2 CONSTITUTION OF PORT LINCOLN HOCKEY ASSOCIATION INC. NAME 1. The name of this body shall be the PORT LINCOLN HOCKEY ASSOCIATION and it shall be referred to as the Association. OBJECTS 2. (a) To promote interest in hockey. (b) To promote good fellowship among those interested in hockey. (c) To educate, train, coach and encourage members of the Association. (d) To do all such things and acts conductive to the furtherance of the objects and interests of the Association. 1

3 MEMBERSHIP 3. Any person who is interested in hockey shall be eligible for membership. 4. (a) The annual membership fee for all classes of membership shall be determined at the Annual General Meeting each year. (b) Persons under the age of eighteen years shall be eligible to join as junior members at such special fees as shall be determined but they shall not be entitled to hold office, or vote or take part in business procedure at General and Board meetings of the Association. 5. A properly constituted Annual General Meeting or Special General Meeting may appoint any person as an honorary member or honorary life member of the Association in recognition of services rendered in promoting the interests and objects of the Association. 6. Any member may resign from the Association and such resignations must be in writing and forwarded to the Secretary of the Association. 7. Upon any person ceasing to be a member of the Association for any reason whatsoever he/she shall not be entitled to the return of his/her membership subscriptions or any portion thereof. 8 (a) The Board may expel from the Association or otherwise punish or penalise any member whose conduct, in the opinion of the Board, is discreditable or injurious to the character or interests of the Association. (b) to Before any member is expelled or otherwise punished or penalised his conduct shall be enquired into by the Board and the member shall be given the opportunity to defend himself/herself and justify or explain his/her conduct. Provided that a quorum is established and the majority of the Board present when the matter is enquired into is of the opinion that the member has been guilty of such conduct or action as aforesaid, then the Board may expel or suspend him/her from membership or otherwise punish or penalise him/her. (c) Should any member fail to appear at any enquiry conducted under Clause 8 (b) hereof, or any adjournment thereof, the Board may proceed in that member's absence to conduct the said enquiry and to make its decision as herein before empowered. (d) Before hearings are conducted under this clause a written report must be submitted to the Association Secretary within forty eight hours of the said incident occurring or unless a motion carried at a Board meeting deems that such an enquiry is necessary. 2

4 GENERAL MEETINGS 9. The Annual General Meeting of the members shall be held in the month of February in each year, and members shall be given notice in writing at least fourteen days before such meeting. 10. The Annual Report and Audited Balance Sheet or Financial Statement shall be submitted to members at the Annual General Meeting. 11. The Annual General Meeting or the Special General Meeting may make By-Laws necessary for proper administration of the Association. Any By-Law so made shall not be repealed, added to or amended unless and until:- a) Notice of intention to propose such repeal, addition or amendment is first given in writing by a member of the Association to the Secretary of the Association not later than fourteen days prior to the date of such Annual General Meeting or Special General Meeting and includes in the agenda for such meeting. b) Such repeal, addition or amendment is proposed at such Annual General Meeting or Special General Meeting and is approved by not less than two thirds of the members of the Association present at such meeting and voting thereon. 12. The election of Board Members and Association Officers shall take place at the Annual General Meeting together with business mentioned in the notice paper convening the meeting and any other business arising. 13. A Special Meeting of members shall be called at the request of the President or the Secretary or any three members of the Committee or at the written request of ten financial members of the Association. Such meeting shall be held within thirty days of such request and all members shall be notified in writing not less than ten days before such meeting. 14. The President of the Association shall be the Chairman of all General Meetings. Should he not be present then the Vice-President shall take the chair, and if the Vice-President is not present, members shall elect a member to take the chair. 15. (a) (b) At all meetings the Chairman's decision on points of order shall be final. The Chairman shall have a casting vote in addition to his deliberative vote. 16. The quorum for a General Meeting shall be twelve members present. 17. If at any General Meeting there be no quorum within thirty minutes of the time appointed for the meeting, then the meeting shall lapse unless a majority of the members present decide to adjourn the meeting for a period of not exceeding fourteen days. If there be no quorum within thirty minutes after the time appointed for such an adjourned meeting then the meeting shall lapse altogether. 18. Only members of the previous financial year present in person shall be entitled to vote. 3

