1 Page 1 Minutes of the Regular Meeting of the Township Committee of the Township of Hillsborough, in the County of Somerset, State of New Jersey, held in the Municipal Complex at 7:30 p.m. on the above date. Upon call of the roll, the following Committee members were recorded present: Committeeman DelCore, Committeeman Ferrera, Committeeman Robert Wagner, Deputy Mayor Carol Suraci, and Mayor Gloria McCauley. Also, in attendance were Township Attorney Albert E. Cruz, Township Administrator / Acting Clerk Mike Merdinger, and Deputy Clerk Pam Borek. SALUTE TO THE FLAG Following roll call, Mayor McCauley advised that notice of this meeting was made in accordance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law 1975, by posting on the bulletin board at the Hillsborough Township Municipal Complex and notifying the officially designated newspapers that this meeting would take place at the Hillsborough Township Municipal Complex at 7:30 p.m. on October 25, PROCLAMATIONS / PRESENTATIONS / APPOINTMENTS Proclamation honoring Rachel Karan members of the Somerset Valley YMCA 10 and Under Girls Freestyle Relay Team that broke the state 200 meter freestyle record WHEREAS, Rachel Karan, Hillsborough resident and sixth-grader at Auten Road School, is a member of the Somerset Valley YMCA 10-and-under girls relay team that broke the state 200-meter free-style record at the Long Course Junior Olympics; and WHEREAS, we, the Township Committee of the Township of Hillsborough, recognize the many hours Rachel has devoted to practicing in order to achieve such an honor; and WHEREAS, Rachel started swimming at the age of 7 at the Roycefield Swim Club; and WHEREAS, at Roycefield Swim Club this summer, Rachel broke the 9-10 age group record for the 50-yard Breast Stroke and also broke the 9-12 age group record for the 200-yard Free Relay and the 200-yard Medley Relay along with her fellow teammates; and WHEREAS, Rachel has been a member of the Somerset Valley YMCA Swim Team since she was 8 years old; and WHEREAS, for the Somerset Valley YMCA Swim Team, Rachel and her fellow teammates came in 1 st Place in the 200-meter Medley Relay at the Long Course Junior Olympics; and NOW, THEREFORE, BE IT PROCLAIMED that we, the members of the Hillsborough Township Committee, do hereby recognize and extend our sincere congratulations to Rachel Karan for her hard work and dedication to her sport, and wish her many more successes in her swimming career. Proclamation honoring Haley Tevnan members of the Somerset Valley YMCA 10 and Under Girls Freestyle Relay Team that broke the state 200 meter freestyle record WHEREAS, Haley Tevnan, Hillsborough resident and a fifth-grader at Auten Road School, is a member of the Somerset Valley YMCA 10-and-under girls relay team that broke the state 200-meter free-style record at the Long Course Junior Olympics; and WHEREAS, we, the Township Committee of the Township of Hillsborough, recognize the many hours Haley has devoted to practicing in order to achieve such an honor; and WHEREAS, Haley started swimming at the age of 6 at the Roycefield Swim Club; and

2 Page 2 WHEREAS, at Roycefield Swim Club this summer, Haley broke the 9-12 age group record for the 200-yard Free Relay and the 200-yard Medley Relay along with her fellow teammates; and WHEREAS, Haley has been a member of the Somerset Valley YMCA Swim Team since she was 7 years old; and WHEREAS, for the Somerset Valley YMCA Swim Team, Haley and her fellow teammates came in 1 st Place in the 200-meter Medley Relay at the Long Course Junior Olympics; and NOW, THEREFORE, BE IT PROCLAIMED that we, the members of the Hillsborough Township Committee, do hereby recognize and extend our sincere congratulations to Haley Tevnan for her hard work and dedication to her sport, and wish her many more successes in her swimming career. Proclamation declaring October as National Community Planning Month WHEREAS, New Jersey municipalities, counties, and regional planning entities continually face changes in their communities and natural environment, and WHEREAS, community planning and plans can help manage this change in a way that provides better choices for how people work and live; and WHEREAS, community planning provides an opportunity for all residents to be meaningfully involved in making choices that determine the future of their community; and WHEREAS, the full benefits of planning requires public officials and citizens who understand, support, and demand excellence in planning and plan implementation; and WHEREAS, the American Planning Association has designated the month of October as National Community Planning Month throughout the United States of America and its territories to highlight the contributions of sound planning and plan implementation, and WHEREAS, the celebration of National Community Planning Month gives us the opportunity to publicly recognize the participation and dedication of the members of planning and zoning boards and other citizen volunteers who have contributed their time and expertise to the improvement of Hillsborough Township, New Jersey; and WHEREAS, we recognize the many valuable contributions made by professional planners in the Township of Hillsborough, New Jersey and extend our heartfelt thanks for the continued commitment to public service by these professionals; NOW, THEREFORE, BE IT RESOLVED THAT, the month of October 2011 is hereby designated as Community Planning Month in Hillsborough Township, New Jersey in conjunction with the celebration of National Community Planning Month. Mr. Bob Ringelheim, the Township Planner and Mr. David Kois, the Zoning Officer accepted the proclamation. Credit Card Advisory Committee Presentation with Affinity Federal Credit Union Deputy Mayor Suraci, liaison to the Credit Card Advisory Committee, introduced Mr. Don Simmons, the committee chairman. Mr. Simmons announced that the following groups were in attendance to receive a grant check from the Credit Card Advisory Committee: Hillsborough Rockets, Hillsborough Junior Raiders Youth Football Organization, and Boy Scout Troop 89. The Hillsborough Rockets group came forward to accept their grant and thanked the committee and all of the residents of Hillsborough for the grant money which will be used to buy new costumes for the group. The dance group performs at local event, nursing homes, and many other facilities.

