1 October 12, 2017 The regular meeting of the County Commissioners of Allegany County was held in the Commissioners Meeting Room, Allegany Room 100, 701 Kelly Road, Cumberland, at 5:00 p.m. on the above date. The following were present: Commissioner Jacob C. Shade; Commissioner Creade V. Brodie, Jr.; Commissioner William R. Valentine; County Administrator David A. Eberly; and County Attorney William M. Rudd. The following business was transacted: The Pledge of Allegiance was led by Danny Williams. MOTION There were no additions or deletions to the agenda. MOTION Upon Motion by Commissioner Brodie, seconded by Commissioner Shade, and Motion carried, the Commissioners approved the minutes of the September 21, 2017, public business meeting. PRESENTATION Item 1 Allegany College of Maryland Adult Basic Education Program Adult Literacy Volunteer Program: Deborah Miller, Instructional Specialist. County Administrator David Eberly explained that because of a scheduling conflict, the presentation regarding the Allegany College of Maryland Adult Basic Education Program would have to be rescheduled for a later date. Item Household Hazardous Waste Collection Report Siera N. Wigfield, Recycling Coordinator (See News Release). Siera Wigfield, Recycling Coordinator for Allegany County, presented a report on the 2017 Household Hazardous Waste Collection event held on Saturday, September 9, 2017, from 10 a.m. to 3 p.m., at the Allegany County Fairgrounds. A copy of her report is attached to and made a part of these Minutes. Commissioner Brodie thanked Mrs. Wigfield for her report. Commissioner Shade asked her how much paint was collected. She replied that the total volume of containers was 2,451 gallons, but that wasn t the total of the amount of paint in the cans. Mrs. Wigfield also confirmed to Commissioner Shade that it was a very successful day for paint can recycling. Mrs. Wigfield thanked the Commissioners for their time, and they in turn thanked her for her presentation. PUBLIC HEARING Item 3 Public Hearing for Prince Albert/Sunnyside Water Project David K. Nedved, Economic & Community Development Representative, reported that notice was given in the Cumberland Times-News on Saturday, October 7, 2017, that the Allegany County Commissioners would sponsor a public hearing on the following subject: Sunnyside and Prince Albert Water Project. He explained that background on this Project was provided on the County s website part of the preceding week, and all of this week, and that paper copies were available on the front table and by the entrance to the meeting room. A copy of the background information presented by Mr. Nedved is attached to and made a part of these Minutes. After presenting the public hearing background information, Mr. Nedved invited anyone present to make comment on the Sunnyside and Prince Albert Water Project to come forward so he could take such comment. The only person to speak was Mr. Danny Williams, who spoke from the audience and thanked Mr. Nedved. The Commissioners also expressed their appreciation for this Project. The hearing was closed. ACTION AGENDA Item 4 Resolution Prince Albert/Sunnyside Water Project $102,000 United States Department of Agriculture (USDA) Loan Resolution Board of County Commissioners to approve Resolution Prince Albert/Sunnyside Water Project $102,000 USDA Loan Resolution Jason M. Bennett, CPA, Director of Finance, explained that Resolution 17-26, before the Board of County Commissioners, was for the Commissioners permission to close on a $102,000 USDA Loan. He further explained that this is a $1,700,000 total project with USDA, MDE, and CDBG money, in a grant and loan mix. Mr. Bennett added that the project will be completed in the Spring of 2018, will service approximately 60 customers, and was originally authorized as part of Bond Bill

2 5-15. He provided the terms of the loan: 1.75 percent, for 40 years, with a debt service of $3,556 annually, with the loan to be paid by the users of the system. Mr. Bennett told the Commissioners that, with their approval, County staff will close the loan next month. Upon Motion made by Commissioner Valentine, seconded by Commissioner Brodie, and duly carried, the Commissioners unanimously approved and passed Resolution Prince Albert/Sunnyside Water Project $102,000 United States Department of Agriculture (USDA) Loan Resolution. Item 5 Resolution Pond Circle Water Project $100,000 United States Department of Agriculture (USDA) Loan Resolution Board of County Commissioners to approve Resolution Pond Circle Water Project $100,000 USDA Loan Resolution Jason M. Bennett, CPA, Director of Finance, reported that Resolution concerned another small water project, and a $100,000 USDA loan for the Pond Circle Water Project. Mr. Bennett explained that this is a part of a $280,000 project, with USDA grant and loan and MDE money involved. He added that the Project will serve 17 customers, and was also authorized with Bond Bill He gave the terms at