5 BOARD OF MANAGEMENT 19. (a) The business and affairs of the Association shall be under the management and control of the Board, provided however that except in the case of extreme urgency the Board shall not take any action contrary to decisions made at a General Meeting. (b) The Board may, subject to the decisions made at General Meetings, exercise all the powers of the Association and do all such acts and things as may be done by the Association or which it considers necessary or expedient to carry out the objects of the Association. 20. The Board shall consist of:- (a) The President, a Vice-President, a Secretary, a Treasurer and (b) Two members of the Association, elected at the Annual General Meeting or as otherwise provided herein. 21. All members of the Board must be financial members of the Association. 22. Should a vacancy occur, in the Board of the Association other than in the normal course of elections, the Board shall fill such vacancy from the financial members of the Association and such member duly elected shall hold office for the unexpired portion of his predecessor's term. 23. The Boardshall meet as often as may be required to conduct the business of the Association. The President or the Secretary or three members of the Board shall have the power to call a meeting of the Board. The President of the Association shall take the chair at all Board Meetings. Should the President not be present then the Vice-President shall take the chair and if the Vice-President is not present the Board shall elect one of its number to take the chair. 24. The Chairman at all Board Meetings shall have a casting vote in addition to a deliberative vote. 4

6 25. (a) All notices of Board Meetings shall be given in writing to members of that Board at least twenty four hours before such meeting. (b) The accidental omission to give any member, or the non-receipt by any member of any notice required by this constitution shall not invalidate or affect any proceedings at such meetings. 26. (a) The Board shall have the power to delegate any of its powers to a Sub-Committee to deal with any particular matter or matters and upon such terms as the Board may think fit. The President and the Secretary shall be ex-officio members of all Sub-Committees. (b) All acts or decisions done or made by any meeting of the Board or any member thereof shall, notwithstanding that it be afterwards discovered that there was some defect in the appointment of such member or all or any members of the Board be as valid and effective as if they had all been properly appointed, unless it is proved that the appointment was made by fraud or bad faith. 27. The quorum for Board Meetings shall be four members present in person. 5

7 ELECTION OF THE BOARD OF MANAGEMENT AND ASSOCIATION OFFICERS 28 a) Each Board Member shall be elected for a term of two years with half of the board reelected at each Annual General Meeting i. In the first instance, the President, Secretary and one committee member shall be elected for a period of one year with subsequent elections in each year ending with an even number ii. In the first instance the Vice-President, Treasurer and one committee member shall be elected for a period of two years with subsequent elections in each year ending with an odd number b) Each Association Officer shall be elected for a term of twelve months (c) be Nominations for each candidate for election as Board Members and Association Officials must made in writing to the Association Secretary at least fourteen days prior to the Annual General Meeting, and must bear the signature of the proposer and seconder who must be financial members of the Association. The nomination must also be signed by the candidate declaring his/her intention to accept office if elected. (d) If a written nomination is received for a vacancy fourteen days prior to the Annual General Meeting no further nominations may be made at such meeting. (e) Should no written nominations be received for a vacancy fourteen days prior to the meeting, nominations may be made at that meeting. 29. No person shall be eligible for election unless he is a financial member of the Association. 30. The election for the Board Members and the other Association Officials shall be by ballot of members present and voting thereon, held at the Annual General Meeting. No ballot shall be required when the number of candidates nominated for each office does not exceed the number of vacancies and they shall be declared duly elected. 6

8 DUTIES 31. (a) The Secretary shall carry out his/her duties under the direction of the Board and keep a true record of all minutes of all meetings, attend to correspondence, issue notices for meetings, keep records and carry out such duties as the Board may from time to time direct. (b) and The Treasurer shall receive all moneys payable to the Association and give receipts for same. All moneys so received shall be paid into the banking account for the Association. The Treasurer shall present at each General Meeting a balance of the finances of the Association shall keep proper books of account of all moneys received and disbursed and generally perform all such duties as are directed by the Board from time to time. ASSOCIATION OFFICERS (c)(i) The Property Officer shall keep records of the location of all equipment and property of the Association and the condition of same. (ii) The Canteen Manager shall run and organise the Association's canteen. The Canteen Manager shall pay all moneys received into the Association's Canteen Account and report to all Board Meetings on the finances of that account. (iii) The Junior s Representative shall provide advice and report to the Board of matters relating to the Junior Competition and perform other duties as required by the Board. (iv) (v) (vi) The Umpire s Coordinator shall provide advice and report to the Board of matters relating to umpiring and perform other duties as required by the Board. The Records/Fixtures Officer shall provide advice and report to the Board of matters relating to Records and perform other duties as required by the Board. Publicity Officer shall provide advice and report to the Board of matters relating to publicity and perform other duties as required by the Board. 7

9 (vii) Refreshment Officer shall provide advice and report to the Board of matters relating to the Association Bar and perform other duties as required by the Board. FINANCE 32. The financial year shall be from 1st January to 31st December in any year. 33. All moneys of the Association shall be paid into the accounts of the Association at such bank as the Board may from time to time direct. 34. No money shall be drawn from the Association's account save by cheque signed by the bank signatories authorised by the Board. No cheque shall be signed or money withdrawn unless such withdrawal has been approved by the Board, or in the case of urgency, by the President and the Secretary. 35. The books and accounts of the Association shall be audited annually by an Auditor appointed by the Annual General Meeting. 36. The property, assets and income of the Association, wherever derived shall be applied towards the promotion of the objects of the Association, and no portion thereof shall be paid or transferred either directly or indirectly by way of dividend, bonus or otherwise by way of profit to members generally of the Association. Provided that nothing herein contained shall prevent 8

