How do you answer that without getting into a HUGE issue with someone that you still would like to have a relationship with after the election? You just have to say, it just doesn t work that way anymore. The Democrats of yesterday do not share the same core values and moral system than that of the Democrats, dare I say Socialcrats of today. Do you think John F. Kennedy would recognize his Democratic Party today? We need to reach out to those independent, nonpartisan voters who share more in common with our Conservative principles and point out that no matter if the person that they think is a good neighbor and will represent Nevada, Clark County, Las Vegas when they are in Washington, Reno or here in Clark County. Truth is they will fall in line and vote that Democratic, liberal, spend and tax way. We need to point out, that this midterm election is about taking care of Nevada! Taking care of our State with good Conservatives in the Senate Dean Heller, the House Crescent Hardy, Danny Tarkanian and Joyce Bentley. We need to support our Republican State Officers every single one! We need these strong leaders who will watch out for those bills that will raise our taxes, infringe on our freedoms and look out for our Nevada land! In Clark County we have strong Republicans running for County Commission let s take back control of the Commission and budget pending where it is needed most. Local representation for conservatives! Time is critical! You can help make a difference in this election! Volunteer at a call center ARW will have a Call Center Day soon, where we call go and make calls together. All our candidates need help with calling and walking. Most of all you can call your neighbors, friends and family and make sure that they are registered to vote. If they say yes and tell you that they are nonpartisan please encourage them to take a good look at each party platforms and then offer them a new voter registration form. We have a great August program planned for you. Congressional Candidates, information on Elections, and a couple of surprises speakers too. I look forward to seeing you all there. 6 Our Constitutional Rights Part 4 The First, Second and Fourth Amendments are the canaries in our constitutional coal mine. Why was the right to own and bear arms listed second in our Bill of Rights? Could it be that this was considered the next most important right? Like the First Amendment, this right is under attack today. It reads, A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed. Consider the first phrase, A well regulated Militia.... There's been a lot of debate over this since the 1980s. Most of that debate has been generated by people who have a particular agenda that ignores history. It has two key parts: the definition of the word militia and the phrase well-regulated. Some have claimed that militia refers to the National Guard. That ignores the fact that the founders had no idea of a National Guard. That's a modern invention. They could not have meant something they never thought of. What did the writers of the Bill of Rights mean by the word militia? The founders explained it meant, quote, the whole people. As the Supreme Court ruled, that makes it an individual right. In 1775, the first battle of our American Revolutionary War was about the right to own and bear arms. The British Army tried to confiscate the colonist's rifles, powder and a cannon at Lexington, Massachusetts. Those British troops were met by a group of citizens, mostly led there by their pastors. They were everyday people: farmers, pastors, store clerks and others. The militia were ordinary citizens. The next phrase is, being necessary to the security of a free State. Two key words are security and free. The security part was illustrated in World War II. Japanese Admiral Yamamoto, who planned and led the attack on Pearl Harbor in 1941, was asked by Japanese leadership if the Japanese should invade America after the American Navy was destroyed at Pearl Harbor. Yamamoto answer was no, saying, there would be a gun behind every blade of grass. He knew no foreign army could conquer a nation whose people freely owned arms. Every dictatorship in modern history began with disarming citizens. Several founders said that the day could come when all our rights could depend on our Second Amendment right.
