1 THE LEGISLATIVE, EXECUTIVE AND ADMINISTRATIVE SERVICE 1. BILL OFFICE 1.1 Introduction: Bill office deals with the Government as well as the Private Members Legislative Business. The Rajya Sabha had 78 sittings in all during the year. Government Private Members Legislative Business came up before it during 27, sittings in the 198 th,199 th 200 th Sessions of the Rajya Sabha respectively. 1.2 Government Legislative Business: (i) Bills introduced in the Rajya Sabha: 19Bills were introduced in the Rajya Sabha during the year. (Annexure-1.1) (ii) Bills originating in the Rajya Sabha considered passed: 14 Bills were those Bills which were introduced in the Rajya Sabha transmitted to the Lok Sabha after consideration passing. Discussion on motion for consideration of the Constitution (Scheduled Tribes) (Union Territories) Order 2003 was deferred as agreed to by the House on 9 th April, 2003 (Annexure 1.2). (iii) Bills transmitted by the Lok Sabha laid on the Table of the Rajya Sabha considered, Passed/Returned: 52 Bills were transmitted by the Lok Sabha laid on the Table of the Rajya Sabha during the year of which 21 were Money Bills 31 were other Bills. All the Money Bills were returned by the Rajya Sabha without any recommendations. As regard other Bills, 27 Bills were considered passed without any amendment. Two Bills namely, the Central Vigilance Commission Bill, 2003 the Indian Council of World Affairs 2003 were passed returned to Lok Sabha with amendments. The formal amendments made in the Foreigners 2003 the British Statutes (Repeal) Bill, 2003 were agreed to by the Rajya Sabha. Besides formal amendments in one Bill namely, the Banking Service Commission (Repeal) Bill, 2002 made by the Lok Sabha during last year were also agreed to by Rajya Sabha (Annexure-1.3) (iv) Bills originating in the Rajya Sabha referred to the Parliamentary Sting Committees: In all,9 Bills as introduced in the Rajya Sabha were referred to the

2 Parliamentary Sting Committees. (Annexure 1.4) (v) Bills originating in the Lok Sabha referred to the Parliamentary Sting Committees: 13 Bills introduced in the Lok Sabha, were referred to the Departmentrelated Parliamentary Sting Committees under the administrative control of the Rajya Sabha. (Annexure-1.5) (vi) Bills withdrawn: Only one Bill namely the Companies Bill, 1997 was withdrawn on 7 th May, 2003 by leave of the House. (vii) Bills negatived: Themotion for leave to introduce the University of Allahabad Bill,2004 was negatived by the House. Accordingly the Bill could not be introduced. 1.3 Private Members Legislative Business: (i) Bills introduced in the Rajya Sabha: 57 Private Members Bills were introduced in the Rajya Sabha during the year. (ii) Bills originating in the Rajya Sabha, considered passed/negatived or withdrawn: The Rajya Sabha discussed 4 Private Members Bills during the year. In all five Private Members Bills were withdrawn by the leave of the House including one Private Members Bill by mati Bimba Raikar namely, the Hindu Marriage 2003 was withdrawn by leave of the House without any discussion. (Annexure 1.6) 1.4 Pending Bills: The details of the Bills pending in the Rajya Sabha at the end of each Session during the year is as under: Sl. 4 obtained by the Rajya Sabha six Constitution Bills namely the Constitution (Eighty-seventh Amendment) Bill, 2003, the Constitution (Eighty-ninth Amendment) Bill, 2003 the Constitution (Ninetieth Amendment) Bill, 2003, the Constitution (Eighty-eighth Amendment) Bill, 2003, the Constitution (Ninety-first Amendment) Bill, 2003 the Constitution (Ninety-second Amendment) Bill, 1.6 Action Plan of the Bill Office Goals Objectives set therein: There has not been any substantial change in the original action plan of the Bill office during the year All the points are, therefore, the same that were identified while approving the plan in As regards the performance of the section, review meeting was held by the Secretary-General, with the concerned officers to have an assessment of achievement of the goals targets set under the plan. To further improve performance in the field of processing of Private Members Bills, it is desired that officers dealing assistants connected with it should be imparted training on Legislative drafting. Two statements, one, showing the action plan of the Bill office for 2003 other, describing performance of the section in achieving the goals/ targets are placed at (Annexure ) respectively. Currently, entries relating to the Bills processed during 200 th Session are being made. Weeding out of old files Precedents Renovation of Store The process of review of the files of the Government Private Members Bills has to be initiated a fresh in the light of the fresh orders regarding re-classification of files as also the reduction in the retention period of files. The process could not be taken up earlier in the absence of clear orders for their re-classification. However, the files are being reviewed but the process has been deferred till the conclusion of the 200 th session. All the precedents occurred so far have been entered in the precedent register it has been properly indexed. Renovation of Store has to be undertaken on priority in coordination with the G.A. Section. G.A. Section has been reminded twice through our office notes

40 dated the 4 th September, th December, 2001 but to no avail. S.G. in his previous review meetings has highlighted the need for renovation of Store.