10 the payment in good faith of remuneration to any officer or servants of the Association or any member in return for services actually rendered, nor prevent the payment of interest on money borrowed from any member of the Association. 37. Should the Association for any reason whatsoever cease to function, any member or person holding any Association moneys or property shall forthwith pay the same to the Board. Should every endeavour to reform the Port Lincoln Hockey Association fail then the members of the last Board shall pass all assets of the Association onto the South Australian Hockey Association Incorporated. RUNNING OF COMPETITION HOCKEY APPEALS COMMITTEE 38(a) The Appeals Committee shall consist of the President of the Association as Chairman and the four Club Presidents. Should the President of the Association not be present, the Vice President of the Association shall take the chair. If the Vice-President is not present, the Board shall elect one of its members to take the chair. (b) 38(c) Any member of the Association with a grievance/appeal against a Board decision shall approach their Club President, and if supported through his/her club s decision-making process, who will represent their concerns to the Appeals Committee. 39. Subject to the Constitution and By-Laws and any resolution passed by the Annual General Meeting and Special General Meeting, the Board shall:- (a) Decide on what teams are to be accepted for the premiership competition and how they are to be graded. (b) Prepare programmes of all matches to be played. 9

11 (c ) Decide on the registration of team uniforms. (d) Deal with all matters associated with the running of competition hockey SEAL 40. The Association shall have a Seal, which shall be kept in the custody of the Secretary and shall not be used or affixed to any instrument except by authority of the Association in General Meetings or the Board, both of whom shall subsequently sign the instrument to which the Seal has been affixed. PUBLIC OFFICER 41. The Public Officer required by the provisions of the Association's Incorporated Act 1985 shall be appointed by the Board of the Association and shall continue to be a Public Officer until he/she dies, resigns or is removed by the Board. AMENDMENTS TO CONSTITUTION 42. This shall be the only Constitution of the Port Lincoln Hockey Association and shall come into force forthwith and shall not be altered, varied, added to or repealed unless two-thirds of financial members present at an Annual General Meeting or at a General Meeting convened for that purpose are in favour of such alteration, variation, addition or repeal. INTERPRETATION 43. In this constitution masculine includes feminine. "In writing" or "written" means and includes printing or other means of representing or reproducing words in visible form. Words importing singular include the plural and words importing plural include the singular where context permits. 44. The Board shall be the sole authority for the interpretation of this Constitution and of the By-Laws and regulations made thereunder and the decisions of 10

12 the Board upon any question of interpretation and upon any matter affecting the Association and not provided for by this Constitution or by the By-Laws and regulations made thereunder, shall be final and binding on the members. RE-TYPED APRIL, 2003 ***************************************** 11

13 PORT LINCOLN HOCKEY ASSOCIATION INCORPORATED BY-LAWS 1. RULES a) The rules of the I.H.R. board and the current A.H.A. rules and interpretations will apply for all senior competition hockey. b) Junior competition rules may be altered by the Boardto suit local conditions during the current season. 2. FINANCE a) A $20.00 affiliation fee is to be paid prior to the seasons first match by all nominating clubs. b) The Treasurer shall render accounts to all Clubs or persons and these accounts are payable within twenty-eight days of receipt except for Club team fees covered in By-Law 2 (c). c) Half the Clubs Team fees are to be paid within three weeks of the season and the balance is to be paid prior to the seventh week of competition. d) Any Club or person failing to pay fees and monies payable to the Association shall be charged interest at the rate of eighteen percent (18%) per annum on monies outstanding until the account is paid. e) In the event of a Club failing to pay fees on the due date it shall be deemed to be unfinancial and the President and Treasurer of such Club shall be notified and if the fees are not paid within fourteen days of notification the teams of the Club shall not score premiership points until the fees are paid. f) Any fine imposed on a Club, under the authority of the By-Laws or by the Board, shall be payable within fourteen days of receipt, except where payment is specified by separate By-Law. In the event of a Club failing to pay fines on the due date By-Law 2 e) to be enforced. 1

