4 CITY OF GALESBURG Administration Operating Under Council Manager Government Since 1957 CITY COUNCIL MEETING City Manager s Report October 20, 2014 CONSENT AGENDA # Item Quit Claim Deed City staff recommends approving quit claim deed to the State of Illinois for a portion of East Main Street for the East Main Street Underpass project. There is a section of the existing roadway on the east side of the tracks south of the centerline of the roadway, that could not be determined who owned the property. In order to clear up ownership, the City will release any rights possibly held as owners. Item QCREDA The City Manager and Director of Community Development recommend approval of the resolution ceding the City s private activity bonding authority to the Quad Cities Regional Economic Development Authority. At this point, the City has no project on which these private activity bonds could be utilized. Item Appropriation of Funds City staff recommends approval of payment to Western Illinois Title Company for the purchase of properties located at 536, 587 and 663 East Main Street as well as the vacant lot east of 536 East Main Street in order to construct the East Main Street underpass project. Sufficient funds are available for the purchase. Item Bills Bills and Advanced Checks are submitted for approval; please direct questions to Gloria Osborn, Director of Finance and Information Systems. ORDINANCES AND RESOLUTIONS Item Festival Ordinance The City Manager, City Clerk, and the Liquor Advisory Commission recommend approval of this Ordinance adding Special Event License (Class P) to the Alcoholic Liquor Ordinance. This will allow alcoholic beverages on City property. The Liquor Advisory Commission has been investigating the possibility of a Special Event License for City-owned property where the host is a Merchants Association or civic, charitable or non-profit organization for several months. The Ordinance would allow the above mentioned groups to apply for a Special Event License, or Class P License, to host a festival, celebration, etc. where the consumption of alcohol would take place on the premises. All applications would be approved by the City Manager. There will be a $50 application fee and an additional $250 license fee for a non-merchants Association. (Final Reading). Item Public Participation The City Manager and City Clerk recommend approval of an ordinance regulating public comment as required by the Open Meetings Act. In January 2011, Public Act became effective amending the Open Meetings Act to permit any person an opportunity to address public officials by adding a Public Comment section to every agenda, including all boards and commissions. 5 CITY OF GALESBURG Administration Operating Under Council Manager Government Since 1957 municipalities must now have written rules established on public comments at all meetings and having a long-standing policy on public comment is not enough to meet this obligation. (Final Reading) Item Jurisdiction on Main Street Staff recommends approving a jurisdictional transfer agreement with the Illinois Department of Transportation (IDOT) for a portion of East Main Street. The section of East Main Street that is covered under the jurisdictional transfer begins just west of the ramps located west of Interstate 74 and extends westerly to the east driveway of the former Mobil gas station and near the Taco Bell driveway. The purpose of the jurisdictional transfer is to transfer maintenance of the street surface and right-of-way. This is being proposed to allow more flexibility and options for the East Main Streetscape Improvements Project proposed for this portion of East Main Street. IDOT staff suggested the City consider a jurisdictional transfer of this section of East Main Street. If the jurisdictional transfer is approved, the City would be able to install the various design features proposed in the East Main Streetscape Plan. Funds from TIF II will be utilized to rehabilitate this portion of East Main Street. The estimated cost for this project is approximately $328,000 for design services and the actual rehabilitation work. (Final Reading). Item Galesburg Historic Walking Tours Staff recommends approving a resolution authorizing the submittal of an application to fund the updating and reprinting of the Galesburg Historic Walking Tour Brochure. Each year funds are made available to Certified Local Governments (CLG) for preservation activities, including publications. The brochures were last updated in 1997, and the City is now out of brochures. The estimated cost to print 10,000 12,000 copies is $15,000. The CLG program would reimburse 70 percent. Sufficient funds are budgeted for the local share. Item Not to exceed 105 percent Staff recommends approving the resolution not to exceed a levy of 105 percent over the 2012 property tax levy extension. BIDS, PETITIONS AND COMMUNICATIONS CITY MANAGERS REPORT A. TAC Report B. Approved Special Events: a. Use of Lincoln Park Gazebo for wedding on May 30, MISCELLANEOUS BUSINESS (Agreements, Approvals, Etc.) Item Prairie Plot Staff recommends approval of the application to install a prairie plot at 1722 North Broad Street. There is no impact upon the budget. Item Development of Enterprise Zone Staff recommends approval of the contract submitted by PGAV Planners in the amount of $31,300 for professional services related to completion of an Enterprise Zone application. The changes to the Enterprise Zone program also removed the ability for future automatic extensions of the expiration date. It is not a given that a community with an existing enterprise zone will receive a Prepared by: TT Page 2 of 3

