2 Manage Subpoenas Though PROTECT has always provided users a way to generate subpoena documents, the Manage Subpoenas feature (November 2008) now gives users the ability to track, and in many cases report upon, subpoena information beyond document generation such as: Information that Can be Tracked Subpoena Service Details: How should the subpoena be served? How was it ultimately served? When? Where? To whom? What is the name of the person who served the subpoena? (he/she may be called to testify). When was it sent to the server? When was it received by the server? Did service fail? Notes fields (non reportable) to track How many attempts to serve? Were there associated service fees? Was the subpoena served outside our county? Outside the state? If service failed, why? Is the person incarcerated? In warrant? No longer at that address? Queue up and Batch print documents via Manage Subpoenas Track Service Details OR Manage Subpoenas Window Track Cancellation Details Regular/standard document generation See Summary or Status Information Subpoena Cancellation Details: What court events, for which subpoenas were sent, are now cancelled? All witnesses on this event need to be called off. Which court events are still ON but have witnesses that are no longer needed? Who are the witnesses that need to be called off and contact info so I can call them quickly. How was the witness called off? By phone? By mail, ? Subpoena Status: Has the subpoena yet been served? Who has it? The server? Has it left our office? Can we cut it off at the pass? Are all my subpoenas/witnesses for tomorrow s or next week s Jury Trial good to go? Has a particular witness been called off? Have all cancelled witnesses been called off? Generating The Document Two Options Which is best for you? For offices that wish to generate subpoenas from within the DA Case through the Document Generation window, this is still a viable procedure and is not wrong. For offices that wish to batch print their subpoena documents the Manage Subpoenas window is where the process begins. Subpoenas are first put into a queue where they wait to be printed by anyone, at any time. It doesn t matter to PROTECT who queues up the subpoena or who prints it from the queue, each office determines their own policies/procedures. In some offices, putting subpoenas into the queue may become the way that an attorney requests needed subpoenas from his/her staff. In other offices, the attorney may continue to request subpoenas from staff they way he/she always has, and the staff person adds the subs to the queue. 3 Needed PROTECT Admin Pre-Work Before you start using Manage Subpoenas, some behind the scenes work needs to be done by a PROTECT Administrator(s) in your office Detailed instructions for each task are found in the PROTECT Admin User s Guide (1) Set Template Properties Equivalent To Subpoena All subpoena templates (adults, juvenile, officer notifications, etc) must be set to Equivalent to Subpoena in PROTECT Admin before they can interact with the Manage Subpoenas feature. When a template is set to Equivalent to Subpoena documents generated from that template are shown in the Manage Subpoenas window. Documents generated from a subpoena template before it was set to equivalent to sub will not be displayed. The sooner you can set your subpoena templates to Equivalent to Subpoena the better. Even if you don t plan to fully use the Manage Subpoenas feature right away, it s strongly recommended that you activate this template setting as soon as possible so that the subpoenas you generate today, will be visible in the Manage Subpoenas window weeks or months from today or whenever you wish to start tracking service and/or cancellation details. (2) Determine Your Evidentiary Events When setting the court events to display in the court event grid at the top of the Manage Subpoenas window, users have a pick list option called Evidentiary Events. Evidentiary events could be thought of as court hearings that typically require subpoenas. Since each office may have a different definition of evidentiary, the Manage Subpoenas Preferences window in PROTECT Admin allows each to define the court events that fall into this category. (3) Map Job Codes to New Job Category PSERVER If your office wishes to track service details including the name of the person who served a subpoena, that person must be (1) in your database as a professional, (2) associated to a Job Code and (3) that job code must be mapped to the new Job Category PSERVER. Many times, servers are professionals already in PROTECT, such as officers, sheriffs or in-house servers in larger DA Offices. In those cases, you only need to map the appropriate Job Codes (such as Officer) to the Job Category PSERVER. Professionals associated to the PSERVER job category appear in the Manage Subpoenas window only, on the Service Tab in the served by drop down field. Manage Subpoenas Page 3 of 14

