2 4. Matt Charton NY 5. Charmaine Daley VI Call to Order Chairwoman S. Andrews (OH) called the meeting to order at 1:00 pm ET; nine voting members were present, establishing a quorum. Agenda Commissioner C. Gibson-Beltz (NE) moved to approve the agenda as presented. Commissioner J. Seigel (IN) seconded. Agenda approved. Minutes Commissioner A. Precythe (NC) moved to approve the minutes from December 8, 2015 as written. Commissioner A. Aylward (WA) seconded. Minutes approved. Discussion Rules Committee Report: The Committee has not met since the last Executive Committee meeting. DCA Liaison Committee: The Committee had to cancel its last meeting. The committee continues its mentoring program with NM DCA. Training Committee Report: Commissioner A. Precythe (NC) presented the Training Committee report (see attachment). The questions came out from the amendment trainings: rule amendment and the definition of warrant (to include warrants in ICOTS). Commissioner A. Precythe (NC) wants to clarify Rule The rule is effective March 1 and she inquired if the process is available to states (discretionarily) March 1. A. Precythe wants to make sure that is correct and the new conviction does not necessarily have to be after March 1. Meaning if a state has someone who has already been convicted for a new crime outside the sending state (for example last year) and is currently serving a 20 year sentence, after March 1 they would have the option to use this discretionary process. Legal Counsel R. Masters stated that we cannot apply the rules retroactively, unless it listed in the state s statute. However, he thinks that it might be a problem and an offender can challenge the compact on this issue. J. Seigel and R. Masters will research the issue and prepare a legal memorandum for review at the March meeting. Commissioner A. Precythe (NC) will discuss the changes to the definition of warrant at the March meeting. 2 Approved on March 29, B.S.
3 Technology Committee Report: X. Donnelly presented the written report (see attachment). The Technology Committee will be meeting later this month. Compliance Committee: The Compliance Committee canceled its last meeting, since the issue they were going to discussed was resolved - Illinois paid its dues. The national office sent an invoice for accrued interest to Illinois. Finance Committee Report: The Commission is running 1.3% under budget as of January 1. The long term investment portfolio has over $1.3 million. As of market close on Jan 13, 2016, the CSG portfolio was down about for 4% for the year. Region Reports East Region: The East Region cancelled its last meeting due to lack of quorum. South Region: The South Region will be meeting tomorrow. Midwest Region: The Midwest Region met on January 21, The Region discussed MD-FL case, halfway houses, and Tracy Hudrlik was appointed as the vice-chair. West Region: The West Region has not met since the last Committee s meeting. Executive Director Report Executive Director H. Hageman presented his written report to the Committee (see attachment). The U.S. Virgin Islands commissioner has been inactive in the Compact. The U.S. Virgin Islands has a new governor who may not be aware of the Compact. Commissioner A. Precythe (NC) moved to authorize Legal Counsel R. Masters to notify the Governor s office that the U.S. Virgin Islands may be held in default for not appointing a commissioner. Commissioner A. Aylward (VI) seconded. Motion passed. Executive Director H. Hageman presented the ABM 2017 meeting sites to the Committee (see attachment). After discussion, the Committee selected the cities in the following order: Pittsburgh, Hartford, and Philadelphia. The national office will complete the site visits to the hotels and present the results at the upcoming March meeting. Victims Representative Report Victims Advocate P. Tuthill participated in a victims advocate meeting with ACA in New Orleans where she discussed the VineWatch implementation. A lot of states are uncomfortable implementing this system. Minnesota has a conflict with its local law. P. Tuthill suggested launching a survey where states are in this process and asking them what kind of assistance they need for the implementation. She will also submit a request from MI to the national office regarding adding more information for violent offenders under victims sensitive field in ICOTS. 3 Approved on March 29, B.S.
4 P. Tuthill will speak with Appriss regarding the VineWatch services and report it at the upcoming Committee meeting. Legal Counsel Report Legal Counsel R. Masters stated that the CT offender s case who challenged the Compact Rules in Massachusetts was pending. There is a similar case with a district court in California. He will report on these cases at the face-to-face meeting in March. Legal Counsel R. Masters informed the Committee about a published decision by the Vermont Supreme Court concerning use of ICOTS documents in revocation proceedings: State vs Eldert. The decision was made about a year ago, however, the Commission was not aware about it until recently. The case will be discussed in details at the upcoming face-to-face meeting. Old Business ABM Planning Workgroup: The workgroup met on February 4, Commissioner C. Norman (AL) will present a detailed report at the March meeting. GA Progress Report: The Committee will discuss the issue at the March meeting. New Business Ad hoc on sanctions and retaking: Commissioner R. Maccarone (NY) updated the Committee on the ad hoc committee progress. They had multiple WebEx meetings. The ad hoc committee came up with a comprehensive proposal that will be discussed at its face-to-face meeting later this month. The ad hoc committee took a fresh look at violent behavior, definition of violation, sanctioning rule and matrix, violation reports, and offender s application. The committee will report its findings at the March Executive Committee meeting. Adjourn Commissioner A. Aylward (WA) moved to adjourn. Commissioner A. Precythe (NC) seconded. 6 INFORMATION TECHNOLOGY COMMITTEE REPORT February 9, 2016 ICOTS Helpdesk Tickets submitted decreased by 34% in December from the previous month, to 79, and again by 27% in January, to 57 tickets. While November, December and January are historically low months for the number of tickets submitted, these past two months are some of the lowest ever. Initial review points to a large drop in the number of duplicate offender records created and an overall lack of new bugs in ICOTS. ICAOS Website Total visits increased slightly in December, and more dramatically in January. So while the number of helpdesk tickets continued to drop, traffic to the ICAOS website seems to be rebounding from the seasonal dip in visitors. Mobile visits were roughly the same in December, but increased significantly in January, up to 38.3% of overall website traffic. Rule Amendment Changes Appriss is still on schedule for the development of the approved 2016 rule amendments. Xavier is awaiting confirmation from Appriss that the official release date will be February 24, Committee Meetings The committee had a meeting scheduled in January that was cancelled when the national office was closed due to a snow storm. The next committee meeting is scheduled for Wednesday February 17, 2016.
7 Commissioners Changes/Vacancies Executive Director s Report February 2016 Commissioner vacancies include IL and MD. Tammy Richardson is the interim Commissioner for KS, Robert Hasse is the new Commissioner for CA and Anthony Rowell is the Acting Commissioner for OK. The Commission has heard from the Virgin Islands commissioner and there has been a change in governors. The Virgin Islands DCA doesn t think that the new governor is aware of the compact. I recommend that the Executive Committee authorize Rick Master to notify the Governor s office that may be held in default for not appointing a commissioner. Complaints, Conflict Resolution and Misc. calls Other PA indicated they are preparing a complaint against Maryland for letting an offender bond out ln a retaking warrant. Received payment from IL, however they did not include the interest. Eighteen states have not complied with the policy requiring that they submit a roster for their state council. The national office signed the MOU for the data exchange with the Rocky Mountain Information Network (RMIN)/ Regional Information Sharing Systems (RISS) and sent it to them for signing.. The national office renewed the WebEx contract at the current pricing. The national office renewed the ICOTS vine agreement and is preparing for discussions with Appriss regarding the ICOTS maintenance agreement. The national office sent a notice to the stares reminding them that policy requires them to submit an update list of state council members. The national office is preparing the FY 2018 budget draft for Charles review prior to presenting it to the executive committee at the March meeting. Barno is working with Commissioner Maccarone to prepare for the upcoming face-to-face meetings in Louisville, Ky.