3 Page 3 A representative for the Hillsborough Junior Raiders accepted the grant check for the organization which will use the money to purchase new helmets with greater safety capabilities. Boy Scout Troop 89 members attended the meeting and accepted the grant to be used to purchase new tents for the Boy Scouts to use on their trips. Mr. Simmons stated that the Credit Card Advisory Committee s goal is to provide funds to the non-profit organizations in Hillsborough. Mayor McCauley congratulated our grant recipients and said that the credit card grant program is such a wonderful program here in Hillsborough. Mayor McCauley thanked Ms. Natale and Mr. Simmons for their presentation and thanked the entire Credit Card Advisory Committee for their tireless efforts and dedication to promote the program and to vet the many submitted applications from these worthy organizations serving our youth and seniors. Mayor McCauley stated that this is the 10 th award given this year by the Credit Card Advisory Committee and the township committee looks forward to the continued success of this program. APPROVAL OF MINUTES Approval of the October 11, 2011 Regular Meeting Minutes Upon motion by Committeeman DelCore, seconded by Committeeman Ferrera, the minutes of the October 11, 2011, Regular Meeting was approved upon the call of the roll. Yes Ferrera, Wagner, DelCore, Suraci, McCauley Committeeman DelCore REPORTS FROM COMMITTEE LIAISONS, AND RECEIPT OR REPORTS, PETITIONS OR COMMUNICATIONS Committeeman DelCore, who is on the Hillsborough Sustainable Steering Committee, announced there will be a Central Jersey Best Sustainable Practices event this Saturday, November 5 from 1 4pm at Duke Farms. Committeeman DelCore said the event is sponsored by the Hillsborough Steering Committee and Sustainable Jersey organization. Committeeman DelCore said there will be group sessions at the event where residents can learn about ways to save money in sustainable ways. Committeeman DelCore stated that information on home energy, recycling improvements, electric cars, rebates, and more will be available at the event. Committeeman DelCore said there is free registration at sustainablejersey.com/event.php or more information may be found on the township website. Committeeman DelCore also mentioned that the Somerset County Sheriffs Office will be holding two medication collection programs. Operation Take-back will be on Saturday, October 29, and American Medicine Chest Challenge will be on Saturday, November 12. Committeeman DelCore stated that both programs will be held at the Somerset County Administration building at 20 Grove Street, Somerville from 10am-2pm on the dates listed.

