Regan Mayor Smart called the meeting to order at 7:30 PM and upon roll call all members of the Council were present with the exception of Mr. Volpe who was ill. The Mayor then read the following statement: This is a Special Meeting of the Mayor and Council of the Borough of Haworth. I am informed by the Clerk that adequate public notice has been provided by mailing notice to The Record, by posting a notice on the bulletin board in the Municipal Center, by filing a copy of the notice in the office of the Municipal Clerk and by mailing notice to all persons who requested same and prepaid the cost fixed by the Council. Ordinance No Administrative Salaries A motion was offered by Mr. Weiss, seconded by Mr. Rosenberg and unanimously carried that Ordinance No be offered for second reading. The anniversary date of the salary schedule relating to all full-time employees shall be the first of each and every year. Where an appointment is made on or before June 30th of any year, the anniversary date shall revert to January 1st of such year; where the appointment is made subsequent to June 30th of any given year, then the anniversary date of this salary schedule shall not be effective until January of the following year.

Special Meeting of March 20, 2017 All full-time employees of the Borough of Haworth covered by this Ordinance shall be entitled to the following holidays: New Year's Day, Martin Luther King Jr. Day, Lincoln s Birthday, Presidents' Day, Good Friday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, Friday after Thanksgiving, Christmas Day. SECTION IV. The following employees are considered to be part-time employees of the Borough of Haworth: Chief Financial Officer, Deputy Chief Financial Officer, Tax Assessor, Municipal Court Judge, Borough Prosecutor, Alternate Borough Prosecutor, Board of Health Recording Secretary, Board of Health Sanitarian, Construction Official, Plumbing Sub-Code Official, Sewer Inspector, Planning Board Recording Secretary, Board of Adjustment Recording Secretary, Fire Prevention Officer, Wastewater Collection System Operator, Fire Sub-Code Official, Library Clerks, Electrical Inspector, Fire Inspector, Senior Van Driver & Coordinator, Clerical Help, DPW Seasonal Help, Summer Recreation Employees, Mayor and Council, Tennis Court Maintenance. SECTION V._LONGEVITY. Payment of longevity shall be consistent with the Personnel Policy and Ordinances governing such practice, provided, however, that effective January 1, 2014 new hires will not be eligible for longevity payments. SECTION VI. HEALTH BENEFITS CONTRIBUTION. Each full time employee shall contribute to offset health benefits cost per pay period as designated in Chapter 78, P.L SECTION VII. TERMINAL LEAVE Terminal leave payment for unused sick days is capped at $15, for employees hired after May 21, SECTION VIII. The provisions of this Ordinance shall be retroactive to January 1, Any ordinance or resolution in conflict with this Ordinance, other than the current contracts of employment, is hereby repealed. The Ordinance shall take effect upon final publication as provided by law.