14 3. REGISTRATION a) No player shall take part in any premiership match unless and until he is a registered player with the Association by a member Club. A player must be resident in South Australia in the current season before being registered. b) Before the commencement of the first competition match all Clubs must submit to the Association Secretary a detailed list of their Club officials address and phone number. Junior players team list of players and numbers also to include dates of birth. c) Each registered player should have a number on their shirt, individual to themselves in the male and female competition. This team list of players and numbers is to be submitted to the Association Records/Fixtures Officer before the season starts. d) A Club failing to comply with this By-Law be fined $10.00 per week until such lists and/or registrations are supplied to the relevant persons within the Association unless arrangements are made with the relevant persons through the Board. 2

15 CLEARANCES 4a) A player who has been registered by another Club or in another State shall not be registered unless granted a clearance from their former Club or State Association. b) Grounds for refusing a clearance by a Club or P.L.H.A. shall be limited to failure to meet a financial obligation or comply with a disciplinary ruling by the Club or Association. c) A player needing a clearance may at any time between the months of February and August (inclusive) apply in writing on the P.L.H.A. clearance form to the Club for which he wishes to play. The Secretary of that Club will obtain the clearance signature of the former players Club and then forward the form to P.L.H.A. for registration. d) No player shall register with more than one P.L.H.A. Club during any one season without the approval of the Board but no clearance shall be granted between P.L.H.A. Clubs after the 1st July. e) The clearance shall be deemed to have been granted by the Club concerned on the day in which the application was registered, unless the Secretary receives notice from that Club with ten days of posting by the Club Secretary that the clearance has been refused. If a clearance is refused the Secretary will notify the player concerned. f) If a Club refuses a clearance, the player concerned may appeal to the Board which has the power to investigate the dispute, and itself either grant or refuse the clearance and if granted, it shall ante-date the clearance to the date on which the application was made. g) Any person who suspects that a player has been registered without proper clearance may apply to the Board for a fee of $10.00 (refunded if proven correct) to review the registration of the player whereupon the Board shall investigate the matter and either confirm the players registration or deregister him from such a date as appears just. h) Upon compliance with By-Laws three and four a player, Coach, Manager or Team Official shall be deemed to be duly registered until the Club is notified by the P.L.H.A. Secretary that the registration has been refused or cancelled. 3

16 5. GRADES a) There shall be separate Competitions and Grades for all senior Female and Male players. b) No Club playing more than one team in the same grade shall transfer a player who has played four matches in one team to the other without a permit from the Board, or in case of urgency the President or Vice-President of P.L.H.A. c) After 1st July a player who has played four matches in any one grade is not eligible to play in any lower grade without the opposing Captains permission or a permit from the Board, Junior players exempted. d) No player shall play in more than one grade on any one day unless the player has received prior permission from the opposing Captain in the second match. Such permission must be noted on the match card prior to the start of the match and verified by the Captains and Umpires. e) No player who has played less than one third of matches over one third of the current season shall be eligible to play in any major round of the current season. f) Where a higher grade team has a bye, no player who has played four or more matches in the higher team may play for a lower grade team without the opposing Captains permission. g) In Junior matches a player may play in more than one Junior grade provided any additional match is in a higher age grade than the player is qualified in by age, U13 mixed exempted. Junior competition guidelines issued by the Board each season, are to be compiled with by Junior grades. h) A Junior graded player may also play in any senior grade match subject to compliance with By-Law 5 d). i) PENALTIES the Any Club playing a player in contravention of this By-Law shall be deemed to have lost match in which that player took part, the score to be recorded being 0-5, or the actual score, whichever is the worse defeat. If both teams play a player in contravention of the By-Law, neither team shall score any premiership points, but both teams shall be recorded as having been defeated 0-5 or the actual score, whichever is the worse defeat. 4

17 6. PREMIERSHIP POINTS 6.1 NATURE OF COMPETITION a) Each team in a grade shall play each other team in six rounds of matches, subject to the discretion of the Board, and shall receive two premiership points for a win and one point for a draw. b) A team receiving a forfeit shall be credited with two premiership points and a goal score of 5-0. c) If two opposed teams both forfeit, neither shall be credited with any points or goal score. d) Should any teams have equal points, their final position shall be calculated in the following manner:- GOAL DIFFERENCE (being goals for minus goals against). Should GOAL DIFFERENCE be equal then the team with the greater goals for shall be deemed to be the higher placed team. e) A team shall consist of at least seven eligible players. 5

