12 City of Newnan, Georgia - Mayor and Council Date: April 26, 2016 Agenda Item: Prepared by: Project Support for Roundabout Consideration State Route 14 (Greenville Street) at Corinth Road Michael Klahr, Public Works Director/ City Engineer Purpose: Background: To consider an Indication of Roundabout Support with the Georgia Department of Transportation for a roundabout at the intersection of SR 14 (Greenville St) and Corinth Rd The Georgia Department of Transportation (GDOT), at the City s request, recently completed a warrant analysis to determine the need for the installation of a stop and go traffic signal at this location. Warrants are met. A roundabout analysis was also performed for the intersection; based on existing traffic volumes and crash history, GDOT has concluded that a roundabout would be the most beneficial improvement for the location. (Benefit cost ratio= 6.32) The support agreement obligates the City for certain maintenance costs including the cost of electricity and maintenance for lighting and maintenance of the associated landscaping. Home construction continues in the Avery Park subdivision. A current builder has agreed to construct sidewalk along The Boulevard. This sidewalk would be within the Right-of-Way for The Boulevard but would traverse the Right-of-Way for Transcontinental Gas Pipe Line Company. The consent agreement has been reviewed and approved by the City Attorney. Options: 1. Enter into the Consent Agreement 2. 20 City of Newnan, Georgia - Mayor and Council Date: April 26, 2016 Agenda Item: Howard Warner Project Guaranteed Maximum Price for Renovation and Construction Prepared & Presented by: Cleatus Phillips, City Manager Submitted by: Cleatus Phillips, City Manager Purpose: To present City Council with Garbutt Construction s Guaranteed Maximum Price (GMP) for the renovation and construction of the Howard Warner Facility and Gym. Background: Architect, Carter Watkins Associates, Owner Representative, Comprehensive Program Services (CPS), and Garbutt Construction as Risk have been selected and are under contract for the Howard Warner renovation project. City Council previously approved CCO #1 (included in the GMP total) so that demolition and abatement could begin. As the project moved forward to full design, pricing was simultaneously taking place using local subcontractors when possible. Garbutt has presented the GMP to staff at a total of $3,131,056. Funding: SPLOST 2007 / SPLOST 2013 / GF Recommendation: Attachments: To approve the Guaranteed Maximum Price of $3,131,056 for the construction portion of the Howard Warner Renovation as presented by Garbutt Construction or other as directed by Council. 50 City of Newnan, Georgia Mayor and Council Date: April 26, 2016 Agenda Item: Text Amendment Application to the Zoning Ordinance to add Hotels/Motels in the OI-2 zoned districts as special exception uses. Prepared and Presented by: Dean Smith, Planner Purpose: To consider the text amendment application by Georgia Retail Investments, LLC to amend the Zoning Ordinance, Chapter 21, , table pertaining to hotels/motels locating in the OI- 2 zoned districts as special exception uses.. Background: Georgia Retail Investments, LLC is requesting that the City consider amending its ordinance to allow hotels/motels as a special exception use in the OI-2 zoning districts. Currently, the zoning ordinance permits Hotels/Motels as conditional uses in the following zoning districts: Planned Development Commercial (PDC); Community Shopping Center District (CCS); Central Business District (CBD); General Commercial District (CGN); and Heavy Commercial District (CHV). Chapter 33, Sec , (32) stipulates the conditions that must be satisfied when developing a Hotel/Motel site: a. Location Critera: Hotels, motels, and other similar traveler s accommodations, excluding travel trailer or RV parks shall be located on or with ready access to major streets. Ready access shall mean any court or service road directly linking to a major street. b. Site Development Criteria: 1. Each room within a hotel, motel or other similar traveler s accommodations (excluding travel trailer or RV Parks) shall be accessed through an interior hallway and shall not have access to the exterior of the building, except through the main or central lobby or as otherwise determined by fire codes. No guest rooms shall be accessible without passing through a secured area. 2. The main or central lobby shall be a minimum of 700 square feet with staff or management on duty 24 hours per day, 7 days per week. 3. Each guest room shall have a minimum of 300 square feet.

