1 The Regular Meeting of the Township Council of the Township of Rockaway was held on Thursday, January 23, 2018 in the Municipal Building 65 Mt. Hope Road, Township of Rockaway, County of Morris, State of New Jersey commencing at 7:30 p.m. Council President Jedynak led those present in the Salute to the American Flag. Council President Jedynak called for a Moment of Silence to remember the Service and Sacrifices of the Armed Service Members who Protect our Nation and the First Responders who Protect our Neighborhoods Acting Clerk Marcy Gianattasio stated that this meeting was advertised in the Daily Record, the official newspaper for the Township of Rockaway on January 8, The Citizen and the Star Ledger were notified in writing. Notice was posted on the official bulletin board of Rockaway Township. Present : Council Member Quinn, Council Member Friedlander, Council Member Puzio, Council Member Palumbo, Council Member Smith, Council Member Sackett, Council Member Kelley, Vice President Abrahamsen and President Jedynak Present from Administration : Mayor Dachisen, Attorney Iaciofano, Mr. Brewer, Mrs. Seger, Mrs. Palmieri, Mr. Lutz, Mr. Tabbot, Chief McParland and Tax Assessor Mark Burek COUNCIL PRESIDENT APPOINTMENTS: A. Special Committees 1 Year Term Economic Development Committee: Council Member Palumbo (Chair), Council Member Smith, Council Member Sackett OPEN TO THE PUBLIC: Michael Antenelli of 9 Timberbrook Rd, Rockaway, he asked how you can introduce an Ordinance that hasn t gone through attorney review. Jacqueline Baeder of 129 Richard Mine Road, Rockaway, Ordinance O she asked the council to please vote with good conscious of the town and the taxpayers who voted you in. She feels this ordinance will cause legal ramifications that will cost the township a lot of money. Frank Jeckell of 16 Faesch Ct, Rockaway, he wants to comment on the revisions to O-18-03, he feels not sending things through the attorney may cost the town less money but all ordinances that are passed are for the good of Rockaway Township. You cannot predict if there will be law suits. He fears ordinances without attorney review will result in law suits. He thinks the ordinance is just not right. Katie Platts of 2 Valhalla Way, Rockaway, she says each Council Member ran for office, you understand the rule of the law. She wants to know if any of the Council Members have legal backgrounds. You created a law to take away attorney review. $ an hour is a low amount 1

2 of money. She wants to know what fiscal reason this ordinance was created for. What other Municipalities have passed this type of ordinance? She says this ordinance is irresponsible. Rachel Brookes of 7 Lindberg Trail, Rockaway is concerned about ordinance O-18-03, and the high risk the insurance carrier might find it to be without legal review. The town will have a lawsuit coming from the Grossman Family after the TORT claim that the township received. If we have no insurance to cover us what will be done. It doesn t make sense. Paul Minenna of 4 Florence Dr, Rockaway said he served on the Council for many decades, no time was an ordinance not reviewed by the Township Attorney. This is to protect the taxpayers. Think about misfeasance and malfeasance. Think carefully about passing this ordinance. Ray Tahan of 957 Green Pond Rd, Rockaway he sees no reason to amend the current ordinance. It is already in the standard form in municipalities throughout the state. It has served Rockaway well for many years. Without attorney review you will be exposing Rockaway to future lawsuits. I HEREBY CERTIFY the above to be a true copy of a Resolution adopted by the Township Council of the Township of Rockaway at a duly convened Meeting held on January 23, R E S O L U T I O N R ACTING MUNICIPAL CLERK WHEREAS, the Mandatory Source Separation & Recycling Act, P.L. 1987, c.102, has established a Recycling Fund from which Tonnage Grants may be made to Municipalities in order to encourage local Source Separation and Recycling Programs; and WHEREAS, it is the intent and spirit of the Mandatory Source Separation & Recycling Act to use the Tonnage Grants to develop new municipal Recycling Programs and to continue and expand existing Programs; and WHEREAS, the New Jersey Department of Environmental Protection has promulgated recycling regulations to Implement the Mandatory Source Separation & Recycling Act; and WHEREAS, the Recycling Regulations impose on Municipalities certain requirements as a condition for applying for Tonnage Grants including, but not limited 6