percent, for 40 years, with a debt service annually of $3,408, and further explained that the loan would be paid by the users of the system. Mr. Bennett asked for the Commissioners approval of Resolution and pointed out that the loan would close next month with that approval. Upon Motion made by Commissioner Brodie, and seconded by Commissioner Valentine, the Commissioners unanimously approved and passed Resolution Pond Circle Water Project $100,000 USDA Loan Resolution. Item 6 Allegany County Employees Retirement Incentive Board of County Commissioners hereby authorizes a retirement incentive to county employees accepting the tiered plan based upon years of service and age, as per public discussion at the September 21, 2017 Work Session. Employees must leave county service by May 31, 2018 Jason M. Bennett, CPA, Director of Finance, referred the Commissioners to the previous discussion of the Allegany County Employees Retirement Incentive at the public work session held on September 21, Mr. Bennett confirmed the reasons for the Incentive, to stabilize the County Government s workforce and keep it at current level or possibly shrink it slightly. He remarked that the County had good luck with such a program in 2010 and 2011, when 36 individuals retired, many of them not replaced. Mr. Bennett explained that more retirees will be replaced this time, but there will still be some positions that will be eliminated. Sixty-one (61) employees are currently eligible to participate in the Employees Retirement Incentive Program, and County staff has put together a tiered system, as discussed at the September 21st Work Session: $15,000 for 30-year employees; $12,500 for 25-year employees; $10,000 for 10-year employees; $7,500 for 5-year employees, age 62; plus $150 a year per year of service (for those age 62 with only between 5 and 9 years of service, $200) Mr. Bennett then provided the timeline for the Retirement Incentive Program: Upon the Commissioners approval, it will be opened up December 1, 2017, for applications from employees, and continue through February 28, Those participating would have to leave County service by May 1, 2018, with the incentive benefits paid to them the first payday in May. Mr. Bennett explained that those employees would then be off the books for the pension payment and for the next budget year. He further explained that the outlay of funds for the Program and the ultimate savings to the County will depend on how many of the employees who are eligible for the Program actually participate in it. Commissioner Shade asked Mr. Bennett how many employees are eligible for the Retirement Incentive Program. He said that there are 61. Commissioner Brodie asked about a target number, and Mr. Bennett replied that, if this Program turns out like the previous one, he would expect 20 to 30 employees to participate. Commissioner Valentine commented on the value of the Program to both the County and prospective retirees. Commissioner Valentine moved that the Commissioners authorize a Retirement Incentive to County employees, accepting the tiered plan based upon years of service and age, as per public discussion at the September 21, 2017 Work Session. Item 7 State of Maryland Rural Legacy Program Board of County Commissioners to sign an Agreement of Sale and a Deed of Easement pertaining to the purchase of a preservation easement in the Mountain Ridge Rural Legacy Area. Seller of the easement is 1100 Industrial Blvd., LLC. David A. Dorsey, Planning Coordinator, asked that the Commissioners authorize

3 Commissioner Shade (as President) to sign an Agreement of Sale and a Deed of Easement pertaining to a 104-acre parcel in Election District 29. He explained that State of Maryland funds will pay for this grant to acquire an easement from the willing property owner of the parcel. Mr. Dorsey pointed out that the property is in the designated Mountain Ridge Rural Legacy Area. Upon Motion by Commissioner Valentine, and seconded by Commissioner Shade, the Commissioners, by a vote of two to one, authorized the President to sign an Agreement of Sale and a Deed of Easement pertaining to the purchase of a preservation easement in the Mountain Ridge Rural Legacy Area. VOTE: Commissioner Valentine Commissioner Brodie Commissioner Shade In favor Opposed In favor Item 8 Fiscal Year 2018 Capital and Operating Assistance Grant Agreements Board of County Commissioners to accept and authorize the County Administrator to sign the FY 2018 Public Transportation Capital and Operating Grant Agreements. The grant agreements are to provide up to $1,352,837 in federal funds, and $494,082 in state funds, to be matched with $433,863 in local funds Roy S. Cool, Transportation Planner, defined this Item as simply the annual grant that keeps the County s buses and AllTrans System operating. He explained that there was nothing really outstanding about this year; and that three replacement buses were needed. Upon Motion by Commissioner Brodie, seconded by