New Business (Discussion and possible action) The DCCC is unable to discuss or take action on items not on this agenda when those discussions pertain to matters within the jurisdiction of the San Francisco Board of Supervisors. Introduction of the 2017 San Francisco Democratic Party Summer Interns and Fellows (Mehis) Executive Director Mehis introduced summer interns and spoke of their work for the summer - voter registration, visibility and outreach, attending democratic club meetings; thanked Members Gupta and F. Hsieh for serving on internship committee; thanked Bahlam for keeping time during public comment; interns briefly introduced themselves. 11a. Ratification of DCCC appointment to current vacancy in AD19 Chair Wu requested to take Item 11a out of order. Eric Mar has resigned, requested ratification of appointment of Kelly Groth; spoke about her background and qualifications; Member Campos spoke in strong support of his former campaign manager as future of the party; Member Yee spoke in support of former D7 resident, former appointee on SFPUC CAC; Member Fewer administered oath. Motion to ratify: LaCroix Second: Urmila Gupta Soper and F. Hsieh Vote Count: Approved by acclamation Abstentions: None 6. Proposed Bylaws Amendment on Language Access Policy for the San Francisco Democratic Party (F. Hsieh, Gupta) (Discussion and possible action) (Bylaws amendment, needing 2/3 vote) Chair Wu clarified process for bylaws amendment threshold. Member F. Hsieh introduced original measure and described expansion to include disability access, answered questions previously raised including access requirements for chartered clubs and clarification around terms Tagalog vs. Filipino; Jonathan Lyens (FDR Democratic Club) spoke in support and responded regarding club participation - clubs are the entry level point for all political involvement so it s critical that clubs have an obligation and understanding of access; Member Kim expressed concerned about offering interpretation without being able to provide services, suggested amending to just cover Cantonese, Mandarin, Tagalog and including best

7 efforts language for remaining languages, including ASL, question whether chartered clubs had the resources to provide ASL interpreters; Member F. Hsieh responded that it would be unlikely that an obscure language would be covered, she had also made commitment to raise the necessary funds and had referrals for interpreters to cover all language needs Member T. Hsieh brought up concerns with cost for translating documents; Member F. Hsieh clarified that bylaws amendment only required interpretation (spoken) not translation (written) services; Member T. Hsieh proposed amendment to accessibility portion to state that chartered clubs and organizations shall endeavor to provide access, concerned with overly burdening clubs, would support encouraging rather than requiring; Jonathan Lyens (FDR) responded that lack of accessibility for events is discriminatory and exclusionary and it is very possible to find venues that are accessible, just asking for equality; Member Ting asked how interpretation was going to work - is there access to interpretation headsets; Member F. Hsieh responded that she had a group that was willing to rent equipment to us at low cost; Member Campos felt it was an important issue that should have been addressed a long time ago and the party should make a commitment to fund as a whole, motion to continue, call for committee to answer these outstanding questions; Member Alysabeth agreed to creating this bar for SFDCCC, would like committee to look into what costs would be, look into creating a support fund for clubs; Member Yee did not want to limit which languages are offered, wants to uncover needs and advocate for resources and services, and wanted the SFDCCC to make the commitment as a whole to raise the funds and put this in the budget; Member Jung was concerned with the use of private homes for events which often lack ADA accessibility; Member Wiener would like to separate out two issues, accessibility is easy to reach but language access is complex although it should be our goal; Member Kim suggested adding a threshold for required languages versus best effort so that we can deliver on promise, suggested best efforts for ASL interpreters; Members Gupta suggested that working group should consider a special fund instead of just general fund so that we can accept specific donations. 