7 to, making and keeping accurate, verifiable records concerning the amount of eligible Recyclable materials collected and claimed by the Municipality; and WHEREAS, a Resolution authorizing this Municipality to apply for the year 2016 Tonnage Grant which will memorialize the commitment of this Municipality to Recycling and indicate the assent of the Mayor and Council of the Township of Rockaway to the efforts undertaken by the Municipality and the requirements contained in the Recycling Act and Recycling Regulations; and WHEREAS, such a resolution should designate the individual authorized to ensure the application is properly completed and timely filed. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Rockaway that Rockaway Township hereby endorsed the submission of the RECYCLING TONNAGE GRANT APPLICATION to the New Jersey Department of Environmental Protection and designates AL KNOTH, RECYCLING COORDINATOR, 65 Mt. Hope Road, Rockaway, NJ to ensure that the said Application is properly filed; and BE IT FURTHER RESOLVED that any monies received from the RECYCLING TONNAGE GRANT be deposited in Dedicated Recycling Trust Fund to be used solely for the purposes of Recycling. Council President opened the meeting to the public: Michael Alardi of 19 North Brookside Dr. asked what streets are being affected by this ordinance. ORDINANCE NO O AN ORDINANCE AUTHORIZING THE GRANT OF THREE TEMPORARY ACCESS EASEMENTS WHICH ARE DEPICTED ON SURVEY DRAWINGS DATED MAY 31, 2017 WHICH WERE PREPARED BY KELLER & KIRKPATRICK, SURVEY ARCHITECTS, RESPECTING REAL PROPERTIES DESIGNATED AS LOT 1 in Block 11407, LOT 5 in BLOCK 11401, and LOTS 7&8 in BLOCK ON THE OFFICIAL TAX MAP OF THE TOWNSHIP OF ROCKAWAY WHICH LOTS ARE MORE COMMONLY KNOWN RESPECTIVELY AS 132, 133 AND 129 RICHARD MINE ROAD and WHEREAS, N.J.S.A. 40A:12-4 authorizes a municipality to acquire easements; WHEREAS, N.J.S.A. 40A:12-5 requires that the acquisition of easements by municipalities be accomplished by ordinance; and WHEREAS, it has been determined by the Engineer of the Township of Rockaway (Township) that it is necessary for the Township to acquire three Temporary Access Easements (Easements) from the subject real property owners in order to perform Township maintenance responsibilities respecting a stream running through the Township, which stream is contiguous and adjacent to the real properties which are the subject of the Easements; and 10

11 WHEREAS, it is the intention of the Township that the Easements should be temporary in duration and it is estimated that the construction work to be performed will be completed within one year of the passage of this Ordinance; and WHEREAS, the subject real properties and their owners, who have agreed to Grant such Easements at no cost to the Township are identified as follows: Owners Address Lot Block Baeder 129 Richard Mine Road 7& McCabe 132 Richard Mine Road Pagano 133 Richard Mine Road WHEREAS, it has been determined by the Township Council that approving the acquisitions of the three TEMPORARY ACCESS EASEMENTS which are attached hereto and made a part hereof by reference are necessary for the Township to perform its maintenance responsibilities and that such acquisition would be in the best interests of the Township; NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Rockaway, County of Morris, State of New Jersey, as follows: SECTION 1. The Township is hereby authorized to acquire three Temporary Access Easements respecting the real property aforesaid under the terms and conditions set forth in the subject Easements, copies of which are attached hereto and made a part hereof by reference. After all requirements respecting the enactment of this ordinance have been fulfilled the three Temporary Access Easements shall be recorded in the Office of the Morris County Clerk. SECTION 2. Having passed a first reading, this Ordinance shall be published in the manner required by N.J.S.A. 40:49-6, at least once not less than ten (10) days prior to the time fixed for further consideration for final passage. SECTION 3. Pursuant to N.J.S.A. 40:49-6, at least one week prior to the time fixed for final passage, a copy of the Ordinance, together with notice of the introduction, including time and place fixed for final passage, shall be mailed to every person whose land may be affected by the Ordinance. SECTION 4. The Township Clerk shall, within sixty (60) days after the Ordinance becomes effective, file a certified copy thereof, under the seal of the Township of Rockaway, together with a copy of the proof of publication thereof, in the Office of the Clerk of Morris County, pursuant to N.J.S.A. 40: SECTION 5. The Mayor and Township Clerk are hereby authorized to execute any and all instruments and to do all things necessary to effectuate the purposes hereof. 11