4 Open and Tour the Manage Subpoenas Window Open the Manage Subpoenas window from the View/Navigate window via the (1) Activity Menu Manage Subpoenas or (2) the Manage Subpoenas button on the PROTECT toolbar or (3) by clicking Ctrl + S. When Manage Subpoenas is open, the button at the top of the PROTECT window becomes disabled or grayed out so users cannot open the window twice. The Microsoft Task Bar along the bottom of the window displays a Manage Subpoenas button. Click this button to toggle between the Manage Subs window and other already opened applications. Manage Subpoenas can be kept open all day. When the user clicks on a different Task Bar button, the Manage Subs window is automatically minimized. Or, users an manually minimize the window via the - in the upper right corner. At times, you may notice that the Manage Subs icon is absorbed into the PROTECT icon on your taskbar. This may happen when several applications are open at once or when the ereferral open window open. The PROTECT button will display a number equal to the number of applications housed within this one button, and a drop down arrow. When the PROTECT button is clicked, you ll see the Manage Subs button from the pick list that opens. Close Manage Subpoenas through the X button in the upper right corner or the Close button in the lower right corner. When the Manage Subs window is first opened, the user may see a list of future court events along the top half of the window. If a DA Case is currently active/open, events from this DA Case are displayed. If no DA Case is currently open, the user can find and display court events using the three pick lists along the top of the window. Select a court event at the top of the window to see or enter subpoena information within the tabbed divisions along the bottom of the window. In the court events grid, each row of information represents one day of a court event. On the divisions, each rows represent one subpoena document for that event. In the screen shot at right defendant Arthur Fonzerelli has a Jury trial scheduled for Saturday November 15 at 10 AM. On the Summary Tab, two case parties were ordered to court; an Officer Witness and an Expert Witness. One subpoena needs to be cancelled and one has been cancelled already. 5 Court Events Grid Overview In the court events grid at the top of the Manage Subpoenas window, one row of represents one day of a court event. For example, a 3-day Jury Trial, taking place October 20, 21 and 22 would appear as three separate rows. This allows users to indicate track details for each day individually, such as cancellations that are needed for some but not all days of the hearing. The default sort order for the rows of court events is the same as the column order. In other words, the first field, Event Date/Time is the primary sort, followed by Location, etc. Users can change the sort order by clicking any column heading to sort by that column/field. When this is done, a small arrow is displayed in the sorted by column heading. By sorting on the Event Status column, for example, you could group together events that are cancelled to see them easier. Columns can be resized by click/hold/dragging column headings left or right. This may be needed for long defendant names. You cannot save a particular sort order or column width, these are re-set when the window is closed. More than one court event can be selected by <Ctrl> + clicking. This is done only when Requesting or queuing up a new subpoena, where one document should reference more than one court event. More than one court event cannot be selected when indicating service or cancellation information. COURT EVENT GRID FIELD NAMES/DESCRIPTIONS FIELD NAME Event Date/Time Event Defendant Court Case # DA Case # Event Status Atty on Case Atty on Event VW on Case Unit on Case Judge Location DESCRIPTION, NOTES Displays the date and time of the court event. This date/ time will appear or already does appear on the generated subpoena. User-set court event abbreviation, may differ from county to county. This is set in PROTECT Admin. Defendant associated to the court event * For CCAP scheduled events this displays the Court Case # associated to the event. * For user scheduled events, if defendant on event has one court case #, this displays that one Court Case #. * For user scheduled events, if defendant on event has more than one Court Case#, this will be blank. Displays ON to mean that a court event will happen or did happen, and OFF to mean that the event will not or did not happen. When an event is turned off, either by the PROTECT user or via the CCAP Interface, the status for all subpoenas generated for that event will automatically become Needs Cancel Initials of the attorney assigned to the DA Case. Initials of the attorney assigned to the court event. Displays the initials or abbreviation of the Victim Witness professional assigned to the DA Case Displays the user-set abbreviation for the unit assignment for the DA case. Initials of the judge assigned to the court case. Displays the user-set location associated to the court event which will print out on the document. If this column is displaying non-standard locations, it may be a sign that your office has received a court event location from CCAP That needs to be mapped to a PROTECT location. 