1 MINUTE OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CALABAA, CALIFORNIA, HELD WEDNEDAY, FEBRUARY 16, 2005 Mayor Harrison called the meeting to order at 7:32 p.m. in the City Council Chambers of City Hall, Mureau Road, Calabasas, California. ROLL CALL- Present: Mayor Harrison, Mayor pro Tem Groveman, Councilmembers Bozajian, Devine, Washburn. Absent: None. taff: Colantuono, Coroalles, Jomsky, Lysik, Mink, Roess, Tamuri. The Pledge of Allegiance was led by Gabriella Minassian. APPROVAL OF AGENDA Councilmember Washburn moved, seconded by Mayor pro Tem Groveman, to approve the agenda. MOTION CARRIED 5/0. ANNOUNCEMENT/INTRODUCTION tuart Lewis, Jennifer Breager, and Dane Dorfsky, Calabasas tudy Buddy Program, thanked the City Council for supporting the Calabasas tudy Buddy Program. Mayor Harrison read a proclamation for the Los Angeles County heriff Department s afe Communities Week. Councilmember Washburn invited everyone to attend the Method Fest Film Festival April 1-8, He also announced that Phil Angelides will be presenting the City with the first installment of the tate s $8.2 million grant for the Library construction project on Friday, February 18, Councilmember Devine reported on the potlight the Arts fundraising event. The City Council recognized the appointments of Fred Gaines and Robert Friedman to the Wall of Honor. ORAL COMMUNICATION - PUBLIC COMMENT Margaret Moore, 5916 North Las Virgenes Road, spoke in support of Item No. 9. urged city council to direct staff to prepare an ordinance ban the use and sale of poisons that affect the city s wildlife and environment. Mireille Neumann, Old Topanga Canyon, urged the City Council to protect the local wildlife by banning the use and sale of rat poisoning in the City. Patricia Doroshow and Richard Wentz, Heschel West Day chool, requested that the City Council agendize a discussion regarding Councilmember Devine s letter pertaining to the Heschel West Day chool Environmental Impact Report. INFORMATIONAL REPORT 9. tatus report regarding the Rental Registration Program. Lori Milligan, Calabasas resident, Nancy Arnaoundoff, Calabasas resident, Anthony Pecoraro, Calabasas resident, Tom hea, Calabasas resident, and Ernesta Luzi, Calabasas

2 resident, requested City Council assistance regarding improper billing practices being employed by apartment owners within the City. Tara Bannister, California Apartment Association, clarified billing practices utilized by apartment owners. The City Council agreed, by consensus, to authorize Councilmember Devine to meet with the owners of the Malibu Meadows Apartments in order to identify facts related to the issues raised by the tenants. Mayor pro Tem Groveman moved, seconded by Councilmember Washburn, to direct staff to bring back a resolution amending the rental assistance program available for the mobile home park residents so as to expand it to a citywide program, utilizing the same criteria as the current program. MOTION CARRIED 5/0. The City Council agreed, by consensus, to direct staff to continue to gather information regarding irregular increases to rental rates and fees, meet with the Malibu Meadow Apartment owners, and report back to City Council. NEW BUINE 8. tatus report regarding the traffic signal design for the intersection of Paseo Primario and Parkway Calabasas; recommendation to approve construction plan for the project; and direct staff to obtain bid proposals for construction. Judy Gilbert, Park Granada, Pamela Evans, Park Hacienda, Jennifer Bersey, Peale Drive, Patricia Knepley, Park Pinta, spoke in support of the proposed traffic signalization project. Councilmember Washburn moved, seconded by Mayor pro Tem Groveman, to approve Item No. 8. MOTION CARRIED 5/0. The City Council recessed at 9:03 p.m. and reconvened at 9:27 p.m. CONENT ITEM 1. Approval of the minutes for the January 5, 2005 City Council meeting. 2. Adoption of Ordinance No , amending Title 3 of the City of Calabasas Municipal Code regarding the Transient Occupancy Tax. 3. Adoption of Ordinance No , amending the City of Calabasas Municipal Code by making non-substantive changes to Title 1, 2, and Approval of a letter of support for potlight the Arts fundraising effort. -2-2/16/2005