12 SECTION 6. All Ordinances, resolutions, and regulations or parts of ordinances, resolutions and regulations inconsistent herewith are hereby repealed as to the extent of such inconsistency. SECTION 7. If any section, paragraph, article, subdivision, clause or provision of this Ordinance shall be judged invalid, such adjudication shall apply only to the section, paragraph, article, subdivision, clause or provision so adjudged and the remainder of this Ordinance shall be deemed valid and effective. SECTION 8. This Ordinance shall take effect upon final passage and approval in accordance with law. Statement of Purpose Marcy Gianattasio, Acting Township Clerk The purpose of this ordinance is to acquire three Temporary Access Easements at no cost and expense to the Township in order to reconstruct or construct and/or perform necessary stream maintenance which is the responsibility of the Township, which maintenance would be impossible without the Township s first securing a right of entry access to the stream by way of Easements to real properties which are contiguous / adjacent to the subject stream. A motion was made b y Council Member Smith and seconded by Council Member Puzio to adopt ordinance O Council President Jedynak opened the meeting to the public: There was no public comment. 12

13 Council Member Kelley asked if any septic systems on Richard Mine Road would be disturbed. Township Engineer Lutz said no, there would be no septic systems disturbed. O ORDINANCE AMENDING CHAPTER 2, SECTION ORDINANCES AND RESOLUTIONS OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF ROCKAWAY TO CLARIFY ROLES IN THE PREPARATION OF ORDINANCES AND RESOLUTIONS WHEREAS, the Township Council has deemed it necessary to amend the language of Chapter 2 Section (a) to clarify the roles of Councilmembers and the Township Attorney with regard to the preparation of ordinances and resolutions to be introduced by the Township Council. NOW, THEREFORE, BE IT ORDAINED, by the Township Council of the Township of Rockaway, County of Morris and State of New Jersey as follows: Section (a) is hereby amended to read as follows: a. Preparation. Ordinances and resolutions may be drafted by any Councilmember. Ordinances and resolutions may be drafted by the Township Attorney, who shall prepare such ordinances and resolutions as the Council may request. Ordinances and resolutions not drafted by the Township Attorney may be reviewed by the Township Attorney as to form and legality, upon the request of the Council. All ordinances, resolutions and regulations, or parts of ordinances, resolutions and regulations inconsistent herewith are hereby repealed to the extent of such inconsistency. If any section, paragraph, article, subdivision, clause or provision of this Ordinance shall be judged invalid, such adjudication shall apply only to the section, paragraph, article, subdivision, clause or provision so adjudged, and the remainder of this Ordinance shall be deemed valid and effective. NEW BUSINESS: The Council listened to a presentation by the Tax Assessor, Mark Burek, regarding Municipal Wide Reassessment for the 2018 Tax Year. Mr. Burek explained the difference between revaluation and reassessment and what is the need for revaluation and reassessment. He also explained what is meant by full and fair share value. Council Member Sackett shared an ordinance with the council. O ORDINANCE RESTRUCTURING THE RECREATION DEPARTMENT AND ITS VARIOUS PARTICIPATING SPORTS LEAGUES OF THE REVISED GENERAL ORINANCES OF THE TOWNSHIP OF ROCKAWAY TO CLARIFY ROLES OF THE RECREATION DEPARTMENT AND INCREASE TRANSPARENCY After a long discussion with the Council, Township Attorney, and Administration it was decided that Council Member Sackett will meet with Administration to discuss this ordinance further. Council President Jedynak asked Administration about an he sent out asking about a