6 Change the Court Events Display At the top of the Manage Subs window are search fields that allow users to find court events based on criteria you choose. Pick a value from one or all of these three fields and then click <Find Now> to populate the grid. After the search is complete, the values selected for each list remain displayed in the drop down fields so that at any time you can see and understand the events being displayed in the court events grid. When Manage Subpoenas is first opened, a default search is performed for you. Evidentiary events for the currently active DA Case, taking place between today and one year from today, assigned to any/all attorneys are displayed. Displays court events your office designates as evidentiary via PROTECT Admin. Displays Preliminary Hearings and CCAP Preliminary Hearings Displays court events for which a document marked Equivalent to Subpoena in PROTECT Admin has been generated for at least one case party. Displays any court event for which the Needs Cancel check box on the Cancel tab has been checked and the Confirm Cancel Check box on the Cancel tab has not been checked for at least one case party. Monday Friday are business days. Count starts with tomorrow s events and onward. If an event is taking place on a weekend, it will still be included in the search results. Displays initials of any professional with a DAAssign job category. (category must be nonhidden). N/A = court events where any attorney or no attorney is assigned. Use this option you want to see only those events for which a Subpoena would normally be created, may help in determining where subpoenas are needed. To quickly hone in on only these events that always require subpoenas Particularly useful for VW staff. This option is essentially a to do list when working on cancelling subpoenas. Lets you quickly look ahead on your agenda to court events taking place Monday Friday. Quickly see only the events on CASES that are assigned to a particular attorney, not the event assignment. Buttons Along The Bottom Of The Manage Subpoenas Window Subpoenaed Parties radio button. Use this when you want to know or see only the witnesses that you ordered to court, as opposed to all case parties associated to the DA Case on the selected court event. (Note to PROTECT Administrators: People for whom an equivalent to subpoena document has been created are the only parties shown). Manage Subpoenas Page 6 of 14

7 All Case Parties radio button. Displays all persons on the DA Case for the selected event, regardless of whether a subpoena has been created for them Edit Case Party opens the Details for Case Party window for the case party selected on any of the tabbed divisions of the Manage Subs window. Users can quickly update/edit case party information, <Save>, <Close> and are then returned to the Manage Subs window. This is useful when a VW Coordinator is in the process of calling of a witness. He/she sees that no telephone number is listed and so quickly adds that info. With the ability to indicate that an existing case party is also a witness or a victim, a user could edit a Mother or Father case party by adding a witness role. Then <Save>, <Close> and return to the Manage Subs window to queue up a subpoena for the witness role as opposed to the Mother. Add Case Party opens the Add Case Party window within the DA Case on the selected event. Users add a case party, <Save, <Close> and are returned to the Manage Subs window. This is useful when a user is queuing up subpoenas and notices that not all witnesses have been added to the DA Case. Go To DA Case takes the user to the Case Tab of View/Navigate for the DA Case on the selected event. This is useful for times when a user wants to see more case information than what is shown on the Manage Subs window Close closes the Manage Subs window. Summary Tab Overview The Summary Tab gives users a big picture view of the subpoenas created for a particular event. When the Summary Tab is first opened, the Subpoenaed Parties radio button in the lower left corner is selected showing only those case parties that received a subpoena. Users can see all case parties by clicking the All Case Parties radio button. You can see who was ordered to court, the date that appears on the generated subpoena document, the template that was used and most importantly the subpoena s status. When changes are made to the subpoena on the other tabbed divisions Request, Service, Cancel the subpoena status shown on the Summary Tab may change. Subpoena status also appears in View/Navigate on the Case Events, Victim and Witness Tabs. This status only appears for documents generated from templates that have been made Equivalent to Subpoena in PROTECT Admin Manage Subpoenas Page 7 of 14