3 Councilmember Washburn moved, seconded by Mayor Harrison, to approve Consent Item Nos. 1, 2, and 3. MOTION CARRIED 4/0. Consent Item No. 4 Councilmember Washburn expressed concern regarding the timing stated in the letter of support and suggested the following change: econd paragraph, first sentence, second line, change to accommodate construction of a 6,000-8,000 square foot theater to to accommodate construction of a theater with a 6,000-8,000 square foot foot print. econd paragraph, eliminate both the second and third sentences. Councilmember Washburn moved, seconded by Mayor pro Tem Groveman, to approve Consent Item No. 4, as amended. MOTION CARRIED 4/0. PUBLIC HEARING 5. Introduction of Ordinance No , amending Title 6 - Animals, of the City of Calabasas Municipal Code to create a system to grade animal facilities based on required annual inspections, and to revise affected penalty, licensing, and fee provisions. Motion to waive further reading. Mayor Harrison opened the public hearing. No one indicated a desire to speak. Mayor Harrison closed the public hearing. Councilmember Washburn moved, seconded by Councilmember Devine, to introduce Ordinance No and continue the public hearing to the March 2, 2005 meeting. MOTION CARRIED 5/0. 6. Adoption of Resolution No , to approve and adopt the updated Developer Fee Program for the Detailed Fire tation Plan for the County of Los Angeles benefitting the Consolidated Fire Protection District. Mayor Harrison opened the public hearing. The City Council, by consensus, directed staff to meet with the Los Angeles County Fire Department regarding the Developer Fee Program to discuss the program, identify the fee rates being charged to the City, and determine what monies are being spent for the benefit of Calabasas. Councilmember Washburn moved, seconded by Mayor Harrison, to continue Item No /16/2005

4 to the April 6, 2005 City Council meeting. MOTION CARRIED 5/0. PECIAL ITEM 7. Approval of the Civic Center Task Force s recommendation regarding Interim Design Development plans for the Civic Center Project. Pamela Evans, Calabasas resident, suggested that the proposed Civic Center site should include a playground for children. Councilmember Washburn moved, seconded by Mayor pro Tem Groveman, to approve the Interim Design Development Plans of the Civic Center, with the following recommendations: Use of stone finish in building materials in order to maintain anticipated plaza activities Expansion of the amphitheater area in order to delineate the site plan ubstitution of the words public garden for landscaping Prioritization of locally available recycled wood products or recovered wood for the designated wood paneling AYE: Mayor Harrison, Mayor pro Tem Groveman, Councilmembers Bozajian, Devine, Washburn. NOE: None. ABENT: None. INFORMATIONAL REPORT 10. February 2005 Check Register. No action taken. FUTURE AGENDA ITEM Mayor pro Tem Groveman moved, seconded by Councilmember Washburn, to agendize a discussion regarding the nature of the previous correspondence from Councilmember Devine regarding the Heschel West Day chool. MOTION CARRIED 5/0. The City Council directed staff to agendize the following: Discussion regarding a funding request in the amount of $32,000 from Coach Bret aberhagen and the Calabasas High chool Baseball Team to purchase and install an electronic scoreboard at Calabasas High chool. Discussion regarding acceptable overnight parking locations for trucks in the City. Recommendation from the Public afety Commission regarding an extra member of the heriff Department s Juvenile Intervention Team. Review of the Dark kies Ordinance as it relates to the wildlife corridors and rural -4-2/16/2005

5 areas. Review of the potential removal of the roundabout at Liberty Bell and Paul Revere Drive. Direction to staff to review wildlife issues pertaining to rat poisoning. ADJOURN The City Council adjourned at 10:24 p.m. Robin Parker, City Clerk -5-2/16/2005