18 6.2 MAJOR ROUND a) At the conclusion of the Minor rounds, teams shall compete for the Premiership in a Major round as follows:- FIRST SEMI FINAL : 3RD vs 4TH SECOND SEMI FINAL : 1ST vs 2ND PRELIMINARY FINAL : Loser Second Semi Final vs Winner First Semi Final GRAND FINAL : Winner Second Semi Final vs Winner Preliminary Final b) In a major round match, if the result is drawn the winner of the match shall be determined after a five minute rest as follows:- In Senior grades teams will change ends, play for ten minutes, have a five minute rest, change ends, and then play for another ten minutes. In U16 and U13 grades, teams will change ends, play for ten minutes, have a five minute rest, change ends, and then play for another ten minutes. Except in a Grand Final if the result is drawn after extra time the team which held the higher position at the end of the minor round shall be the winner. c) A Grand Final which is drawn after extra time as provided for in By-Law 5 (b) will be determined by a penalty stroke competition as provided for in By-Law 6.3, except in U13 grades, if the result is still a draw both teams will be declared Joint Premiers. 6

19 6.3 PENALTY STROKE COMPETITION a) Five players from each of the two teams, chosen by their respective Captains, but excluding any player who has been fully suspended by an Umpire during the game, shall take a penalty stroke alternately against one and the same goalkeeper of the other team, unless the latter has been incapacitated and replaced, making a total of ten penalty strokes, five for each team. b) The Umpires shall choose the goal to be used, and they shall toss with the Captains to decide which team shall take the first penalty stroke. The team having been awarded the highest number of goals shall be the winner. c) In the event of an equal number of goals having been awarded another series of penalty strokes shall be started with the same players, and shall feature "sudden death", which shall mean that the winner shall be the first team to have been awarded more goals than the opposing team after an equal number of strokes. If necessary this "sudden death" series may exceed ten penalty strokes. The sequence does not have to be the same as in the previous series. d) The team whose player has taken the first penalty stroke of the first series shall not take the first penalty stroke of the "sudden death" series. 7

20 7. MATCHES 7.1 PROGRAMME Except with the express permission of the Board and subject to By-Law 7.2, all premiership matches shall be played on the day and at the time set out in the programme of matches, or such alternative thereof as notified by the Secretary to the Clubs concerned, and any team not playing in accord therewith shall forfeit the match. 7.2 FORFEITS a) A Club intending to forfeit a match, shall before noon on the day preceding the match, notify the Secretary of the P.L.H.A., and the Secretary of the opposing Club. b) If a Captain or acting Captain of a team refuses to comply with a request of an Umpire to prepare for, begin, or continue a game or if the number of players refusing to comply with this request of the Umpire is such that there are less than seven players of the team on the field, then:- 1) That team shall forfeit forthwith; and 2) The Umpire shall write a report to the Board. c) A team shall forfeit if it has less than seven players. d) A team which forfeits loses 0-5 or by the score standing at the time the game is forfeited, whichever is the greater loss. e) A Club shall forfeit from its lowest grade Senior team upwards if forfeiting a Senior grade. 8

21 7.3 MATCH REPORT a) Before the commencement of any match, the Captain of each team shall list the name and number of each member of his/her team on the official match card, including any new registrations. b) The Umpire shall report any team failing to comply with By-Law 7.3 a) and the Club concerned shall be fined $10.00 c) Where it has been proved that a player has played in a match under a false name the penalty shall be loss of premiership points accumulated by the team for matches in which he/she played. 7.4 MATCH TIMES a) The time allocated for each half of play in each grade shall be approved by the Board and notified to each member Club prior to the start of the season. b) An Umpire shall blow a whistle and advise team Captains of the amount of time remaining before each team must be on the field and ready to begin play. c) A team not ready to start play five minutes after the scheduled time as advised by an Umpire shall forfeit, unless the team is waiting for a player who is umpiring an unfinished match. d) If an Umpire or both Umpires are absent after five minutes, each Captain shall appoint a player or other suitable person as Umpire and play shall start forthwith, unless the teams are waiting for an Umpire who is playing an unfinished match. e) Time as decided by the Umpire shall be conclusive unless that Umpire is immediately informed by a Captain disputing such decision. 9

22 8. UMPIRING a) Each Club shall:- Provide at least three candidates for each Senior team who shall be required to attend the lectures prescribed by the P.L.H.A. Umpires Coordinator and sit for the S.A.H.U.A. exams each year. Upon notice from the Board, provide Player and Honorary Umpires as required by the Official programme, from the team of the Club nominated. b) PENALTIES Any Club failing to have in attendance at any of the series of lectures or S.A.H.U.A. exams the minimum number of six candidates shall be fined $10.00 per candidate for each absence, with a maximum fine of $30.00 per series. c) UMPIRING OF MATCHES Before each match the umpires shall ensure that the teams list is completed and shall sign it when the results of the match are entered. The Umpires shall choose their three Best Players independently and record them in order on the cards provided, at the end of the match. The Captain shall record if an interchange player does not take the field. d) If a Club fails to provide an Umpire as requested that Club shall be fined $ In addition after the fourth breach by the allocated team from that Club, that team will lose one premiership point for each subsequent breach. e) A Club failing to pay the required ratified fines shall not score premiership points. 10

