1 OFFICIAL MINUTES OF THE CITY COUNCIL CITY OF THIBODAUX CITY HALL THIBODAUX, LOUISIANA DECEMBER 7, 2010 The City Council of the City of Thibodaux assembled in regular session at its regular meeting place, City Hall, 310 West 2 nd Street, Thibodaux, Louisiana, on Tuesday, December 7, 2010 at 5:00 o clock P.M. There were present: Councilmen Hebert, Richard, Taylor, Mire and Badeaux. There were also present: Mayor Charles Caillouet and Germaine Jackson. The minutes of the November 16, 2010 and November 30, 2010 Council Meetings were approved as written. Councilman Mire introduced an ordinance to amend Ordinance No Appropriation Ordinance for the Year 2010 (Supplemental Appropriation). The Public Hearing for this ordinance will be held at the December 21, 2010 Council Meeting. Councilman Hebert introduced an ordinance to amend and re-enact Section of the Thibodaux City Code of Ordinances (Water Rates). The Public Hearing for this ordinance will be held at the December 21, 2010 Council Meeting. Councilman Richard introduced an ordinance to amend and re-enact Section of the Thibodaux City Code of Ordinances (Sewer Rates). The Public Hearing for this ordinance will be held at the December 21, 2010 Council Meeting. Councilman Mire introduced an ordinance to amend and re-enact Section of the Thibodaux City Code of Ordinances (Natural Gas Rates). The Public Hearing for this ordinance will be held at the December 21, 2010 Council Meeting. The Public Works Director advised the Council Administrator that it is necessary for the City Council to consider the adoption of a resolution approving Change Order No. 2 for the 2010 Road Improvement Project. This change order is being proposed in order to reconcile the final contract quantities with the actual quantities required to complete the construction in accordance with the contract document. The proposed change order increases the contract price by a total of $75, thereby making the total final contract price $945, Leonard Chauvin, the engineer for the project, answered questions from the Council and stated that the change order was largely due to the resurfacing of Peltier Park Drive. He stated that unforeseen problems occurred with the subsurface of this street which required more extensive repairs. Councilman Taylor questioned Mr. Chauvin in regard to core samples. He also stated that in the future maybe more steps could be taken to alleviate these problems. Councilman Badeaux questioned the budgeted amount for this project. The Finance Director explained that this project was over the budgeted amount. 1

2 Councilman Mire questioned the total cost of Peltier Park Drive and asked to postpone this item until the December 21, 2010 Council Meeting. On motion of Councilman Mire, seconded by Councilman Hebert, the Council motioned to postpone the resolution authorizing the Mayor to sign Change Order No. 2 with Barriere Construction for the 2010 Road Improvement Project until the December 21, 2010 Council Meeting. Upon roll call the vote was as follows: The City Council held two condemnation status hearings. The first hearing, requested by Councilman Mire, was for the property located at 1259 St. Charles Street, St. Charles Manor Apartments. The property owners contacted Councilman Mire concerning the status of the demolition of this property and requested that the City Council review their current situation. Kirk Calhoun, of th Street in Metairie, LA, addressed the Council and stated that his company was contacted by two individuals that are interested in having the property donated to them instead of it being demolished. Troy Brown, of Francine Circle in Geismar, LA, addressed the Council and stated that his intentions are to have the property renovated should the owners decide to donate the property to him. James Brown, Pastor of the Gospel Assembly Church of Houma, stated that the intentions of his church are to renovate the property should the owners decide to donate the property to them. The Council questioned both parties in regard to the financial obligation and completion of the renovation to this property. Both parties stated that they are financially able to have the property completely renovated and plan to do so in a timely manner. On motion of Councilman Richard, seconded by Councilman Taylor, the Council voted to allow the property owner s 30 days to make a decision on the donation of the property. Upon roll call the vote was as follows: The second hearing was for property located at 1020 Lagarde Street. The owners appeared at a hearing on September 7, 2010 and discussed the progress being made to the property. The City Inspector also acknowledged the progress. The owners were given 90 days to complete the necessary repairs to the property and were asked to be present at tonight s meeting for a status report. The City Inspector stated that the property was secure and that the owners were planning to continue improvements and upkeep on the property. No action was required by the Council at this time. The Council considered the adoption of a motion to call a special meeting for December 13, 2010 in the Plantation Room at the Harang Auditorium in order to have the swearing in ceremony of the elected officials of the City of Thibodaux. This is the day that the new administration takes office in accordance with the City Charter. 2

3 After the ceremony the Council will convene the special meeting in order to consider the appointees that Mayor-Elect Eschete has selected in order for them to begin work. On motion of Councilman Taylor, seconded by Councilman Mire, the Council voted to adopt a motion calling a special meeting of the City Council to be held on December 13, 2010 at 10:00 a.m. in the Plantation Room of the Harang Auditorium. Upon roll call the vote was as follows: The Zoning Administrator informed the Council Administrator that the Planning and Zoning Commission has reviewed a request by Jaron Land Development Company to amend the TND Zoning District regulations in order to amend Section 1.08 (m) Guidelines for Lighting. The amendment would allow street lights to be installed at intervals of not less than 75 feet or greater than 250 feet and may be located on either side of the street. The current ordinance requires street lights be installed at intervals of no greater than 75 feet on both sides of the road. After review of the Planning Commission they have recommended approval by the City Council of this request. On motion of Councilman Mire, seconded by Councilman Richard, the Council voted to adopt an ordinance to amend and re-enact Article V of the Thibodaux Zoning Ordinance (Schedule of District Regulations) to amend guidelines for lighting in the TND Zoning District. Upon roll call the vote was as follows: ORDINANCE NO AN ORDINANCE TO AMEND AND RE-ENACT ARTICLE V OF THE THIBODAUX ZONING ORDINANCE (SCHEDULE OF DISTRICT REGULATIONS) TO AMEND GUIDELINES FOR LIGHTING IN THE TND ZONING DISTRICT BE IT ORDAINED by the City Council of the City of Thibodaux in regular session assembled, that Article V of the Thibodaux Zoning Ordinance (Schedule of District Regulations) is hereby amended and re-enacted so as to read as follows: Section 1.08 m. Guidelines for lighting, (1) Street lighting shall be provided along all streets. Generally more, smaller lights, as opposed to fewer, high-intensity lights, should be used. Street lights shall be installed at intervals of not less than 75 feet or greater than 250 feet and may be located on either side of the street. Street lighting design shall meet the minimum standards developed by the Illumination Engineering Society. 3

4 (2) Exterior lighting shall be directed downward in order to reduce glare onto adjacent properties.