resolution where the State requires a Certifying Officer and Assistant Certifying Officer. Administrator Brewer let the Council know the resolution is being drafted and will be on for approval at the next Council meeting. Council President Jedynak stated that on January 8, 2018 Council Member Kelley relayed a complaint from a resident about an employee allegedly using township equipment on his private property to remove snow from his driveway and deck. Administration was given photos and video of the alleged act. After a follow up , President Jedynak sent a follow up asking administration to be prepared to discuss the personnel issue by Rice noticing the employee if 14

15 need be. He received no response right away. On January 19 th the Mayor responded that Administration determined that the equipment used was private property and not company property. The property was also being used on the weekend and not during work hours. Administrative action was taken. President Jedynak asked the Mayor to report on pictures and the video, how Administration conducted their investigation, and to describe the specific actions taken. Council President says he did not get a response on this. Council Member Puzio and Council Member Quinn said to let Administration do their jobs. Council Member Kelley says this is an accusation. This may be a small matter but if it was transparent and if there was a simple response it would not have come to this. Council President Jedynak made a motion to appoint a Committee of the Council to investigate this complaint and to interview members of Administration as necessary, due to the unsatisfactory response from the Mayor on this matter, seconded by Vice-President Abrahamsen. Roll Call was taken. 6 Yah Votes 3 Nah Votes (Quinn, Friedlander, Puzio) Motion is carried. President Jedynak appointed 3 members to the Investigation Committee: Vice-President Abrahamsen (Chair) Council Member Kelley Council Member Sackett President Jedynak explained that with 5 new members on the Council, he would like to have a list of active and ongoing litigation. Township Attorney Iaciofano explained the different kinds of litigation. He also stated that the list would take some time to generate. He would be happy to generate a complete list. He is guessing the list will take a minimum 3-4 weeks. REPORTS : Council Member Quinn: Tomorrow night he and Council Member Puzio will attend a local Board of Education Meeting. Council Member Friedlander : He attended Morris Hills Regional Board Meeting. They mentioned a Performing Arts & Dance Studio. He attended a Library Board meeting. The library is planning a Library Festival Day. Council Member Puzio : He announced that on March 20, 3018 at 7:00pm at Copeland School there will be a program called Stop the Bleed. It will teach the average person how to stop bleeding using techniques people actually learn in medical school. Council Member Palumbo : He attended the Chamber of Commerce meeting, with speaker Megan Hansure, she is hoping to aid and assist us to draw businesses to Rockaway Township. Council Member Smith : She attended the Rockaway Area Chamber of Commerce meeting it was very informative. She wants to thank the Council President for appointing her to the Economic Development Committee. She thinks the committee will work well together to encourage businesses to move into Rockaway. Council Member Sackett : He attended a Laundry Love of Rockaway held on January 15 th, a program that will allow the homeless people in the area to wash their clothes once a month. He wants to thank Emily Coleman for hosting the event, please check out their Facebook page. He attended the Chamber of Commerce meeting and he looks forward to being on the Economic Development Committee the next meeting is February 9 th at 9-10am at the Atlantic Health 15