23 9. UNIFORMS AND PLAYING EQUIPMENT a) All players having competed in three competition matches for their Club shall wear the Clubs registered numbered uniform in all following matches. b) Goalkeepers must wear a uniform contrasting with that of their team-mates and that of the opposing team. c) All players of the same team except the goalkeeper must wear the same uniform. d) An Umpire may not allow an incorrectly attired or incorrectly equipped player to take part in a match. 10. GROUNDS a) Club grounds and equipment must be of a suitable standard, and comply with the Rules of Hockey. b) Details of unsuitable grounds and/or equipment are to reported on match cards. c) The Board may reallocate matches to avoid unsuitable grounds and/or equipment. d) If the Captains agree (or an Umpire resolves a dispute) that conditions are unsuitable for play to begin or continue, play shall be halted, and if conditions prevail such that the match cannot be completed in an agreed time, the match shall be abandoned. All circumstances must be fully reported on the match card. e) An abandoned or postponed match shall be rescheduled for play at the same time on the Sunday of the following week. f) The President of P.L.H.A. (or in his absence, the Vice-President of P.L.H.A.) shall postpone the days play (not including matches already completed) in the event of:- Extreme weather conditions; Grounds being unplayable; 11

24 Severe damage would result to grounds from play. 11. AGES OF PLAYERS a) The age of a participating player is determined on the first of January of the current year. b) In Veterans grades, players must be at least thirty five years of age. c) In Junior grades, a player must be less than the age of the grade shown in the programme. 12. REPORTING AND SUSPENSION OF PLAYERS, COACHES, MANAGERS AND OTHER TEAM OFFICIALS POWER OF UMPIRES a) An Umpire or any person acting in the capacity of an Umpire at any match programmed by the Association may take any of the following actions which they deem proper in order to exercise control and/or to eliminate contravention of the rules of Hockey. 1) They may warn a player, Coach, Manager, or any other Team Official. (GREEN CARD) 2) They may temporarily suspend a player, Coach, Manager or Team Official. (YELLOW CARD) 3) They may fully suspend a player, Coach, Manager or Team Official. (RED CARD). b) Any player who receives a suspension is to be reported. c) Any Coach, Manager, Team Official or player listed on the match card and not actively participating in the game at the time, will, on being shown a RED CARD, remove himself/herself from the immediate area of the sidelines/backlines for the remainder of the game. 12

25 12.2 SUSPENSIONS TO BE REPORTED BY UMPIRES a) Umpire reports concerning an offence must be in writing and must be sent to the persons nominated below within twenty four hours from the date of the offence complained of (excluding Sundays or holidays). 1) Temporary Suspensions - noted on match card to be recorded by Assistant Secretary of P.L.H.A. 2) Full Suspensions - noted on match card and a written report sent to the Assistant Secretary of P.L.H.A. b) Reports are to be submitted by both Umpires controlling the game in which a Full Suspension has occurred ACTION ON RECEIPT OF REPORTS a) Temporary Suspension - the Records/Fixtures Officer of P.L.H.A. will record the suspension and notify the Club concerned in writing. b) Full Suspension - the Secretary of P.L.H.A. shall inform the player, Club Secretary, Umpire and members of the Tribunal and any witnesses who may have been nominated. The Records/Fixtures Officer will record the full suspension. 13

26 12.4 AUTOMATIC MATCH SUSPENSION a) A player or Official who receives four temporary suspensions or the equivalent thereof within any eight month period must serve a one match suspension. b) A player or Official who received six temporary suspensions in any eight month period must serve a further one match suspension, and a further match when he receives his eighth temporary suspension, or equivalent thereof, and so on. c) The P.L.H.A. Secretary shall notify the player by notifying his Club Secretary of the date the suspension has to be served. d) A full suspension shall be equivalent to three temporary suspensions for the purpose of the operation of the By-Law 12.4 only in the event that the Reports Tribunal finds the charge resulting from that full suspension proved. e) Any match suspension seeming to a player or Official under the provisions of parts 12.4 a) and 12.4 b) herein before as a result of the player receiving a full suspension shall be served in addition to any suspension imposed by the Reports Tribunal at the hearing of the report on the incident which led to the full suspension FULL SUSPENSIONS a) Any player or Official sent off shall appear before the Tribunal following the report at the time notified, whether they plead guilty or not guilty to the report laid by the Umpire. If the person reported does not attend, the case will be heard in their absence. b) The Umpire or party making the report shall also attend the Tribunal Hearing at the time notified by the Secretary of the P.L.H.A. 14