Commissioner Valentine, and unanimously carried, the Commissioners accepted and authorized the County Administrator to sign the FY 2018 Public Transportation Capital and Operating Grant Agreements, which are to provide up to $1,352,837 in federal funds, and $494,082 in state funds, to be matched with $433,863 in local funds. CONSENT AGENDA As recommended by the County Administrator Upon Motion by Commissioner Brodie, seconded by Commissioner Valentine, and Motion carried, the Consent Agenda as recommended by the County Administrator is adopted. Item 9 Resolution Western Maryland Fiber Network Board of County Commissioners approved and passed Resolution giving Tri-County Council for Western Maryland the authority to utilize Maryland Economic Development Assistance Authority and Fund (MEDAFF) funding from the Maryland Department of Commerce to match with Appalachian Regional Commission (ARC) funds for a fiber lighting initiative. Mr. Guy Winterberg of Tri-County Council came forward to speak about this Item. He thanked the Commissioners for their support, and explained that Tri-County Council is involved in the Western Maryland Fiber Network Project because it is a bi-county project (Allegany and Garrett). Mr. Winterberg further explained that this Project will end up providing fiber into seven industrial business parks across both Counties, and ultimately support about 9,000 jobs, including current employment and projected employment over the next three years. Mr. Winterberg again expressed his appreciation to the Commissioners for their assistance. Commissioner Valentine pointed out that a number of years ago, the State of Maryland received funds to use to get high-speed internet to rural areas. He remarked that the rural areas ended up being Prince George s County and Montgomery County, and that finally, money is coming Western Maryland s way, thanks to Mr. Winterberg. Mr. Winterberg commented that much of the previous project focused largely on the public sector, while this one is all about the private sector and trying to bring them the same access that the public sector has. He added that a large part of it involves Downtown Cumberland. Mr. Eberly asked Mr. Winterberg if the funding, when it comes in, would provide the opportunity for completion of the splicing exercise on fiber currently in the ground, but not lit, and how many miles of fiber this would involve. Mr. Winterberg told him that it could be anywhere from 63 to 90 miles of fiber that has been laid in the ground since 2013 but not lit. Item 10 Federal Fiscal Year 2017 State Homeland Security Program Grant Acceptance Board of County Commissioners authorized the acceptance of the FFY 2017 State Homeland Security Program Grant in the sum of $148,606 as well as modification to budget 1448 to reflect this grant. This grant will be utilized to enhance interoperable communications as well as to update and enhance emergency preparedness and response plans.

4 Item 11 Tactical Emergency Casualty Care (TECC) Responder Training Grant Board of County Commissioners authorized the acceptance of $25, from Maryland Institute for Emergency Medical Services Providers (MIEMSS) as well as modification to budget 1382 to reflect this grant. Item 12 Allegany County Tourism Website Development Request for Proposal Board of County Commissioners authorized the Allegany County Tourism Director to advertise Request for Proposals for a responsive website redesign and content management system rebuild. Ms. Ashli Workman, Allegany County Tourism Director, came forward to provide some additional information about this Item. The information she presented is included in her Staff Report dated October 2, 2017, a copy of which is attached to and made a part of these Minutes. She concluded by saying that Tourism s strategy will be to serve the visitor, which in turn serves the County s businesses and, ultimately, the community. Item 13 Potomac Highlands Airport Authority Re-Appointment Board of County Commissioners re-appointed David Weimer to the Potomac Highlands Airport Authority. His term will expire on June 30, Item 14 Declaration of Surplus Vehicles Board of County Commissioners authorized the Allegany County Sheriff s Office to declare the following vehicles surplus and sold by public auction: 1995 Jeep Cherokee VIN# 1J4GZ78Y3SC653148, 2002 Chevy Trailblazer VIN # 1GNDT13S , 2002 Ford Explorer VIN # 1FMZU63E12UA13496, 2002 Chevy Cavalier VIN # 1G1JC , 1994 Saturn PC VIN # 1G8ZH5597RZ286033,1998 Chevy Cavalier VIN # 1G1JC1242W , 1993 Chevy S10 VIN# 1GCCS19R4P , 1999 Toyota Corolla VIN # 2T1BR12E6XC245494, 2002 Dodge Neon VIN # 1B3ES56C12D626149, 2001 Chevy Cavalier VIN # 1G1JF , and 2011 Ford Fiesta VIN # 3FADP4BJ8BM Item 15 Declaration of Surplus Transit Vehicles Board of County Commissioners authorized Allegany County Transit to declare the following vehicles surplus and sell by public auction: Ford Bus #293 VIN # 1FDXE45P95HB44812, Ford Bus #295 VIN # 1FDXE45P25HB44814, Ford Bus #297 VIN # 1FDXE45P65HB44816, and an International Bus #305 VIN # 1HVBTAFLX8H Item 16 Governor s Office of Crime Control and Prevention, School Bus Safety Board of County Commissioners authorized the Allegany County Sheriff s Office to accept funding from the Governor s Office of Crime Control and Prevention, School Bus Safety Enforcement, Overtime Patrols, in the amount of $5,000. This is a 100% funded grant for August 1, 2017 through June 30, Item 17 Allegany County Health Department Drug Interdiction Grant Board of County Commissioners authorized the Allegany County Sheriff s Office to receive and utilize $10,000 in grant funding made available by the Allegany County Health Department for FY 2018, with a goal of reducing the illicit supply of opioids in Allegany County. Item 18 Purchase of New Dump Trucks for Roads Division Bid Award Board of County Commissioners authorized the Department of Public Works Roads Division to award the purchase of two new dump trucks to Freightliner of Hagerstown, Halfway Boulevard, Hagerstown, Maryland, in the amount of $257,028. (Mr. Eberly pointed out that the price also includes the warranty for each vehicle.) Item 19 Allegany County Board of Elections Memorandum of Understanding for Early Voting Board of County Commissioners agreed to sign the Memorandum of Understanding with the Allegany County Board of Elections and authorized use of the Allegany County Office Complex for the process of Early Voting in Allegany County for the Primary and General Elections in Item 20 Vision Benefits of America Renewal Agreement Board of County Commissioners approved the Vision Care Contract renewal for Allegany County employees for the period from October 1, 2017 through June 30, The monthly rate will remain unchanged at $7.40 per individual member, $13.30 per two-person unit, and $18.05 per family unit. This is elective and is 100% paid by the employee. County Administrator David Eberly reported that last Thursday and Friday (October 5 and 6, 2017) he had the privilege of once again this year participating in MACo s Affiliate Conference for County Administrators. He said that he was joined by nine of his colleagues from around the State, and Garrett County hosted the event. Mr. Eberly added that a portion of the attendees activities at this Conference included a tour of a working strip mine here in Allegany County, and a tour of AES Warrior Run. He acknowledged and thanked Commissioner Brodie for joining them at the strip mine and providing the entire class with a twenty-minute tutorial on everything that they were seeing that day. Mr. Eberly also mentioned a thank-you note from Ken Decker in Caroline County to Commissioner Brodie.

5 County Attorney William Rudd read a Statement Regarding the Closed Session held on Thursday, September 21, 2017, at 4 p.m. A copy of this Statement is attached to and made a part of these minutes. After Attorney Rudd s reading of the Statement, Commissioner Shade reported that the Commissioners voted to release the minutes of the Closed Session, and that they are available upon request. Commissioners statements, comments, recognition Commissioner Valentine talked about his visit to Annapolis earlier in the day. He reported that he attended another meeting of the Kirwan Commission, which deals with the future of education, and that it was a very good meeting. Commissioner Valentine said that the Kirwan Commission s final report is due at the end of December 2017, but, in speaking with other members of the Commission, it appears that the report is not going to be completed by that time. It is likely that an extension will be needed. Commissioner Valentine commented that it is already October, and there has still not been one discussion about the cost of proposals. Commissioner Brodie thanked Mr. Eberly for the opportunity to speak at the Administrators Conference, and remarked that he was very proud to speak about coal mining, which he described as the backbone of this County. Commissioner Brodie added that the coal mining industry has an $800,000,000 a year impact on Allegany County. He complimented the group participating in the tour of the strip mine, for their comprehension. Commissioner Brodie also discussed a tour he took the previous week at the Allegany County Animal Shelter. He commented that in his opinion, they are doing a fantastic job out there. Commissioner Brodie reported that the updated facility was very clean and orderly. Commissioner Shade acknowledged two elected officials in the audience, Delegate Mike McKay and Board of Education Member Tammy Fraley, and welcomed them to the meeting. He also remarked that the Commissioners are looking forward to Governor Hogan s visit to Allegany County tomorrow, and commented on the Governor s commitment to Western Maryland, as well as the commitment of many of his Cabinet Secretaries. The Secretary of Labor visited the County in September, and the Secretary of Commerce has also visited recently. Commissioner