Declarations of Interest 2. Elections A) Chair B) Vice Chair There were no declarations of interest. The Clerk called for nominations for the position of Chair of the EFW-WMAC. Moved by P. Nelson, That George Rocoski be nominated for the position of Chair of the EFW-WMAC. Moved by P. Nelson, That nominations be closed. The Clerk asked G. Rocoski if he wished to stand. G. Rocoski advised he would stand. G. Rocoski was acclaimed as Chair of the EFW-WMAC. G. Rocoski assumed the Chair for the remainder of the meeting. Chair Rocoski called for nominations for the position of Vice-Chair of the EFW-WMAC. Moved by T. Baker, That Paul Nelson be nominated for the position of Vice- Chair of the EFW-WMAC. Moved by P. Nelson, That Paul Ankrett be nominated for the position of Vice- Chair of the EFW-WMAC. Moved by E. Collis, That Wendy Bracken be nominated for the position of Vice-Chair of the EFW-WMAC. Moved by T. Baker, That nominations be closed.

3 June 1, 2016 Page 3 of 9 Discussion ensued regarding whether it would be appropriate that either the position of Chair or Vice-Chair of the EFW-WMAC be filled by a member from the Municipality of Clarington, as the Municipality of Clarington is the host community for the Durham York Energy Centre. Chair Rocoski asked P.Nelson if he wished to stand. P. Nelson advised he did not wish to stand. The Chair asked P. Ankrett if he wished to stand. P. Ankrett advised he would stand. The Chair asked W. Bracken if she wished to stand. W. Bracken advised she would stand. A vote was taken and P. Ankrett was elected Vice-Chair of the EFW-WMAC. 3. Adoption of Minutes Moved by T. Baker, That the minutes of the following meetings be adopted: - Special EFW-WMAC meeting held on Thursday, January 21, 2016; and - EFW-WMAC meeting held on Thursday, April 21, Announcements A) Municipality of Clarington Appointed Member John Hicks M. Januszkiewicz introduced John Hicks who was appointed by the Municipality of Clarington to the EFW-WMAC to replace D. Climenhagen who resigned from the Committee. J. Hicks provided a brief overview of his background and interest in the EFW-WMAC. The Committee members welcomed Mr. Hicks to the EFW-WMAC. 5. Presentations P. Ankrett, Vice-Chair assumed the chair during Chair Rocoski s presentation. A) Presentation by George Rocoski, EFW-WMAC Member Regarding The Blue Box and Recycling in Ontario G. Rocoski provided a PowerPoint presentation on The Blue Box and Recycling in Ontario. A copy of his presentation was provided as a handout.

Rocoski stated that recycling began with the soft drink regulations that were introduced in the mid-1980s under the Environmental Protection Act and that by the late 1980s, one million households had blue boxes. He also stated that in 1994 regulations were introduced that required every municipality with a population of at least 5,000 residents to operate a blue box program. He further stated that the program was mandated to collect 5 specific materials: aluminum, steel, glass, Polyethylene terephthalate (PET), and newsprint. He added that at that time, leaf and yard waste composting was established. G. Rocoski advised that in 2002 the Waste Diversion Act was introduced which required companies whose packaging was managed through the municipal waste stream to contribute towards 50% of the program fees. He explained that this fund pays municipalities a 50% share of the net cost of operating residential recycling programs. G. Rocoski stated that in 2015 the provincial government introduced the Waste Free Ontario Act (Bill 151) with the objective to increase resource productivity and reduce waste; enable an efficient and effective recycling system and, create conditions to support sustainable end-markets. He advised that the Waste Free Ontario Act includes two acts: a proposed Resource Recovery and Circular Economy Act that will set overarching provincial direction and establish a new producer responsibility regime; and, a proposed Waste Diversion Transition Act that will replace the Waste Diversion Act, G. Rocoski responded to questions from the Committee. B) Presentation by Craig Bartlett, Manager, Waste Operations, The Regional Municipality of Durham, Regarding Status of Bill 151, Waste Free Ontario Act, 2016 C. Bartlett provided a PowerPoint presentation on the Status of Bill 151, Waste Free Ontario Act, A copy of his presentation was provided as a handout. C. Bartlett stated that municipalities deliver the highest quality integrated waste management system. He also stated that Stewards of blue box material do not have a sense of obligation to reach public goals as their focus is only on reducing their contribution. He noted that municipalities maintain that Stewards have not complied with the cost containment plan. C. Bartlett advised that in 2015, the province introduced new waste management legislation, Waste Free Ontario Act (Bill 151), that builds on the government s climate change agenda. He noted that it was passed into legislation on June 2, C. Bartlett advised that