4 Page 4 Committeeman DelCore said these programs allow residents to dispose of unwanted medicine in a safe manner. Committeeman DelCore announced that the 17 th Economic and Business Development Commission (EBDC) Business Social will be held at Pheasant s Landing on Monday, November 21, 2011 tentatively starting at 6pm. Committeeman DelCore said the event is a wonderful networking opportunity for anyone interested and for further information, please contact Mr. Gene Strupinsky, the Township Business Advocate, at x106. Committeeman Ferrera Committeeman Ferrera announced that the township will once again be starting leaf pick up throughout the town starting November 1 st. Committeeman Ferrera reminded residents that leaves may not be in the street and may be in a bin with the sides being less than 36 inches. Committeeman Ferrera also mentioned that the town offers leaf drop off at the Auten Road dump on the following Saturdays from 7am to 3pm: November 5, 12, 19, December 3, 10, 17. Committeeman Ferrera stated that proof of residency is required at the dump when dropping off leaves. Committeeman Ferrera also addressed the issue of programs for special needs residents by giving a history of the programs available within Hillsborough Township. Committeeman Ferrera stated that in 2005, Hillsborough started the second program in New Jersey for having inclusive recreational programs and has added many more programs since then. Committeeman Ferrera mentioned that in 2006, in coordination with the Hillsborough School System, started Camp Heart an inclusive summer camp for residents. Committeeman Ferrera stated that in 2007 Hillsborough was recognized by the Governor by winning the Governor s Award from the NJ Department of Government Affairs for having the best recreational programs for people with disabilities. Committeeman Ferrera said that by the end of 2007, the township offered 15 different programs that incorporated Hillsborough special needs residents into the same programs as all other residents. Committeeman Ferrera continued to talk about the history of the programs and how in 2010, he and a team raised $100,000 to build the first inclusive park at Ann Van Middlesworth Park. Committeeman Ferrera said that park was built by over 100 volunteers and did not use any tax payers funds. Committeeman Ferrera acknowledged Rich Resavy and the Parks and Recreation Department along with Lenore Johnson from the Hillsborough Board of Education for their work in making these programs happen. Committeeman Ferrera thanked the Police, Fire, and Rescue departments for their countless hours of learning and understanding the special needs of some of our residents. Committeeman Ferrera said that Hillsborough Township has done a tremendous job providing opportunity for special needs residents.

5 Page 5 Committeeman Ferrera finished by saying that he is working in conjunction with the town and county to set up a program for teaching on the job training for our special needs adults. Committeeman Wagner Committeeman Wagner reminded residents that the township will be holding their annual Veterans Day Commemoration at 7pm on November 11. Committeeman Wagner said that there will be a brief ceremony outside the Municipal Building at the Garden of Honor with a reception inside following. Committeeman Wagner said to register for the event residents may to go to the township website Deputy Mayor Suraci Deputy Mayor Suraci mentioned that the Recreation In-town basketball program is still open for registrations and may be done online through the township website. Mayor McCauley Mayor Gloria McCauley updated the residents that FEMA has extended the deadline until the end of November for disaster relief assistance. Mayor McCauley advised residents to visit the Township website should they need any further information. Mayor McCauley announced that she and the committee members attended the Resource Center of Somerset s annual gala. Mayor McCauley said the black-tie gala was once again a success in raising additional funds for the programs and services offered by the Resource Center, that are offered to the survivors of domestic violence and their families within Somerset County. Mayor McCauley announced that the township committee was honored to be named the recipients of this year s Peter J. Biondi Public Service Award, which is presented yearly to an individual or group for outstanding support and contribution through public service. Mayor McCauley said it was quite an honor and privilege to be recognized for this prestigious award. Mayor McCauley said that she placed a wreath at the Vietnam Remembrance Traveling wall, located in North Branch Park in Bridgewater, in honor of Hillsborough resident Jules T. Girtanner, who was killed in action during Vietnam. Mayor McCauley said that each of the four days that the wall was present at the park, a different ceremony was conducted in honor of the men and women who served in all wars or conflicts defending the freedoms of the United States of America. Mayor McCauley reminded everyone that on Friday, November 11 th all Veterans are invited to attend the 3 rd Annual Veterans Day Ceremony here at the Township at 7pm. The evening will include a ceremony at the Garden of Honor, a march of the Veterans and a brief reception with light refreshments in the multipurpose room. Please visit the Township website to register. Mayor McCauley thanked Boy Scout Troop 89 for inviting her to participate in their civics discussion at their most recent meeting. Mayor McCauley said the event started off with a presentation by Scout Eddie Norgard on the history of Hillsborough and she congratulated him for doing such a wonderful job.

