Update on John Muir Safe Routes to School Application Speakers: 5 Action: It was M/S (Gerhardstein/Howe) to hold a joint Bicycle and Pedestrian Subcommittee meeting to evaluate conditions related to safety at John Muir School, review its Safe Routes to School application, and discuss recommendations at the TC. 9 Transportation Commission Excerpts of Council Actions 2016 C2 April 5, Refer to Transportation Commission to Reassess UC Berkeley Game Day Parking Fines in RPP areas A, B, D, F and G Surrounding Campus From: Councilmembers Droste, Wengraf, and Capitelli Recommendation: Refer to the Transportation Commission to review current parking fines ($72) for UC Berkeley Football game day parking in RPP zones A, B, D, F and G and recommend higher fees to deter visitors from parking in those RPP zones. Berkeley Strategic Transportation Plan (BeST) From: City Manager Phillip Harrington, Public Works, Action: Presentation made and discussion held. March 29, 2016 City Manager Comments: 1. Pedestrian safety improvements completed on Claremont Avenue near John Muir School. 30. Extend Residential Preferential Parking Permit Program (RPP) on Sections of Blake Street, Parker Street, Cedar Street, Harper Street and Shattuck Avenue From: City Manager Recommendation: Conduct a public hearing and upon its conclusion, adopt a Resolution amending Resolution No. 56,508-N.S. Sections 25C, 25E, 25J and 25M by adding subsections to extend Residential Preferential Permit Parking on six city blocks. Financial Implications: General Fund - $2, Contact: Phillip Harrington, Public Works, Public Testimony: The Mayor opened the public hearing. 3 speakers. M/S/C (Maio/Moore) to close the public hearing. Vote: All Ayes. Action: M/S/C (Bates/Arreguin) to adopt Resolution No. 67,422 N.S. revised to to state that the Harper Street block is between Russell Street and Ashby Avenue. Vote: All Ayes. 35. Point-to-Point Car Share Program From: City Manager Recommendation: Adopt two Resolutions: Page 1 of 7

Identifying dedicated money from the general fund to revise ordinances and implement protocols that allow for point-to-point car share operations in Berkeley, and designate the custodian of the program. Financial Implications: General Fund - $120,500 Contact: Phillip Harrington, Public Works, Action: Item removed from the agenda by the City Manager. 42. goberkeley Parking Management Program Recommended Rate Adjustments for May 1, 2016 From: City Manager Contact: Phillip Harrington, Public Works, Action: Moved to Consent Calendar. Approved the revised materials correcting the Downtown and Southside/Telegraph Premium goberkeley areas parking meter rate to $3.25 per hour, not $3.00 per hour and to reduce time limit in the Value Area from 8 hours to 4 hours. March 15, Prioritize Installation of Bicycle Lane on Fulton Street From: Mayor Bates and Councilmember Arreguin Recommendation: Direct the City Manager and Transportation staff to prioritize and expedite the installation of a bicycle lane on Fulton Street between Bancroft Way and Channing Way. M/S/C (Bates/Moore) to approve the recommendation with the inclusion of the full version of the letter in attachment 2 as printed in the supplemental material. Vote: All Ayes. 8. City Manager Referral: Plan for Lighting and Signage at the Ohlone Greenway at Cedar, Rose, and Hopkins From: Councilmember Maio Recommendation: Refer to the City Manager to develop a plan to improve the lighting and signage (e.g. stop signs) at the Ohlone Greenway crossing at Cedar, Rose, and Hopkins, particularly for bicycle transit. Funds will be relinquished to the City s general fund for this purpose from the discretionary Council Office Budgets of Councilmember Moore and any other Councilmembers who would like to contribute. Vote: Ayes Maio, Moore, Arreguin, Capitelli, Wengraf, Worthington, Droste, Bates; Noes None; Abstain None; Absent Anderson. 39 Adopt a Council Prioritization Process for Referrals: Reweighted Range Voting From: Councilmember Droste Recommendation: Adopt a system of Reweighted Range Voting to prioritize Council referrals and refer to city staff to develop the following: 1) A schedule of annual meetings for Council to hold prioritization sessions. 2) A system of Reweighted Range Voting (RRV) for Council to identify and establish priorities among all existing and unaddressed referrals at prioritization sessions. a) If a Councilmember does not rate a specific referral, the Councilmember s default score for that referral is a zero (0). 3) Protocol for referrals passed after a prioritization session takes place. New referrals those passed between one prioritization session and the next, will go into a holding position until they can be prioritized at the following session, unless: a) Council designates a referral as urgent if the referred work is necessary to protect life safety or is necessary to secure or avoid losing time-sensitive funding (e.g., grant funding that the funding agency may take back unless a specific action is taken). b) Staff designates an item as short term that can be addressed within a three month time frame. 