1 ABOVE DERWENT PARISH COUNCIL Minute s of the Parish Council Meeting held on Wednesday 25 th July 2012 at 7.15.p.m. in the Stair Village Hall. PRESENT: Councillor Richard Kealey (RK) Chairman Councillors: Pauline Soulsby, () Don Thoburn (DT), Geoff Davidson, (GD), Helen Davies, (HD), Margaret Throp, (MT), Geoff Davies () Ken Rutland,(KR) Bob Kemp (BK) and Keith Harryman (KH). Cumbria County Councillor, Ron Munby & NT Ranger, Roy Henderson. 79 Apologies for Absence RESOLVED that the meeting receive apologies from Councillor Joe Bennett, (JB) and the reasons be noted. 80 Declarations of Interest No declarations advised 81 Minutes of Meeting RESOLVED that the Chairman be authorised to sign, as a correct record, the minutes of the Parish Council Meeting held on 20 th June 2012, and (pages 5-9). 82 Public Participation No members of the public in attendance, 83 National Trust Representative RESOLVED that the meeting receive a verbal report from Roy Henderson as follows: The NT are in the process of agreeing a Code of Conduct with the users of Stoneybeck Ghyll for Ghyll Scrambling noted this should cover Parking; Litter including items of clothing left in the ghyll; Using the area as a toilet; Changing regime to avoid semi-nudity. 84 National Park Representative No LDNPA representative present and nothing to report back, but noted that the gate at Thornthwaite Church had been replaced. 85 Consultations/Projects requiring action or decision RESOLVED that the new Code of Conduct be adopted subject to the Parish Council s decision that there be no Other Registerable Interests. 86 RESOLVED that for Above Derwent Parish Council there be no other registerable interests as defined by the Localism Act. 87 RESOLVED that the Financial Declaration form should be amended accordingly and completed and signed by all Councillors as soon as possible 88 RESOLVED that a Parish Referendum relating to MRWS is not practical at this stage, but may be considered when the timing is more appropriate. 89 RESOLVED that the Parish Council will clarify the statement made by Alan Ellis of the NDA at the last MRWS meeting that each Council could, if they felt it appropriate, only agree to proceed to stage 4 in relation to a specified part of their geographic area. If this is confirmed, clerk to e mail each councillor in Allerdale and Cumbria CC, and Judith Cooke of the LDNPA to make them aware of this. to work with 90 RESOLVED that the following councillors will endeavour to attend the MT all 10

2 CALC MRWS meeting on 29 th August (7.30pm Hunday Manor), following which any proposed final statement or representation will be drafted to be considered and approved at the next meeting on 5 th September: MT;;;RK & BK 91 RESOLVED that Councillor s phone numbers and photographs will be displayed on the website. All Councillors to e mail a digital photograph to. BK to assist if required. 92 RESOLVED that the Parish Council are supportive of the community initiative of exploring the viability of a Community Interest Store in Braithwaite, but that this should not be a Parish Council Project. 93 RESOLVED that Margaret Throp should be nominated as a Parish Council representative to be part of any management committee/steering group. 94 Ward Representatives RESOLVED that the meeting receive the following verbal report from Cumbria County Councillor, Ron Munby; Ron does not know when CCC Councillors will be discussing MRWS prior to the final decision and is unaware/unsure of the possibility of a partial agreement to proceed to Stage 4 as noted in Minute 89 above; Tourism income is already well down this year, further risks from the bad press of an underground repository will feature in the decision making; Concern that Connecting Cumbria will not be able to deliver Broadband to the required level to every rural area and the Braithwaite Exchange may be one that does not achieve the hoped for service. 95 RESOLVED that there be no report from Allerdale Borough Councillor, Tim Heslop, but that the empty house in Braithwaite remains empty if that continues to be the case after the end of July, clerk to report the matter to Mr Heslop for further action. 96 Action Reports/Updates from Councillors RESOLVED that the meeting received a verbal report from RK on speeding issues in Thornthwaite and a working party of RK, MT, DT, be set up to develop a Community Speedwatch Project for submission to PC Alan Taylor for approval 97 RESOLVED that after the removal of the No Parking Signs by persons unknown, will place leaflets on cars parking opposite Farmhouse Mews explaining that they are obstructing the highway; DT will measure the junction and will ask the police to monitor and enforce such obstructions. Matter to be considered further at September meeting. 98 RESOLVED that the Parish Council will not submit a response to the DEFRA Rights of Way Consultation 99 RESOLVED that the clerk will finalise the Parish Council response to the Allerdale Local Plan Consultation to include particular concerns about affordable housing, local occupancy conditions being robust; detrimental effect of second homes and over dependency on nuclear economy risking income from tourism and farming. 100 RESOLVED that the meeting receive a written report from on Connecting Cumbria along with confirmation of fears that the Braithwaite Exchange may be part of the suggested 10% that Superfast Broadband may not reach. 101 RESOLVED that the meeting receive the following verbal report from & HD from the CALC meeting of Allerdale Parishes: if the new power station goes ahead on the west coast, the current pylons would not be able to cope so a new set of larger pylons are proposed from the coast to the M6. These would not be in the National Park except close to the west coast. 102 RESOLVED that the meeting receive the following verbal reports from All 11 RK BK BK MT RK MT DT DT

