ROLL CALL 7:11 pm Present: Hall, Johnson, Linvill, Ng, Olson, Wagley Absent: Parsons, Pietras, Winkel Public Present: PUBLIC COMMENT (Limit: 3 minutes per person; 5 minutes per organization) Susan Cerny stated that her students at UC Berkeley have drafted landmark application for 2600 Bancroft, the YWCA. She asked how to initiate the Landmark process. Chair Olson describe the process, and requested that 2600 Bancroft be added to the initiations list. 3. AGENDA CHANGES A. CONSENT CALENDAR (LPC consideration of routine or non-controversial projects) Motion: (Johnson, Wagley): Move Item 6A up on the agenda, before Item #4, to accommodate a number of staff and consultants who were present for the item. Action: Motion approved. 4. CONTINUED PUBLIC HEARINGS A University Avenue, Consideration of Landmark or Structure of Merit Status (LM # )** (Note: Hard copies of the application were provided to the Commission for the July 2, 2009 meeting.) Status: Nomination of the property as a City of Berkeley Landmark or Structure of Merit. On May 7, 2009, the Landmarks Preservation Commission initiated the property at 2054 University Avenue and scheduled a public hearing for the LPC meeting on July 2, On June 14, 2009, the City of Berkeley received the landmark designation application for the property. On July 2, 2009, the Commission opened the public hearing and continued the item until the September 3, 2009 LPC meeting. LPO Applicability: The LPO requires the LPC to evaluate the nomination against the criteria contained in Section Staff Recommendation: Staff recommends that the Commission open the public hearing, receive public testimony, and based on the written and oral evidence direct

2 September 3, 2009 Page 2 staff to return with a Notice of Decision consistent with the Commission s determination. Daniella Thompson said that she had sent correspondence to the Commission, but it was not in the packet. She stated the building meets the criteria for cultural significance, and also suggested that the rear building may also be part of the original structure. Susan Cerny spoke in favor of the designation Craig Larsen, owner, spoke about the building and invited the Commission to visit the property. He stated that the two story rear building was built in the 1970 s. Commissioner Johnson spoke about the benefits of the Mills Act. Steve Finacom spoke about the cultural significance of the building, and recommended that the windows and sides of the building be designated as significant. Motion: (Johnson, Wagley): Approve the nomination as a City of Berkeley Landmark 5. PUBLIC HEARINGS A Shattuck Avenue (2044 Vine Street), the Capitol Market Building, Consideration of Landmark or Structure of Merit Status (LM # )** Status: Nomination of the property as a City of Berkeley Landmark or Structure of Merit. On July 2, 2009, the Landmarks Preservation Commission initiated the property at 1500 Walnut and scheduled a public hearing for the LPC meeting on September 3, On August 13, 2009 the City received the landmark designation application for the property. LPO Applicability: The LPO requires the LPC to evaluate the nomination against the criteria contained in Section Staff Recommendation: Staff recommends that the Commission open the public hearing, receive public testimony, and based on the written and oral evidence direct staff to return with a Notice of Decision consistent with the Commission s determination. Susan Cerny spoke in favor of the nomination John English spoke in support of the nomination Motion: (Hall, Wagley): Approved the nomination as a City of Berkeley Landmark Vote: (Y: Hall, Johnson, Linvill, Ng, Olson, Wagley; Absent: Parsons, Pietras, Winkel) Action: Motion Passed B Shattuck Avenue, Structural Alteration Permit (LM # )** Status: Structural Alteration Permit application to make alterations and repairs (replace the signage) to a designated City of Berkeley Landmark. LPO Applicability: LPO Section C requires the LPC to evaluate the project against the review standards and criteria contained in Section

