1 SHIAWASSEE COUNTY PLANNING COMMISSION PUBLIC HEARING/BOARD MINUTES JANUARY 25, 2017 Call to Order: William Thelen called the regularly scheduled monthly public hearing of the Shiawassee County Planning Commission to order at 7:00 P.M. on January 25 th, The hearing was held within the County Board of Commissioners meeting room located on the first floor of the Surbeck Building, 201 N. Shiawassee Street, in Corunna, MI. Roll Call: Present: Steve Andrews, Bonnie Reno, Walt Saxton, Robert Ebmeyer, Michael Bruff, Bonnie Ott, and William Thelen. Absent: None Also present: Use Planner. Peter Preston, Community Development Director and Matthew Lafferty, Land Excused Absences: None. Pledge of Allegiance: Thelen led the Pledge of Allegiance to the Flag. Proof of Publication: The board was informed that a legal notice of the scheduled hearing was placed within the Shiawassee County Independent Newspaper on January 8 th, Thelen declared the hearing as legally noticed. Election of Officers: Motion: Ebmeyer nominated William Thelen for the position of Chairman of the Planning Commission. Support: Reno. Motion Carried: 7 ayes, 0 nays. Motion: Andrews nominated Bonnie Ott for the position of Vice Chairman of the Planning Commission. Support: Ebmeyer Motion Carried: 7 ayes, 0 nays. Board of Commissioner Comments: Thelen stated that he would like to thank the newest Planning Commission member and Board of Commissioner, Michael Bruff, for being in attendance. Mr. Bruff stated that the Board of Commissioners recently finalized their one year moratorium on Wind Energy Conversion Systems. Call to the Public on Non-Agenda Items: None heard. 2 a. Application Request #PSUP16-13 Applicant John Gall, District Manager, 9536 E. Lennon Rd., Lennon, MI Property Owner Waste Management of Michigan, Inc. Site Location Southwest of Venice Park Recycling and Disposal Facility. Tax Id.# , Section 27, Venice Township. Request Special Use Permit and Site Plan Review approval for a surface mine also known as a Soil Borrow Area for Venice Park Recycling and Disposal Facility. Ordinance Reference Section , (Surface Mining) Thelen opened the public hearing. Lafferty presented the staff report. Thelen asked the applicant to explain the proposal and why it should be approved. Tami Gibbons, of Lymar Consultant Group (representing the applicant, Waste Management), stated that the proposed project is necessary because the Michigan Department of Environmental Quality requires daily covering and capping of landfill waste with soil. Soil boring tests are currently being finalized and results will be distributed to the Community Development Department. Lafferty then presented a letter from Mr. and Mrs. Nicholas Shewalter, residents of Venice Township, in support of the applicant. The letter also asked whether the proposal would change the intake of the landfill from low-volume to high-volume and whether disturbing the soils (through the proposed mining operation) would affect local aquifers. Tami Gibbons, representing the applicant, then stated that soil boring tests through the Michigan Department of Environmental Quality are being administered to ensure local aquifer safety, but it is not expected that the proposed soil borrow will affect local wells. The proposal is also not expected to affect the waste acceptance rate. Thelen asked if there was anyone in the audience in opposition to the proposal, and heard none. Thelen then called for comments from Venice Township. Brian Martindale, Chairman of the Venice Township Planning Commission, read a letter recommending conditional approval of PSUP16-13, if temporary fencing remain not less than four (4) feet in height and landscaping along the western property line be maintained and replaced as needed. Bruff stated that the proposal showed a forty (40) foot excavation depth once the proposed mining process is complete, would this be a pond? Tami Gibbons stated that the operation would take between thirty (30) and thirty five (35) years to complete, but at that time it is expected the former mining area would be a pond. Thelen closed the public hearing. Thelen asked staff to recite the criteria of approval for a special use permit. Page 2 of 13
