1 SHIAWASSEE COUNTY PLANNING COMMISSION PUBLIC HEARING/BOARD MINUTES OCTOBER 25, 2017 Call to Order: Bonnie Ott called the regularly scheduled monthly public hearing of the Shiawassee County Planning Commission to order at 7:00 P.M. on October 25 th, The hearing was held within the County Board of Commissioners meeting room located on the first floor of the Surbeck Building, 201 N. Shiawassee Street, in Corunna, MI. Roll Call: Present: Walt Saxton, Robert Ebmeyer, Michael Bruff, Steve Andrews, Thomas Foster and Bonnie Ott. Absent: Bonnie Reno. Also present: Matthew Lafferty, Land Use Planner and Michael Daly-Martin, Assistant Planner. Excused Absences: Motion: Saxton motioned to excuse Bonnie Reno. Support: Foster Motion Carried: 6 ayes, 0 nays. Pledge of Allegiance: Ott led the Pledge of Allegiance to the Flag. Proof of Publication: The board was informed that a legal notice of the scheduled hearing was placed within the North and South zones Shiawassee County Independent Newspaper on Sunday, October 8 th, Ott declared the hearing as legally noticed. Approval of the Agenda: Motion: Bruff moved to approve the agenda as printed. Support: Saxton. Motion Carried: 6 ayes, 0 nays. Approval of Board Minutes: Ott noted an error on page 2 of the September 28 th Planning Commission Meeting Minutes. Motion: Saxton moved to approve the September 28 th, 2017 Planning Commission Meeting Minutes with changes to page two. Support: Bruff. Motion carried: 6 ayes, 0 nays. Board of Commissioner Comments: Bruff stated that during the previous Board of Commissioners meeting Preston approached the board to ask for an extension of the Wind Energy Conversion Systems moratorium. This would extend from January 1, 2017 to June 1, Call to the Public on Non-Agenda Items: None at this time. Old Business: None. New Business: a. Application Request #PREZ Applicant Alec Faber Owner Fitness Coliseum, LLC (Alec Faber) Site Location 4377 S. M-52, Owosso, MI Page 1 of 5

2 Tax ID#: (a portion thereof); Section 10, Bennington Township Request Map amendment approval for the rezoning of a portion of property from the A-2, Agricultural Production/Rural Residential district to the B-2, General Business district. Action Needed A recommendation to the Shiawassee County Board of Commissioners. Ott opened the public hearing. Preston provided the staff report. Alec Faber, the applicant, stated that Bennington Hills Golf Course was established in 1971 and ran for decades. Alec noted that he purchased this property and wanted to revitalize it. His vision is to bring in corporate clientele for wellness programs and integrate the event center into his existing business. Alec stated, currently we have 4 miles of trails that could be adapted for a variety of uses. He continued, we re really trying to benefit ourselves and our neighbors by bringing people into the area, we need to rezone this property to construct the wedding venue and we re really trying to accommodate our neighbors. Ott called for comments in support of the proposal. Jim Woodworth, resident of Bennington Township, spoke in support of the applicant. Robert Meiers, resident of Bennington Township, spoke in support of the applicant. Bret Ruess, resident of Bennington Township, spoke in support of the applicant. Kim Sprague, resident of Bennington Township, spoke in support of the applicant. Sam McLaney resident of Bennington Township, spoke in support of the applicant. Justin Horvath, SEDC, spoke in support of the applicant. Brandon Podolak, resident of Bennington Township, spoke in support of the applicant. Ott called for comments in opposition to the proposal. None at this time. Ott called for comments from the Township. Matt Dutcher, representative of the Bennington Township Board, stated that the Township recommended denial of the proposal because it didn t meet the land use plan. He explained that the Township currently has 20 acres of B-2 land and to add 37 acres of B-2 would be a significant increase that. Mr. Dutcher noted that Bennington Township was working on updating its future land use plan and it would be appropriate to consider adding additional B-2 property throughout the update. Ott called for the applicant s rebuttal. None was heard. Ott closed the public hearing. The board deliberated. Motion: Andrews motions to recommended that the Shiawassee County Board of Commissioners approve PREZ17-003, FABER, the petition to amend the zoning district from A-2, Agricultural Production/Rural Residential to B-2, General Business district for a portion Page 2 of 5