8 The Summary Tab is not interactive like the other tabbed divisions, it is only a place to look at information. Subpoena details that are entered on the Request, Service and Cancel tabs are summarized and displayed on the Summary Tab. A one page summary of all details for one subpoena can be seen by double clicking a subpoena record/row on the Summary Tab. The All Details window captures information entered on all four tabbed divisions - Request, Service and Cancel. SUB STATUS In Queue ABBV QUE DISPLAYED ON THE SUMMARY TAB AND IN VIEW/NAVIGATE when a sub has been added to the Subpoena Queue from the Request Tab. Offices that do not batch print subs will not see this status. Generated GEN after a subpoena has been generated REGARDLESS of how it was generated batch or regular. Sent to Server SSVR after a user clicks the Sent to Server check box on the Service Tab. Received by Server RSVR after a user clicks the Rec d by Server check box on the Service Tab. Served SVD after a user clicks the Sent to Server check box on the Service Tab. Service Failed FAIL after a user clicks the Service Failed check box on the Service Tab. Needs Cancellation NCAN after a user clicks the Needs Cancellation check box on the Cancel Tab AND/OR when the underlying court event is turned off by the CCAP Interface or manually by a user in the DA Office Cancelled CNCD after a user clicks the Confirm Cancel check box on the Service Tab. Mixed Status Detached MIX DET If a single subpoena is associated to more than one court date and some dates have a different status than others. EX: A three-day jury trial, a witness is subpoenaed for all three days. Later, the witness is not needed for day 3. Days 1 and 2 = Served, but day 3 = Needs Cancel. In the Manage Subpoenas window, you can see the court event day by day. But in View/Navigate you only see the document generation event, and so the status of that entire subpoena document is Mixed This will only happen for multiple day subpoenas. If a subpoena is detached from the DA Case. This status will only appear for equivalent subpoena documents and it will ONLY appear in View/Navigate - detached subpoenas are removed from the Manage Subpoenas window. This same All Details window can also be opened from the View/Navigate screen, on the Case Events, Victim and Witness Tabs by double clicking a subpoena record there and then clicking the Subpoena Details button. 9 Request Tab Overview The purpose of this tab is to add needed subpoenas to the Subpoena Queue for Batch Printing. The Request Tab changes or replaces the way subpoenas are add to the Subpoena Queue, but it does not change the queue itself. If your office prefers to continue generating subpoenas from within a single DA Case, this tab can be ignored. The Summary, Service and Cancel tabs can still be used to track other subpoena information, regardless of how the subpoena is generated. Batch printing is optional. If you are not familiar with batch printing, it is strongly recommended that you consult that lesson within the User s Guide for more information. There is significant pre-work involved before an office can batch print documents. For offices that choose to batch print their subpoenas, the Request tab could become the means for attorneys to communicate the need for subpoenas to their staff. Instead of created a document or hand writing notes about needed subpoenas, attorneys could add subpoenas to the Subpoena Queue, for a secretary to batch print later. Offices that communicate the need for subpoenas by writing on paper or by generating a request for subpoenas document can continue to do so this is not wrong. The secretary can either work from that paper to add subpoenas to the Subpoena Queue for batch printing or generate the subpoenas through standard document generation. In v3.0, document generation has been enhanced to allow users to accomplish much of the same work that can be accomplished via the Manage Subpoenas window, it is only a matter of preference. When the Request Tab is first accessed, the All Case Parties radio button is selected by default. Users can enter details for each subpoena they queue up through the Request Details window, which is opened by double clicking a case party/subpoena record on the Request Tab. Add to Queue adds a subpoena to the Subpoena Queue for the checked case party with request details, if these details are present. Remove from Queue removes the selected case party s subpoena from the Subpoena Queue, without having to go to the Subpoena Queue. Go to Queue opens the Subpoena Queue window so you can see the list of all subpoenas waiting to be batch printed. Batch Print opens the Batch Printing window where you can batch print subpoenas added to the Subpoena Queue Manage Subpoenas Page 9 of 14