4) Basic background information on referrals prior to prioritization sessions, including but not limited to a broad indication of staff time and financial resources required to complete a referral, an estimate of the impact of each referral in terms of citywide outcomes. 5) A window, prior to prioritization sessions, in which sponsoring Councilmembers can identify any referrals that are no longer needed and should be removed from the prioritization process. 6) Once a Strategic Plan is completed, all referrals should have a nexus to the Strategic Plan. 13 Transportation Commission Excerpts of Council Actions 2016 C2 February 23, Grant Award: Metropolitan Transportation Commission s Climate Initiatives Parking and TDM Grant Program From: City Manager Recommendation: Adopt a Resolution authorizing the City Manager or Designee to file an application for $950,000 of funding assigned to the Metropolitan Transportation Commission and committing any necessary matching funds equivalent to 33% of the total project costs and stating assurance to complete the project known as the goberkeley Residential Shared Parking Pilot. February 9, Restrict Parking in the Hills Hazardous Fire Area (Continued from January 12, 2016) From: Disaster and Fire Safety Commission Recommendation: Refer to staff the design of a parking restriction program in the Hills Fire Zone to ensure access for emergency vehicles and to allow for safe evacuations in an emergency and to hold public meetings to get community input in the design of such a program. 17 C-5 Human Welfare and Community Action Commission ACTION CALENDAR April 26, 2016 To: From: Honorable Mayor and Members of the City Council Human Welfare and Community Action Commission Submitted by: Praveen Sood, Chairperson, Human Welfare and Community Action Commission Subject: Commission Process Improvement RECOMMENDATION Adopt a Resolution requesting that the City Manager examine the addition of language to the Berkeley municipal that clarifies aspects of the management of City of Berkeley commissions and the removal and appointment of commissioners. FISCAL IMPACTS OF RECOMMENDATION There are minimal costs associated with the actions recommended beyond amending the policy as appears in city publications. CURRENT SITUATION AND ITS EFFECTS The city of Berkeley has a unique system of commissions that acts on a consultative basis with city council on a variety of topics. Like most organizations, commissions need to constantly look at ways to improve their process. The current code regarding the operations of the city commissions is unclear in several areas and this resolution attempts to find solutions to these needs. BACKGROUND On 9/16/2015 the HWCAC held a public meeting with a resolution on Divestment from Israel as one of the agenda items. Just before the start of that meeting, Cheryl Davila, the commissioner who had brought the resolution forward was informed that she was being removed by her appointing councilperson, Darryl Moore. According to Ms. Davila, Councilperson Moore had a conversation with her a day before the meeting and had warned her to pull the resolution or face the consequences. This dismissal just before the meeting effectively removed Ms. Davila from the debate that night and from any potential vote on the resolution. In addition to the dismissal, several members of the council appointed new commissioners to the HWCAC just before a vote on the resolution. One of these last minute appointments was for only one meeting, which happened to be the one on 10/21/2015 where the divestment resolution was being voted on. Other appoints didn t even show up for the meetings, and were eventually removed. Whether these appointments were made to purposely manipulate the vote is a separate discussion, but they gave that impression to many commissioners and members of the public. We firmly believe that whatever your feelings are in regards to a topic, in this case Divestment from Israel, the rights of commissioners and the public to engage in open debate and to a fair vote on the topic should not be compromised. These actions by city council highlight how the current code is vague on dealing with some aspects of commissioner dismissals and appointments and how that lack of clarity may be used to exert influence on commissioners and manipulate open debate. This resolution recommends several changes to the code regarding commissions in an effort to clarify these points and protect the role of the commissioner and improve the performance of these valuable groups. ENVIRONMENTAL SUSTAINABILITY There are no identifiable environmental impacts or opportunities associated the action suggested in this report. RATIONALE FOR RECOMMENDATION As a member of the commission system the Human Welfare and Community Action Commission has a vested interest in the improved operations of the commission system. In addition, we believe that clarifying certain parts of the process will help the commission system to better serve the community by providing the opportunity for people to tackle difficult subjects. ALTERNATIVE ACTIONS CONSIDERED None CITY MANAGER The City Manager takes no position on the content and recommendations of the Commission s Report. Commission Improvement Process WHEREAS, the Human Welfare and Community Action Commission is organization with the city s