To be awarded an enterprise zone, a community must document their proposed zone meets or exceeds at least three of the ten new criteria qualifications that are in the new law. The more criteria that can be met, the higher the points will be awarded in the scoring of the application. Due to the extensive amount of research, data collection, documentation and analysis in the pre-application phase, an estimate from PGAV Planners was obtained for part of this work. Staff will also be involved, including the actual application preparation. Sufficient funds are available for this work. Item Legal Description for Enterprise Zone Staff recommends approving the proposal submitted by Bruner, Cooper and Zuck in the amount of $15,800. (See related item # ). Since the enterprise zone was first established, the boundaries have changed multiple times. The new Enterprise Zone application process requires a legal description be included in the application which will be acceptable to the County Recorder s Office. Sufficient funds are available for this expense. Item East Main Street roadway Staff recommends approval of a proposal from Bruner, Cooper and Zuck to prepare construction plans for the East Main Street roadway improvements. If the jurisdictional transfer (Item # ) is approved, it makes sense to do the needed inlet repair, deteriorated curbing repair and installation of a center left turn lane for westbound traffic for the existing Taco Bell driveway. The City does not have staffing available to prepare the plans and specifications. BC&Z submitted a proposal at a not to exceed figure of $19,600. Sufficient funds are available for this work. Dave Scholl, Galesburg Rescue Mission, gave the invocation. Council Member Dennis moved, seconded by Council Member Goad, to approve minutes of the City Council meeting from the September 15, 2014, meeting. PASSAGE OF ORDINANCES AND RESOLUTIONS Ordinance on first reading amending Chapter 113 of the Galesburg Municipal Code by adding Section Special Event License (Class P). This would allow alcoholic beverages on City property only in the Central Business District. Adam Vitale, representing the Liquor Advisory Commission, as well as G&M Distributors, addressed the Council regarding the collaborative efforts in formulating the ordinance. He added that the goal was to provide an ordinance that would allow for responsible, controllable and enhanced events. Council Member Fleming moved, seconded by Council Member Dennis, to eliminate Section (D) Term, restricting that an organizer is only eligible for one license per year and a Merchant s Association is only eligible for five licenses per calendar year, as well as eliminating that an approved location be in the Central Business District only and instead allow it anywhere within the City with the City Manager s approval. Absent: None Chairman declared motion carried Ordinance on first reading amending Chapter 30 of the Galesburg Municipal Code by adding Section Public Participation. Council Member Fleming moved, seconded by Council Member Karlin, to amend the ordinance by eliminating the first sentence in Section Public Participation (D) pertaining to signing in with their name and address ten minutes prior to the Council meeting, and eliminating (E) that speakers shall provide their address before making comments. 9 Ordinance on first reading approving a jurisdictional transfer agreement with the Illinois Department of Transportation (IDOT) for a part of East Main Street Council Member Goad moved, seconded by Council Member Dennis, to approve the bid from Fort Dearborn Life Insurance Company through local insurance agency Bullis & Sundberg LLC for the consolidation of exempt personnel life insurance programs. Annual cost of one term life plan will be approximately $26, Roll Call #6: Ayes: Council Members Goad, Dennis, Fleming, Andersen, Schwartzman, Allen, and Karlin, 7. Nays: None Absent: None Chairman declared motion carried Council Member Allen moved, seconded by Council Member Goad, to approve Resolution naming the overpass of the Burlington Northern Santa Fe Railroad tracks at Seminary and Kellogg Streets the Seminary/Kellogg Streets Overpass. Cora Douglas addressed the Council and presented copies of petitions with approximately 200 signatures in support of naming the overpass the Bickerdyke Bridge. She presented historical information on Mother Bickerdyke, including her involvement with the Civil War and her establishment of over 300 field hospitals. Joan Larsen also addressed the Council regarding her support of the naming and that this is the perfect opportunity to honor the Galesburg citizen, Mother Bickerdyke. Pam Johnson also addressed the Council as Mother Bickerdyke, thanking the Council for their consideration of naming the bridge after one of the most influential women that changed the world. Mayor Pritchard