3 Lafferty stated the general standards for approval of a special land use permit. Andrews asked whether this site will be turned into housing when proposed soil borrow is complete? Tami Gibbons, stated that she does not know the intended use of the site following completion of the proposal, at this time. Ott asked if there were any other soil borrow areas, in the vicinity of the landfill, currently being used. Tami Gibbons, stated that the landfill is not currently using any off site soil borrow areas. Saxton asked whether the four (4) foot fencing could be made any taller. Tami Gibbons, stated that a four (4) foot fence will be temporary, and a permanent six (6) foot fence will be constructed around the perimeter of the site following completion of the project. Motion: Reno motioned to approve the Special Land Use Permit/Final Site Plan, PSUP16-13, Waste Management of Michigan, Inc., request for a surface mine also known as a Soil Borrow Area for the Venice Park Recycling and Disposal Facility, to be located on the north side of Lytle Rd., and as legally described in Section 27 of Venice Township (Tax I.D. # ) based on the following reasoning and conditions: Reasoning: 1. Subject to the conditions provided below, it is found that the petitioned special use permit for a surface mine meets the general standards as provided for in Article 12 of the Ordinance. 2. Subject to the conditions provided below, it is found that the petitioned site plan for a surface mine meets the general standards as provided for in Article 14 and specific use standards set forth under Section Conditions: 1. Provide information as noted by this staff report as having not been provided for on the site plan or in supplemental information. Compliance shall be determined by the Community Development Director prior to the issuing of permits or authorization of construction of the petitioned use. 2. Compliance with the provisions of the Zoning Ordinance shall be determined by the Community Development Director prior to the issuing of permits or authorization of construction of the petitioned use. 4 3. Temporary fencing will be maintained at a minimum height of four (4) feet. 4. Current landscaping, used as buffering along the western property line, shall be maintained and replaced as needed for the life of the use. Motion carries: 7 ayes, 0 nays. b. Application Request #PSUP16-14 Applicant Prolime Ag Services c/o Robert V. Rogers; Van Dyke, Washington, MI Property Owner Pine View Mining Development (Robert V. Rogers) Site Location 9542 W. Beard Rd., Laingsburg, MI Tax Id.# , Section 21, Woodhull Township. Request Special Land Use & Site Plan approval for an Agricultural Services Establishment also known as an Agricultural Pelletizing Facility. Ordinance Reference Section (Agricultural Service Establishment) Thelen opened the public hearing. Preston then presented the staff report. Thelen asked for the applicant s statement. Bob Rogers, CEO of Prolime, stated that his company processes lime for agricultural use as well as concrete crushing when road work on I- 69 requires it. On-site, a Special Use Permit for surface mining has been in place since 1969 and Prolime has been operating out of its Beard Rd. location since May of Currently Prolime imports lime from water treatment plants (lime is a byproduct of the water softening process) and lays the product out for natural drying to occur. The dried lime that is produced is then spread on fields to adjust the PH of the soil and increase crop yields. Over the years farming has developed with new technology. Farmers now use equipment which can measure soil content and know exactly how much fertilizer and other agricultural products to use in various areas of a cultivated field. By pelletizing the lime, it can be applied more precisely which will help eliminate run-off and will save farmers money. The closest plant which produces a pelletized lime product is 350 miles away, in Ohio, and if this proposal is approved it will be the first of its kind in Michigan. Mr. Rogers then stated that his proposal has the support of the Regional Chamber of Commerce, local farmers, and some neighbors. If the proposal is approved Mr. Rogers would like to be operational by the fall or winter of Mr. Rogers then stated that Prolime has always tried to be good neighbors and address issues as they arise. At the Woodhull Township Planning Commission meeting, there were complaints regarding a few issues. One was regarding odor associated with the business. Lime is and odorless product. Another was the business s effects on neighboring water quality. Mr. Rogers then read a letter from the Shiawassee County Health Department stating that there have been no health affects to neighboring water sources from Prolime s activity. Mr. Rogers then stated that the site in question was a sand mine for over thirty (30) years and at its height serviced approximately sixty (60) trucks daily using designated routes. He then stated that Prolime is regulated not only by the Shiawassee County Health Department, but the Michigan Department of Environmental Quality and Air Quality Division, Page 4 of 13