3 Councillors in respect of progress with Village plans Newlands Good response to questionnaires and big turnout at the Valley meeting. Now in the process of analysing results Thornthwaite in process of verification of plan Braithwaite - written most of questions, aim to complete by end of July, then try on some guinea pigs before distribution to all. Portinscale making progress with questionnaire. There is an update on the website about Braithwaite, other areas to provide with updates for completion. 103 RESOLVED that the importance of any questions relating to housing needs should not be underestimated, particularly in the most populous areas of Portinscale and Braithwaite. and GD to meet to try to ensure a co-ordinated approach. 104 RESOLVED that Becx Carter be appointed to undertake work to draft the Newland Valley Plan and comment on/alter the Thornthwaite plan as advised, and if required, to assist with the other villages and whole plan. 105 Applications for Development RESOLVED that the following applications are received and the Parish Council delegate power to the clerk to submit observations to the Lake District National Park Authority, including the following:- Ref no. Suggest S106/parish council approval of tenants Further enquiries to be made re number of caravans covered. existing conditions consistent with current policy in any case 106 RESOLVED that in respect of Ravens Creek, it is noted that the wording of the clause re the roof has left the LDNPA with enforcement difficulties and the situation will be regularly monitored 107 Pre notified Village Matters RESOLVED that the meeting receive the following verbal report from RK re Thornthwaite flooding issues: CCC are in process of assessing the ongoing stability of the land above the village with particular reference to drainage and culverts; villagers are talking to EA re clearing of the beck (although EA currently maintaining this is not their responsibility, DT pointed out that they cleared it in 2009); Foul sewerage problem developed over the weekend of the flooding. The Parish Council will set up a meeting of PC, Forestry Commission and CCC Highways 108 RESOLVED that the application to the Neighbourhood Forum be for the full cost of a notice board in Stair. Clerk to complete form and arrange for it to be signed and submitted 109 Clerks Report RESOLVED to note Clerk s actions since the last meeting and to receive the following verbal report: new consultations have been received re Gritting/use of Red diesel (KH to review and summarise proposed response for consideration on 5/9/12) Cheque payments( & to review and summarise proposed response for consideration on 5/9/12) 110 RESOLVED: that there is insufficient time to respond fully to CCC Mineral GD KH 12

4 and Waste Consultation except to confirm PC opposition to an underground repository for radioactive waste; nothing to add to Parish Council s expressed views on Community Travel Plan re CCC Travel Strategy. 111 RESOLVED to note Clerk s actions outstanding: Locate minute of HA offer of islands on A66 from 1998 Update planning spreadsheet put on Word Continue to chase Housing Associations for full info re involvement in Ashcroft Community Plan overall plan of action/co-ordination CilCA portfolio 112 Correspondence Received RESOLVED to receive the 2 circulated digest of correspondence 113 RESOLVED to note the temporary TRO re closure of a bridleway in Whinlatter Forest due to flood issues 114 Highways Matters RESOLVED to update and resubmit Highways table of outstanding issues with particular reference to the following new matters: road sweeper is needed in Thornthwaite village/church Lane; the cattle grid at Sheepshanks is rotten; road surface Methodist Chapel to Braithwaite needs serious attention; bridge at RiggBeck has been damaged and has partially collapsed 115 RESOLVED that the draft Equal Opportunities Policy be approved with slight amendment and placed on the website 116 Police No Police in attendance RESOLVED that the meeting receive the following verbal report from the clerk: number of issues relating to flooding including a vehicle aquaplaning near Thornthwaite turning near Brackenhill; some traffic incidents; damage to tyres on a parked vehicle. The Parish Council noted that there is an increased risk of this sort of incident if there are ongoing incidents of inconsiderate parking causing an obstruction of the highway. 117 Financial Matters RESOLVED that the following payments for year ended 31 March 2013 be approved payee V.N. Thanks to Councillor Harryman for refreshments Meeting closed at 10.50pm Councillor Matters Chairman...JWB... Date...5/9/ Newlands Church burial ground is running out of space. There is an opportunity to buy some of a nearby field and a request that the PC could assist. KH will find out the figures and timescale involved. 2. There is a tree across the footpath from Thornthwaite towards Hope Memorial. HD will contact the landowner to advise. 3. Attention was drawn to a new Facebook page for Braithwaite Village, set up by a parishioner 4. A parishioner has drawn attention to the fact that there is no footpath on the road from Braithwaite round towards Thornthwaite (Middle Ruddings) noted. 14