3 September 3, 2009 Page 3 Staff Recommendation: Staff does not recommend approval of the replacement vertical signage as proposed by the applicant. Discuss the proposed signage with the applicant and give further direction. A representative from the applicant s sign company was present. The Commission noted that the signs had already been approved; staff agreed that the signs had been illegally installed prior to the Commission s approval, and confirmed that no building permits had been issued for the signs. Motion: (Johnson, Wagley): close public hearing. Designate a subcommittee comprised of Olson, Ng, Hall, and Linville to meet at the site and recommend appropriate signage for the building, which would then return to the full Commission for approval. Jim Novosel, architect for the restoration of the building who was involved with the Longs signage should also be invited to attend. (None of the proposed/installed signage was approved by the Commission). C Shattuck Avenue, Structural Alteration Permit (LM # )** Status: Structural Alteration Permit application to make alterations and repairs (replace the signage) to a designated City of Berkeley Landmark. LPO Applicability: LPO Section C requires the LPC to evaluate the project against the review standards and criteria contained in Section Staff Recommendation: Approve the application. Yogurtland representative spoke to the commission and answered questions. Motion: (Johnson, Wagley): close public hearing. Approve Option B, the oval sign in a size consistent with the other similar wall signs on the building; Approve the blade sign with the condition that the bracket height should be consistent/compatible with the height of the other blade signs on the building. 6. Section 106 Consultation A. 830 University** Status: Section 106 Consultation with Landmarks Preservation Commission regarding renovation of City of Berkeley Public Health Clinic LPO Applicability: LPO Section establishes the LPC s authority to carry out, assist, and collaborate in studies and programs designed to identify and evaluate structures, sites, and areas worthy of protection. Staff Recommendation: 1) Receive testimony from the public and provide comments to staff regarding the renovation project s effect on the historic character of the Public Health Clinic; and 2) receive testimony and comment on the historic evaluation of the Public Health Clinic, and whether or not the property is eligible for

4 September 3, 2009 Page 4 the National Register. Staff introduced the project and the action that was before LPC. Lorin Jensen, Supervising Civil Engineer, described the proposed renovation project, the services the clinic provides, and the schedule and restrictions on the federal money for the project. Daniella Thompson and Susan Cerny of BAHA both spoke in support of the renovation project but stated that they disagreed with the historic consultant s conclusion that the property was not eligible for the National Register. Motion: (Wagley, Johnson): 1) The Commission has received compelling information that indicates that the property could be eligible for the National Register. The Commission disagrees with the Knapp report s conclusion that the property would not be eligible for the National Register. The Commission also indicated that the property could be initiated as a City of Berkeley Landmark at some future date. 2) The Commission approved of the proposed renovation project because it would comply with the Secretary of the Interior s Standards for the Treatment of Historic Properties. 3) The Commission concurred that the APE for the renovation project is limited to the property. 7. PROJECT REFERRAL A Dwight Way, (AUP # )** Status: Pending application to expand an existing duplex by constructing a threestory addition at the rear of the subject building. LPO Applicability: The building appears on the State History Resource Inventory. Staff refers projects with alterations to SHRI-listed properties to the LPC. Staff Recommendation: Staff requests that the Landmarks Preservation Commission determine whether the subject building appears to be eligible for designation as a City Landmark or Structure of Merit and, if so, that it initiate the property for designation. The owners were present and answered the Commissioner s questions. Action: The Commission did not initiate the property. The Commission concurred with BAHA s comments about the treatment of the front of the building and stated their preference for having complimentary, but different window and siding treatment on the addition. Some Commissioners raised concerns regarding the mass or the addition at the rear. 8. ACTION ITEMS A. Establish Subcommittee 2031 Sixth Street (Lifelong Medical Clinic) Staff distributed a late report to the Commission via . Motion: (Johnson, Wagley): Establish a subcommittee made up of Parsons, Winkel, and Olson, unless Winkel and Parsons, who were not present, prefer not to be on the subcommittee. Establish Subcommittee Branch Library Projects** Motion: (Hall, Wagley): Create a flexible Subcommittee made up a mix of the following members: Linvill, Olson, Hall, and also Parsons and Winkel (as available/interested) to work with the project planner and the applicants to make recommendations to the full Commission. C. Opportunity for Commissioner comment on status of projects for which the LPC has established a subcommittee or liaison (Note: Site will come off the subcommittee list upon approval of a Certificate of Occupancy).** 10. OTHER MATTERS Commissioners may comment on other matters and ask for additional discussion to be scheduled on a future agenda (per the Brown Act, no deliberation or final LPC action may be taken). Staff will provide the Commission with a brief update regarding the following projects, which may be scheduled for action at an future LPC meeting: 1512 La Loma Demolition of garage on Landmarked property under Mills Act Shattuck Hotel Balconies The Commission expressed concerns about the possible omission of the balconies because they were an important reason why the Structural Alteration Permit was approved, including granting replacement of the windows. 11.
