The rules contained in the current edition of Robert s Rules of Order Newly Revised shall govern the meetings of the Board in all cases to which they are applicable and in which they are not inconsistent with the law, these rules or are otherwise waived by the Board. 2. No comments from the floor will be allowed under any circumstances. 3. The Board shall hear as many comments from the public as practicable during any meeting. 4. No member of the public may address the Board who has not previously signed up to address the Board, unless he or she is requested to do so by the Chair. 5. Any member of the public who wishes to address the Board on any topic, which appears on the agenda or otherwise, must sign up before the scheduled time for public comments. 6. All speakers will be limited to five (5) minutes per topic, unless leave is given by the Chair. 7. Any identifiable group of three (3) persons or more shall be limited to a total of ten (10) minutes per topic. 8. All members of the public given the privilege of addressing the Board, shall do so at the beginning of its scheduled meeting, or immediately following the lunch time break, if the scheduled meeting continues past the lunch time break. 9. The Chair may rule any speaker out of order and require that speaker to cease addressing the Board and if necessary order the bailiff to remove that speaker from the Commission Chambers if: A. The speaker refuses to confine his remarks to the topic at hand. B. The speaker becomes belligerent, irrational, or in any way disruptive to the meeting of the Board, or, C. The speaker refuses to cease addressing the Board after his allotted time. 10. No agenda item will be designated for any specific time other than a time during the first three (3) hours of the meeting, unless leave is given by the Chair. All times shown on the agenda are approximate. 11. No item may be added to the agenda of the Board of County Commissioners except upon request of the Chair, a Board member, the County Manager, the Clerk of the Board or the County Attorney. 12. All decisions of the Chair concerning parliamentary procedures, decorum, or rules of order will be final, unless they are overcome by a majority of the members of the Board in attendance. 13. The Chair shall vote on all issues that come before the Board in the same manner as a member of the Board. Notice: All items listed on the agenda are for discussion & possible action including vote by the Board. The Board reserves the right to amend the agenda of any meeting to the fullest extent allowed by law. 41 RESOLUTION A RESOLUTION OF THE MADISON COUNTY BOARD OF COUNTY COMMISSIONERS FINDING THE CONTINUING AND REPETITIVE SPILLS OF RAW SEWAGE INTO THE WITHLACOCHEE RIVER AND MUD CREEK BY THE CITY OF VALDOSTA, GEORGIA TO BE UNACCEPTABLE AND INTOLERABLE; REQUESTING MEANINGFUL ENFORCEMENT ACTION BY THE STATE OF GEORGIA AND FLORIDA STATE AGENCIES AND PERSONNEL IN POSITION TO BRING SUCH ACTIONS; AND REQUESTING THE SUPPORT OF THE STATE OF FLORIDA, THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION, THE SUWANNEE RIVER WATER MANAGEMENT DISTRICT, AND ALL OTHER INTERESTED AGENCIES IN ADDRESSING THE ISSUE OF RAW SEWAGE SPILLS BY THE CITY OF VALDOSTA, GEORGIA. WHEREAS, since January 1, 2008, the City of Valdosta, Georgia has reported to the Georgia Environmental Protection Division multiple raw sewage discharges from its Withlacoochee Water Pollution Control Plant and Mud Creek Water Pollution Control Plan, both of which are located within the Suwannee River Basin; WHEREAS, pursuant to permits issued to the City of Valdosta by the Director of Georgia Environmental Protection Division, the City of Valdosta water pollution control plants are permitted to discharge treated wastewater into both the Withlacoochee River and Mud Creek so long as the wastewater is within certain regulatory limits set by the Georgia Environmental Protection Division; waterway; WHEREAS, the permits do not permit the discharge or spillage of raw sewage into any WHEREAS, the Withlacoochee River and Mud Creek both flow into and contribute to the flow of the Suwannee River, which is both an important ecological and environmental asset and a vital tourism feature of Madison County; WHEREAS, pollution of the Withlacoochee and Suwannee Rivers are a matter of great public interest as such pollution negatively impacts the quality of life for our citizens and visitors and threatens both the economic vitality and tourism appeal; WHEREAS, in 2013, the City of Valdosta and the Georgia Environmental Protection Division entered into a Consent Order whereby the City of Valdosta acknowledged in detail the raw sewage spills
42 that had occurred to that point, and the Consent Order imposed upon the City of Valdosta certain obligations under a five-year plan approved by the City of Valdosta City Council in April 2013 to prevent spills from occurring; WHEREAS, it is evident that the Consent Order and the City of Valdosta Five-Year Plan have failed to alleviate the cause or causes of spills of raw sewage into the Suwannee River Basin; WHEREAS, Madison County helped organize the Middle and Lower Suwannee River and Withlacoochee River Task Force, hereinafter referred to as the Task Force, under the direction of the North Central Florida Regional Planning Council, whose membership is comprised of a county commissioner from each of the 12 counties within the north central Florida region, to address the issue of raw sewage spills by the City of Valdosta into the Withlacoochee River and Mud Creek; and WHEREAS, it appears to the Madison County Board of County Commissioners that more immediate and decisive action is necessary to protect Madison County s natural resources and interest in maintaining a high quality of life for our citizens and enjoyment of the area for residents and visitors. NOW, THEREFORE, BE IT RESOLVED by the Madison County Board of County Commissioners that: 1. Madison County finds unacceptable and intolerable the repeated raw sewage spills by the City of Valdosta from its Withlacoochee and Mud Creek Water Pollution Control Plants. 2. Madison County find that the implementation of the Consent Order has not corrected this persistent problem. 3. Madison County requests that the City of Valdosta notify all downstream governmental entities within 12 hours of a spill so they can alert citizens to the impending public health hazard. 4. Madison County requests the State of Florida, the Florida Department of Environmental Protection, the Suwannee River Water Management District, and all other similarly situated agencies and entities with the authority to act, to join Madison County is addressing raw sewage spills by the City of Valdosta into the Withlacoochee River and Mud Creek. 5. Madison County requests that the State of Florida, the Florida Department of Environmental Protection, the Suwannee River Water Management District, and the United States Environmental Protection Agency carefully examine the conduct of the City of Valdosta, the
43 State of Georgia, and any other parties to the operation of the City of Valdosta Withlacoochee and Mud Greek Pollution Control Plants and to take any and all necessary and proper actions to ensure spills of raw sewage into these waterways come to a lasting end. 6. Madison County requests the Florida Federal Delegation to partner with the State of Georgia to obtain funding to fix the issues so that raw sewage spills will be eliminated. 7. Madison County requests funds be made available to reclaim our status as a world-renonwed tourist destination and promote tourism of our natural resources in Madison County. RESOLVED this 13 th day of March 2019, in regular session, by the Madison County Board of County Commissioners.
