7 Minutes of City Council Work Session September 14, City Council WORK SESSION September 14, :15 p.m. Council Members Present: Mayor Dull, Vice Mayor Kier, Council Members Oakes, Harrington, Curren, Holmes, and Obenschain. The Mayor called the meeting to order at 6:15 p.m. and the invocation/moment of silence was given by Dr. Curren. 1. Consideration of Revised Work Session and Regular Meeting Agendas Consistent with Procedural Memorandum No. 3, amended by Council at its organization meeting on July 1, 2016, the agendas were presented for Council consideration. Mr. Obenschain moved to approve the Work Session agenda, and to approve the Regular Meeting agenda, with the change in Item C. Discussion of Resolution Establishing the Percentage of Relief at 40% for Purposes of the Personal Property Tax Relief Act (PPTRA) Mr. Owen stated that Commissioner of Revenue Maggie Ragon would be presenting this item. She asked that Council set the Personal Property Tax Relief rate for the personal property tax assessments for the City of Staunton for motor vehicles. Ms. Ragon stated she is asking for the rate this year to be set at 40%. In 2016, she noted that it was set at 41%. She informed Council that the rate for Augusta County is also set at 40% and the City of Waynesboro is set at 50% for this year. In 2004, the General Assembly essentially froze the amount of Personal Property Tax Relief that the state provides to each locality. She stated that she does a calculation each year based on the tax book assessment to conclude what percentage that will cover for the personal property tax bills that she is expecting for the fall, which would be the 40% and would exhaust the full amount of the $1.652 million that the City receives. Ms. Ragon then presented numerous interesting facts regarding taxable vehicles in the City, including their aggregate value, which has increased since last year, the most expensive vehicle, the most popular car and truck, and the oldest taxable vehicle, which is still a 1923 Ford Model T. This will be Item A on the regular meeting agenda.

8 Minutes of City Council Work Session September 14, Discussion of Request from Advanced Energy Economy for Letter in Support of Local Renewable Energy Access Initiative Mr. Owen stated Council Member Curren would be presenting this item. Dr. Curren noted that he had received a letter from Advanced Energy Economy, a national advocacy group for renewable energy, asking Council to join with other localities expressing Council s desire to be able to source renewable energy directly. This letter comes in advance of the upcoming Governor s election. He stated that it did not commit the City to purchasing anything or getting any renewable energy; that it was just a statement to have that option in the future. Dr. Curren then explained the difference in sourcing renewable energy versus installing solar equipment. No further questions were asked, and Mayor Dull stated the consensus of Council that the initiative could be supported and the requested letter should be sent. 4. Economic Development Update Mr. Owen stated Billy Vaughn, Director of Economic Development, would be presenting this item. Mr. Owen commented that Mr. Vaughn would be addressing Council s 2025 vision, in addition to the related 3-year priorities that were identified and approved previously by Council. Mr. Vaughn spoke about the progress in recruitment and development for Staunton Crossing, preparing the site for development, and how the Economic Development Authority is aggressively seeking economic development for the future of the city. He presented a slideshow showing the updated construction sites for Staunton Crossing and Frontier Center. Mr. Vaughn also reviewed the VDOT Smart Scale grant awarded to the City in the amount of $8.7 million for road construction. Other upcoming projects in the surrounding area were also addressed. Mr. Owen answered Council members questions regarding the upcoming Queen City Mischief & Magic event. He addressed how the City is prepared for the impact regarding parking, use of the shuttle service and closure of several streets. Mayor Dull expressed thanks to the Celebration of Holiday Lights Committee for providing dinner for Council. She noted that the committee s hard work and efforts during the holiday season are appreciated and are a great example of our community coming together for something good and positive. Mayor s Report Mayor Dull thanked the Celebration of Holiday Lights committee for providing dinner for Council members and expressed her appreciation for their efforts made at Gypsy Hill Park during the holiday season, noting it is a positive example of how our community comes together. She also recognized the upcoming African-American Heritage Festival, taking place September Finally, Mayor Dull commented on the Queen City Mischief & Magic event which will take place September It is expected to draw large crowds with many of the downtown merchants participating in the event. Resolution Establishing the Percentage of Relief at 40% for Purposes of the Personal Property Tax Relief Act (PPTRA) Mr. Owen presented this item. He stated there is a resolution before Council that would establish the percentage of tax relief for the coming year at 40%. Mr. Owen noted that in the 1998 gubernatorial campaign car tax relief was promised, with both candidates offering some form of vehicle tax relief. A version was adopted, but never fully funded, as local governments predicted. By , the General Assembly decided local governments needed to adopt policies, procedures, resolutions and an ordinance for a formula for how the tax relief check that is sent from the state every year would be explained to the public. Mr. Owen noted that the amount of money received from the state was frozen in the early 2000 s and as cars have continued to be bought and sold, new car prices are now higher, so the percentage of relief is smaller every year. He remarked that this year it has dropped to 40% in Staunton, as calculated by the Commissioner of Revenue and the Finance Department. Mr. Owen told Council they have before them a resolution that would set the amount of tax relief at 40%. He commented that Augusta County s rate is also set at 40%. He mentioned Waynesboro s rate is 50%, but that it had applied a much higher tax rate and has a different evaluation system. Dr. Harrington moved that a resolution, as proposed, be adopted establishing the Personal Property Tax Relief Act (PPTRA) percentage at 40%. The motion was seconded by Ms. Oakes and carried unanimously as follows: Ms. Oakes aye Mr. Obenschain aye Dr. Harrington aye Mayor Dull aye Dr. Curren aye Vice Mayor Kier aye Mr. Holmes aye RESOLUTION IMPLEMENTING ORDINANCE , CODIFIED AS SECTION OF THE STAUNTON CITY CODE, TO FURTHER IMPLEMENT THE CHANGES TO THE PERSONAL PROPERTY TAX RELIEF ACT OF WHEREAS, by Ordinance , adopted April 13, 2006, and codified as Section of the Staunton City Code, the Council of the City of Staunton fashioned a local program of tax relief that serves the best interests of the citizenry regarding personal property tax on qualifying use vehicles, pursuant to modifications made by the General Assembly of Virginia to the Personal Property Tax Relief Act of 1998 (PPTRA); WHEREAS, the City's program of tax relief contemplates the allocation of PPTRA relief provided by the Commonwealth of Virginia pursuant to the provisions of Ordinance , codified as Section of the Staunton City Code, as further implemented by resolution adopted annually after the personal property tax book is certified by the Commissioner of Revenue and delivered to the Treasurer;

