1 AGNDAITM# I~ September 9,2014 MMORANDUM Interviews September 4,2014 TO: FROM: SUBJCT: County Council Linda Lauer, Clerk Board ofappeals - Interviews for Member and Chair The Council received four applications to the Board ofappeals from persons seeking to fill the expiring term of Catherine Titus. Three others were received but are ineligible because of their party affiliation. The position can only be filled by a Republican, or by a voter who declines to affiliate with a party, or by a member ofanother party officially recognized by the Montgomery County Board oflections. Current members ofthe Board include Chair Catherine Titus (Republican), Vice Chair David Perdue (Unaffiliated), Stan Boyd (Democrat), John Pentecost (Democrat), and Carolyn Shawaker (Democrat). Once the Council appoints the new member, it then will appoint a Chair from among the members ofthe Board. The Council could select a current member ofthe Board to serve as Chair, or could designate the new member as Chair. Two current members ofthe Board have indicated interest in selection as the next Chair: Vice Chair David Perdue and Carolyn Shawaker. Mr. Perdue's second term will end in September 2015, and Ms. Shawaker's second term will end in September Their interviews will be held in the 3 rd floor conference room at 2:30 p.m. and will be televised. 5 c BOARD OF APPALS Created: Term: Purpose: Membership: Financial Disclosure: Compensation: Meetings: Current Members: Montgomery County Code, Sections through Section Four years. xercise functions and powers ofregional district as such functions and powers are prescribed in the Maryland-Washington Regional District Act (as revised and included in the new Land Use Article) to extent that such functions and powers are not vested in another administrative officer or agency. Hear and decide: all petitions for special exceptions, except as otherwise provided in County Code; all petitions for variances; and administrative appeals, including all appeals taken under the Building Code; all appeals concerning licenses for hospitals, sanitariums, nursing homes and care homes; and all appeals concerning licenses for private educational institutions. Also hear and decide appeals concerning: orders directing removal ofdiseased trees, orders concerning restaurant permits, licenses for places of amusement and amusement enterprises, the hotel license law, the plumbers and gas fitters license law and the Plumbing and Gas Fitting Code, the electrical contractors license law, and all other appeals as the Board may be authorized to hear from time to time by law, ordinance, or resolution. Five members, who must be residents ofthe County, are appointed by the County Council. No more than three members shall be from the same political party. The Chair is appointed by the Council. Public financial disclosure statements must be filed. Chair - $21,245.62; Member - $15, Both receive annual cost-of-living adjustments each December to reflect 50% ofthe change in the Washington Area Consumer Price Index. 6 Montgomery County Council For Immediate Release May 20, 2014 FOR INFORMATION: Anne Brown, N W S R L A S Montgomery Council Seeks Applicants for County Board of Appeals Deadline to Submit Applications Is Wednesday, July 16 ROCKVILL, Md., May 20, 2014-The Montgomery County Council is seeking applicants for a vacancy on the Montgomery County Board of Appeals. Catherine Titus's second term will expire in September She also serves as chair ofthe board. County law provides that the Council may designate a member ofthe Board for the position ofchair. The Council will select a new chair from among the current or new members ofthe board in conjunction with this appointment process. Applications for the position must be received no later than 5 p.m. on Wednesday, July 16. Interviews for the vacancy are anticipated to be scheduled in September. By law no more than three members ofthe board shall be from the same political party. The position can only be filled by a Republican or by a voter who declines to affiliate with a party; or by a member ofanother party officially recognized by the Montgomery County Board of lections. In addition to Ms. Titus (Republican), the other members of the board are John Pentecost (Democrat), David Perdue (declined to affiliate), Carolyn Shawaker (Democrat) and Stan Boyd (Democrat). (MOR)
7 Members of the board receive $15, annually, with the chair receiving $21, Salaries are adjusted annually each December to reflect 50 percent ofthe change in the Washington Area Consumer Price Index. Duties of the Board of Appeals include making decisions on most applications for special exceptions as provided in the Zoning Ordinance; hearing and deciding requests for variances from development standards contained in the Zoning Ordinance; and hearing appeals from certain administrative decisions rendered by county government agencies. The board normally holds weekly hearings all day Wednesday and worksessions every other week. If necessary to accommodate an extended caseload or continued hearings, the board schedules hearings on other weekdays. Members are expected to prepare for the hearings by reading the cases to be heard and to share the workload of drafting and editing opinions or to follow-up on investigations on specific cases. Members work approximately hours a week. The principal jurisdiction of the Board of Appeals (concerning special exceptions and variances under the Zoning Ordinance) does not include the municipalities of Barnesville, Brookeville, Gaithersburg, Laytonsville, Poolesville, Rockville and Washington Grove. The normal Council practice is not to appoint residents ofthose municipalities to the board. Letters expressing interest, including a resume listing professional and civic experience, political party affiliation, home and office telephone numbers and an address, should be addressed to: Council President Craig Rice, County Council Office, 100 Maryland Avenue, Rockville, Maryland or can be ed to county.council@montgomerycountymd.gov. Applications must be received no later than 5 p.m. on July 16. It is the Council's policy not to consider applications received after the deadline. After the application closing date Councilmembers will review the letters of application and select applicants for interviews, which will be held in September. Letters of application and resumes are made public as part of the appointment process. Interviews are open to the public and will be televised. A financial statement of assets, debts, income and family property interests will be required of all applicants. Only the appointed candidate will be required to make the financial statement available to the public. # # #