7 A clear statement of this principle was in the 1850s Dred Scott decision of the US Supreme Court. A slave in the south sued for his freedom. The Supreme Court ruled against him, saying that if he were allowed to have rights, then he could own firearms. If he could own firearms, then he wouldn't be a slave anymore. Slaves can't have firearms. The last phrase says, the right of the people to keep and bear Arms, shall not be infringed. This shows that, (1) keeping and bearing arms is a personal right, and (2) the people, you and I, have this right. Infringed means interfering with our rights. The Third Amendment reads, No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law. This forbids the government from forcing us to have soldiers housed and fed in our homes, as the British Army did in colonial times. During colonial times, British soldiers could come into your home, take up residence, sleep in your bed and eat or take whatever they wanted. The Third Amendment was the end result. The Fourth Amendment is also under attack today by progressives. Here it is: The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. The matters of government mass surveillance, warrantless searches and seizures of property are all serious issues today. In colonial times, a British judge could issue a blanket warrant, allowing British troops to break into any home or business and confiscate whatever struck their fancy. These warrants specified no particular place or person to be searched nor what was to be sought. The Fourth Amendment resulted from this. The first part says we are to be secure from unreasonable searches and seizures. Thus the amendment allows reasonable searches and seizures. What's reasonable can vary. It continues with... no warrant shall issue, but upon probable cause. Probable cause is essential to be legal. Finally, it must be supported by oath or affirmation and be very specific about the places to be searched and what is expected to be found. Thus, law on the Fourth Amendment revolves around what's reasonable, probable cause and a very specific description of persons and places to be searched and what is expected to be found.
8 What's reasonable depends upon the circumstances. When I went through the San Bernardino Sheriff s Academy, much class time was spent on this. In general, all the Fourth Amendment restrictions apply to warrants. However, there are exigent circumstances that allow a search and seizure without a warrant. An exigent circumstance occurs when there's an emergency situation requiring swift action to prevent imminent danger to life, serious damage to property, to stop the immediate escape of a suspect, to prevent the destruction of evidence or for officer safety. For example, if an officer chases a suspect into a building, he's in hot pursuit and may continue. If the officer loses sight of the suspect for a while, he can't. If there's someone screaming in obvious fear and distress, an officer can enter a house if it seems like human life may be in jeopardy. Otherwise, a warrant is needed. I was once part of a door kick to save a lady's life when, as I peered though a window on a possible suicide call, I saw her arm laying still on the floor, poking out of a bedroom door. I bounce off the door twice before a much larger officer made it through. We saved her life. Pat downs in public are to preserve evidence and ensure officer safety. Officer safety is a given, but evidence searches need probable cause, or PC. There's a lot of case law on probable cause, so officers are extensively taught about this. Sometimes, all an officer has initially is his street smarts, called reasonable suspicion. He or she needs to build a string of increasingly likely causes that lead from one step to the next. It may start with some small observation. For example, an officer may smell marijuana smoke on a traffic stop. That's not actual evidence. It is, however, sufficient for a pat-down. The pat down reveals a small amount of the drug. With the suspect out of the car, the officer sees something suspicious poking out from under the driver's seat. That allows the officer to retrieve it. He finds a large bag of marijuana. Now he obtains permission to search the vehicle and finds heroin. Now it's a legitimate drug bust. The officer cannot just arbitrarily search the car. He is limited by the plain sight doctrine. If something is not in plain sight, he can't search without a warrant. More, the officer can only search where it's possible to find the specified object of a search. For example, an officer cannot search for a stolen TV set in a drawer, since a TV won't fit in a drawer. Seizure occurs when something is taken. In fact, in Nevada, if you are prevented from freely going your way after being detained for one hour, that is a seizure, or taking of your person and is then illegal without an arrest. If a search reveals contraband or an illegal item while searching for something else specified in a warrant, that object can be seized, but not used as evidence against the person.
9 Mass invasion of public privacy is, on its face, a violation of the Fourth Amendment. Again, this might be permitted by a court if that court determines that the circumstances constituted a greater need than your need for privacy. Thus, while we have a constitutional right to privacy, the wording of the Fourth Amendment protects us only when a search or seizure is unreasonable. Reasonable and unreasonable is another matter. Two things must be realized. First, the Bill of Rights originally applied only to the Federal government. The Fourteenth Amendment following the Civil War extended these rights to all levels of government everywhere. However, the Bill of Rights doesn't apply to civil matters not involving government. That's why much of the hollering over rights is based on ignorance, not constitutional law. Case law is another matter. Next time, we'll examine the rest of our Bill of Rights.