8 7. Resolution in Support of Citywide Project Labor Agreement Policy (Alexander, T. Hsieh, Campos, F. Hsieh, DeJesus, Farrell, Alioto, Norton, Jung, Baraka, Cohen) (Discussion and possible action) Member T. Hsieh introduced resolution, gave history of Project Labor Agreements (PLAs), wage theft and OLSE, equality for minority workers, 20 year process, Giants in the labor movement - Larry Mazzola and Stan Smith; Member Alexander spoke about her sponsorship that this one of the fastest ways to increase middle class jobs, hits to labor, including right to work litigation; Member Maxwell stated that people of color have not historically had access, questioned what has changed that make it fair and equal access; Member Alexander responded that this resolution deals primarily with prevailing wage and wage theft, BoS is supposed to figure our policy questions; Member Yee supports PLAs, supported it at School District, thanked Farrell, proposed amendment to Resolved clause instead of excess of one million dollars and replace in excess of the agreed upon threshold amount since that amount is still in negotiation, seconded by Member Maxwell ; Member Fewer also worked on PLAs at Board of Education, sets a standard for living wage jobs, in support of Member Maxwell, motioned for amendment in last sentence In addition the SFDCCC supports the PLA as a mechanism to employ formerly incarcerated people, seconded by Member Dufty ; Member T. Hsieh inquired about parliamentary procedure for discussing motions; Member LaCroix clarified that it was possible to have up to three (3) motions at a time, and that motions with no seconds do not become active; Member T. Hsieh spoke against Member Yee s amendment and asked to not remove $1M since it mirrors BOE resolution and should have goal to enforce at this amount regardless of what happens to resolution at Board of Supervisors, this will help bridge income inequality; Member Dufty spoke in support of Member Maxwell and her concerns and support of Citybuild, supported PLAs, urged support for Member Fewer s amendment; Member Baraka requested confirmation that, in addition to wages, included insurance and other labor rights, queried for more details about threshold amount; Member Hsieh clarified that any public contract over $1M would be subject to a project labor agreement, and include prevailing wage for all employees; Member Alexander clarified that the $1M threshold is consistent with the SF Labor Council threshold, and captures smaller projects that are harder to get labor agreements on, does not support Member Yee s amendment; Member Farrell thanked members for resolution and labor for support, is the sponsor for legislation at Board of Supervisors, the threshold is a compromise between higher and lower amounts; Member Campos supports PLAs and Member Fewer s amendment, $1M threshold is important to provide leverage and demonstrates our support for labor and will not support Member Yee s amendment; Member Norton urged support for Members Campos and Farrell s comments, spoke in support of $1M threshold members; Member Yee reaffirmed his support for PLAs and clarified intention with amendment to match other efforts and withdrew amendment; Member Fewer reread proposed amendment.

Resolution on Accessibility at all California Democratic Party Meetings (Gallotta, Alexander) (Discussion and possible action) Member Gallotta thanked to Hene Kelly and CDP Disabilities Caucus for bringing this issue up, party needs to do a better job of making sure that meetings and events are accessible, introduced measure, invited Director Kelly to speak; Director Hene Kelly the little old lady with the loud voice, has been working on this for 5 years at regional meetings, caucuses, and convention, open the tent; Member Alexander reviewed resolution, which calls on access at all meetings, including democratic polling locations, precinct caucus locations, county, district, and state locations including convention, committee, and caucus sites; Member Baraka asked Jonathan Lyens to speak about his experience at convention with access; Jonathan Lyens (FDR), FDR passed this resolution and these standards, spoke about experience with access in the past, has been going for to CDP events for nearly 10 years, when raised concerns in the past has been grilled about requesting access at convention, spoke to support for Ellis as Chair due to her support response to get to convention; Member Ting was requested by Mayor of Adelson of El Cerrito to speak about her experience in wheelchair at convention, had no way of getting to convention due to lack of transportation to/from hotel Requested to be added as cosponsor: DeJesus, Alioto, LaCroix, Maxell, Ting, Baraka, Farrell, Campos, Fewer, Kim, Groth, Gupta, F. Resolution Calling for an Independent Audit of the 2017 California State Democratic Party Officer Election (Gallotta, DeJesus) (Discussion and possible action) Member Gallotta gave background on resolution, convention was a lively crowd with excited first time delegates, a lot of energy and excitement for Chair vote, there was a 62 vote count difference, raised questions about integrity and how election was conducted, a number of conflicts of interest, agreed that party should come together and unity depends on trust on the fairness of the election and party, process is not about removing chair, but about sunshining of process, this is best chance at rational path for party unity, thanked those who spoke in support of audit resolution; Member Dejesus there were ballot irregularities that could not