6 Page 6 Mayor McCauley talked about the Family Fun night, at Auten Road School, which combined the Municipal Alliance Red Ribbon Kick off with the Mayor s Wellness Campaign. Mayor McCauley thanked Minda Maggio, Margo Meyer, Betsy Hollenbach, Pam Borek, and the entire Red Ribbon Committee for all of their hard work for this well attended event. Mayor McCauley said that she participated in the Magic show and was honored to participate at the event. None at this time NEW BUSINESS PUBLIC COMMENT ON NEW BUSINESS AND MATTERS NOT ON THE AGENDA Mr. Bill Courtier, 1095 Millstone River Road, addressed the committee as to his desire for FEMA to buy-out his family s property and requested the township committee to aide in the process. Committeeman DelCore explained to the resident that FEMA will only pay 75% of the cost but would require Hillsborough to pay the remaining 25% which would financially be difficult for the township to cover. The committee agreed to look into the issue and see if the township administration would be able to help Mr. Courtier fill out the paper work for FEMA even though Hillsborough would not be able to pay the 25% in additional funds. Mr. Tony Risoli, Triangle Road, asked the committee if they could expand the leaf pick-up/drop off to include brush in the future. Mayor McCauley said that at this time we do not have the equipment to accommodate that however, they are looking into the acquiring additional equipment that may help with that in the next few years. Mr. Risoli also asked Mr. Albert Cruz, the township attorney, if the township committee is able to ask or demand to have the Board of Education include an item on their ballot. Mr. Cruz said that the Board of Education is an autonomous organization and the township committee has no jurisdiction over. Mr. Cruz stated that Mr. Risoli and any resident have the right to address the Board of Education as he is with the township committee. Mr. Risoli asked the Township Committee to look into the idea of a feasibility study at the Board of Education level as is being done with the Police and Court Departments. Mr. Cruz addressed the fact that the township committee has no legal recourse to do that and the township committee suggested resident could take that suggestion to the county level. None at this time PUBLIC HEARINGS INTRODUCTION OF NEW ORDINANCES An Ordinance amending Chapter 188 (Development Regulations), Article V (Districts and Standards) of the Code of the Township of Hillsborough, County of Somerset, State of New Jersey, in order to amend Section to revise the

7 Page 7 requirements for the minimum floor area ration in the GA, Gateway A District. Further consideration of this ordinance and public hearing will be held on November 22, BE IT ORDAINED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey, as follows: Section 1. Amend Chapter 188 of the Code of the Township of Hillsborough by revising Section D(1)(g) to read as follows: (g) Floor area ratio: Section 2. Severability. If any provisions of this ordinance shall be adjudged invalid, such adjudication shall not affect the validity of the remaining provisions, which shall be deemed severable there from. Section 3. Effective Date. This ordinance shall take effect immediately upon passage and publication according to law. Committeeman Wagner moved that the aforesaid Ordinance be passed on first reading and that the Ordinance be further considered at a public hearing held on November 22, 2011 at 7:30 p.m. Said motion was seconded by Committeeman DelCore and unanimously approved upon call of the roll An Ordinance amending Chapter 188 (Development Regulations), Article V (Districts and Standards) of the Code of the Township of Hillsborough, County of Somerset, State of New Jersey, in order to amend Section to revise the sign area requirements for wall, corner and canopy awning signs in the C-l, P/R, OLC, HS, GV Commercial Districts, as well, as to revise the sign area requirements for wall and corner signs in the O-2, O-5, I-1, I-2, I-3, GI, ED, CDZ, M, Q, TECD AND LI Industrial Districts and to amend Section to revise the sign area requirements for wall, corner and canopy awning signs in the GA District and to amend Section to revise the sign area requirements for wall, corner and canopy/awning signs in the GB District. Further consideration of this ordinance and public hearing will be held on November 22, BE IT ORDAINED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey, as follows: Section 1. Amend Chapter 188 of the Code of the Township of Hillsborough by revising Section 83 J(3)(a) to read as follows: (a) Each permitted use may have one (1) wall sign, provided the sign shall not exceed an area equal to ten percent (10%) of the area of the ground floor façade, or forty (40) square feet, whichever is less. Section 2. Amend Chapter 188 of the Code of the Township of Hillsborough by revising Section 83 J(3)(c) to read as follows: (c) Corner uses may have a second wall sign, provided that such sign is located on the secondary street façade and does not exceed an area equal to one half (1/2) of the area of the primary street façade wall sign or twenty (20) square feet, whichever is less. Section 3. Amend Chapter 188 of the Code of the Township of Hillsborough by revising Section 83 J(3)(d) to read as follows: (d) Each permitted use may have one (1) canopy or awning sign; however, such signs shall not exceed an area equal to ten percent (10%) of the area of the ground floor façade, or thirty (30) square feet, whichever is less, and such signs shall be located on the valance area only.

