In support of its Application, Charter Fiberlink states as follows. 1. Identity of Applicant. Charter Fiberlink is a limited liability company organized under the laws of the State of Delaware and is an indirect, wholly-owned subsidiary of Charter Communications, Inc. Charter Fiberlink s principal offices are located at Powerscourt Drive, St. Louis, Missouri
8 2. Description of Certificates of Authority Currently Held by Charter Fiberlink. (A) Local Niche Service Authority. On December 31, 1997, the Commission granted a Certificate of Authority to Marcus Fiberlink, LLC ( Marcus Fiberlink ) in Docket No. P- 5535/NA to provide local niche services in the Minnesota exchanges of Apple Valley, Rosemount, Lakeville and Farmington that are served by Frontier Communications of Minnesota, Inc. ( Frontier ). Thereafter, on February 8, 2000, the Commission approved the application of Charter Communications Holding Company, LLC to acquire Marcus Fiberlink in Docket No. P- 5535/PA On May 31, 2000, the Commission approved an amendment to Marcus Fiberlink s Certificate of Authority that changed the name on that Certificate of Authority from Marcus Fiberlink, LLC to Charter Fiberlink, LLC in Docket No. P-5535/M Pursuant to its local niche authority, Charter Fiberlink has provided, and currently provides, intrastate private line telecommunications services to certain customers in the Apple Valley, Rosemount, Lakeville and Farmington exchanges served by Frontier. (B) Local Facilities-Based Service Authority. On November 30, 1998, the Commission granted a Certificate of Authority to Seren Innovations, Inc. d/b/a Astound Broadband ( Seren ) in Docket No. P-5704/NA to provide facilities-based local exchange services, resold local exchange services, interexchange services and local niche services in the St. Cloud exchange of Minnesota that is served by Qwest Corporation ( Qwest ). On September 13, 2000, the Commission approved an amendment to Seren s Certificate of Authority in Docket No. P- 5704/M to allow Seren to provide facilities-based local exchange services, resold local exchange services, interexchange services and local niche services in the St. Joseph exchange of Minnesota that is served by Qwest. Thereafter, on December 14, 2005, the Commission approved the application of CCVIII Operating, LLC and Charter Fiberlink to acquire substantially all of the 7
9 Minnesota assets of Seren, including Seren s Certificate of Authority, tariff, 911 plan and interconnection agreement, in Docket No. P-5535, 5704/PA Pursuant to its local facilitiesbased authority, Charter Fiberlink has provided, and currently provides, a full array of facilitiesbased local exchange and interexchange services to customers in the St. Cloud and St. Joseph exchanges of Minnesota served by Qwest. On June 28, 2006, the Commission approved an amendment to Charter Fiberlink s Certificate of Authority in Docket No. 5535/M , to expand the service area in which Charter Fiberlink may offer facilities-based local exchange services, resold local exchange services, interexchange services and local niche services to include the following exchanges and rate centers: (1) Duluth, Northfield, Twin Cites Metropolitan Service Area, Little Falls, Sauk Centre, Marshall, Montevideo, Willmar, Rochester, Stewartville and Winona, served by Qwest; (2) Cokato, Osseo, Eyota and Benson, served by Embarq Minnesota, Inc. ( Embarq ); (3) Mound, Byron and Cottonwood, served by Citizens Telecommunications Company of Minnesota, LLC, d/b/a Frontier Citizens Communications of Minnesota ( Citizens ); (4) Apple Valley, served by Frontier Communications of Minnesota, Inc.; and (5) Mankato, served by Mankato Citizens Telephone Company. Pursuant to its local facilities-based authority, Charter Fiberlink provides, or is undertaking to provide, a full array of facilities-based local exchange and interexchange services to customers in those exchanges and rate centers. On October 18, 2006, the Commission approved an amendment to Charter Fiberlink s Certificate of Authority in Docket No. P-5535/M , to further expand the service area in which Charter Fiberlink may offer facilities-based local exchange services, resold local exchange services, interexchange services and local niche services to include the following exchanges and rate centers: Faribault and Owatonna, served by Qwest. Pursuant to its local facilities-based authority, 8
10 Charter Fiberlink provides, or is undertaking to provide, a full array of facilities-based local exchange and interexchange services to customers in those exchanges and rate centers. On February 12, 2007, the Commission approved an amendment to Charter Fiberlink s Certificate of Authority in Docket No. P-5535/M-07-26, to further expand the service area in which Charter Fiberlink may offer facilities-based local exchange services, resold local exchange services, interexchange services and local niche services to include the following exchanges and rate centers: Albert Lea, Austin, Brainerd, Cass Lake, Glenwood, Nisswa, Park Rapids, Red Wing, Staples, Tracy and Wadena, served by Qwest; Aitkin, Alexandria, Browerville, Crosby, Deerwood and Long Prairie, served by Embarq; and Eagle Lake, served by Mid-Communications, Inc. d/b/a HickoryTech. Pursuant to its local facilities-based authority, Charter Fiberlink provides, or is undertaking to provide, a full array of facilities-based local exchange and interexchange services to customers in those exchanges and rate centers. On March 26, 2007, the Commission approved an amendment