5 June 1, 2016 Page 5 of 9 this new legislation will transfer 100% responsibility for end of life management of designated packaging and products to the producers. He stated that fair compensation, legislative standing, and a well-constructed transition for residents and municipalities are what will make this new system succeed. He also stated that producers must accept their new role and fund all the costs to manage their products and packaging and be part of the broader public diversion goals. C. Bartlett responded to questions from the Committee. C) Presentation by Peter Veiga, Supervisor, Waste Operations, The Regional Municipality of Durham, Regarding Anaerobic Digestion: Request for Proposal Process P. Veiga provided a PowerPoint presentation on Anaerobic Digestion: Request for Proposal Process. A copy of his presentation was provided as a handout. P. Veiga advised that the Region of Durham currently has a successful waste diversion program with a diversion rate of 55% as of He explained what is in household waste; and, noted that household waste contains over 50% of divertible material. P. Veiga provided an overview of the anaerobic digestion (AD) studies and investigation conclusions; and, the next steps with respect to issuing an RFP to obtain consulting expertise in AD. He stated a report will be brought to Regional Council in the Fall of 2016 with recommendations for next steps. P. Veiga advised that the AD business plan will include an options analysis to re-confirm that AD with pre-sorting is the best option for Durham. It will also determine a preferred business model to have the most effective and efficient source material pre-sorting option, highest diversion potential, and AD fuel output with the lowest net cost, budget and tax implications for the Region. He noted that, pending Council approval, the timeline will be separated into the following two parts: 1) summer/fall: complete options analysis; identify preferred technologies and outputs; develop a business model recommendation; and, identify the best type of energy partner; and, 2) fall winter: negotiate with energy partners; and, develop an RFP to initiate system procurement process. P. Veiga responded to questions from the Committee. D) Presentation by Wendy Bracken, EFW-WMAC Member, Re: Durham York Energy Centre Dioxin/Furan Exceedances of May 2 to 11, 2016, Past Dioxin/Furan Emission Tests and Monitoring Issues, and Report #2016-J-21 from C. Curtis, Commissioner of Works

Bracken provided a PowerPoint presentation on the Durham York Energy Centre Dioxin/Furan Exceedances of May 2 to 11, 2016; Past Dioxin/Furan Emission Tests and Monitoring Issues; and Report #2016-J-21. A copy of her presentation was provided as a handout. W. Bracken advised that there have been major dioxin and furan exceedances during two stack tests at the Durham York Energy Centre. She noted that the results of the stack test completed during May 2 to 11, 2016 indicated an exceedance in Boiler #1 of 818 pcg per cubic metre of dioxin/furan. She stated that the media release issued by the Region of Durham did not convey the magnitude of the exceedance. W. Bracken called into question the results from the October 2015 stack test and stated that there has been no apparent investigation of interference by the Ministry of the Environment and Climate Change. She also raised concerns that Covanta repeated the tests under different operation conditions; that there was a failure to collect AMESA dioxin/furan raw data during the commissioning; and, that the AMESA sampling and stack test results differ greatly with no correlation between the results. W. Bracken advised there are many questions, and great uncertainty and fear among the residents of the Municipality of Clarington because of the exceedances of these highly toxic pollutants, and the potential risk to the public. It was the consensus of the Committee to consider Item 9. B) Durham York Energy Centre Source Test Update (2016-J-21) under Other Business next. 9. Other Business B) Durham York Energy Centre Source Test Update (2016-J-21) Matthew Neild, Facility Manager, Covanta Durham York Renewable Energy responded to questions from the Committee with respect to clarification on how the two boilers varied so dramatically in their emission results; whether Covanta is aware of the contents of the waste that was being burned in Boiler #1 during the stack test; and, whether Covanta has had similar issues with emission exceedances in their other facilities. Jennifer Baron, Business Manager, Covanta Durham York Renewable Energy was also in attendance and responded to questions with respect to the Abatement Plan being developed by Covanta; whether Covanta s Corporate Office is disputing the results; and, how the garbage that would normally be burned in Boiler #1 is currently being disposed of.