3 of property located in Section 10 of Bennington Township (Parcel ID # , a portion thereof) as legally described in the petition based on the following reasoning and conditions: Reasoning: 1. The ten (10) finding of fact outlined in Section 19.5 as detailed in the staff report have been met. Second: Ebmeyer. Roll Call Vote: Ayes: Robert Ebmeyer, Steve Andrews, Michael Bruff, Thomas Foster, Walt Saxton, and Bonnie Ott. Nays: None. Motion Passed: 6-ayes, 0-nays. b. Application Request #PSPR Applicant Telecad Wireless Site Design, as Agent for Skyway Towers, LLC Owner Ron & Paulette Riley Site Location 5370 E. Riley Rd., Owosso, MI Tax ID# , Section 25, New Haven Township. Request To amend the site plan associated with PSUP15-09, to eliminate condition 4, associated with the special use permit and site plan approval, which requires the applicant to include buffering that has 6 Spruce trees all around the leased area. Ott opened the public hearing. Daly-Martin provided the staff report. Andy Webber, representing the applicant, stated that the company would like to take the landowner s priorities into concern. Ron Riley, the landowner, noted that he would not intentionally spray the trees but does spray the weeds surrounding them. Mr. Wood also noted his concern with tree roots destroying his recently tiled field. Ott called for comments in support of the proposal. None was heard. Ott called for comments in opposition to the proposal. Terry Wood, nearby property owner, noted that he would like to see some kind of buffering surrounding the tower. Ott called for comments from the Township. New Haven Township Planning Commission sent a letter in support of the applicant. The board deliberated. Page 3 of 5

4 Motion: Andrews motions to approve PSPR17-002, TELECAD WIRELESS, an application for to amend the Site Plan of PSUP15-09, Skyway Towers, request for a 240' self-supporting lattice type communication tower, a 10 by 11 (110-sf) equipment shelter, a 1,000 gallon propane tank and a propane-powered emergency generator within a 100 by 100 (10,000-sf) leased area, as submitted Telecad Wireless on behalf of Skyway Towers, to be located on the south side of E. Riley Rd., and as legally described in Section 25 of New Haven Township (Parent Tax I.D ) based on the following reasoning and conditions: Reasoning 1. Requirements and standards set forth under Article 14 of the Ordinance have been or can be met subject to the conditions set forth below. 2. The lack of buffering via spruce trees is not anticipated to cause undue impact, nor change the essential character of previous approvals. 3. The property owner has stated that spraying the farm field would kill the spruce trees and keeping them would be detrimental to the farm land. 4. Any additional reasoning as set forth by members of the Site Plan Review Committee. Conditions 1. The removed landscaping must be replaced with some type of opaque material, acceptable to the Shiawassee County Community Development Department, in order to obscure the view of the structure. Second: Ebmeyer. Roll Call Vote: Ayes: Walt Saxton, Robert Ebmeyer, Steve Andrews, Michael Bruff, Thomas Foster and Bonnie Ott. Nays: None. Motion Passed: 6-ayes, 0-nays. Committee Reports: Ordinance Review: None at this time. Future Land Use: None at this time. Parks and Recreation: None at this time. Gravel Committee: Preston stated that staff was unable to secure site visits due to a variety of reasons, but considering the time of year it seems to be appropriate to seek visits in Communications Received: None at this time. Directors Comments: The Board of Commissioners will be taking on a possible extension of the Wind Energy Conversion Systems moratorium and this is due to the fact that we re still receiving comments from townships and developers. In order to assess those comments properly Community Development will need additional time. Public Comments: Justin Horvath, stated that he was very pleased with the discussion tonight and noted that more development is coming. The rezoning that happened tonight was a good Page 4 of 5

5 example of that. As a County we should try and be proactive and address areas of expected development, particularly those surrounding state highways. Brian Martindale, resident of Venice Township, noted that Muzzy Farms held no zombie paintball this year. Their Special Use Permit noted that if they re inactive for a period of more than a year it expires, correct? Preston stated, yes that is correct. We will notify the owners of Muzzy Farms that their Special Use Permit is expired and copy the Township within that correspondence. Adjournment: Motion: Andrews moved to adjourn. Support: Bruff. Motion carried: 7 ayes, 0 nays. The public hearing adjourned at approximately 8:44 P.M.
