 pm. Presentation by Ripley detailing a request to conditionally rezone 534 N State Street from R1 Single Family Residential to R3 Multifamily (parcel # ) by the parcel s owners, 1 st Baptist Church. The purpose of the conditional rezoning is to provide for the development of seven residential units on the site while preserving the historic character of the building s exterior. Conditions proposed for the development and operation of the property include: All apartment units will be a minimum of 700 square feet, consistent with the restriction of downtown apartment units. Limit parking spaces to the areas adjacent to the adjoining alley. Conceal and secure any exterior trash receptacles within a designated fenced or walled off area adjacent to the alley. Restrict ground signage to five feet in height.

46 J-3 Alma Planning Commission March 4, 2019 Page #2 Limit exterior lights to the greatest extent possible while maintaining safety for all neighborhood residents. Motion detecting lights will be used whenever possible to keep lights to a minimum, meeting the City of Alma illumination regulations. Place an opaque fence not less than four feet in height between the yard/play area and the southern and eastern property lines. Ripley explained that the goal of the proposed conditions was to provide for a quality housing development while maintaining the historic character of the structure and the neighborhood in which it resides. Should the commission approve the request, the Owner shall apply for and receive all required permits for building, plumbing, electrical and HVAC before beginning work. Site plan approval must be obtained before construction verifying the parking and trash area. Parking area drainage must be reviewed and approved by the Public Services Department. The conditional zoning ordinance provision requires that the project must be commenced within 18 months of the effective date of publication of the conditional rezoning action and must proceed diligently to completion. This deadline may be extended by the City Commission. A presentation was then given by Maloney on the development of the project. Maloney proposed the removal of the existing exterior ramp on the west side of the exterior. Current plans may include the installation of an elevator to the upper units. The design goal of the project is to preserve and respect the historical quality of the building exterior including maintenance work to fix existing masonry issues. In lieu of a small dumpster, 3-5 rollaway waste carts is proposed, screened in a designated area adjacent to the alley behind an opaque 4-foot fence. A concrete walk will be installed extending from the alley to the rear entrance of the building. Public Comments: The first question was if the conditional rezoning process would allow for the Michigan Prison Reform organization to utilize the proposed units as Rooming Houses? Maloney responded that this process would not prevent or encourage this type of housing arrangement. A housing owner may not discriminate potential residents under Michigan Housing Law. Mayor Mapes inquired after the general concerns voiced at the neighborhood pre-meeting regarding this project? Ripley replied that the main concerns of the pre-meeting involved lighting, trash and security concerns. Ayers inquired as to if the proposed motion lighting would present a nuisance to the neighborhood? Ripley replied that lighting levels would be kept low adhering to the 1-candlefoot at property line ordinance provision. Mapes inquired if the proposed parking configuration would set a precedence in future developments involving parking off city alleys. Ripley replied that conditional zoning requests do not set precedence for future requests as they look at the merits of each proposed development independently. Wheeler inquired if the proposed number of parking spaces (7) conforms with our existing parking requirements for multi-family units? Ripley replied that the existing parking requirement for multi-family units is two spaces per unit, but the developer is conditionally requesting one

47 J-3 space per unit in this case citing that overflow parking is available in a nearby city parking lot by permit. Kulling inquired what is the ideal completion date of the project? Ripley and Maloney replied that the approval process will take 2-3 months with construction taking another 4-6 months giving an overall completion time of 6-9 months. A motion was offered by Mapes, and supported by Kulling, to close the Public Hearing at 5:50 pm. A motion was offered by Mapes, and supported by Wheeler, to approve and recommend the conditional rezoning of 524 N State Street as proposed with presented conditions to City Commission. Avalon & Tahoe Manufacturing is planning to construct a new dealer meeting room and a production expansion for a total of 17,100 square feet of additional space for the facility at its existing location at 903 Michigan Avenue (parcel # ) The property is zoned LI, Limited Industrial. The proposed additions are permitted in the LI district and requires a site plan approval by the planning commission. The additions consist of the construction of a 7,500 square foot dealer meeting room and a 9,600 square foot addition to the existing production facility. The owners will request a variance for the front setback of the dealer room of 13 feet before the Zoning Board of Appeals. This meeting is scheduled for March 25 th. This matches the existing front setback of the office area. The proposed side lot setback to the east is 90 feet and meets current setback requirements in the LI District. The expansion of the production facility proposes a front setback of 100 feet and rear setback of 380 feet which are also within the requirements of the LI District. The proposed lot coverage of all buildings on the property are proposed to increase to a total of 731, 808 square feet bring the new lot coverage value to 34% coverage which is within the allowed coverage of 40% in the LI District. Ripley added that developers would need to submit a review of stormwater drainage, parking details pertaining to egress flow at the east driveway near Michigan and Bridge Ave., staff is providing the zoning review of each addition this evening. Nevychel commented that the proposed projected size of the production area expansion has increased from 9,600 square feet to 12,800 square feet. This change meets proposed setback requirements and increases lot coverage to 258,306 square feet and changing the percent of lot coverage to 35% meeting the allowance of 40% for the district.