Special Meeting of March 20, 2017 The meeting was opened to the public on Ordinance No As there were no comments the meeting was closed to the public on this ordinance. A motion was offered by Mr. Rosenberg and seconded by Mr. Bain that Ordinance No be passed on second and final reading. On roll call the vote was as follows: Ayes; Messrs. Poosikian, Rosenberg, Bain, Weiss, Duffy. Nays - none. Declared carried. A motion was offered by Mr. Weiss, seconded by Mr. Rosenberg and unanimously carried that the adoption of Ordinance No be advertised as required by law. Refund of Escrow Deposits The following resolution was offered by Mr. Weiss, seconded by Mrs. Duffy and unanimously carried: WHEREAS, the following escrow amounts were established with deposits to offset expenses; and WHEREAS, the following amounts were expended. 6 61. Special Meeting of March 20, 2017 Designation of Acting Municipal Court Administrator Shared Services cont d. WHEREAS, the Borough of Haworth and the Borough of Norwood consent and agree to share the professional services of the Municipal Court Administrator on a provisional basis to undertake the duties of the absent Municipal Court Administrator during scheduled and/or unscheduled leaves within the two respective municipalities; and WHEREAS, the pay rate shall be $50.00 per hour. NOW THEREFORE BE IT RESOLVED, the Borough of Haworth and the Borough of Norwood shall both pass a resolution to consent to such an agreement. Urging Legislature to Reduce Local Affordable Housing Burdens The following resolution was offered by Mr. Rosenberg, seconded by Mr. Bain and unanimously carried: WHEREAS, municipalities do not have the resources to provide court mandated housing to comply with the Mount Laurel doctrine without proper funding; and WHEREAS, lawsuits increase housing four-fold through court mandates and without an affirmative defense municipalities can do nothing to stop growth and sprawl, costing millions of dollars outside of local budgets; and WHEREAS, property taxes must be raised exponentially to pay the costs associated with court mandates and, therefore, population, further overburdening taxpayers; and WHEREAS, the cumulative impact of years of unfunded court mandates has left many municipalities with serious needs and burdensome property taxes; and WHEREAS, expected state population growth of.3 percent does not provide sufficient demand to justify court-mandated 30 percent housing supply increase; further congesting our state; and WHEREAS, New Jersey is already the most densely populated state in the country with 1,195 persons per square mile; and WHEREAS, the quality of life and public welfare in this municipality will be reduced, negatively impacting infrastructure, water and sewer capacities; school class sizes and school services; municipal services such as volunteer and staffed ambulance services and fire departments, police departments, public transportation and traffic; and WHEREAS, the lack of affordable housing and rentals is not due to a lack of units, rather it stems from residents paying property taxes that are unaffordable and increasing by roughly $700 million annually; and

Special Meeting of March 20, 2017 WHEREAS, the State of New Jersey should relieve the burden of unfunded court mandates and provide statewide parity and predictability in regard to municipal affordable housing obligations; and WHEREAS, the Assembly is urged to pass Assembly Bill No imposing an end-of-year moratorium on all affordable housing litigation; and Assembly Bill No establishing the Affordable Housing Obligation Study Commission to assist in finding solutions to the affordable housing crisis foisted upon municipalities by the end of the year; and WHEREAS, it is the responsibility of the state and the legislature to assist municipalities; and WHEREAS, the time has come to reasonably address affordable housing needs in New Jersey to preserve the integrity of the state and its quality of life; now therefore be it RESOLVED, that the Borough of Haworth urges the state and the legislature to aid municipalities over-burdened by court-mandated affordable housing; and be it further RESOLVED, that we enthusiastically must reach a solution to affordable housing in New Jersey; and be it finally RESOLVED, that certified copies of this Resolution be forwarded to Governor Chris Christie, Lieutenant Governor Kim Guadagno, Department of Community Affairs Commissioner Charles A. Richman, New Jersey Senate President Steve Sweeney, New Jersey Senate Republican Leader Thomas Kean, Jr., New Jersey Assembly Speaker Vincent Prieto, New Jersey Assembly Republican Leader Jon Bramnick, our State Senator Gerald Cardinale, our Assembly(wo)men Holly Schepisi and Robert Auth, and to the New Jersey League of Municipalities.. Additional 2017 Temporary Budget The following resolution was offered by Mr. Weiss, seconded by Mr. Rosenberg and unanimously carried: WHEREAS, conditions have arisen with respect to various appropriations listed below, and no adequate provision has been made in the 2017 temporary appropriations for the aforesaid purpose, and N.J.S. 40A:4-20 provides for the creation of a temporary appropriation for the purpose above mentioned, and WHEREAS, the Borough of Haworth does not anticipate adopting its final budget for 2017 for several months; WHEREAS, the total temporary resolutions adopted in the year 2017 including this resolution total $1,849, NOW, THEREFORE, BE IT RESOLVED (not less than two-thirds of all the members thereof affirmatively concurring) that in accordance with the provisions of N.J.S. 40A:4-20:

The following temporary appropriations be and the same are hereby made for: CURRENT FUND Operations Contractual Management Other Expenses $20, Natural Gas Other Expenses $10, TOTAL AMENDMENT TO TEMPORARY BUDGET $30, Approval of Payment of Bills The following resolution was offered by Mr. Weiss and seconded by Mr. Rosenberg: FOR COPY OF RESOLUTION AND BILL LIST SEE PERMANENT MINUTES PAGES 65A - 65N On discussion Mayor Smart reported that in connection with the cancellation of last week s meeting, the payment of bills was reviewed and it was determined that a number of checks had to go out and he signed those checks. On voice vote all members voted in the affirmative. Declared carried. Appointment of Public Safety Officer `A motion was offered by Mr. Rosenberg, seconded by Mr. Poosikian and unanimously carried that Robert Hennion be appointed Public Safety Officer at an annual salary of $53, plus an annual clothing allowance of $ retroactive to January 1, Budget Discussion Mayor Smart explained he and Mr. Mariniello worked on several amendments to the budget as follows: CFO salary is now $70,000. down from the original figure since this position has yet to be filled.

9 64. Special Meeting of March 20, Budget Discussion cont d. Auditor s fee should be $23,400. and Financial Management fee, $11,600. Overtime of $1,000. removed from Public Safety salary. $45,000. for Capital Improvement Fund may be changed. Total budget - $7,620, Mayor Smart said the school budget increase is up by 2% as reported at a meeting at the school that he attended this morning; the Borough s equalized valuation has declined therefore Haworth s share of the high school and county funding will be going down. Mr. Weiss commented this is the beginning of the process, noted various changes and requested councilmembers check with their portfolios. Mr. Poosikian discussed and questioned the following budget items: Less being budgeted for equipment maintenance. Mr. Weiss responded the historical usage of this line item indicates those funds have not been spent. Computer maintenance why $10,000 more. Mayor Smart explained how the current provider has been charging, discussions have been held regarding moving to a cloud based version and other efficiency processes and a proposal will be forthcoming for replacing the server, etc. Prosecutor s office funds being set aside for separate trials, i.e., DWI trials for which the prosecutor is requesting to be paid. Suggested $1,000. Shade Tree he would recommend the same as last year. Recreation Mr. Bain responded to Mr. Poosikian s question explaining their trust fund, they are expanding programs this year therefore will need some funding. Also, the Celebration of Public Events line item will all be under the Recreation budget. Mr. Poosikian further referred to the following budget items: court revenue, recycling tonnage grant, cell tower leases, DPW seasonal help, engineering services and police purchase of vehicles. Mrs. Duffy noted that the senior accounts are in different places in the budget which makes it difficult to understand that budget, she would like to meet with the Finance Committee for clarification and it was suggested Mrs. Duffy meet with the CFO regarding her questions.

Mayor Smart then discussed the timing for the budget, i.e., introduction on March 28, introduction of the CAP Bank Ordinance and the timing for the Swim Pool budget. It was concurred to have department heads, Police, Fire and DPW present their budgets at the March 28 th meeting and Library, Ambulance, and Swim Club at the April executive meeting. Open Meeting to Public Dr. M. Kahn, Paulson Place thanked the Mayor and Council for all the improvements in the downtown area, however he said the rear of the buildings on Stevens Place is still unsightly and suggested landscapers doing some planting in that area. Mayor Smart responded the town has a volunteer who will be doing seasonal plantings and maintain the green areas however some of the area is private property. He also noted that the business owners have been asked to install a fence to screen their disposal containers. Dr. Kahn then asked who promoted the ordinance banning smoking in public parks. Mr. Weiss responded the Board of Health and in particular where children congregate and it is a quality of life issue regarding good health. Dr. Kahn questioned if it was a health issue or a style of life issue, data is poor regarding a health issue with outdoor smoking and it is making citizens and taxpayers unhappy as there is no health issue. Adjournment As there were no further comments, the meeting was closed to public discussion.