11 Minutes of Staunton City Council Meeting September 14, 2017 Page No WHEREAS, on September 1, 2017, the Commissioner of Revenue delivered to the Treasurer a certified personal property tax book; and WHEREAS, the Commissioner of Revenue has recommended to the Council of the City of Staunton, Virginia, that with respect to qualifying vehicles with assessed values of more than $1,000 the percentage of relief to be applied to the first $20,000 in value of each such qualifying vehicle should be 40%, which the Commissioner of Revenue estimates will fully use all available state PPTRA relief. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Staunton, Virginia, that 40% shall be the percentage of relief to be applied to the first $20,000 in value of each qualifying vehicle with an assessed value of more than $1,000, pursuant to and in accordance with the provisions of Section of the Staunton City Code. 105 Adopted this 14 th day of September, Approved: Clerk of Council B. Public Hearing and Consideration of a Request by Stefan Zdanski to Rezone 603 North Coalter Street, 608 Randolph Street and 610 Randolph Street From B-1, Local Business District, to R-2, Low Density Residential District Mr. Owen stated Rodney Rhodes, Senior Planner, would present this item. Mr. Rhodes stated Mr. Zdanski is requesting to rezone 603 N. Coalter Street, 608 and 610 Randolph Street from B-1, Local Business District, to R-2, Low Density Residential District. He noted that 603 N. Coalter Street is currently developed with a single-family dwelling and the other two lots are vacant and are basically the yard for the dwelling at 603 N. Coalter Street. Mr. Rhodes remarked that Mr. Zdanski currently rents the property and has a contract to purchase the property, but the property is legally nonconforming in that it is a dwelling on commercially zoned property. In order for Mr. Zdanski to achieve financing and purchase the property, it needs to be rezoned to the current use of the property; therefore, he is applying for rezoning to residential. Mr. Rhodes stated at the Planning Commission meeting, Mr. Zdanski publicly stated he does not intend to develop the other two lots and that they would continue to be part of the yard for the 603 N. Coalter Street property. City staff conducted a review of the proposal which did not identify any issues. The Comprehensive Plan designates this area as general commercial; however, the City is in the process of updating the Comprehensive Plan and as part of that process it is anticipated that the land use designation of the area may change from Commercial to Low Density Residential. Mr. Rhodes stated this would match the existing zoning behind it on Randolph Street. Prior to the Planning Commission s public hearing conducted on August 17, 2017, City staff recommended approval of the request. Mr. Rhodes noted that no one spoke in opposition to the request and the