Amend Chapter 188 of the Code of the Township of Hillsborough by revising Section 83 K(3) to read as follows: (3) Each permitted use may have one (1) wall sign, provided the sign shall not exceed an area equal to ten percent (10%) of the area of the ground floor façade, or forty (40) square feet, whichever is less. Committeeman DelCore moved that the aforesaid Ordinance be passed on first reading and that the Ordinance be further considered at a public hearing held on November 22, 2011 at 7:30 p.m. Said motion was seconded by Deputy Mayor Suraci and unanimously approved upon call of the roll An Ordinance to amend, revise and supplement the Township Code of the Township of Hillsborough, most notably Chapter 73, Officer and Employees, especially Section 73-83, Director of Parks and Parks and Recreation, Duties and Responsibilities ; Section , Assistant Supervisor of Parks, Duties ; and, Section , Director of Public Works, Duties. Further consideration of this ordinance and public hearing will be held on November 22, WHEREAS, the Township Committee of the Township of Hillsborough wishes to reorganize a portion of the Township s Public Works Department by assigning the Assistant Supervisor of Parks and the employees under his supervision to the control of the Director of Parks and Recreation. NOW, THEREFORE, BE IT ORDAINED that the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey that the Township Code of the Township of Hillsborough is hereby amended, revised and supplemented as to Chapter 73, Officers and Employees, most notably Section 73-83, Director of Parks and Recreation, Duties and Responsibilities; Section , Assistant Supervisor of Parks, Duties; and, Section , Director of Public Works, Duties, as follows: A. Section of the Township Code is hereby amended, revised and supplemented as follows: (1) Create a new subsection 19 under 73-83B of the Township Code, which states: Oversees the day to day and long term operation and maintenance of the parks, grounds, facilities and equipment of the Township of Hillsborough. Serves as the direct Supervisor of the Assistant Supervisor of Parks. (2) Create a new subsection 17 under 73-83C of the Township Code, which states: Oversees the day to day and long term operation and maintenance of the parks, grounds, facilities and equipment of the Township of Hillsborough. Serves as the direct Supervisor of the Assistant Supervisor of Parks. (3) Renumber the current subsection 17 under 73-83C to subsection 18 under 73-83C of the Township Code. B. Section of the Township Code is hereby amended, revised and supplemental as follows by creating a new subsection C, which states: C. The Assistant Supervisor of Parks shall report directly to the Director of Parks and Recreation. The Assistant Supervisor of Parks shall be responsible to insuring the manpower under his supervision are providing the services that their job responsibilities require and/or are necessary. C. Section of the Township Code is hereby amended, revised and supplemented as follows: 1. Revise subsection E to state as follows:

10 Page 10 E. Prepare and present long-range planning recommendations for the improvement of the Township s roads, building and grounds and equipment. 2. Revise subsection J to state as follows: J. Supervise and administer the Department of Public Works and its personnel, other than the Parks and Recreation Department. 3. Create a new subsection L under of the Township Code, which states: L. During emergency operations, supervise and administrate the Department of Public Works personnel, as well as those employees assigned to the parks under the Parks and Recreation Department. NOW, THEREFORE, BE IT FURTHER ORDAINED that: 1. All ordinances or portions of ordinances which are inconsistent with this Ordinance shall be repealed as to their inconsistencies only. 2. If any provision or paragraph of this Ordinance shall be held invalid by any court of competent jurisdiction, the same shall not affect the other provisions or paragraphs of this Ordinance, except so far as the provision or paragraph so declared invalid shall be separable from the remainder or any portion thereof. 3. This Ordinance shall take effect after final passage and publication in accordance with law. Committeeman Ferrera moved that the aforesaid Ordinance be passed on first reading and that the Ordinance be further considered at a public hearing held on November 22, 2011 at 7:30 p.m. Said motion was seconded by Deputy Mayor Suraci and unanimously approved upon call of the roll. CONSIDERATIONS 1. Resolution accepting the Central Jersey Housing Resource Center - CJHRC (formerly known as the Somerset County Coalition on Affordable Housing/SCCOAH) proposed 2012 Affordable Housing Agency agreements, effective January 1, 2012 through December 31, 2012 and authorizing the Mayor and the Township Administrator/Acting Clerk to enter into said agreements with CJHRC for existing Affordable Housing units at Hearthstone at Hillsborough, Crestmont Hills and New Center Greens, in AN amount not to exceed $12, WHEREAS, the Central Jersey Housing Resource Center (CJHRC) has submitted the following Affordable Housing Agency Agreements: the 2012 Affordable Housing Independent Agency Agreement for the administration of the affordable housing units in Hearthstone at Hillsborough, Crestmont Hills and New Center Greens; and WHEREAS, this agreement will be effective January 1, 2012 through December 31, 2012; and WHEREAS, the Township Planner has recommended that the Township approve said agreements as to ensure continued compliance with the applicable affordable housing requirements; and WHEREAS, funds are available and have been certified as such by the Chief Finance Officer and said certification is attached to this resolution. NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey that the Mayor and the Township Administrator/Clerk are hereby authorized to enter into an Affordable Housing Independent Agency Agreement for Hearthstone at Hillsborough, an Affordable Housing Independent Agency