stated that he has reviewed many of the suggestions over the last few months that have been presented to him for naming the overpass. He agreed that this group is the most organized and persistent to present a suggestion but added he is not in favor of naming the bridge after a person, especially one that has already been honored in our community with a beautiful statue at the Knox County Courthouse. He stated that there are many deserving people from our community that could be chosen and is not in favor of the City naming overpasses or other properties or buildings. Council Member Allen agreed that Mother Bickerdyke was a tremendous person but that she is already honored by a beautiful statue, with new landscaping, on the Courthouse grounds. He added that if a list were made, many people would be worthy of the naming. Council Member Fleming added that this group has put a lot of heart into their support of the bridge naming and added that Mother Bickerdyke will also be honored at the Full View Point Park at the base of the bridge. 10 Further discussion was held on the historical significance of Mother Bickerdyke s work and possible honoring of a woman historical figure. It was noted that with her job as a nurse, it is fitting to honor the bridge that will connect the south side of Galesburg to our two hospitals and VA Clinic. Council Member Fleming moved, seconded by Council Member Schwartzman, to amend the Resolution naming the overpass at Kellogg and Seminary Streets the Bickerdyke Bridge. PUBLIC COMMENT Laura Fultz addressed the Council thanking them for the demolition approval of 740 Abingdon Street, across the street from her relative s new Habitat for Humanity home. She also thanked Roy Parkin and the Community Development Department. Mavis Sanders addressed the Council stating that she had been chased and bit by her neighbor s pit bull. The Police were called but she stated that as far as she knew, a Dangerous Dog investigation report had not been filed. Police Lt. Bradford stated that when an incident happens, the Police Department does an investigation with Animal Control. City Manager Thompson stated that reports must be filed and that citizens also have a responsibility to follow through with filing the appropriate report. He added that if a citizen is ever discouraged or deterred from filing a Dangerous Dog report they should contact the City Manager s office. Council Members discussed the possibility of revisiting and reevaluating the Animal Ordinance as several challenges still remain, especially with confusion over divided duties between the City s Police Department and the Humane Society. Marv Dahlberg, City Treasurer, noted that he does get some information in terms of redemption fees collected from the KCHS on a monthly basis. Sherman Kelly addressed the Council stating that he witnessed some of the altercation between Mrs. Sanders and the pit bull. He encouraged Council to reevaluate the ordinance. CITY MANAGER S REPORT A. Approve Special Events: a. Use of Standish Park Gazebo for a wedding on October 11, b. Use of Pilot Club Fishing Pier for a wedding on September 12, MISCELLANEOUS BUSINESS (Agreements, Approvals, Etc.) Council Member Goad moved, seconded by Council Member Dennis, to approve the fiscal year 2015 LaserFiche maintenance agreement from EDCO Group, Inc. in the amount of $8,000. This arrangement would provide for professional management, allows for a smooth transition from the current operator, and for continued sharing of resources with the Park Division. A City loan no greater than $300,000 at an interest rate of three percent, amortized over 25 years with a balloon payment at ten years. 2. Payments will be interest only for the first 24 months. 3. Secure the City loan with: a. A UCC-1 filed on all business assets. b. Second position on mortgage. Janko Group LLC is developing an approximate 2.43 acre site fronting East Main Street for a new Holiday Inn Express & Suites. CLOSING COMMENTS Council Member Schwartzman invited the public to attend a boxing event sponsored by the Galesburg Youth Athletic Club on Saturday, October 18, 2014, at the American Legion. Tickets are $10 or $5 for students and available from him or by contacting the GYAC. Council Member Goad stated that he watched the cement being poured for the bridge deck of the overpass today and is looking forward to its completion. He also added that the Full View Point Park will be done soon and is very impressive. He also reminded bicyclists on Fremont Street to obey all traffic laws. Mayor Pritchard read comments from an he received from a former Galesburg citizen, whereby he was listing all the good things happening in the community. Among them included the new bus shelters, Quiet Zone crossings, new schools, remodeling of Knox College s Alumni Hall, bike paths, landscaping at the Courthouse, and the new sidewalks at Standish Park, just to name a few. The Mayor added that many times we take for granted the good things going on in Galesburg and encouraged citizens to be aware of the progress. 