51 4. Each building shall have a minimum roof pitch or 4 in Any outdoor recreational areas provided shall be located to the rear of the site within all building setbacks. 6. No outside storage or permanent parking of equipment or vehicles shall be permitted. 7. Hotel or motel uses shall be separated from residential or institutional uses by a Type D Buffer as specified in the Landscape and Tree Preservation Ordinance. A Type D buffer ranges in width between 25 to 50 feet, depending upon the lot size. The foregoing conditions enumerated in Section (32) would have to be met by any hotel/motel applicant as a component of a special exception use application in the OI-2 districts. In a brief survey of some comparable Georgia cities, staff discovered that Hotels/Motels are allowed in transitional zoning districts similar to the Office Institutional and Planned Development zoning districts in Augusta, Cartersville, Dahlonega, Holly Springs and Sandy Springs, Georgia. Holly Springs, GA has a similar process to our special exception uses procedures for hotels/motel establishments desiring to locate in one of its Office Institutional zoning districts. This application was heard by the City of Newnan s Planning Commission at a Public Hearing on March 8, At the conclusion of that hearing, the Planning Commission voted affirmatively that this request should be forwarded to City Council for their consideration to ratify it into the Ordinance, along with the Planning Commission s recommendation that the ordinance be tailored to only allowing Hotel/Motels to be considered as special exception uses in the OI-2 zoning districts. Options: A. Approve the text amendment as proposed. B. Approve the text amendment with conditions or exclusions. C. Deny the text amendment. Recommendation: Staff would concur with the recommendation of the Planning Commission Previous Discussions with Council: February 9, 2016

59 AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE CITY OF NEWNAN, GEORGIA, BY ADOPTING A TEXT AMENDMENT TO CHAPTER 21, GENERAL PROVISIONS OF ZONING, BY AMENDING USE TABLE OF SECTION 21.09, TABLE 21.04; AND FOR OTHER PURPOSES WHEREAS, the City Council of the City of Newnan received an application for consideration of the adoption of a text amendment to the Zoning Ordinance with regard to amending Chapter 21, General Provisions of Zoning, Section 21.09, Table 21.04, by adding hotels, motels and other similar traveler s accommodations, excluding travel trailer RV parks as a Special Exception Use in the OI-2 Zoning District and referred the issue to the Planning Commission for consideration and recommendation of a text amendment to the City Zoning Ordinance; and WHEREAS, in accordance with the requirements of the City Zoning Ordinance, the Planning Commission of the City of Newnan has forwarded its recommendation to the City Council with regard to such text amendment; and WHEREAS, pursuant to said requirements of the City Zoning Ordinance, the City Council has conducted a properly advertised public hearing on the application for consideration of the adoption of a text amendment to the Zoning Ordinance not less than fifteen (15) nor more than forty-five (45) days from the date of publication of notice, which public hearing was held on the 26 th day of April, 2016; and WHEREAS, after the above referenced public hearing, the City Council has determined that it would be in the best interest of the residents, property owners and citizens of the City of Newnan, Georgia to adopt a text amendment to the Zoning Ordinance to amend Chapter 21, General Provisions of Zoning, Section 21.09, Table by adding hotels, motels and other similar traveler s accommodations, excluding travel trailer RV parks as a Special Exception Use in the OI-2 Zoning District. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the City of Newnan, Georgia, and it is hereby ordained by authority of the same that a text amendment to Chapter 21, General Provisions of Zoning, Section 21.09, Table 21.04, be and is hereby adopted as follows: Section I. The Use Table of Section 21.09, Table of Chapter 21, General Provisions of Zoning of the City s Zoning Ordinance, is hereby amended by 1