16 Building. There will be a Citizen Recreation Committee meeting on February 6 th at 7:15pm. Stoneybrook School held candy bar bingo. There were a lot of families there from Ward 4. The kids had a great time. Council Member Kelley: He attended the Chamber of Commerce meeting. Thank you to Mr. Burek for the presentation he gave about property taxes. The ice and water drill held by the fire companies was eventful. This drill is a good thing to do. Monti s Garden Center project on Mount Hope Road and Richard Mine Road looks great. He built a wonderful building and garden center. Girl Scouts are selling cookies please buy them. He asked administration about the mechanism to request maintenance and repairs on our fire trucks; can he get copies of the requests? Council Vice President Abrahamsen : 4 th grade teacher, Ms. Thomas along with Pastor Mateo and Tom Dagnan who has a group mobile unit. Children are gathering hats, gloves and mittens and non-perishable items. This is to give out to the local homeless population; this is very big in Morris County. President Jedynak : Thank you to the Tax Assessor for the presentation. He attended the Chamber event and, thanked the Morris County Economic Development Committee. They showed a market profile for Denville that they were working on. This would be an excellent project for Rockaway to undertake. Mayor Dachisen: He had a very long conversation with Mall Management and online shopping is taking over. Even though they had a great holiday season they are still worried about losing outer stores and small inner stores. They are looking to put in more entertainment based stores and restaurants. The Mayor stated we don t want the mall to fail. Attorney Iaciofano : No Report. Mr. Brewer : No Report. Mrs. Seger : No Report. Mr. Lutz: No Report Mrs. Palmieri: No Report Chief McParland: Saturday our police patrols assisted with the Woman s Right Rally and Parade. There were cars broken into overnight around Birchwood. Patrols were increased in that area. Vice President Abrahamsen asked if an alert could be sent out to inform people about something like this. OPEN TO THE PUBLIC: Mike Antonelli 9 Sunny Brook Dr, asked if it is an option to get an explanation from the Council as to the yes and no votes on Resolution and also he would like feedback from the Township Attorney or the Mayor on this resolution. Pat Degnan 88 Valley View, she is very unhappy with the street signs along White Meadow. The signs are unclear and need to be marked better. The roads are narrow and plows cannot get past the cars that are there before the snow starts and are not moved. Rockaway Borough has no parking on certain streets between April 1 st and November 1 st. Doing this in Rockaway Township may help with this problem. She is very disappointed with the Council for discussing a personnel matter in public and this should never have been done. Michael Alardi -19 North Brookside Dr, He said with the hills in White Meadow people would have a problem getting their cars in the driveways if there was no parking on the street. He wants to know why Council mail isn t delivered electronically. He is disappointed with the Council s behavior at the meeting. 16

17 Tom Brennan, 6 North Ridge Ct, He wants to thank the Council for appointing him to the IT Committee and the Planning Board. He also thanked Council Member Sackett for the time he spends with the town s recreation and sports programs. He feels the town budget does not show a breakdown of money spent for different sports and recreation programs. Jacki Baeder 129 Richard Mine Road, She is disgusted in the way the Council acts. She is on the Recreation Committee, and they have been working on the recreation ordinance for a long time. She feels the ordinance should have been reviewed by the Recreation Committee and she is disappointed by this. She also feels the items presented by the council that was not on the agenda should not have been talked about tonight. This is a waste of everyone s time and is making the meetings run too long. There should be a timeline on items on the agenda to make the meeting go faster. Rob Carmagnola 2 Durham Rd, He thinks the Recreation Ordinance is great. He believes there needs to be checks and balances. He is the Vice-President of Rockaway Soccer Club. The money does not get broken down to the different sports evenly. He feels the money should be split evenly amongst the sports teams. Kati Platts 2 Valhalla Way, Asked as far as the tax assessment presentation we heard tonight, why don t we wait until the determination of the potential lose in property values and see what the Federal Taxes changes are going to be before we go forward with it. She explained that OPRA is usually used by attorneys for to get their answers for discovery faster. She attends a lot of Board of Education meetings and she only sees Council Member Puzio at those meetings. She wishes the Council would think about the residents and the people who votes for them.