16 CITY OF GALESBURG COUNCIL LETTER OCTOBER 20, 2014 AGENDA ITEM: Resolution to approve quit claim deed to the State of Illinois for the East Main Street Underpass project. SUMMARY RECOMMENDATION: Approval of the resolution to approve quit claim deed to the State of Illinois for a portion of East Main Street for the East Main Street Underpass project. BACKGROUND: The State of Illinois will be acquiring a permanent easement in order to construct and maintain the new underpass structure. During the title search process the title company discovered a small section of the existing roadway on the east side of the tracks south of the centerline of the roadway to the south right of way line, where they couldn t confirm if BNSF, the City, or the State owned it. Therefore, the title company requested the City to approve a quit claim deed in order to help clear up ownership. It is believed that it is likely owned by the BNSF as all other property north and south is owned by them. Approval of the quit claim deed by the City will release any rights the City may have had in the property, but it is not believed that the City likely has ownership of the property. The quit claim deed will make sure that the existing ROW is not owned by the City. The quit claim deed and plat are attached. In order to move forward with the acquisition of the permanent easement the City will need to approve the quit claim deed to the State of Illinois. BUDGET IMPACT: None SUPPORTING DOCUMENTS: 1. 17 RESOLUTION NO. WHEREAS, the City of Galesburg is in the process of planning for the construction of an underpass project concerning the Burlington Northern Santa Fe Railway Company railroad tracks which currently cross East Main Street at grade; and WHEREAS, as a part of said underpass project the State of Illinois must acquire a permanent easement over property adjacent to said railroad tracks (the subject property ), and WHEREAS, the real estate records concerning the subject property make it difficult to ascertain fee simple title to that property; and WHEREAS, the City of Galesburg claims no ownership interest in the subject property; NOW THEREFORE BE IT RESOLVED AS FOLLOWS: SECTION ONE. 21 COUNCIL LETTER CITY OF GALESBURG OCTOBER 20, 2014 AGENDA ITEM: Resolution ceding the City s 2014 private activity bonding authority to the Quad Cities Regional Economic Development Authority (QCREDA). SUMMARY RECOMMENDATION: The City Manager and Director of Community Development recommend approval of the resolution ceding the City s private activity bonding authority to QCREDA. BACKGROUND: On April 7, 2014 the City Council approved a resolution reserving the City s 2014 private activity bonds volume cap. The purpose of this resolution was to hold the available volume cap of $3,174,500 for possible City use, instead of losing the volume cap to the Governor s office. At this point, the City has no project on which these private activity bonds could be utilized. Andrew Hamilton, the executive director of QCREDA, contacted the City regarding the availability of the City s 2014 private activity bonding authority. A RESOLUTION REALLOCATING $3,174,500 OF THE CITY OF GALESBURG, ILLINOIS PRIVATE ACTIVITY BOND ALLOCATION TO THE QUAD CITIES REGIONAL ECONOMIC DEVELOPMENT AUTHORITY RESOLUTION transferring and reallocating the aggregate remaining, unused allocation of the private activity bonds of the City of Galesburg to the Quad Cities Regional Economic Development Authority. WHEREAS, the City of Galesburg, Knox County, Illinois, (The City ) is a municipality and a home rule unit of government duly organized and validly existing under Section 6(a) of Article VII of the 1970 constitution and laws of the State of Illinois; and WHEREAS, Section 146 of the Internal Revenue Code of 1986 (the Code ), as amended, and Section 1301 of the Tax Reform Act of 1986, places a ceiling (the Volume Cap ) on the aggregate principal amount of private activity bonds (as defined in the Code) that can be issued in the State of Illinois from January 1, 2014, to and including December 31, 2014; and WHEREAS, the City s portion of the Volume Cap equals $3,174,500; and WHEREAS, the City has reserved $3,174,500 in Volume Cap through Resolution No as approved by the City Council on April 7, 2014; and WHEREAS, the City has issued private activity bonds to which portions of the Volume Cap have been allocated in the aggregate principal amount of $-0- from January 1, 2014, through the date of adoption of this Resolution; and WHEREAS, the City has a remaining, unused balance of Volume Cap in the amount of $3,174,500 for the remainder of calendar year 2014; and WHEREAS, the Illinois Private Activity Bond Allocation Act (30 ILLS 345//et seq) provides among other things, the City may reallocate any remaining, unused portion of its Volume Cap to a state agency; and WHEREAS, the Quad Cities Regional Economic Development Authority (QCREDA) has requested the City cede its remaining unused portion of the available Volume Cap to QCREDA for economic development purposes in QCREDA s service area; and WHEREAS, it is in the best interest of the City to transfer and reallocate $3,174,500 of the City s remaining, unused Volume Cap to QCREDA. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GALESBURG, KNOX COUNTY ILLINOIS: SECTION 1: Consent to Reallocate to QCREDA. The City hereby agrees to reallocate to QCREDA the City s 2014 private activity volume bonding cap in the amount of $3,174,500. 