1 LEGISLATIVE REPORT BOMA/SUBURAN CHICAGO November 30, 2018 The Illinois House and Senate wrapped up the Fall Veto Session this week where the General Assembly continued to take up measures vetoed by Governor Rauner. The focus this week was on the House as it was poised to take override action on vetoed legislation which the Senate voted to reverse two weeks ago. In 2018, Rauner issued 53 total vetoes and 30 amendatory vetoes this year. A total of 18 total vetoes were overridden and another 14 AV s were overridden. That s a combined 61 percent override sustain rate for Rauner - 76 percent for total vetoes but 53 percent for AV s. The Senate adjourned on Wednesday and the House adjourned on Thursday. Both chambers are set to return for a two-day lame duck session starting Monday, January 7. UPCOMING DATES January 9, 12:00 PM House & Senate Inauguration Ceremonies January 14, 2019 Constitutional Officers Inauguration Ceremonies February 20 Governor s Budget Address February 26 Consolidated Primary Election April 2 Consolidated Elect VETO WATCHLIST HB4163 EQUAL PAY ACT-WAGE HISTORY (MOELLER A) Prohibits an employer from: (i) screening job applicants based on their wage or salary history, (ii) requiring that an applicant's prior wages satisfy minimum or maximum criteria, and (iii) requesting or requiring as a condition of being interviewed or as a condition of continuing to be considered for an offer of employment that an applicant disclose prior wages or salary. Prohibits an employer from seeking the salary, including benefits or other compensation or salary history, of a job applicant from any current or former employer, with some exceptions. Limits defenses. Provides for penalties and injunctive relief. RECENT STATUS

2 11/28/ BILL DEAD - No Positive Action Taken - Amendatory Veto HB4282 MUNI-TERRITORY DISCONNECTION (BURKE K) Amends the Illinois Municipal Code. Provides that the owner of record of territory may have the territory disconnected from the corporate limits of a municipality if it does not contain any territory designated as part of a redevelopment project area or any territory otherwise subject to tax increment financing by the municipality. Effective immediately. RECENT STATUS 11/28/ Both Houses Override Total Veto UNDER-21 TOBACCO BAN FAILS NOTEWORTHY VETO VOTES Illinois lawmakers failed Wednesday to reverse Gov. Bruce Rauner's veto of a bill that banned the sale of tobacco to those younger than 21. The House voted to overturn the "Tobacco 21" veto, but it needed a three-fifths majority of 71 votes to become law. The legislation would have set a minimum age of 21 to buy cigarettes, cigars, chewing tobacco and nicotine-based products such as e-cigarettes and vaping materials. PEER-TO-PEER CAR RENTAL BUSINESS House Deputy Majority Leader Arthur Turner of Chicago skipped the vote on Rauner's veto of legislation on so-called peer-to-peer car rental apps. It would subject the rental cars to safety rules and tax collection required for rental car companies. The Senate previously voted to overturn the veto two weeks prior Turner, who sponsored the measure, hopes he can negotiate a deal and present new legislation in January. Critics said the programs allow people to make extra cash by renting their cars and shouldn't be required to follow the same rules as companies with large fleets. Greg Scott of the American Car Rental Association said in a statement that he welcomes discussions "to ensure greater consistency, fairness and safety" in the industry. PRITZKER ANNOUNCES GROWING OUR AGRICULTURE ECONOMY COMMITTEE Governor-elect JB Pritzker and Lieutenant Governor-elect Juliana Stratton announced the formation and members of the transition s Growing Our Agricultural Economy Committee.

3 The committee is the fifth of several working groups of the transition made up of subject-matter experts who will advise and guide the incoming Pritzker-Stratton administration. The Growing Our Agricultural Economy Committee will be chaired by former USDA Rural Development state director Colleen Callahan and former state senator John Sullivan and consist of 22 members. GROWING OUR AGRICULTURAL ECONOMY COMMITTEE MEMBERS Colleen Callahan co-chairs the transition s Growing Our Agricultural Economy Committee and is the former state director for USDA Rural Development in Illinois. During her tenure, she oversaw a 20% reduction in staffing while still being able to generate a $1 billion increase in the Illinois loan portfolio. Prior, Callahan served as the agribusiness director for WMBD in Peoria, a position she held for 30 years. She was the first female president of the National Association of Farm Broadcasting. John Sullivan co-chairs the transition s Growing Our Agricultural Economy Committee and served as state senator of the 47th district from 2003 to 2016 and as chair of the Senate s Agriculture and Conservation committee. In the Senate, he championed legislation to create jobs, improve industry and infrastructure, and grow the economy. Before elected office, Sullivan managed his family-owned auction business that specialized in farm real estate and machinery. The committee is the eighth of several working groups of the transition made up of subjectmatter experts who will advise and guide the incoming Pritzker-Stratton administration. The Restorative Justice and Safe Communities Committee will be chaired by Cook County State's Attorney Kim Foxx, State Rep. Jehan Gordon-Booth, and Congresswoman Robin Kelly and consist of 42 members. RESTORATIVE JUSTICE AND SAFE COMMUNITIES COMMITTEE MEMBERS Kim Foxx co-chairs the transition s Restorative Justice and Safe Communities Committee and is the first African American woman to lead the Cook County State s Attorney s Office. HB2778 INS CD-PROOF OF FIRE COVERAGE (WILLIS K) Provides that a fire protection district may annex any property into its jurisdiction for which it is providing coverage under the Emergency Telephone System Act. Provides notice and hearing requirements. Provides that a certified copy of the annexation ordinance shall be transmitted to certain individuals and that the annexed property shall