Shade also thanked the Election Board for their efforts. Before turning the meeting over to the Constituents portion, Commissioner Shade welcomed those present to speak, and stated that, speaking on behalf of the Commissioners and County staff, they are all committed to DelFest and are happy to have them in Allegany County. He added that they all want the festival to stay in the County and grow, and they all also welcome the idea of a second DelFest festival. Constituents In order of sign-up sheet Mr. Ed DeWitt Mr. DeWitt, of Frostburg, explained that he has been involved behind the scenes with DelFest for nine of the ten years it has been in Allegany County. He said that he was present to voice his concerns about recent news in the media. Mr. DeWitt described DelFest as a measure of hope that offers national prominence and excitement in this area. He remarked that DelFest is unmatched by anything else in the County. He expressed his hope that the Commissioners will do everything they can to keep DelFest in Allegany County. Commissioner Valentine remarked that there is no one in County Government who in any way, shape or form would like to see DelFest leave. He added that he started volunteering with DelFest the first year, well before he was a County Commissioner, and that he serves as a greeter at the festival. Commissioner Valentine also commented on the contract process. Mr. Patrick Riley Mr. Riley, of Garrett County, thanked the Commissioners for their support of DelFest. He said that although he resides in Garrett County, he also owns property in Allegany County and is employed here. Mr. Riley explained that he has attended DelFest almost every year, and it seems to bring great people together across the political spectrum to enjoy great music. He asked the Commissioners to keep supporting the DelFest organization and to also encourage them to put on more than one event a year. Mr. Craig Miller Mr. Miller read a statement he prepared, regarding the impact of DelFest on the local economy and local community, including the charitable organizations which receive donations from the DelFest organization out of the proceeds of the festival. He also asked the County Commissioners some questions, which were discussed with the Commissioners.

6 The County Commissioners all stressed their support of the DelFest event in Allegany County. Commissioner Valentine spoke about the misunderstandings and misinformation that have been connected with the contract negotiations. He also pointed out that the festival is growing and there are many more elements brought into it now than during its first years in Allegany County. County Attorney Rudd also spoke about the contract negotiations, and clarified that the County has offered to negotiate the contract via phone conferences or face to face meetings, but DelFest representatives did not take them up on this. He remarked that negotiations need to be done between the parties to the contract, not on the radio or in the newspaper. At the end of his comments, Mr. Miller asked the Commissioners if they would go on the record with support of a multi-year contract. Commissioner Valentine said that he would like to see a 10 or 20-year contract. Commissioner Brodie said that he absolutely supported a five-year deal. Commissioner Shade agreed, and spoke of requests from DelFest that have been addressed by the County Commissioners and, in many cases, granted. Mr. Miller thanked the Commissioners for their time and for answering his questions. 7 2017 Household Hazardous Waste Collection Report Saturday, September 9, 2017 at the Allegany County Fairgrounds The last event was held October T of HHW collected 112 cars. Total of 336 cars- 219 Drop of Paint and or HHW and 117 Dropped of HHW only Paint Containers total volume 2,451 gallons, granted all were not full - I estimate 10% paint is left over. Total of 8.3 Tons of HHW was disposed of properly. The event total cost should be under budget at an estimated $27,600 (a final invoice has not come in yet) In the meantime, the following items can be disposed of year-round in Allegany County: Antifreeze- AC Recycling Center & MT view Disposal Area Oil- AC Recycling Center, MT View Disposal Area, Oldtown and Flintstone Refuse Sites Fluorescent Lights- Penn-Mar recycling accepting all -even tube for $1 each BaHeries Freon Containing Items Medications- can be disposed at AC Sheriff's Office, Cumberland/Frostburg City Police or the State Police Barracks in LaVale. For other items, I ask that residents store HHW in original containers with labels, out of reach of pets and children and to consider o Replace toxic pesticides and cleaning products with less toxic or non-toxic alternatives. - CBT grant allowed us to hand out spray bottles with a non toxic all purpose cleaner recipe at the event. o Reduce the amount of HHW used, and thus purchased. Buying smaller quantities of HHW reduces exposure to the environment and people. o Dispose of HHW that are no longer needed, or effective thru approved methods. Like County HHW collection events. Workman, Director of Tourism DATE: October 2, 2017 RE: Allegany County Tourism Website RFP For the Agenda of: October 12, 2017 BACKGROUND: Allegany County Tourism is represented through the website - mdmountainside.com. It is advantageous for Tourism to be represented through an exclusive website separate from government, due to the nature of the visitor. A tourism website focuses on the visitor and potential visitors within the county. The goal of mdmountainside.com is to promote Allegany County through destination awareness and to leverage our assets by delivering strong content and imagery. 