42 COUNCIL LETTER CITY OF GALESBURG OCTOBER 6, 2014 AGENDA ITEM: Ordinance to amend Chapter 113 of the City Code of Ordinances adding Section Special Event License (Class P). SUMMARY RECOMMENDATION: The City Manager, City Clerk, and the Liquor Advisory Commission recommend approval of this Ordinance adding Special Event License (Class P) to the Alcoholic Liquor Ordinance. This will allow alcoholic beverages on City property only in the Central Business District. BACKGROUND: The Liquor Advisory Commission has been investigating the possibility of a Special Event License for City-owned property where the host is a Merchants Association or civic, charitable or non-profit organization for several months. A sub-committee was formed, chaired by Adam Vitale, to review other communities that have similar licenses available. After several drafts and meetings with the Police Department and Legal, the attached ordinance has been submitted by the Commission as a recommendation for Council approval. The Ordinance would allow the above mentioned groups to apply for a Special Event License, or Class P License, to host a festival, celebration, etc. where the consumption of alcohol would take place on the premises. The license would be restricted to the Central Business District area and only merchants with a current liquor license would be allowed to sell alcohol. All applications would be approved by the City Manager. The organizer would have to comply with all requirements of the ordinance at all times, including the purchase of wrist bands for all attendees that are over the age of twenty-one, have State of Illinois BASSET training, provide evidence of insurance, and operate the event without any public nuisance or hazard. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GALESBURG, ILLINOIS, AS FOLLOWS: SECTION ONE: Chapter 113 of the City of Galesburg Code of Ordinances is hereby amended by adding thereto the following sections: (A) Definitions. SECTION SPECIAL EVENT LICENSE (CLASS P) For the purposes of this Section, the following definitions shall apply unless the context clearly indicates or requires a different meaning. Approved Location. Special event locations must be approved by the City Manager. Class P Special Event License. A City license issued to an event Organizer issued for a specific term as set forth below. Special Event. An event, outing, festival, celebration or other such special occasion for consumption of alcoholic beverages on premises or within an area specifically designated as a Class P license. Merchants Association. A group of three or more businesses located within a two (2) block area with the purpose of promoting tourism or community gathering, with at least one member of the association holding a current liquor license. Organizer. The civic, service, charitable, not-for-profit, or merchants association responsible for hosting, organizing, managing, and monitoring the event. (B) License Required. No person shall operate a special event serving alcoholic beverages on any portion of the city s property without a valid Class P Special Event License to do so issued by the City Clerk. A Class P Special Event License may only be issued to an Organizer. (C) License. The City Clerk shall issue a license to an organizer if the organizer meets the requirements of this Section and Section of this Chapter. If the organizer is a corporation, the organizer shall identify a manager and state the name and address of its manager; (2) Attach a copy of its plan of operation as provided for in subsection (G) below; (3) Certify that the special events license is located in an Approved Location; (4) Provide evidence of the event manager s completion of a BASSET certified training program; (5) Provide evidence of insurance insuring the organizer against liability arising out of the operation of the organizer s special event in amounts of at least $500,000 for the injury or death of one person, $1,000,000 for the injury or death of two or more persons and $50,000 for damage to property. The city shall be named as an additional insured in the policy providing the insurance, and the policy shall further provide that it may not be canceled except upon ten days written notice filed with the City Clerk; (6) The application shall be made with the City Clerk not less than thirty days prior to the date of the event. (D) Term. A Class P Special Event license shall be issued for a specific date, and shall be valid only during the hours shown on the license, which hours shall be subject to the approval of the City Manager. In no event shall the hours exceed 7:00 a.m. to 12:00 midnight. (E) Fee. (1) A non-refundable application fee of $50.00 to recover the cost of processing the application shall be paid to the City Clerk by an Organizer which is a Merchants Association. (2) A non-refundable application fee of $50.00 to recover the cost of processing the application shall be paid to the City Clerk by an Organizer which is not a Merchants Association. The Organizer then must pay a non-refundable license fee of $ once said license is approved by the City Manager, prior to the issuance of the license. (F) Inspection; Records. (1) The city reserves the right to inspect all licensed premises at any time. (2) Every holder of a Class P Special Event license shall keep complete and accurate records, including a daily sheet showing receipts from the sale of alcoholic liquor. (G) Plan of Operation. Each organizer shall provide a copy of its plan of operation to the City Clerk. The plan of operation shall provide, at a minimum, the following:

45 (1) A dimensional plan drawn to scale and done in a professional manner showing the special events area and all public improvements (sidewalks, light posts, benches, planters, trees and tree grates) in the immediate area, and showing the location and approximate size of all proposed signs and banners advertising alcoholic beverages; (2) The location of the entrances and exits of the special event, which shall include the organizer s proposal to provide secure access to the event; (3) The location of all trash receptacles for the special event; (4) The location of any portable toilets for the special event, if deemed necessary; (H) Restrictions. (1) The organizer shall conduct the special event in a safe manner. (2) The organizer shall: (a) Operate the special event in accordance with the plan of operation filed with and approved by the city. (b) The City Manager or Manager s designee may consider the following characteristics of the event as proposed to determine whether to request a meeting with the organizer ahead of the event and whether to recommend the imposition of additional security measures as a condition of the license, which additional security measures may include compliance with Section (D) of the City Of Galesburg Alcoholic Liquor ordinance: (1) The size of the event (2) The duration of the event (3) The number of persons that can reasonably be expected to attend the event (4) The event s proximity to residential areas (5) The event s proximity to public streets or other public rights-of-way (6) Whether entertainment will be provided (7) The Police Department s or other municipalities experience with similar events in the past (8) Any other characteristics of the event as proposed that could be reasonably be expected to adversely affect the public health, safety and welfare in the absence of security measures. If the City Manager or Managers designee deems additional security measures are required the organizer shall pay to the City of Galesburg an amount equal to the prevailing overtime wages which the City is required to pay to any on-duty City of Galesburg police officers required in the discretion of the City Manager or Manager s designee to provide such additional security. (3) The following items are additional requirements with which the organizer must comply:

46 (a) (b) All merchants intending to sell, serve or otherwise distribute alcoholic beverages must be listed on the application. Only merchants with a current liquor license are allowed to sell, serve, or otherwise distribute alcohol at any time during the event. (c) Organizers are required to have checkpoints at all entrances and exits from the event. The checkpoints are required to: (i) Be occupied by at least one volunteer. (ii) Have a trash receptacle. (iii) Have a free standing sign stating, No alcohol past this point, not smaller than 4 feet high and 4 feet wide. (d) Organizers are required to check I.D.s of patrons appearing to be minors. (e) Banners and large signs displaying or advertising alcoholic beverages are not allowed unless specifically approved by the City Manager. Menu signs of reasonable size may be placed in close proximity of alcohol purchasing locations. (4) The organizer is required to purchase wrist bands for all attendees that are twenty-one (21) years of age or older. Wristbands must contain adhesive and be one time use only. Wristbands shall not be transferable to other persons. (5) All drink containers must be made from a non-breakable material including plastic cups and/or aluminum cans. Glass bottles shall not be sold during the event. If a beverage can only be purchased in a glass bottle it must be poured into a plastic cup. The glass bottle must be disposed of by the organizer s staff. At no time may a special event worker hand a consumer a glass container. (6) BASSET Training. The organizer must have been trained via a State of Illinois approved BASSET training program. There must be at least one person on site at all times that is BASSET certified. If the organizer will not be on-site for the entire duration of the special event the organizer must provide names of the additional qualified members on the application. (7) Reservation of rights. The City reserves the right to require any special event to cease part or all of its operation in order to allow for construction, maintenance or repair of any street, sidewalk utility, or public building by the City, its agents or employees, or by any other governmental entity or public utility; to allow for the use of the street or sidewalk in connection with parades, civic festivals and other events of temporary nature as licensed by the City; and to remedy a public nuisance or to protect the public health, safety, or welfare. (8) (a) The organizer shall at all times comply with the requirements of the ordinances of the City of Galesburg and the laws of the State of Illinois while engaged in the operation of the special event, including specifically but not limited to any law, regulation or ordinance pertaining to the possession, sale, transportation or consumption of intoxicating beverages or