27 12.6 REPORTS TRIBUNAL - COMPOSITION a) The Tribunal shall consist of the Presidents of each Club, or their proxy (excluding the President of the Club of the player concerned), the Vice-President of P.L.H.A. or his proxy and the Secretary of P.L.H.A.,. The Tribunal shall sit in camera. b) The Vice-President of P.L.H.A. (or his proxy) shall be the Chairman of all Reports Tribunal meetings. The Chairman shall conduct each meeting of the Tribunal in such a manner as set out in these By-Laws. c) The Tribunal may make a majority decision by vote. The Chairman shall announce the decision of the majority. The Chairman shall only have a deliberate vote. In the case of a deadlock the charge shall be found not proved. d) The Tribunal may determine its procedure where it is not provided for in these By-Laws. e) The Tribunal shall sit on the Wednesday immediately following the report, at the latest. 15

28 12.7 REPORTS TRIBUNAL - POWERS a) The Tribunal shall have the responsibility of exercising and shall exercise the powers of the Association in relation to hearing and determining charges against players referred to it pursuant to these By-Laws and the inflicting penalties. b) The Tribunal shall have all powers necessary and desirable to carry out its responsibilities within the limits of the By-Laws of the P.L.H.A. c) The Tribunal shall have the following powers:- 1. To enquire into, hear and determine any report made by an Umpire or Umpires supplied by the Association against a player or Official on the following grounds:- (i) Using insulting, abusive and offensive language towards any Umpire or player; (ii) Wilfully or intentionally assaulting any Umpire or player: (iii) Interfering with any Umpire; (iv) Persistently disputing any decision or decisions of any Umpire or Umpires; (v) Persistently infringing the rules of the game; (vi) Offensive language. d) The Tribunal may impose such penalty as it thinks fit including expulsion, suspension, censure upon any player found guilty or any charge or may adjourn or set down hearings subject to any witnesses and provide such penalty for non-attendance or failure to answer questions or give evidence by player, Officials or Umpires as it sees fit. 16

29 e) The Tribunal may impose any of the penalties set out in By-Law 12.6 d) singularly or jointly and provide such further or other terms or conditions as it may decide and may suspend any penalty or penalties for such time upon such conditions as it may think fit PROCEDURES a) The Tribunal having assembled with the Secretary, shall admit the Umpire or party making the report or bringing the charge and the person or persons specifically named in the report or charge. (The latter may be accompanied by not more than one Official of the Club to which he/she or they belong, and such official only may examine and cross-examine any witness to the proceedings. An under age player may in addition beaccompanied by one parent or guardian, who may not take part in the proceedings.) 1) The Secretary of the Tribunal shall then in the hearing of the player read the report. 2) The report of the Umpire or other person shall be considered as evidence by the Tribunal. 3) The Umpire or other party may then be cross-examined by or on behalf of the player. 4) Re-examination: The Chairman or members of the Tribunal, through the Chairman may address questions to the Umpire or other party. b) CORROBORATIVE EVIDENCE The Umpire, or other party, may then call or produce his corroborative evidence (witnesses), who shall be dealt with: 1) By examining by the Umpire or other party and Tribunal. 2) By cross-examination by the player or representative. 3) By re-examination by the Tribunal. The player shall then be called upon to plead and to answer the case against him/her. He/she 17

30 may then be elected to give evidence on his/her own behalf whereupon he may be crossexamined by the Tribunal and Umpire or other party. c) WITNESSES FOR THE DEFENCE. The player may then call his/her supporting witnesses. Each will be examined by the player or Official representing him/her and cross-examined by the Tribunal and Umpire/other party. All extraneous matter should be ruled 'out of order' by the Chairman of the Tribunal as and when it arises. The person making the report and the player, or his/her representative, may then make a closing address to the Tribunal. All persons other than the Tribunal members shall then withdraw. If the complaint is found 'not proved' the parties concerned shall be brought in and the decision announced. If found 'proved': (1) The Secretary shall then state in the presence of the player the players previous record (if any). (2) The Chairman shall give the player or Official representing him/her an opportunity to admit or deny any matter mentioned in his/her record and to present a plea for leniency on the proven charge. (3) In the case of any player disputing any matter raised in his record it shall be sufficiently proved to the Tribunal if a certificate is given by the keeper of records stating it is the original record of the players offences. (4) All persons other than the Tribunal members shall again withdraw. (5) The Tribunal take into consideration any matter it thinks fit, whether referred to by the player in his plea for leniency or not and whether it is in favour or against the player before arriving at its decision on penalty. (6) The Chairman of the Tribunal shall announce the decisions of the Tribunal as to penalty as it affects the player himself. (7) The Chairman of the Tribunal will report the Tribunals findings to the Association in writing. 18