5 by the Shiawassee County Road Commission through designated trucking routes, as well as the Michigan Department of Transportation. Mr. Rogers stated that we re not the original owners of the site, but we ve heard that residents have complained about dust. We don t believe that our neighbors should have to deal with dust and we will be installing a tire washing station to address that issue. Mr. Rogers noted that he wanted to explain his process and keep it simple. The lime comes in wet, like Crisco, and we dry it out. The wet product would go into the proposed facility into a large dryer which spins the product around. Then a material, similar to tree sap, is added to the lime (which is spinning) and forces the product clump together in pellet form. The newly created lime pellets then go into another dryer which hardens them to retain their desired shape. Reno asked what the hours of operation would be if the proposal is approved. Mr. Rogers stated that in this industry there is a big push for product in the spring and fall, so we ll work whatever hours we need to fulfill an order. I would hire 15 to 20 people right off the bat, and would like to see 20 to 30 employees eventually. Bruff stated that his concern is with noise, will there be any noise produced? Mr. Rogers stated that no noise is produced because it is contained in a building. Inside the building noise levels will comply with OSHA requirements. Bruff asked if there was any dust produced. Mr. Rogers stated that dust is only produced from trucking in the material, not from the proposed process. Thelen called for comments in support of the applicant. Norm Tannis, of Imlay City, Michigan, stated that his company currently imports pelletized lime from Ohio and would rather buy from a local source. Chris Eveleth, Mayor of Owosso, stated that agriculture was the only industry that held Michigan afloat during its down years. We have almost no agricultural processing in Michigan and we can bring good paying jobs in with businesses like this. It would send a message that Shiawassee County is open for business. I can t say enough in favor of this project. Russell Hauser, resident at 9637 Beard Rd., stated that this proposal would be a good idea because it would be better for farmers, it would cut down on fertilizer run-off, and would create jobs. Gordon Hauser, resident at Woodbury Rd., stated that he is in support of the applicant, that Prolime has been good neighbors and thinks the development would benefit the community. He states that his property is the closest to the proposed facility and doesn t think the noise will bother him. Page 5 of 13
6 Randy Beebe, concerned citizen, stated that Prolime is trying to expand in a way that s taking residential concerns into account. It seems like a good way to expand the economy. Jason Rogers, son of the applicant, stated that there will be no waste created from this product and the proposed facility should not be seen as a factory, but rather a refinery to recycle waste. Prolime is not the only party to benefit from this project and will make a positive community impact. Jeff Desen, of the Regional Chamber of Commerce, stated that his organization has been trying to sell the geography of Shiawassee County and this proposal is a prime example of that. Thelen then called for comments in opposition to the applicant. Jim Brehm, of 9535 W. Beard Rd., asked what this proposal will do to property taxes? Would anyone want to have 3 shifts and 60 to 70 trucks going in and out of residential area every day? There are many issues that we aren t looking at. I am firmly against this proposal. Nicholas Kleinhardt, of 9529 W. Beard Rd., stated that he s concerned about the noise. The applicant said that there will be no noise, but what about equipment noise? Will consumers need to update their facility? I am concerned about specifics and decibel levels. Elaine Curtis, of 9060 W. Beard Rd., stated that Mr. Rogers recently purchased a wetland adjacent to her property and wants to know what they will do with it. Will Prolime use the driveway next to my house? Also how will they do background checks on new employees for the proposed use? I ve heard that Prolime is known to hire former prisoners. Gwen Gates, of 9545 W. Beard Rd., presented a poster board with pictures of gradiences seemingly caused by Prolime. Ms. Gates stated that she has spoken to neighbors about Prolime s proposal and that many were opposed to it. She further stated that Prolime was originally going to reclaim the mine site and put houses on the property. Residents have had lime affect their shower heads and it s all over the roads. Ms. Gates noted that she moved out to Beard Rd. because it was a rural residential area, this proposal needs to be in an industrial area. Melissa Moorehead, of 9511 Beard Rd., stated that there s some discrepancies about how this proposal is discussed. If this proposal is successful and business is well then that will pull in more contracts and more lime. Mr. Rogers stated that there will be no increase from traffic in the past, but that is the intent of the business. The hours of operation would also likely be increased and that is a concern to me too. We ve heard a lot from neighbors on Beard Rd. tonight and we worry about excessive traffic. No matter how great this process is it will increase the cost to local residents. Mike Allen, concerned citizen, stated that he s lived off of Beard Rd. for 50 years. What makes this a class A road? Thelen stated that would be up to the digression of the Shiawassee County Road Commission. Page 6 of 13
