2 PUBLIC INPUT AT BOARD MEETINGS: An opportunity for the public to address the Board on public interest items will be provided for up to two (2) minutes per person for a cumulative total of twenty (20) minutes. Testimony shall be limited in content to matters which are within the subject matter jurisdiction of the Board. The Board may not take any action on matters discussed during the Public Comment period. The Board will also provide an opportunity for the public to address the Board on agenda items before or during consideration of the item for up to two (2) minutes per person for a cumulative total of up to ten (10) minutes. Members of the public who wish to speak under Public Comments or on any agenda item are required to submit a speaker card to the Executive Officer prior to the time the item is announced by the Chair for each item they wish to address. Speaker cards are available at the back of the Board Hearing Room. Failure to submit the speaker card in a timely manner may preclude a member of the public from speaking during the subject comment period. VOTING AND DISPOSITION OF ITEMS - Items require a majority vote of the entire membership of the Board (3 votes) for approval. Any member of the Board may move to "reconsider" any vote on any item on the agenda, except to adjourn, suspend the Rules, or where an intervening event has deprived the Board of jurisdiction, providing that said member originally voted on the prevailing side of the item. The motion to "reconsider" shall only be in order once during the meeting, and once during the next regular meeting. The member requesting reconsideration shall identify for all members present the Agenda number, meeting date and subject matter previously voted upon. A motion to reconsider is not debatable and shall require an affirmative vote of three members of the Board. The Board rules provide that all items adopted by the Board will not be distributed or presented to the Mayor, or other designated office, until the adjournment of the regular Board meeting following the date of the Board action. A motion to send an item "forthwith", if adopted by three (3) votes, suspends these rules and requires the Board Secretariat to forward the matter to the Mayor, or other office, without delay. (Mariposa), the 4th low bidder, listed their Total Bid Amount incorrectly. Staff corrected Mariposa's Total Bid Amount in accordance with the procedures set forth in the General Instructions and Information for Bidders. Mariposa was contacted and notified of the correction. The Correction did not change the order of the bids. An evaluation of the bids indicates that this bid is reasonable. The Bureau of Street Services (BSS) recommends that this project be awarded to Thrifty, first low bidder, subject to verification of all other bidding requirements. Local Business Preference (LBP) Program The City passed Ordinance No , which adopted the LBP Program. The Program is designed to increase local employment and expenditures in the local private sector. Businesses that qualify as a Local Business Enterprise (LBE) may be granted an eight percent reduction oftheir Bid amount solely for Bid evaluation purposes. Additionally, all non-lbe bidders may be granted a one percent reduction, up to a maximum of five percent, of their Bid amount for Bid evaluation purposes, for every ten percent of their bid that is to be performed by an LBE subcontractor. For this project, the Bureau of Contract Administration (BCA) staff verified that the first low bidder, Thrifty, is a certified LBE. Business Inclusion Program (BIP) Board of Public Works Meeting - April 8, PAGE 8

9 DEPARTMENT OF PUBLIC WORKS BUREAU OF STREET SERVICES BUREAU OF STREET LIGHTING BUREAU OF CONTRACT ADMINISTRATION JOINT REPORT NO. 1 April 8, 2019 Page3 On January 12, 2011, the Mayor issued Executive Directive No. 14 which created the BIP. This Program provides MBE, WBE, SBE, EBE, DVBE, and OBE firms an equal opportunity to compete for and participate in City Contracts. Additionally, the BIP requires bidders to perform and document a BIP Outreach via the internet utilizing the Los Angeles Business Assistance Virtual Network service. This project was advertised with anticipated participation levels of percent MBE, 4.00 percent WBE, 4.00 percent SBE, 4.00 percent EBE, 4.00 percent DVBE, and with mandatory BIP documentation requirements. The BSS, based on a review of the documents submitted by Thrifty reported that the contractor pledged participation levels of 4.00 percent MBE, 0.00 percent WBE, 0.00 percent SBE, 0.00 percent EBE, 0.00 percent DVBE, 0.00 percent OBE, and complied with the BIP outreach requirements of the bid. The Mandatory Subcontracting Minimum requirement for this project is 4.00 percent and the contractor has complied by pledging a subcontractor participation level of 4.00 percent. C.) Section related to peak hour traffic restrictions, unless an Exemption from the Peak Traffic Hours Prohibition is approved. CONTRACTOR RESPONSIBILITY ORDINANCE All contractors participating in this bid process are subject to compliance with the requirements specified in the City of Los Angeles' Contractor Responsibility Ordinance #173677, [Article 14, Chapter 1, Division 10, L.A.A.C.]. 11 DEPARTMENT OF PUBLIC WORKS BUREAU OF STREET SERVICES BUREAU OF STREET LIGHTING BUREAU OF CONTRACT ADMINISTRATION JOINT REPORT NO. 1 April 8, 2019 PageS CONTRACTOR PERFORMANCE EVALUATION In accordance with Article 13, Chapter 1, Division 10 of the City of Los Angeles Administrative Code, the project manager and the City inspector for this construction contract shall submit Contractor Performance Evaluation Reports to the BCA (Department of Public Works) upon completion of this project. CONCLUSION In view of the above findings, the BSS staff recommends that the Board declare Thrifty, first low bidder, to be the lowest responsive, responsible bidder, and award Thrifty the contract for this project. FUNDING Sufficient funds are available in the Street Lighting Maintenance Assessment Fund 347, Department No. 50, Account No. 50R900. FINANCIAL LIABILITY CLAUSE The City's liability under this contract shall only be to the extent of the present City appropriation to fund the contract. However, if the City shall appropriate funds for any succeeding years, the City's liability shall be extended to the extent of such appropriation, subject to the terms and conditions of the contract. SEIU Local 721 was provided a copy of the Notification of Intent to Contract prior to the Bureau of Street Services requesting approval to advertise for bids.