12 Minutes of Staunton City Council Meeting September 14, 2017 Page No Planning Commission, based on the proposed rezoning s consistency with good zoning practice, on a 4-1 vote, recommended approval of the proposed rezoning. He made mention that the one commissioner who voted against the proposed rezoning was not necessarily against the use of the property for residential purposes, but felt that the land use map should be changed to show the property as residential before going to the rezoning. The Public Hearing was opened. Mr. Stefan Zdanski, 603 N. Coalter Street, introduced himself to Council stating he would be willing to answer any questions; however, no questions were presented to him. Mr. Cleveland Morris, 205 N. Augusta Street, spoke in favor of the rezoning for 603 N. Coalter Street. Mr. Morris is a neighbor and spoke highly of Mr. Zdanski and his family There being no one else wishing to speak, the Public Hearing was closed. Vice Mayor Kier moved that Council approve the rezoning and adopt the ordinance, as presented, rezoning 603 N. Coalter Street, 608 Randolph Street, and 610 Randolph Street from B-1, Local Business District, to R-2, Low Density Residential District. Public Hearing and Consideration of a Request by William W. Little to Rezone 1138, 1212 and 1214 Middlebrook Avenue from B-2, General Business District, to I-1, Light Industrial District Mr. Owen stated Mr. Rodney Rhodes, Senior Planner, would be presenting this item. Mr. Rhodes noted the Planning Division had received a letter on September 13, 2017, from the applicant requesting that the matter be tabled until the October 12, 2017 meeting. City staff has reviewed the request and supports tabling this matter until the October 12, 2017 meeting. Dr. Curren moved that, given that the applicant has communicated to City staff a request for a delay of the pending zoning request until Council s October 12, 2017 meeting, Council hereby table the matter identified in its agenda as Item C until its October 12, 2017 meeting, with the following stipulations: 1. the City Manager have staff re-advertise the public hearing and take such other notification steps, if any, as applicable law may otherwise require for the October 12, 2017 public hearing date;

He stated the applicant has made comments that he may want to remove two of the three parcels from consideration for rezoning. Mr. Rhodes remarked that there may be some of the neighbors present, and he wanted them to be informed of this consideration. D. Public Hearing and Consideration of a Request by Staunton Property Redevelopment LLC for a Special Use Permit to Allow Living and Sleeping Quarters on the Ground and Basement Levels of 211 West Frederick Street Mr. Owen called on Mr. Rodney Rhodes, Senior Planner, to present this item. Mr. Rhodes stated Staunton Property Redevelopment LLC is requesting a Special Use Permit to allow living and sleeping quarters on the ground and basement levels of 211 W. Frederick Street. The property is zoned B-2, General Business District. He noted the B-2, General Business District, permits living and sleeping quarters on the ground and basement levels only with a Special Use permit. The original structure was constructed as a two-story dwelling to serve the adjacent church. The building has since been converted into office space. He stated the current owner is undertaking extensive renovations to the building at this time and would like to utilize the front portion of the building for a single-family dwelling while continuing to use the rear portion for office purposes. City staff conducted a review of the proposal during which it did not identify any issues with the proposed Special Use Permit. The City of Staunton Comprehensive Plan designates the area as Commercial; however, it is located at the western edge of the Commercial designation, and the property directly across the street from this on Frederick Street is designated as Neighborhood Residential and has been developed with single-family dwellings. Mr. Rhodes also noted that he believes the intent of the ordinance to have Commercial on the first and basement floors is to assure that there is still a Commercial element to the property that is zoned Commercial, and in this case if it is approved, it would still have a Commercial element to the property and it would just be in the rear of the property, which is just a different configuration of the Commercial and Residential nature. The staff recommended approval of the applicant s request to the Planning Commission and at the Commission s August 17, 2017 meeting, no one spoke in opposition to the request. After discussion, the Planning Commission, on a 5-0 vote, found that the proposed Special Use Permit is compliant with good zoning practice and compatible with adjoining land uses and recommended its approval.

Mr. Carter Green, an architect with Frazier Associates, stated he had been helping the owners of the property at 211 W. Frederick Street. He noted Mr. Rhodes had given a good summary for the approval of the Special Use Permit, and he would answer any questions presented to him. There being no one else wishing to speak, the Public Hearing was closed. Ms. Oakes moved that Council approve the Special Use Permit as recommended by the City Manager. 16 CITY COUNCIL AGENDA BRIEFING Staunton, VA Meeting Date: September 28, 2017 Staff Members: Item # A Rodney Rhodes Tim Hartless Ordinance # Department: Community Development Division of Planning and Zoning Council Vision: Built Environment Subject: Consideration of Final Plat of Forest Ridge Town Homes, Unit Seven Background: Attached is the final plat dated August 8, 2017, of Forest Ridge Town Homes, Unit Seven. City Council issued a Special Use Permit in 2004, for a Planned Residential Development for the Forest Ridge Town Homes, which allowed a clustering of the units to utilize an open space form of development. The preliminary plat, revised in 2013, was approved for a maximum of 37 dwelling units. Thirty-one dwelling units have been developed. The final plat of Unit Seven includes the creation of three lots at the terminus of Forest Ridge Road. All of the lots will have frontage on the street and will be developed with town homes. The plat also shows all necessary utility easements. Staff has reviewed the final plat and all comments have been addressed by the applicant. At its meeting on September 21, 2017, Planning Commission reviewed the final plat and voted unanimously, on a vote, to recommend its approval. City Manager s Recommendation: Recommend City Council accept the recommendation of the Planning Commission and approve the final plat of Forest Ridge Town Homes, Unit Seven, as presented.