7 Greg Gates, of 9545 Beard Rd., stated that he lives across the street and historically the site in question has been a mess with liquid lime all over the road. Mr. Gates noted that he had to install an air conditioning unit because opening the windows in the summer causes lime to get into the house. Jim Stoddard, of 9511 Beard Rd. noted that the strategic planning for the area is residential. Mr. Stoddard then stated that he understands there will be new jobs created if the proposal is approved but who takes care of the road when truck traffic increases? Carol Maize, of 9053 Beard Rd., stated that Prolime already has other special use permits and this will be the third one. The more permits you give them the more activity there is. Even though this area is zoned agricultural it is truly a residential area. John Isham, of 9380 Beard Rd., stated that Prolime is right in his back yard and when he moved into the area 35 years ago they weren t an issue. About 15 years ago, they started to cause some trouble with lime on the roads and not maintaining their property near the road. Now they re talking about putting in a factory with new employees, and maybe 30 people. What kind of issues will that create? Eugene Stek, of 9515 Beard Rd., stated that he had his original well water pump plugged up due to lime. He then had another well installed and had lime issues with that too. Ken Barber, of 9120 Beard Rd., stated that he lives on the east side of Prolime and the noise drives him crazy. Mr. Barber noted that he doesn t want to see a development like this in his neighborhood. Thelen then called for comments from Woodhull Township. Charles Scovill, Chairman of the Woodhull Township Planning Commission, presented the Woodhull Township Future Land Use Map and stated that the area in question is designated as Low-Density Residential use. Mr. Scovill mentioned that 6 out of the 8 that spoke in support of the proposal do not live in the Township. The Township Planning Commission and Township Board unanimously denied the proposal due to: the incongruous nature of the proposal in a rural area, the intensity of use associated with 3 special use permits, excessive traffic, noise, dust and odor associated with the development, and lack of law enforcement in the area making enforcement on site difficult. Mr. Scovill noted that he appreciated the product but thought the site was wrong for the proposal. Thelen asked for the applicant s rebuttal. Mr. Rogers stated that the 17-acres in question was purchased for recreation. There was already an existing driveway there and it would never be used for the proposal. Gas utilities will be upgraded due to this development (paid for by Prolime) which would benefit surrounding neighbors. He noted that background checks are done on all of Prolime s employees and at times in the past Mr. Rogers stated he has hired ex criminals because sometimes people get down on their luck and everyone deserves a second chance. Under the current zoning for the site they want to continue what they are doing. Thelen asked for rebuttal from a representative of the opposition. Charles Scovill stated that the residents have spoken for themselves and there was no need for a rebuttal. Page 7 of 13
8 Thelen then closed the public hearing. Andrews noted a brief history of the site in question and stated his concerns the proposal due to issues associated with increased traffic in the area. Ott asked staff to read the section of the Shiawassee County Zoning Ordinance ( Ordinance ) pertaining to the proposed special use permit. Preston recited a portion of Section of the Ordinance. Thelen stated that this site is zoned A-2 and he personally believes that Prolime is within their zoning rights to move forward with this development. Thelen then stated that he grows crops, but that doesn t mean that he grows the seeds for those crops. This proposal is similar, only we re talking about lime and not seeds. If Prolime is within their rights to put a few hundred head of cattle on this site without a permit, then the proposed use should also be approved. Saxton asked, would it be possible to load trucks inside? Also do you plan on working 3 shifts if