2 Agenda Week 4 Major Developments Looking Ahead to Week 4 April 23 rd Last Day for Regular Committee Meetings
3 2019 Legislative Session Activity Week 4 MAJOR DEVELOPMENTS
4 Surgery Center/Recovery Care HB 25 passed second committee, Health Care Appropriations Has one stop left Senate Bill has only passed one committee Outlook: Senate and House bill are very different. Senate is just 24 Hour Surgery Center Length of Stay House is 48 Hour Surgery Center Length of Stay, Recovery Care Centers, and Birthing Centers
5 Needle Exchange Program SB 366 Passed final committee in Senate HB 171 Passed first committee. 2 Committees left Outlook: House agreement seems to pave the way for approval. No public funds for the purchase of needles.
6 Office Surgery HB 933 was amended to closely mirror the Senate Bill which is positive Eliminates Impact on Level 1 surgeries Focus is now on liposuction procedures and corporate ownership of surgery centers (close the loop hole for punishment) HB removed the controversial Nurse Anesthetist Language that is in the Senate Bill. Outlook: streamlined bill looks more likely to pass.
7 Electronic Prescribing HB 831 passed second committee. Has one stop left. Bill still has no exemptions that mirror the Federal Legislation and a shorter implementation date, Jan Amendment was withdrawn to limit bill to controlled substances. Outlook: Senate bill has not moved yet. Movement toward streamlining the bill.
8 Telehealth SB 1526 passed the first committee. 2 stops left. HB 23 passed the final committee in the House. We prefer the Senate Bill due to payment parity and network adequacy language. House Bill has a fiscal impact on the state due to tax incentives. Outlook: Uncertain due to differences in the bill.
9 Shared Savings SB 524 passed 2 nd committee in the Senate. One stop left. HB 1113 passed 2 nd committee in the House. One stop left. Outlook: not much is preventing this from moving forward. It is an optional plan. State has precedent already in the State Health Plan. All the major conservative think tanks are pushing it. Are their some positive aspects of the bill? Should out of network physicians be available to patients as well?
10 Workers Compensation HB 1399 passed the first committee this week. SB 1636 has first hearing next week. Bills are very different. House has some good (timely authorization, ancillary services, and Performance Score Card) House bill has major cuts to ASCs and Hospitals. Outlook: business community does not like House bill as it does not cap attorney fees. Senate Bill does not cut facility reimbursement.
11 Tort Reform HB 17 Passed House Commerce Committee (13 Y, 7 N) Amended considerably. Medicare Standard for Medical Services in Liability Cases was changed to a tiered program of data the defense is able to inform the jury. 50 th Percentile of Fairhealth Allowed Amounts (contracted rates) if physician bypasses Government Coverage. 85 th Percentile of Fairhealth Allowed Amounts (contracted rates) if physician bypasses commercial insurance. 85 th Percentile of Fairhealth Charge Amounts if patient was not insured.
12 Tort Reform Outlook Senate bill has not moved. Cap on Noneconomic Damages is generating a lot of opposition.
13 Pharmacists Collaborative Agreements/Strep and Flu Testing HB 111 passed the 3 rd and final committee in the House. Ready for floor action. SB 300 has not moved. Pharmacists attempted to amend the House language onto Senate Bill 1170 this week. The bill was not heard. Outlook: The bill will pass the House. Looks unlikely to pass the Senate.
14 Physician Referrals HB 863 passed 2 nd Committee in the House. Has one stop left. Supposedly eliminates hospital self-referral exemption to address vertical integration. Also requires a physician to inform a patient if they are referring to a physician that is out-of-network. Impossible to comply with. Outlook: No Senate Bill so unlikely to pass.