10 Add Subpoenas to the Subpoena Queue for a One-Day Court Appearance How To: 1) Find the court event for which subpoenas are needed and select/click the event. This is the date that will appear on the subpoena document. 2) On the Request Tab, all case parties on the DA Case should be displayed. If not, check the All Case Parties radio button in the lower left corner of the window. 3) Check the check box(es) to the left of the person or people for whom a subpoena should be created. Each person selected represents a single subpoena. 4) Click Add to Queue to add this/these subpoena(s) to the Subpoena Queue for batch printing. 5) The Subpoena Date(s) column/field updates to show the date that will print on the subpoena document(s). 6) The Queue Date field is updated with today s date, to indicate that the subpoena(s) was/were added to the Subpoena Queue today. 7) The Subpoena Status field on the Summary Tab is updated to In Queue Add Subpoenas to the Subpoena Queue for a Multiple-Day Court Appearance If a court hearing takes place over a range of dates, you may want to subpoena witnesses to appear on multiple days, not just one. The subpoena document can reference/display multiple court events. The court event grid at the top of the Manage Subpoenas displays one row of information for each day of a multi-day court event. For example, a 3-day Jury Trial will appear as three rows, each row will have a different date. The dates you choose at the top of the window are the dates that will appear on the subpoena. If you select more than one date, more than one date appears on the subpoena. But, you are only able to select multiple court events for a single subpoena if those events are for the (1) same court hearing and on the (2) same DA case. How to 1) Find the court events for which subpoenas are needed and select them. 2) Click one court event, then hold the Ctrl key on your keyboard to select other events until all desired court events are selected. The events you have selected are the events that will appear on the subpoena document. 3) On the Request Tab, all case parties on the DA Case should be displayed. If not, check the All Case Parties radio button in the lower left corner of the window. 4) Check the check box(es) to the left of the person or people for whom a subpoena should be created. Each person selected represents a single subpoena. 5) Click Add to Queue to add this/these subpoena(s) to the Subpoena Queue for batch printing. 6) The Subpoena Date(s) column/field updates to show all dates that will print on the subpoena document(s). 7) The Queue Date field is updated with today s date, to indicate that the subpoena(s) was/were added to the Subpoena Queue today. 8) The Subpoena Status field on the Summary Tab is updated to In Queue FYI - New bookmarks have been added to PROTECT with version 3.0 that pull more than one court event onto a generated document. The bookmarks control the display of the court events, such as in bullet list or separated by comma. For those offices that wish to generate subpoenas via standard Document Generation, they will also have the ability to select more than one event from the Doc Gen screen. 11 Add or Edit Request Details for a Subpoena After the subpoena has been added to the queue, users can add details such as witness instructions and the way that the subpoena should be served. If the proper bookmarks are added to the subpoena template, this information can print on the generated document. Users can also indicate the number of copies that should be printed to save themselves a trip to the copier. This information can be added any time before the subpoena is generated. Once the document is generated, users cannot add or update these details. Request Details can be added to the subpoena from two places (1) the Request Tab or from (2) the Subpoena Queue. How To: 1) Double click an already queued-up subpoena record on the Request Tab or in the Subpoena Queue. 2) The Request Details window opens. 3) Enter desired information, then Save, Close 4) The record on the Request tab and in the Subpoena Queue is updated and displays information you entered in the Details window. Service Tab Overview The amount of service information each office tracks is determined by that office. Options include: when the subpoena was sent to service and when it was received by the server, whether it was served, how, to whom and by whom as well as failed service and the numbers of attempts made to serve. Some information entered on the Service Tab affects the status of the subpoena. The Summary Tab displays a subpoena status of Sent to Server, Rec d by Server, Served or Fail when the corresponding check box on the service tab is checked. When the Service Tab is opened, only parties for whom a subpoena has been generated are shown. Manage Subpoenas Page 11 of 14