possible? Mr. Rogers stated that he didn t think loading could be done inside and that his employees will need to work all they can to pay off the bank. Reno noted that she had a few questions about other driveways on site, will those be used? Mr. Rogers stated that the other driveways will not be used. Bruff asked Mr. Scovill, why was it a unanimous vote to deny the proposal by the Township Planning Commission and Board? Mr. Scovill responded that the Planning Commission tries to be a fact-based board. If a special use permit is approved it has to pass all 8 of the listed standards for approval. Bruff asked the applicant if there was any other place in the County to put this development. Mr. Rogers responded, no and that he did not own another suitable piece of land for this project in the County. Andrews then stated that the Planning Commission has to follow zoning laws, but that they also have a responsibility to listen to the concerns of the residents. 1) Preston read the standards of approval. The special use shall be designed, constructed, operated, and maintained in a manner harmonious with the character of adjacent property and the surrounding area. (Staff Comments) The petitioned use is proposed in a predominately agriculturally zoned area, heavily wooded, with some scattered singlefamily residential structures. To the northeast is Moon Lake surrounded by heavily wooded area and to the west is the State of Michigan owned, Rose Lake Wildlife Area, Page 8 of 13
9 and cultivated farmland. The nearest residential dwelling is to be approximately 54 from the eastern property line of the site s access drive. voted in approval, 4 ayes to 3 nays. 2) Preston continued, the special use shall not inappropriately change the essential character of the surrounding area. (Staff Comments) Again, the petitioned use is proposed in a predominately agriculturally zoned area, heavily wooded, with some scattered singlefamily residential structures. To the northeast is Moon Lake surrounded by heavily wooded area and to the west is the State of Michigan owned, Rose Lake Wildlife Area, and cultivated farmland. The site has been used for a variety of purposes over a number of years under special land use approval. The proposed use is not anticipated to be outside of the parameters outlined in the Ordinance for such uses. voted in approval, 5 ayes to 2 nays. 3) Preston continued, the special use shall represent an improvement to the use or character of the property under consideration and the surrounding area in general, yet also is in keeping with the natural character and environmental quality of the site. (Staff Comments) Again, the petitioned use is proposed in a predominately agriculturally zoned area, heavily wooded, with some scattered single-family residential structures. To the northeast is Moon Lake surrounded by heavily wooded area and to the west is the State of Michigan owned, Rose Lake Wildlife Area, and cultivated farmland. The site has been used for a variety of purposes over a number of years under special land use approval. The proposed use is not anticipated to be outside of the parameters outlined in the Ordinance for such uses. Review by other agencies, such as the Drain Commission and the Health Department, are intended to address environmental issues that may be present. voted in disapproval, 0 ayes to 7 nays. 4) Preston continued, the special use shall not be hazardous to adjacent property or involve use, activities, materials or equipment which will be detrimental to the health, safety, or welfare of persons or property through the excessive production of traffic, noise, smoke, odor, ground vibration, water runoff, fumes, light, or glare. (Staff Comments) The petitioned facility is not anticipated to generate off-site impacts as described under this item as long as the standards of the Ordinance are adhered to. Under Item 3 of the staff report, the applicant is requested to provide additional information. voted in disapproval, 3 ayes to 4 nays. Page 9 of 13
10 5) Preston continued, the special use shall be adequately served by essential public facilities and services, or it shall be demonstrated that the person responsible for the proposed special use shall be able to continually provide adequately for the services and facilities deemed essential to the special use under consideration. (Staff Comments) Other than general services such as police, fire and emergency services, no additional public facilities are anticipated to be necessary. voted in approval, 7 ayes to 0 nays. 6) Preston continued, the special use shall not place demands on public services and facilities in excess of current capacity unless planned improvements have already been scheduled for completion. (Staff Comments) Subject to providing outstanding