11 Page 11 Agreement for Crestmont Hills and an Affordable Housing Independent Agency Agreement for New Center Greens with CJHRC not to exceed $12, Upon motion by Committeeman DelCore seconded by Deputy Mayor Suraci, the aforesaid resolution was unanimously approved upon call of the roll. 2. Resolution authorizing special item of revenue and appropriation. Pursuant to N.J.S. 40A:87 (Chapter 159, P.L. 1948) WHEREAS, N.J.S. 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any County or Municipality when such item shall have been made by law and the amount thereof was not determined at the time of the adoption of the budget; and WHEREAS, said Director may also approve the insertion of any item of appropriation for equal amount, WHEREAS, the Township will receive $5, in additional grant monies from the New Jersey Department of Health & Senior Services for Hepatitis B inoculations and wishes to amend its 2011 Budget to include this grant. NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the Township of Hillsborough hereby requests the Director of the Division of Local Government Services to approve the insertion of this item of revenue in the budget of the year 2011 in the amount listed and detailed below, which item is now available as a revenue from: STATE OF NEW JERSEY HEALTH & SENIOR SERVICES HEPATITIS B INNOCULATION FUND $5, BE IT FURTHER RESOLVED that a like sum, be, and the same, hereby is appropriated under the above appropriation title. Upon motion by Committeeman Wagner seconded by Committeeman Ferrera, the aforesaid resolution was unanimously approved upon call of the roll. 3. Resolution authorizing a shared services agreement for a shared municipal court between the Townships of Hillsborough and Montgomery. WHEREAS, the Townships of Hillsborough and Montgomery are interested in creating tax savings through the implementation of a Shared Municipal Court; and WHEREAS, an agreement to enter into a shared service for municipalities is permitted under N.J.S.A. 40A:65-1 et seq., the Uniform Shared Services and Consolidation Act ; and WHEREAS, N.J.S.A. 2B:12-1.c allows for the establishment of Shared Municipal Courts and provides that: [t]wo or more municipalities, by ordinance or resolution, may agree to provide jointly for courtrooms, chambers, equipment, supplies and employees for their municipal courts, and agree to appoint judges and administrators without establishing a joint municipal court. Where municipal courts share facilities in this manner, the identities of the individual courts shall continue to be expressed in the captions of orders and process;

12 Page 12 and WHEREAS, the Townships received approval for the Shared Municipal Court pursuant to New Jersey Court Rule 1:33-4(a) which provides that "[t]he Assignment Judge shall be the chief judicial officer within the vicinage and shall have plenary responsibility for the administration of all courts therein ; and WHEREAS, the Townships will take those required steps to implement a Shared Municipal Court including complying with the requirements of the Assignment Judge and Municipal Court Services, including any checklist for the establishment of a Shared Municipal Court; and WHEREAS, the Township of Montgomery has elected not to appoint its own Municipal Court Judge, Court Administrator, Prosecutor or Public Defender pursuant to N.J.S.A. 2B:12-1.c; and WHEREAS, the Shared Services Agreement shall be for five (5) years and may be terminated by either party by providing written notice of termination no later than July 1 of the calendar year in which the Shared Services Agreement will terminate; and WHEREAS, the Township of Montgomery shall pay the Township of Hillsborough thirty (30%) percent of the Township of Hillsborough s expenses to operate the Shared Municipal Court; and WHEREAS, in the event that the case load of the Township of Montgomery Municipal Court increases more than thirty (30%) percent over the prior year s case load utilizing Shared Municipal Court statistics issued by the Administrative Office of the Courts, then the Townships shall negotiate an additional Service Charge to address any increase in costs directly attributable to the increased Township of Montgomery case load; and WHEREAS, the Townships desire to enter into the attached Shared Services Agreement for a Shared Municipal Court between the Township of Hillsborough and the Township of Montgomery substantially in the form attached subject to finalization by the respective Township Administrators and Attorneys in order that the Shared Municipal Court becomes operational on January 1, NOW, THEREFORE, BE IT RESOLVED that the Mayor and Clerk are hereby authorized to sign the attached Shared Services Agreement for a Shared Municipal Court between the Townships of Hillsborough and Montgomery substantially in the form attached subject to finalization by the respective Township Administrators and Attorneys in order that the Shared Municipal Court becomes operational on January 1, 2012; and BE IT FURTHER RESOLVED that this Resolution shall take effect immediately. Upon motion by Committeeman DelCore seconded by Deputy Mayor Suraci, the aforesaid resolution was unanimously approved upon call of the roll. 4. Resolution amending person-to-person transfer of liquor license # to a personto-person and place-to-place transfer from Charlie Browns of Hillsborough, Inc. to KBLJ, LLC for premises located at 315 Route 206, Hillsborough Township. WHEREAS, an application has been filed for a person to person transfer of Plenary Retail Consumption License No , previously issued to Richard M. Grosso, Jr. and Mary Coleen Grosso c/o KBLJ, LLC; and WHEREAS, an amended application has been filed for a person to person and place to place transfer of Plenary Retail Consumption License No , previously issued to Richard M. Grosso, Jr. and Mary Coleen Grosso c/o KBLJ, LLC from 381 Route 206 Hillsborough New Jersey to 315 Route 206 Hillsborough, New Jersey; and WHEREAS, the person-to-person and place-to-place transfer was previously approved by the Township Committee; and

