Almighty and everlasting God, who knows us better than we know ourselves and one another, from outer edge to the very depths of our being, accept our thanksgiving for the days of our lives and the measure of strength we possess to invest our days so that we often count for the common good and sometimes for extraordinary good. Bless this honorable body, the Senate of Pennsylvania, as these days of June unfold and the work of these women and men winds out. Give them clarity in thought and word, and charity in difference of philosophy and pohtics. Let the responsibility to our Commonwealth rest with them not as a burden but an opportunity. May they set themselves like flint on iron to be faithful to their calling, their task, their standard, and their honor, so that having done as much as they can as well as they can the history they create will redound to the well-being of the citizenry and the good name of this Senate. 8 570 LEGISLATIVE JOURNAL - SENATE JUNES, Mav 30, 1995 URGING THE ATTORNEY GENERAL OF THE UNITED STATES TO INVESTIGATE THE AmLINES' IMPOSITION OF A CAP ON COMMISSIONS PAH) TO TRAVEL AGENTS; AND URGING THE CONGRESS OF THE UNITED STATES TO ACT DURING THE PENDENCY OF THE ATTORNEY GENERAL'S INVESTIGATION Senators SHUMAKER, WAGNER, BRIGHTBILL, BELAN, MUSTO, PETERSON, RHOADES and FUMO offered the following resolution (Senate Resolution No. 54), which was read andreferredto the Committee on Intergovernmental Affairs: A RESOLUTION In the Senate, May 30, 1995 Urging the Attorney General of the United States to investigate the airlines' imposition of a cap on commissions paid to travel agents; and urging the Congress of the United States to act during the pendency of the Attorney General' s investigation. WHEREAS, The travel agent industry employs an estimated 9,950 full-time and part-time travel agents in this Commonwealth, who in turn derive almost one-third of their earnings from the traditional 10% commission on airline ticket sales; and WHEREAS, Virtually every major airline has proposed the imposition of a cap on these sales commissions, such that airlines will pay no more than $25 on one-way domestic tickets and $50 for round-trip tickets instead of the current commission of 10% of the cost of the ticket; and WHEREAS, The imposition of such a cap would devastate the travel agent industry, resulting in the loss of thousands of jobs held primarily by women and single parents and adding to the currently high rate of unemployment in this Commonwealth; and WHEREAS, The job loss would have a negative impact on the Commonwealth budget, resulting in a decrease in formerly collected income taxes and an increase in State unemployment compensation expenditures; and WHEREAS, The proposed cap would also harm the traveling public which would become a captive customer of the airline industry and would no longer be able to rely on knowledgeable travel agents to guide it through the maze of travel-related information and provide the most cost-effective travel recommendations; and WHEREAS, It has not yet been determined whether the airline industry' s lockstep approach to cost savings through the imposition of the commission cap constitutes a violation of antitrust law; therefore be it RESOLVED, That the Senate of Pennsylvania urge the Attorney General of the United States to conduct an investigation to determine if the airlines' imposition of a cap on the sales conunissions of travel agents constitutes a violation of Federal antitrust law; and be it further RESOLVED, That the Senate urge the Congress of the United States to prohibit the imposition of commission caps until the Attorney General has completed the investigation requested by this resolution; and be it further RESOLVED, That copies of this resolution be transmitted to the Attorney General of the United States, the presiding officers of each house of Congress and to each member of Congress from Pennsylvania.