information, the petitioned use appears to be consistent with the allowable uses of the underlying zoning district and designation for this property under the Shiawassee County Future Land Use Plan. Please see discussion under Item 2.1 above. voted in disapproval, 2 ayes to 5 nays. 8) Preston continued, for special uses in the A-1, A-1½, A-2 Districts, approval of a permit shall be further determined on the basis of the proposed land use s effect on a loss of prime agricultural land or on the right-to-farm of any adjacent farm. (Staff Comments) The petitioned use does not appear to impact the use of any adjacent farmland. voted in approval, 7 ayes to 0 nays. Bruff asked what the standards of approval were as well as the vote tallies following each standard were intended to do. Preston stated that the standards for approval are a guideline for Planning Commission members to weigh different sides of a proposal before voting on them. Preston further stated that taking official tallies after each standard personally makes him nervous. Each Planning Commission member s vote should be a decision based on the cumulative evidence of each proposal rather than strict adherence to this list of questions. Page 10 of 13
11 Ott then stated that the standards of approval help her think of an issue from a different prospective. Ott further stated that there have been many times that she feels one way about an issue personally and then decides to vote a different way for the community. Motion: Saxton motions to table PSUP16-14, PROLIME, Special Land Use Permit/Final Site Plan request for an Agricultural Service Establishment to be located in Section 21 of Woodhull Township (Parcel Id. # ) based on the following reasoning: 1. Additional clarification and information is necessary to ascertain if the proposed development meets the provisions of the Zoning Ordinance, including those provisions set forth in Article 12, Article 14 and Section Motion dies due to lack of support. Motion: Ebmeyer motions to deny PSUP16-14, PROLIME, Special Land Use Permit/Final Site Plan request for an Agricultural Service Establishment to be located in Section 21 of Woodhull Township (Parcel Id. # ) based on the following reasoning: 1. It is found that the petitioned special land use does not meet the general standards as provided for in Article 12 of the Ordinance. 2. Reno was appointed to the Parks and Recreation Committee and Future Land Use Committee. Saxton was appointed to the Future Land Use Committee and Gravel Committee. Andrews was appointed to the Ordinance Review Committee. Committee Reports: Ordinance Review: Preston read a memo regarding Wind Energy Conversion Systems ( WECS ). On January 12, 2017, the Shiawassee County Board of Commissioners voted to approve a one year moratorium on WECS. Preston s memo outlined a timeline of revisions to the WECS ordinance to be accomplished by staff. Preston also stated that each stage of the rewrite process for WECS will be open to the public at County Planning Commission meetings. Gene Ruess, of 8261 Mason Rd, stated that a lot of the material in question is complex and a 3 minute time limit on public comment will make it hard to address important issues. Can the public choose a representative to speak for a longer period of time on their behalf? Page 11 of 13
12 Thelen stated that the three minute time limit is flexible and if a group wanted to pool their speaking time in order to allow a representative to speak for longer than that would be acceptable. Bruff stated that the public can contact any of the Planning Commission and Board of Commissioners to relay ideas on WECS. Future Land Use: None at this time. Parks and Recreation: Reno stated that next Monday there will be a special meeting of the Parks and Recreation board to discuss pursuing grant funding. Anyone who wants to attend is encouraged to do so. Gravel Committee: Preston noted that a request was received to transfer a Special Use Permit and Site Plan for V & S Development LLC, and High Grade Materials Company. It is recognized that a notary is required to certify this document. Motion: Saxton motions to forward the request to transfer Special Use Permit and Site Plan for V & S Development LLC, and High Grade Materials Company to legal counsel. Support: Reno Roll Call Vote: Ayes to approve: Walt Saxton, Bonnie Reno, Robert Ebmeyer, Steve Andrews,, Michael Bruff, Bonnie Ott, and William Thelen. Nays: None. Motion carries: 7 ayes, 0 nays. Communications Received: Rush Township moved to create a Township Planning Commission. Thelen asked staff to receive and place the document on file. How much weight does our opinion hold when it comes to developing new language? Preston stated that staff wants public input, particularly from Township Supervisors.