to Charter Fiberlink s Certificate of Authority in Docket No. P-5535/M , to further expand the service area in which Charter Fiberlink may offer facilities-based local exchange services, resold local exchange services, interexchange services and local niche services to include the following exchange and rate center: Fergus Falls, served by Qwest. Pursuant to its local facilities-based authority, Charter Fiberlink provides, or is undertaking to provide, a full array of facilities-based local exchange and interexchange services to customers in that exchange and rate center. On August 20, 2007, the Commission approved an amendment to Charter Fiberlink s Certificate of Authority in Docket No. P-5535/M , to further expand the service area in which Charter Fiberlink may offer facilities-based local exchange services, resold local exchange services, interexchange services and local niche services to include the following exchanges and rate 9
11 centers: Ranier and International Falls, served by Citizens. Pursuant to its local facilities-based authority, Charter Fiberlink provides, or is undertaking to provide, a full array of facilities-based local exchange and interexchange services to customers in those exchanges and rate centers. 3. Request for Amendment to Certificate of Authority. Pursuant to Minn. Stat , subd. 4 and Minn. Rules , subpt. 2, , subpt. 2, and , Charter Fiberlink requests that the Commission issue it an amended Certificate of Authority permitting Charter Fiberlink to provide facilities-based local exchange services, resold local exchange services, interexchange services and local niche services to residential and business customers in the following additional exchanges and rate centers served by the following incumbent local exchange carriers in the State of Minnesota: Incumbent Carrier Frontier Communications of Minnesota, Inc. Embarq Minnesota, Inc. Embarq Minnesota, Inc. Qwest Corporation Exchanges Fairmont Rollingstone Lewiston Bemidji The foregoing exchanges and rate centers describing the proposed expansion of Charter Fiberlink s authorized service areas are being provided by Charter Fiberlink to the Commission in lieu of providing a map describing the proposed expansion area. In addition, in accordance with the requirements of Minn. Stat , subd. 4 regarding the expansion of an authorized service area, Charter Fiberlink has served notice of this Application on all affected municipalities and local telephone companies certified in the expansion area. The form of the notice is attached to this Application at Exhibit A. The Affidavit of Service regarding Charter Fiberlink s service of the notice is attached to this Application at Exhibit B. 10
12 4. Interconnection Agreement. Charter Fiberlink has entered into interconnection agreements with Frontier, Embarq and Qwest. Charter Fiberlink also has entered or expects to enter into interconnection agreements (whether by negotiation or adoption request) with other incumbent local exchange carrier(s), including for the purpose of permitting the exchange of extended area service or extended community calling traffic (as applicable) initiated by or terminated to customers in the service areas described herein. 5. Managerial, Technical and Financial Capability. Charter Fiberlink possesses sufficient business experience and technical, managerial and financial capability to provide facilitiesbased local exchange services, resold local exchange services, interexchange services and local niche services in the proposed service areas for which Charter Fiberlink requests authority in this Application. Charter Fiberlink currently provides a full range of local exchange, long distance and private line telecommunications services to customers located in the St. Joseph and St. Cloud exchanges of Minnesota, along with private line telecommunications services to customers located in other portions of Minnesota. Pursuant to its local facilities-based authority, Charter Fiberlink also provides, or is undertaking to provide, a full array of facilities-based local exchange and interexchange services to customers in the exchanges and rate centers for which the Commission, as aforesaid, granted approvals on June 28, 2006, October 18, 2006, February 12, 2007, March 26, 2007 and August 20, 2007 to expand Charter Fiberlink s service areas. Charter Fiberlink currently is providing such services to over 58,000 customers in Minnesota. In addition, Charter Fiberlink provides a wide variety of local exchange, long distance and private line telecommunications services to in excess of 137,000 customers in Wisconsin. Certain affiliates of Charter Fiberlink, which share a common management team with Charter Fiberlink, also currently provide a full array of intrastate, interstate and international telecommunications services to 11
13 customers in Alabama, California, Connecticut, Georgia, Illinois, Louisiana, Michigan, Missouri, Massachusetts, Nevada, North Carolina, Oregon, South Carolina, Texas, Tennessee, Virginia and Washington. Charter Fiberlink and its affiliates currently provide local exchange and long distance services to, in the aggregate, over one million customers. CONCLUSION Charter Fiberlink respectfully requests that the Commission, consistent with the public interest, grant authority to Charter Fiberlink to provide facilities-based local exchange services, resold local exchange services, interexchange services, and local niche services in the additional Minnesota exchanges and rate centers described in this Application.