be confirmed due to lack of information, worried about integrity of compliance review committee and issue not being resolved in a timely and fair way, democrats throughout the state are concerned about timely resolution County Committees in Nevada, San Joaquin, Santa Clara, and Alameda have passed resolutions calling for audit, Harvey Milk, Latino Young Dems Executive Board, Bernal, Potrero, and Latino Democratic Clubs all support resolution; Member Baraka stated this was a tough resolution, because we have bigger battles, but this issue rises to a level that needs us to weigh in, has a report from Ellis campaign, cited concerns about duplicate voting, proxy irregularities as either Democrats or out of district, disenfranchises voters and voices, party should provide transparency around election; Member Alioto stated that with the greatest system in the world, the possibility of irregularities in this process is upsetting, makes party look bad and in disarray, concerned that party be irreparably harmed, opioid crisis; Member Wiener Ellis has not lost with integrity, challenge integrity of individuals, question of class, this issue has festered, not appropriate for SFDCCC to get involved, this is very, very, very sad; Member Jung spoke of improper voting situation that happened with SF chartered club, wanted to know what an independent neutral audit was, explained CDP s thorough process of vetting and credentialing delegates and voters, hurt about reflection on how hard volunteers work and applauds their work; Member DeJesus spoke about her experience at convention getting two ballots; Member Ting, proxy Chekal-Bain spoke about his proxy credentialing experience, read from CPD regarding findings of compliance review committee and process to review items Ellis raised; Member Alexander spoke about process at SEIU, which has had contentious, challenged elections and good democratic processes means you do an audit because it creates sense that election was fair, not about changing results, but important to address concerns, this is not a small number who are concerned, should audit for unity s sake and necessary step to build trust; Member Campos supported idea of more transparency, did not question integrity of people involved, but should err on side of transparency, should not be

11 about sanctifying or vilifying candidates; Member T. Hsieh stated that elections experts are FBI trained, forensic audits are expensive, proving fraud is extremely difficult and standards are high, Republicans will feast on this, Rome is burning, this is so political, not constructive, people should move on Amendments: None Motion: Dufty Second: Kim Vote Count: Ayes: Alexander, Baraka, Breed, Campos, DeJesus, Dufty, Fewer, Gallotta, Groth, Gupta, F. Resolution Opposing H.R. 620 (Gupta, Gallotta) (Discussion and possible action) Member Gupta explained measure, which weakens American with Disabilities Act (ADA), passed around bill summary, increased burden to person with disability, invited Jonathan Lyens to speak; Jonathan Lyens (FDR), only concern among disabilities caucus was that some language was not strong enough, this is an attack on disability committee, concerned that 11 democrats are co-sponsors, including Speier Amendments: None Motion: Campos Second: Gallotta Vote Count: Support by acclamation Abstentions: Feinstein, Ting 11. 12 Director Kelly requested taking item 11d out of order d) Club Chartering (Gupta) Two (2) clubs have submitted materials for rechartering: Asian Pacific Democratic Club, President: Selena Sun, DCCC liaison: Mary Jung; summarized mission and background Motion to recharter by: Gupta, second by: Alexander; rechartered by acclamation, no abstentions Irish American Democratic Club, President: Sharon Johnson, DCCC liaison: Norman Yee; summarized mission and background; comments and background from President Sharon Johnson Motion to recharter by: Gupta, second by: Wiener; rechartered by acclamation, no abstentions Next Leadership Circle in on July 22 at 10 am to noon at Park Presidio United Methodist Church, 4301 Geary at 7th Avenue, to include Roberts Rules training by Board of Supervisors Clerk Angela Calvillo and review on new reporting requirements for chartered clubs. b) Finance (DeJesus) Fundraiser brought in over $161,550, netted $145,778, thanks to support from Rose Pak Democratic Club and Christine Pelosi c) Voter Registration (Baraka) Held two (2) events in May on 4th and 17th, 231 registrants, 130 Democrats; Two (2) events in June on 7th and 22nd, registered 227, 109 Democrats; will do door-to-door registration, let Member Baraka or Director Mehis know if you would like to join e) Outreach (LaCroix) Partnered with SFYD on outreach at Sunday Streets, will be partnering with Angeles Roy on including all clubs in larger outreach and voter registration plan f) Treasurer (Alexander) Ran through finance report, account balance, and expenses for past month g) Executive Director (Mehis) Has been working with summer interns; thanked Chair Wu for her service h) CDP Region 6 Update (Kelly) Thanked everyone for their support in reelection, explained state process on pre-endorsement process and meeting and state rechartering process, upcoming deadlines of updated bylaws to CDP by July 1st and a roster of members by July 15th, working to make sure that every club sends the maximum number of delegates (1 delegate for every 20 members) 12. 