12 Add or Edit Service Details Users can enter subpoena service information directly on the Service Tab through check boxes, radio buttons or pick lists or open the Service Details window to enter details there. How To: 1) Find the court event at the top of the Manage Subpoenas window and select it. 2) Click/go to the Service Tab to see the subpoenas that were generated for this court event. 3) Click appropriate check boxes, pick lists, etc on the Tab and then click Save OR Double click a subpoena record to open the Service Details window, enter information, click Save and Close 4) The Service tab is updated and displays information you ve entered. Longer information may be truncated. Column widths can be made wider or the Service Details window can be reopened to view. FYI When entering service information, you are not allowed to choose more than one court event. The only time multiple court events can be selected is when creating or queuing up the subpoena. Cancel Tab Overview Users come here to (1) indicate which subpoenaed case parties are no longer needed (2) see subpoenas that need to be cancelled (3) see witness contact information and call off witnesses (4) indicate that a successful cancellation has been made. Some information entered on the Cancel Tab affects the status of the subpoena. When a user checks the Need Cancel check box, the subpoena s status changes to Needs Cancel. The Need Cancel check box is also auto checked when the underlying court event is turned off by a PROTECT user or by the CCAP Interface. When the Confirm Cancel check box is checked by a user, the subpoena s status becomes Cancelled The date displayed next to the Need Manage Subpoenas Page 12 of 14

13 Cancel check box is the date the box was checked, regardless of how it got checked. When the Cancel Tab is opened, only parties for whom a subpoena has been generated are shown. Add or Edit Cancellation Information Cancellation information can be entered directly on the Cancel tab via check boxes, radio buttons and pick lists or the Service Details window can be opened and information can be entered there. How to: 1) Find the court event at the top of the Manage Subpoenas window and select it. 2) Click/go to the Service Tab to see the subpoenas that were generated for this court event. 3) Click appropriate check boxes, pick lists, etc on the Tab and then click Save OR Double click a subpoena record to open the Service Details window, enter information, click Save and Close 4) The Service tab is updated and displays information you ve entered. Longer information may be truncated. Column widths can be made wider or the Service Details window can be re-opened to view. Manage Subpoenas Other Considerations: Question: I selected a court event at the top of the screen, but saw no information on any of the tabbed divisions. I know that I generated a subpoena for this event. Where is it? Answer 1: The template must be set as Equivalent to Subpoena in PROTECT Admin before the document is generated. Answer 2: Is the court event a multiple-day event? If so, make sure the correct date is selected. Also, it may be possible that the user created the subpoena for one of the court dates and manually entered the other court date on the document in MSWord. If this happens, PROTECT does not have a document-to-court event association in the database and so the document will not appear when you click the court event. With version 3.0, more than one court event can be associated to a document in previous versions this was not possible. Manage Subpoenas Page 13 of 14

Through Manage Subpoenas users are able to add witness instructions to the sub before it is batch printed. Volume can print as many subs as desired at one time, from across multiple DA Cases Save paper/costs - batch printing reports that summarize the subpoenas recently printed could replace the need to put a copy of the sub into the paper case file. Workstation is tied up during the generation and printing time, each document generates on the screen as it does via standard Doc Gen, if number of documents is larger, time will be longer. The report may not have everything you need, subpoena document may be preferred. Reporting - Subpoena request information such as the number of copies needed, the manner in which the sub should be served and instructions to witnesses are entered on screen, not on the document. Since it s in PROTECT, reporting is possible. If your office does your office care to report on these things? The act of adding subpoenas to the queue, if done by attorneys, could become the way that attorneys communicate needed subpoenas to their staff.