commission program and has a vested interest in the approved function of the commissions. WHEREAS, here is potential for the commission appointment process to be used in ways that it may not have been intended. WHEREAS, the set of rules regarding the removal of commissioners by their appointing city council member is not clearly defined. WHEREAS, we believe the system could be improved with closer contact between commissioners and their appointing city councilpersons. NOW THEREFORE BE IT RESOLVED by the City Council of the city of Berkeley that the city manager examine the feasibility making changes to the existing city code to improve the operations of the commission process. BE IT FURTHER RESOLVED that BMC Vacancy and Removal Section A Sentence 2 be amended with the following or similar language. Vacancies on the board shall result when a member notifies the City Clerk of his/her resignation, or when an elected member moves and establishes residence outside of his/her election district, or when a commissioners appointment is revoked by the appointing city council member in writing with a minimum of 30 days notice. This will ensure that any terminations of appointment are done with advanced notice and will ensure against the conflicts of interest that may arise from last minute removals of commissioners. BE IT FURTHER RESOLVED that BMC Vacancy and Removal Section B Sentence 1 be amended with the following or similar language....finish the unexpired term of the appointment. This vacancy appointment may not vote on commission items till the 2nd meeting following their appointment. This will ensure against the conflicts of interest that may arise from that last minute appointments made to affect the outcomes of votes. BE IT FURTHER RESOLVED that BMC Temporary Vacancies Sentence 3 shall be amended with the following language....remaining representatives of the poor, as long as that appointment is approved by a minimum of 3 representatives of the poor, if three representatives of the poor are not available then the temporary appointment may be voted on by a quorum of commissioners and may be approved by a majority of the quorum. This change ensures that any temporary vacancies on the Human Welfare

BE IT FURTHER RESOLVED that BMC officers, meeting, and procedures be amended with the following or similar language E. This will help ensure better communication between council members and their appointees. 21 TC 4/21/16 D1 Tom Lent 2464 West St Berkeley, CA (510) Testimony to City Council on March 15, 2016 For Item #6 on the Fulton Street Bike lane project I have lived in the flat lands of Berkeley, cycling to meetings, errands, friends and movies and raising a son who bicycled to school and his activities for more than 20 years. I ve seen and appreciated the major improvements the City has made in bike infrastructure and the increasing number of cyclists joining us on the streets over these decades. So I was hit hard by the news that my dear friend Meg Schwarzman had been run over by a car and was in critical condition. In the days that followed a wonderful community of support mobilized to send healing energy to her, food to Mike and the family and to share news as the incredible Meg and her awesome medical team brought her back to life. I was hit hard again when I learned that Meg is not alone. It turns out that Berkeley is #1 in California #1 in crashes with an injury or death to a bicyclist with one reported on average every other day for the last 8 years the state has been tracking. Bicycling is important to all of us in Berkeley whether we ride or not. More cyclists are critical to the health of our community and planet. But as Councilman Moore has said, people must feel safe to meet our alternate transportation goals. We need to fix Fulton Street and fast. And we need to keep going. Meg s crash demonstrates that individual responsibility the responsible riding and the flashy gear she wore and we wear in her honor tonight is not enough. Cyclists will continue to be hit every other day until we have a comprehensive safe network of separated bike lanes throughout the City. We are here today to applaud the action you are taking tonight to fast track the Fulton Project and to urge the City to devote the additional resources needed to rapidly complete the rest of the Bike Plan. We represent many more Berkeley residents who could not be here tonight but care deeply about this issue and intend to stay engaged with you to see the plan through. Meg and Mike have devoted their lives to protecting and improving public health the best way we can honor the sacrifice forced on their family is to promptly make this city much safer for everyone. Through our electronic correspondence, I understand that the Conversion Project is not part of the City s current work plan, and is not within the City s proposed five-year Capital Improvement Plan, for which it will seek funding from the Alameda County Transportation Commission through Measure BB. However, because the Conversion Project continues to be identified in City materials, 1 my client must proceed as though the Conversion Project is presently under consideration as a designated, high-priority transportation improvement.