47 controlled substances. (b) application. The organizer shall not include materially false or misleading information on its (c) The organizer shall at all times operate the special event so that it does not create a public nuisance or a hazard to the public health, safety or welfare. (I) Clean Up. (1) The organizer shall, within 120 minutes after the ending time of the event, remove all refuse, litter debris, garbage and the like from the property used for the event abutting or in any public right-of-way. (2) In the event that an organizer does not remove all refuse, litter, debris, garbage and the like in the 120 minute period, the City may remove all refuse, litter, debris, garbage and the like from the property used for the event and bill the organizer for the costs of removal. (3) Any organizer that does not properly clean up the site will not be allowed to reapply for a special events license of any type for a period of three (3) years. (J) Appeal (1) In the event an organizer violates any provision of the Special Event License requirements contained herein, the City Clerk shall provide written notice to the organizer of the violation, and that the organizer shall not be eligible to apply for another Special Event License for a period of three years. Said notice shall be mailed to the organizer s address as shown on its application. (2) Within 7 days of the date of the mailing of the notice referred to above, the organizer may file with the Clerk a written request for a hearing before the local liquor commissioner. In that event, a hearing shall be scheduled and held no later that 45 days after the request for hearing was filed. For purposes of the hearing, for the following shall apply: (a) All interested persons will be given a reasonable opportunity to be heard. (b) The formal rules of evidence shall not apply. Hearsay testimony will be admissible. (c) The organizer may present evidence and cross-examine the witnesses. (3) The decision by the local liquor commissioner shall be final, subject to the right to appeal the decision to a court of competent jurisdiction pursuant to Illinois law. SECTION TWO: All ordinances or parts of ordinances, in conflict with this ordinance are, to the extent of such conflict, hereby repealed.

(C) The presiding officer may impose reasonable limitations on public participation at public meetings, such as barring repetitious, irrelevant, immaterial, or inappropriate comments or testimony. The presiding officer shall have the authority to halt or suspend the public communications/hearing to a later date due to the duration of the public forum/hearing or lack of compliance with this section. In addition to those portions of a meeting set aside for public participation, the presiding officer shall have the discretion to permit public comment at any other time during a meeting, subject to the provisions of this section. (D) All items must pertain to City business. All speakers shall comply with this section and rulings of the presiding officer. Speakers must be called upon by the presiding officer prior to addressing the public body. (E) Speakers shall identify themselves before beginning their comments or questions, and provide any supporting documentation and/or evidence they may wish to submit to the City Clerk. Speakers shall refrain from engaging in debates, directing threats or personal

(G) Groups of residents should, whenever possible, consolidate their comments and avoid repetition through the use of representative speakers. (H) All speakers shall limit their comments to approximately three (3) minutes. (I) The petitioner of an agenda item is a person or entity with a direct interest in a decision. 53 COUNCIL LETTER CITY OF GALESBURG OCTOBER 6, 2014 AGENDA ITEM: Approve jurisdictional transfer agreement with the Illinois Department of Transportation (IDOT) for a portion of East Main Street. SUMMARY RECOMMENDATION: The City Manager, Director of Public Works, Director of Community Development and City Engineer recommend approval of the jurisdictional transfer. BACKGROUND: Attached for the City Council s consideration is a jurisdictional transfer agreement with IDOT that covers an approximate 0.12 mile section of East Main Street. The section of East Main Street that is covered under the jurisdictional transfer begins just west of the ramps located west of Interstate 74 and extends westerly to the east driveway of the former Mobil gas station and near the Taco Bell driveway. The purpose of the jurisdictional transfer is to transfer maintenance of the street surface and right-of-way. This is being proposed to allow more flexibility and options for the East Main Streetscape Improvements Project proposed for this portion of East Main Street. Currently IDOT has control of the right-of-way; and any improvements to be placed on the right-of-way must meet IDOT design standards. This significantly limits the type of improvements that can be installed under the East Main Streetscape project. Late last year City staff and the City s consultant met