13 Page 13 WHERAS, the person-to-person and place-to-place transfer should be to KBLJ, LLC; and WHEREAS, the Township Committee now desires to amend the effective date of this transfer to read the date of August 24, 2011; and WHEREAS, the submitted application is complete in all respects, the transfer fees have been paid, and the license has been properly renewed for the current license term; and WHEREAS, the applicant is qualified to be licensed accordingly to all standards established by Title 33 of the New Jersey Statutes, regulations promulgated thereunder, as well as pertinent local ordinances and conditions consistent with Title 33; and WHEREAS, the applicant has disclosed and the issuing authority reviewed the source of all funds used in the purchase of the license and the licensed business and all additional financing obtained in connection with the licensed business. NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey does hereby approve, effective August 24, 2011 the transfer of the aforesaid Plenary Retail Consumption License to KBLJ, LLC, and does hereby direct the Acting Township Clerk to endorse the license certificate to the new ownership, for transfer as follows: This license, subject to all its terms and conditions, is hereby transferred to KBLJ, LLC, effective August 24, Upon motion by Committeeman Wagner seconded by Deputy Mayor Suraci, the aforesaid resolution was unanimously approved upon call of the roll. CONSENT 1. Resolution approving the request from Dennis Kowal for the release of Development Review Escrow, in the amount of $ WHEREAS, a request has been received from Dennis Kowal for the release of Development Review Escrow; and WHEREAS, the Hillsborough Township Planner certifies that all work related to the review of the above has been completed; and WHEREAS, the Hillsborough Township Planner recommends that the Township Committee take action to release the $ Development Review Escrow because the work has been completed. NOW THEREFORE BE IT RESOLVED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey, that the recommendation of the Hillsborough Township Planner be and hereby is accepted and approved. 2. Resolution approving the request from Pleasantview Estates/Beazer Homes for the release of Development Review Escrow, in the amount of $8, WHEREAS, a request has been received from Pleasantview Estates/Beazer Homes for the release of Development Review Escrow; and WHEREAS, the Hillsborough Township Planner certifies that all work related to the review of the above has been completed; and

14 Page 14 WHEREAS, the Hillsborough Township Planner recommends that the Township Committee take action to release the $8, Development Review Escrow because the work has been completed. NOW THEREFORE BE IT RESOLVED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey, that the recommendation of the Hillsborough Township Planner be and hereby is accepted and approved. 3. Resolution authorizing Officer Christopher McMinn to enroll in Cultural Diversity in the US and Ethics and the Business Professional and to be eligible for tuition reimbursement of said courses once they have been successfully completed, pursuant to Article XVII or the current PBA Contract. WHEREAS, it is the policy of the Township of Hillsborough to encourage continuing education on the part of full-time employees for the purpose of enabling them to better perform in their jobs and to better prepare them in the event of an opportunity for advancement and promotion within the Township; and WHEREAS, financial assistance for education is outlined in Article XVIII of the current PBA contract; and WHEREAS, Officer Christopher McMinn is requesting authorization to take Cultural Diversity in the US and Ethics and the Business Professional towards his Bachelor s Degree in Criminal Justice; and WHEREAS, Officer McMinn has requested consideration under the Township s Educational Assistance provision upon successful completion of the aforementioned course; and WHEREAS, the Chief of Police has requested favorable consideration of Officer McMinn s request for financial reimbursement of seventy-five percent (75%) of the cost incurred upon successful completion of the classes. NOW THEREFORE BE IT RESOLVED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey, that the recommendation of the Chief of Police is hereby accepted and approved. 4. Resolution amending the appointment of Ryan Giordano as a full time Fire Marshal in the Office of Fire Safety, as established and approved by the Hillsborough Township board of Fire Commissioners on September 8, WHEREAS, at the September 13, 2011 meeting, the Township Committee approved the appointment of Ryan Giordano as a full time Fire Marshal, at a salary of $40,224.00, effective September 14, 2011; and WHEREAS, this position is regulated by the Memorandum of Agreement between the Township of Hillsborough and AFSCME Local 3967, Council No. 73 which states that all salaries will be based on a 37-1/2 hour work week; and WHEREAS, the salary approved for Mr. Giordano at the September 13, 2011 Township Committee meeting was based on a 40 hour work week; NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey, that it hereby amends the appointment of Ryan Giordano as a full time Fire Marshal, as approved by the Hillsborough Township Board of Fire Commissioners, to a salary of $37, per year.