Yes: No: Schooley, Mapes, Kulling, Therrien, Wheeler, Pitts, and Richter. None Site Plan Review 701 Lincoln (Gratiot County Fair for Youth) Presentation given by Ripley. The Gratiot County Fair for Youth is proposing the demolition and reconstruction of an existing horse barn located on its property at 701 Lincoln (parcel # ). The Fair Board wishes to replace the existing barn with a new 7,168 square foot structure. The proposed front setback is 216 feet from Lincoln road. The proposed side setbacks are 233 feet to Hillcrest Street and 1000 feet to the southern property line. The proposed rear setback is 350 from the rear lot line to the east. All setbacks meet the zoning requirements of the district. Proposed lot coverage increases to a coverage of 8% which is well below the allowable 30% within the district. The Special Use Permit required for this development within the R1 district conforms to the existing Special Use Permit granted to the existing structure and property. The developer is required to provide a 10-foot fire separation between the proposed building and existing structures. The developer must obtain proper zoning, building and electrical permits as required. Efaw commented that the updated structure is very much needed by the Fair for Youth and that construction would begin as soon as weather allows, and the proper permits obtained. The project is expected to complete prior to this year s Fair for Youth. A motion was offered by Wheeler, and supported by Kulling, to approve the site plan review as presented. During staff s review of a zoning verification for a Secure Transport Medical Marihuana facility in the Alma North Industrial Park (off Michigan Avenue), the 300-foot buffer requirement from R1, Single Family Residential forced a denial of the request. The City s property northwest of the industrial park, across the river, is less than 300 feet from the proposed building and is zoned R1. There are also two parcels to the southwest with two

Staff would like to discuss the long-term outlook for the City s parcel and the zoning parcels to the southwest. The current zoning buffer prevents the development of seven parcels for marihuana facilities in the North Industrial Park. It was noted that it was the intent of the marihuana facilities ordinance to permit the development of marihuana facilities within the city s industrial parks. Staff questions if R1 is the best long-term zoning designation for the land located north of the river adjacent to the park.? Should industrial parcels be dual zoned as Limited Industrial and Single Family Residential? Staff feels that residential developments on the back half of a Limited Industrial zoned parcel is unlikely. Staff asked what the commission feels would be the best use of the city s property located north of the river? Mapes indicated that the existing development of a bus garage and transportation center adjacent to this land makes it an unlikely candidate for Single Family Residential developments. Ripley noted that the adjacent land north of the river lies in the flood plain and is not buildable land. Wheeler suggested this land not be designated with R1 zoning as the mixing of residential housing and industrial uses causes future development issues, making the current land not compatible as it is currently designated. Reed commented that should the zoning change to allow for marihuana facilities in the North Industrial Park, there would be a potential for a grow facility to share the building in question with the transport facility creating positive synergy between their businesses. Mapes commented that this collaboration would make sense as the industrial park is where marihuana businesses are intended to operate. Woodruff suggested that the zoning ordinance could be amended to ignore the zoning designation of all land deemed not buildable due to existing within the flood plain with regards to the 300-foot buffer. Ripley agreed to speak with the city attorney and reach out to adjacent property owners to explore the desire to rezone parcels surrounding the North Industrial Park.