11 become an integral part of the fire protection district and subject to all of the benefits of service and responsibilities of the district. 11/9/ Effective Date January 1, 2018 HB4268 HOME REPAIR-CONSUMER NOTICES (THAPEDI A) Amends the Home Repair and Remodeling Act. Provides that "residence" means a single-family home or dwelling or a multiple-family home or dwelling containing 6 or fewer apartments, condominiums, town houses, or dwelling units, used or intended to be used by the consumer as his or her dwelling place (instead of "by occupants as dwelling places"). In the home repair consumer rights pamphlet, replaces notice language concerning lien waivers with the following: "Illinois law requires that, before payment, your contractor give you a sworn statement which lists: (1) all the persons or companies your contractor hired to work on your home and their addresses; and (2) the amounts previously paid, the amounts about to be paid, and the total amount owed after the payment to these persons or companies. The sworn statement should be fully completed, signed, and notarized. When the contractor's sworn statement lists an amount due or to become due to a subcontractor, or when a subcontractor gives you notice of an amount due to the subcontractor, you must retain sufficient funds to pay that subcontractor. Subcontractors give the contractors lien waivers when they are paid. Ask your contractor for copies of these lien waivers. If your contractor tells you he or she needs a payment from you in order to pay subcontractors, you have the right to pay the subcontractors directly.". 8/3/ Effective Date January 1, 2019 HB4569 ABOVEGROUND FUEL STORAGE (PARKHURST L) Provides that a facility used for: (i) agricultural purposes at an agricultural site; (ii) refueling construction equipment at a construction site; (iii) parking, operating, or maintaining a commercial vehicle fleet; or (iv) fueling at railway yards, may store an aggregate total of 12,000 gallons of fuel for dispensing in aboveground storage tanks, as long as the facility complies with all other requirements of the rules of the Office of the State Fire Marshal. Effective immediately.

12 7/27/ Effective Date July 27, 2018 HB5542 MORTGAGE LICENSE-REPORTING (BATINICK M) Amends the Residential Mortgage License Act of Provides for a list of specified activities that constitute violations of the Act (rather than a list of required averments that must be attached to an application for a license under the Act). Provides that a licensee filing a Mortgage Call Report is not required to file a report of applicable annual activities with the Secretary of Financial and Professional Regulation. Provides that specified licensee disclosures do not apply to any licensee providing notices of changes in loan terms pursuant to the federal Consumer Financial Protection Bureau's Know Before You Owe mortgage disclosure procedure (rather than excluding licensees limited to solicit residential mortgage loan applications as approved by the Secretary of Financial and Professional Regulation). 11/14/ Passed Both Houses HR527 PROP TAX ASSESSMENT PRACTICES (ZALEWSKI M) Instructs the House of Representatives Revenue & Finance Committee to conduct an investigation into ways to improve property tax assessment practices across the State. 11/8/ RESOLUTION ADOPTED SB3215 PROP TX-SALE IN ERROR (BARICKMAN J) Amends the Property Tax Code. In provisions concerning sales in error, provides that, in cases where improvements upon the property sold have been substantially destroyed or rendered uninhabitable or otherwise unfit for occupancy, the court may order the holder of the certificate of purchase to assign the certificate to the county collector, upon request of the county collector. Provides that the county collector may further assign the certificate to the county, acting as trustee for taxing districts, or to a taxing district having an interest in the taxes sold.

13 8/14/ Effective Date January 1, 2019 SB3394 PROF LICENSING-VARIOUS-MIN AGE (ALTHOFF P) Amends the Community Association Manager Licensing and Disciplinary Act, the Home Inspector License Act, and the Real Estate License Act of Reduces the minimum age requirement for licensure as a community association manager, supervising community association manager, home inspector, broker, or managing broker to 18 years of age (rather than 21 years of age). 8/14/ Effective Date August 14, 2018 SB3561 BLDG COMMISSION-DESIGN-BUILD (MUNOZ A) Amends the Public Building Commission Act. Changes various repeal dates from June 1, 2018 to June 1, 2023 in provisions concerning allowing public building commissions to use the design-build delivery method for public projects. 8/3/ Effective Date January 1, 2019