60 adding hotels, motels and other similar traveler s accommodations excluding travel trailer or RV parks as a Special Exception Use in the OI-2 Zoning District Section II. All Ordinances or parts of Ordinances in conflict or inconsistent with this Ordinance hereby are repealed. Section III. This Ordinance shall be effective upon adoption. 61 WHEN THE STREET LIGHTS GO ON Paramount Worldwide Productions, Inc. 175 Lakewood Way, SW, Atlanta, GA I respectfully request to be added to the next City Council Agendas for April to request a final date change for filming a television pilot in the City of Newnan. REQUEST TO APPROVE NEW FILMING DATES: At the last meeting, the City Council approved a change in dates for filming. Upon discussions with Rednexican restaurant, we determined our new dates would be detrimental to a private party they had planned. The request for the new dates, May 1 st and 2 nd, would eliminate the conflict and enable the filming to take place on Sunday and Monday for less impact to the local businesses and community. WHO: I am the location manager for the show, When the Street Lights Go On, for Paramount Worldwide Productions, Inc. and a resident of Newnan, Georgia. WHAT: Street Lights is a pilot for a series to be aired on HULU. The story is set in 1983 in the suburbs outside of Chicago, IL. Newnan has been chosen as our hero town for the series. WHEN: Street Lights will be filmed over the course of two days from Sunday, May 1 st and Monday, May 2 nd. WHERE: Locations include The Alamo, Newnan Square, a residence on Salbide Ave. We have also been reaching out to several businesses and churches in the area to secure parking of production equipment, vehicles and catering for crew. PLAN: I have been in touch with Chief Douglas Meadows of the Newnan Police Department and I am actively negotiating arrangements with the various locations to secure permissions for filming, parking and basing.. As a resident of Newnan, I am excited to play a role in landing this series in Newnan with the positive economic impact it s sure to bring to the community. Hemrick Enterprises Incorporated Hemrick s Grocery 10 Franklin Road Newnan, Georgia I recently applied for renewal of my City of Newnan Business License just like I have done for the past 40 plus years. It was due on April 1, I mailed it at the Greenville Street post office on Thursday March 31 where it was postmarked as such. On April 8, 2016, I received a notice from the City of Newnan Finance Department that I owed a late fee of $ I promptly contacted Ms. Iris McClung and she proceeded to inform me that this penalty was assessed because my renewal arrived on Monday instead of Friday. I informed her of the postmark and she told me that the City of Newnan went by the date received instead of the postmark date. I personally have never heard of any government entity with this policy including the federal, state, and county. Would you please remove this fee since I was timely with the mail in date? 63 From: Sandi Sent: Wednesday, April 13, :04 PM To: Cc: Jon Simmons Subject: Occupations Tax Penalties for R-781 and R-310 Dear Council Members Shell and DuBose: I was told by Chris Widner, Assistant Finance Director, that I would need to present my case in front of the City Council in order to request an abatement of the penalties that we have been assessed. Our Company has been doing business in the City of Newnan for over 20 years and our record shows that we pay our taxes in a timely manner. I mailed our returns on Tuesday 3/29 so they would be received by the due date of Friday April 1, I received notices in the mail on April 9 th (dated April 8 th ) that our returns were not received until Monday April 4, Our returns were mailed to a P. O. Box so I am unsure how often these boxes are checked. I believe that I mailed them in good faith with ample time to be received prior to the due date. Especially since the notice that was returned to me only took one day. I understand that the City does not go by postmark date but by date of receipt. The date of receipt is out of my control. However, I will use Federal Express in the future so I can track the progress and have proof of receipt. So I may obtain our business licenses and get them posted, I am sending checks today for the penalties (by Federal Express). We hope to hear back from you soon that these penalties have been abated and a refund check is pending. If we need to appear in person, please let me know the time and place. 65 Motion to Enter into Executive Session I move that we now enter into closed session as allowed by O.C.G.A and pursuant to advice by the City Attorney, for the purpose of discussing And that we, in open session, adopt a resolution authorizing and directing the Mayor or presiding officer to execute an affidavit in compliance with O.C.G.A , and that this body ratify the actions of the Council taken in closed session and confirm that the subject matters of the closed session were within exceptions permitted by the open meetings law.