15 Page Resolution ratifying and confirming the actions of the Township Administrator / Acting Clerk approving an application for a Carnival License for Rick Grosso. WHEREAS, an application for a carnival license was filed by Rick Grosso for the Joey G s Grill & Bar outdoor grand opening that was held on October 22, 2011; and WHEREAS, the submitted application form was complete in all respects. NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey that it hereby ratifies and confirms the actions of the Township Administrator/Clerk approving the application submitted by Rick Grosso for the grand opening that was held on October 22, Resolution ratifying and confirming the actions of the Township Administrator / Acting Clerk approving the application for Special Permit for Social Affair for KBLJ, LLC for an outdoor grand opening held on October 22, WHEREAS, an application for a Special Permit for Social Affair has been filed by KBLJ, LLC for an event that was held on October 22, 2011; and WHEREAS, the submitted application form is complete in all respects. NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey that it hereby ratifies and confirms the actions of the Township Administrator/Acting Clerk approving the application for Special Permit for Social Affair for KBLJ, LLC for an event that was held on October 22, Resolution authorizing the re-appointment of Cody Woodrich as temporary help for the Department of Public Works at a salary of $10.00 per hour funded through the Clean Communities Grant. WHEREAS, there is a need for temporary employment in the Department of Public Works in the Township of Hillsborough due to extended sick leaves and retirements; and WHEREAS, the Township of Hillsborough has unexpended monies from the 2011 Clean Communities Grant Fund, which can be used to cover the cost of temporary help in the Department of Public Works for work that meets the criteria established by the Clean Communities Grant; and WHEREAS, the Director of Public Works has recommended that Cody Woodrich be reappointed at a rate of $10.00 per hour for 40 hours per week effective October 26, 2011 and ending December 31, 2011; NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey, that the recommendation of the Director of Public Works hereby be accepted and approved. 8. Resolution authorizing various personnel actions. WHEREAS, there is the need for a temporary Technical Assistant in the Building Department due to an increased work load and extended sick leaves; and WHEREAS, the Chief Finance Officer recommends the temporary transfer of John DeDomenico, who is currently a full-time employee in the Finance/Tax Office, to the position of

16 Page 16 Technical Assistant in the Building Department, effective October 26, 2011and ending December 31, 2011; and WHEREAS, the Recreation Commission and the Director of Parks and Recreation recommend the hiring of Griffin Dunne as part-time Recreation Assistant in the Department of Parks and Recreation, at the rate of $14.50 per hour on an as needed basis not to exceed 29 hours per week effective October 26, 2011 and ending December 31, 2011; and WHEREAS, Randolph W. Bannerman was hired as a part-time Licensed Building Inspector on July 27, 2011; and WHEREAS, Randolph W. Bannerman is also a Licensed Fire Inspector; and WHEREAS, the Director of Building recommends Randolph W. Bannerman be authorized as both a part-time Licensed Building Inspector and Licensed Fire Inspector at the rate of $28.00 per hour for not more than 16 hours per week on an as needed basis effective October 26, 2011 and ending December 31, NOW, THEREFORE BE IT RESOLVED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey that the recommendations of the Chief Finance Officer, Recreation Commission, Director of Parks and Recreation and Director of Building hereby are hereby accepted and approved. Upon motion by Committeeman Ferrera seconded by Deputy Mayor Suraci, the aforesaid resolutions were unanimously approved upon call of the roll.