13 Resolution in Support of SB 33--Prohibiting Financial Institutions from Engaging in Fraudulent Activity That Injures Consumers Sponsors: DeJesus, Gallotta WHEREAS as early as 2005, Wells Fargo Bank imposed on its employees sales quotas to open more client accounts and sell more add-on bank services that led to over two million deposit and credit card accounts opened without customer authorization or knowledge. In the wake of this scandal, the Consumer Financial Protection Bureau (CFPB) ordered Wells Fargo to pay $185 million in penalties for its fraudulent activities. While it appears that Wells Fargo has been bruised by its public relations disaster, it appears that it has triumphed in court, successfully guarding against claims made by consumers injured by the bank. In individual consumer and class action suits against the bank, Wells Fargo has argued that their arbitration clause allowed them to send the dispute over fraudulent accounts into arbitration; and WHEREAS, SB 33 is sponsored by the Consumer Attorneys of California, Consumer Federation of California, and State Treasurer John Chiang and is aimed at curbing Wells Fargo s litigation strategy. SB 33 would limit a financial institution from being able to assert, in a motion to compel arbitration, that a legitimate arbitration clause also covered a purported contractual relationship fraudulently created by the financial institution without the consumer s consent and created by unlawfully using the consumer s personal identifying information. SB 33 narrowly applies to motions to compel filed on or after January 1, 2018; and WHEREAS, a New York Times investigation found that Wells Fargo targeted the most vulnerable victims: immigrants who spoke little English, older adults with memory problems, college students opening their 1 st bank account, and even small business owners with several lines of credit. SB 33 is supported by a wide coalition of labor advocates, low-income rights organizations, and consumer interest groups who believe that binding arbitration has allowed Wells Fargo to shield its activities from the public; therefore BE IT RESOLVED, that the SFDCCC Support SB 33 and urge our legislative representatives to vote YES on SB 33; and BE IT FURTHER RESOLVED, that the SFDCCC send a letter to our state representatives asking them to support SB 33.

14 Resolution in Support of Fair Employment Enforcement Act Sponsor: Maxwell WHEREAS, any form of discrimination robs people of their human dignity and often also of their financial stability and their health. When discrimination is allowed to ensue unchecked it also robs our communities of valuable opportunities to be better and to be stronger; and WHEREAS, recently published research demonstrates that discrimination in hiring remains a persistent challenge for black workers. 17% of Black workers are unemployed as compared to 9% of white workers in California. While Black Americans are more educated than previous generations, they still earn only three quarters of what white workers earn. Lack of enforcement of anti-discrimination laws is a problem that is well documented. Even in California, where protections against employment and housing discrimination were established over 50 years ago, for many Californians enforcement is out of reach; and WHEREAS, under current law, the California Fair Employment and Housing Act, is the principal California statute prohibiting employment discrimination in employment and housing. The Act is silent on the question of whether municipalities can participate in the enforcement of the Act, neither granting permission nor banning local enforcement activities. Local agencies are currently unable to address employment discrimination due to state preemption under FEHA. Removing state preemption expands protections and creates seamless enforcement for residents; and NOW, THEREFORE, BE IT RESOLVED, that the San Francisco Democratic Central Committee (SFDCCC) goes on record supporting enforcement of workplace discrimination in our State Legislature by allowing a city, city and county government to enforce employment discrimination under the Fair Employment and Housing Act; AND BE IT FURTHER RESOLVED that the SFDCCC will work with stakeholders and others to ensure that our Senate, Governor, and California State Legislators are firm in their commitment to workers rights and support for local enforcement of workplace discrimination strengthening employment protections. (Note: Steven Bradford SD 35 and the CDP African American Caucus will present this resolution at the August CDP Executive Board Meeting.)