with IDOT staff to review over the draft plan for the East Main Streetscape Improvements Project that had been developed by the City s consultant. IDOT staff indicated many of the proposed design features would not comply with IDOT regulations. This included the decorative metal fencing with masonry pillars, the decorative City of Galesburg sign, landscaping, as well as restrictions on the type of the decorative lighting to be utilized. IDOT staff suggested the City consider a jurisdictional transfer of this section of East Main Street. If the jurisdictional transfer is approved, the City would be able to install the various design features proposed in the East Main Streetscape Plan. In order to assure reduced initial maintenance costs for this section of East Main Street, the City Administration is proposing to make improvements to this portion of East Main Street in Improvements would include milling off the current asphalt surface, installing a new layer of asphalt, curb repairs, removing the center median and installing a center turn lane at the entrance to the new hotel site (i.e. current driveway entrance for the Taco Bell). Earlier this year the City had also attempted to obtain approval to allow the construction of a driveway directly on to the Welcome Center property. IDOT recommended approval; but had to send the City s request on to the Federal Highway Administration s (FHWA) for their review. FHWA was required to review, since the current access restrictions were developed at the time Interstate 74 was developed. Unfortunately, the FHWA recently denied the request to reduce the Prepared by: MJF Page 1 of 2

54 access restriction. The access to the Welcome Center will continue to be through the former Mobil gas station site, which is located immediately west of the Welcome Center. BUDGET IMPACT: The City will be responsible for maintenance of this.12 mile section of East Main Street. Funds from TIF II will be utilized to rehabilitate this portion of East Main Street. SUMMARY RECOMMENDATION: The City Manager and Director of Community Development recommend approval of the resolution authorizing the submittal of the grant application to the Illinois Historic Preservation Agency for the walking tour brochure update and reprinting. BACKGROUND: The City of Galesburg is a Certified Local Government (CLG), a federal program administered by the Illinois Historic Preservation Agency. Each year funds are made available to CLG s for preservation activities, including publications. The Landmark Commission has recommended the submittal of an application to fund the update and reprinting of the Galesburg Historic Walking Tours Brochures. These brochures were first printed in In 1997, after adding another tour and making some corrections, additional brochures were printed. Both times the brochures were paid for with a combination of state and local funds. The City is currently out of the brochures and would like to print additional copies, which are used for both educational purposes and tourism. The Landmark Commission has reviewed the brochure, made some corrections and added some additional information. The Commission is still attempting to obtain estimates from various companies, but it is proposed to print 10-12,000 copies at an estimated cost of $15,000. The CLG grant applications have recently been released and a complete application is due by November 14, The CLG program would reimburse 70% ($10,500), the local share being 30% (4,500). If the CLG grant is successful, the City would also apply to the local tourism office for a small grant to put toward the local amount. (Wards 5, Ald. Schwartzman) - Resident located on Academy Street between Losey and North Street has requested that the speed limit be lowered to 25 mph in this block. She is concerned with the speeding on the street. She said it is usually the worst during the morning rush hour. Posted speed seems to match drivers perceptions of what speed is safe to drive. This would support leaving the speed at 30 mph. - The existing roadway is a brick street that allows parking on both sides of the street. The street is 34 feet wide and allows for two way traffic with cars parked on both sides of the street. There are sidewalks on both sides of the street and numerous residential driveways along both sides of the street. There are no commercial generators of traffic located in this block. - There are 26 sections of city streets that are currently designated as 25 mph. All other sections are 30 mph or higher. SUMMARY RECOMMENDATION: The City Manager and Director of Community Development recommend that the City Council approve the prairie plot application. BACKGROUND: The Prairie Plot ordinance has been in effect since July This is the first application for a new prairie plot since that time. The prairie plot complies with all regulations of the ordinance: Located in rear yard The ordinance allows a prairie plot to cover 10% of the rear yard, which in this case would be up to 3,240 sq ft. The proposed size is well below what is allowed at 800 sq ft The edge will be defined by building stones Setback to property lines well exceeds the required 5 feet BUDGET IMPACT: There will be no impact upon the budget if the application is approved.