1. ISSUES: The current website is 14 years old and is in particular need of a rebuild. The creative is outdated, but more importantly, the structure is a nonresponsive design and built on a business model that no longer matches the vision and strategy for county tourism. As marketing evolves, it is essential to update the website with the latest technology to ensure that potential visitors will find the information they are seeking quickly and efficiently, and return to the site frequently. By implementing these new technologies, Allegany County Tourism seeks to convert people who are researching destinations into actual visitors. 2. FINANCIAL IMPACT: A website request for proposal (RFP) has been established to follow Allegany County's Procurement Policy. The RFP was created to solicit Phone: Fax:

9 companies to bid on a responsive website redesign and CMS (content management system) rebuild. Submission requirements are clearly listed. A structured review process has been established and will be evaluated by a committee and proposal timeline and terms are clearly stated within the RFP. The RFP has been generated and pending approval will be announced publicly on October 13, Submissions will be accepted until close of business on November 13, A review committee will receive proposals and score by November 29, Awarding of the contract is TBD by the Allegany Board of Commissioners following proposal guidelines and protected by proposal terms. Financial impact will be determined upon receiving bids. 3. ALTERNATIVES: None 4. OTHER CONSIDERATIONS: None 5. CONFORMITY TO COUNTY POLICY: This request meets County requirements and procurement policies. An RFP has been generated and pending approval will be announced publicly on October 13, The RFP will be advertised through the local newspaper and listed on the emaryland Marketplace website to encourage the competitive bid process on a regional scale. 6. 10 STATEMENT REGARDING THE CLOSED SESSION HELD ON THURSDAY, SEPTEMBER 21, 2017, AT 4:00 PM, ROOM 424 The Board of County Commissioners, at a meeting convened on Thursday, September 21, 2017, at 4:00 o clock p.m., voted unanimously to go into a closed session. The meeting time and place and the purpose of the meeting were provided in a public notice distributed on September 19, The notice was provided in the same manner, and also to the same entities, as receive the Commissioners regular business meeting notices. The meeting was closed in accordance with the General Provisions Article of the Annotated Code of Maryland Section 3-305, and the purposes for which the meeting was closed were as follows: 1. To consider a matter that concerns the proposal for a business or industrial organization to locate, expand, or remain in the State (General Provisions Article Section (b)(4)). 2. To discuss the appointment, employment, assignment, promotion, discipline, demotion, compensation, removal, resignation, or performance evaluation of appointees, employees or officials over whom it has jurisdiction (General Provisions Article Section (b)(1)). 3. Consultation with counsel to obtain legal advice concerning the matters referenced in numbers 1 and 2 above (General Provisions Article Section (b)(7)) The Commissioners first discussed negotiations between the County and Delfest, LLC, for a five-year contract for the Delfest festival. The Commissioners discussed with staff, Paul Kahl, Public Works Director, and County Attorney William Rudd, the various proposed contract language and the respective positions of the parties. The Commissioners then voted concerning offers to be made about various contract provisions, with instructions to Paul Kahl and William Rudd to communicate those positions to representatives of Delfest. There was no further business to be conducted in the closed session, and therefore, upon motion by Commissioner Brodie, seconded by Commissioner Valentine, and duly carried, the meeting was adjourned at 4:38 p.m. Present during the entire meeting were Commissioner Jacob C. Shade; Commissioner Creade V. Brodie, Jr.; Commissioner William R. Valentine; County Attorney William M. Rudd, and Paul Kahl, P.E., Director of Public Works. Mr. Kahl participated by telephone. Cindy Young, Secretary to the County Attorney, was present to take notes and prepare the minutes.