31 (8) The Secretary of P.L.H.A. will notify the Club in writing. d) At the conclusion of the hearing the Secretary shall inform the player that he/she has the right to appeal APPEALS a) The Board shall deal with Appeals against the Tribunal findings/decision. b) Any persons found guilty by the Tribunal may appeal to the Board against his conviction or the penalty imposed. The reporting Umpire may appeal against the Tribunals decision, to the Board. c) The Secretary of the P.L.H.A. will inform in writing to the player, Club Secretary, Umpire and Members of the Board and to any witnesses. d) There shall be no further appeal against the decision of the Board, which has the power to quash or confirm the conviction, and quash or repeal the penalty. e) Notice of the appeal against the Tribunals decision, together with a deposit of $20.00 shall be lodged with the Secretary of P.L.H.A. prior to the expiration of one day from the date on which the Tribunal announces its first decision. Such notice shall state details on all grounds on which the appeal is made. f) The deposit of $20.00 may be refunded in full at the discretion of the Board g) The P.L.H.A. Secretary shall forward a copy of the notice to appeal to the President of P.L.H.A. as soon as is practicable, not later than forty eight hours after receiving the notice. h) Appeals have to be made in writing and signed by the player. The giving of a notice of appeal shall lift the operation of every penalty imposed by the Tribunal on the player until the penalty is either confirmed, varied or quashed by the Board i) Any ground which is not clearly set out in the notice of appeal cannot be introduced or relied upon at the hearing of the appeal. j) Any notice of appeal which is not lodged with the Association within the time limited by these By-Laws shall be treated as no notice and the appeal shall not be heard. k) The Secretary of P.L.H.A. shall notify the Club in writing. 19

32 l) Appeals shall be heard by the Board, the Friday immediately following the Tribunals decision at the latest CLUB RESPONSIBILITIES IN RESPECT OF SUSPENDED PLAYERS a) The Club is responsible for informing a player of his suspension. b) If a Club plays a suspended player, the team in which he plays shall forfeit any match (or matches) in which he takes part until the suspension is completed. c) The P.L.H.A. Secretary shall notify the players Club Secretary of the date the suspension has to be served. 13. BREACH OF A BY-LAW a) A breach of a By-Law with respect to Standing Orders shall be dealt with as required by Part 14 of these By-Laws. b) A breach of a By-Law verified in writing as part of a certified match report shall be deemed proved and the offending Club shall be fined $50.00 or the penalty otherwise provided; or the Board may determine an alternative penalty. c) An alleged breach of a By-Law received in writing by the Secretary shall be dealt with by the Board. 20

33 14. STANDING ORDERS FOR CONDUCT OF MEETINGS a) The rules in this part shall govern the conduct of any meeting of the Association and its Committees, except where the rules are specifically provided otherwise. b) Quorum - If at the expiration of thirty minutes from the time for which a meeting is called, there is not a quorum present, the meeting shall be abandoned. c) Chairman - A Chairman shall have a casting vote only. d) Method of voting - 1) A member or Delegate desirous of moving a motion, or amendment, or speaking thereon, shall rise and address the chair and shall not be interrupted unless called to order. 2) The mover of an original motion or amendment shall state the nature thereof before they address the meeting thereon. e) Seconding - No motion or amendment shall be discussed or put to the vote unless seconded, but a member may require the enforcement of any standing order by directing the Chairman's attention to its infringement. f) Withdrawal - No motion or amendment shall be withdrawn without the leave of the Chairman and consent of the mover and seconded. g) Amendments - 1) All amendments to any motion shall be relevant to its subject matter and shall otherwise be disallowed by the Chairman. 2) No second or subsequent amendment whether of an original motion or any amendment shall be received until the disposition of the previous amendment. 21

34 h) Speaking to the Motion - 1) No member shall digress from the subject matter of the question under discussion. 2) No member shall speak a second time on the same question unless the Chairman permits them to explain where they have been misrepresented or understood. 3) A member moving a motion shall be held to have spoken thereon, but shall be entitled, in the case of an original motion only, to reply immediately before the question is put. 4) A member merely seconding a motion shall not be held to have spoken thereon. 5) No discussion shall be allowed on any motion for adjournment of a meeting, or that the question be put. i) Calling to Order - If a point of order is raised the member holding the floor shall sit down until the member calling to order has been heard and the question decided. A member called to order shall remain seated unless permitted to explain by the Chairman. j) Voting - Voting shall be by a show of hands unless any three members or the Chairman require a division or ballot. k) Chairman decision - 1) The Chairman in deciding a point of order, shall state the provision, rule or practice which he deems applicable without discussing or commenting on the same. 2) The Chairman's decision shall be final unless a motion be moved and seconded that the ruling be disagreed with, when the chair shall be vacated in favour of the Deputy Chairperson, or such member as the meeting shall appoint until the motion is decided. 22