7 June 1, 2016 Page 7 of 9 Discussion ensued with respect to communicating the Committee s concerns to the Works Committee. Moved by W. Bracken, That the following concerns of the EFW-WMAC be presented to the Works Committee for their information: The quality of the reporting to the public on the most recent dioxin/furan exceedance: namely that emission concentrations that were measured should have been quantitatively reported to the public in the media release from the Region; and The environmental performance of the facility, namely that the facility has exceeded dioxin and furan emission limits on two separate occasions (October 2015 and May 2016), with the latest Boiler 1 dioxin/furan emissions reported as 818 pg TEQ per cubic metre which is 1363% above the regulatory limit. Staff responded to further questions with respect to what reports have been completed on the impacts of the Durham York Energy Centre on human health. 6. Delegations A) Linda Gasser, Whitby Resident, Re: Overview of the Incinerator Project and Mandate of the EFW-WMAC L. Gasser appeared before the Committee to provide an overview of the Incinerator Project and to discuss the mandate of the EFW- WMAC with respect to the incinerator. A copy of her delegation was provided as a handout. L. Gasser advised that she is a member of the Energy from Waste Advisory Committee (EFWAC) that was mandated by the Ministry of the Environment and Climate Change in Condition 8 of the Durham York Environmental Assessment. She gave a brief history on how the decision to build an energy from waste facility was made by Regional Council; and, the performance of the Durham York Energy Centre to date. L. Gasser noted that Covanta did not actually pass the Acceptance Testing requirements but were granted an Acceptance Test certificate at the end of January, 2016 after the Regions of Durham and York amended the project agreement for the quantity of residual ash.

8 June 1, 2016 Page 8 of 9 L. Gasser stated that in her opinion, the primary focus of the EFW- WMAC must be the incinerator. She advised that over the past two terms she has delegated on the need for the Committee to develop a Work Plan that would include document review to prepare Committee members to address issues. She also stated that the Committee should monitor news media, and Standing Committee and Regional Council agendas to ensure that the EFW-WMAC agendas are set in a manner that achieves the Committee s mandate. L. Gasser responded to questions from the Committee. 7. Correspondence There were no items of correspondence to be considered. 8. Administrative Matters There were no administrative matters to be considered. 9. Other Business A) Update from EFW-WMAC Members Regarding Members Participation in Compost Give-Away Community Events to Date This item was deferred until the next meeting of the EFW-WMAC. B) Durham York Energy Centre Source Test Update (2016-J-21) This item was dealt with earlier in the meeting. See Item 9. B) on pages 6 and 7 of these minutes. 10. Next Meeting Discussion ensued regarding whether a special meeting should be scheduled for June 30, 2016 at 9:30 AM to review Covanta s Abatement plan, and any other reports with respect to the recent emission exceedance at the DYEC. [Following the meeting, it was determined that a special meeting of the EFW-WMAC could not be held on Thursday, June 30, 2016 due to the unavailability of staff; therefore the date of the special meeting is still to be determined.] The next regularly scheduled meeting of the EFW-WMAC will be Wednesday, September 21, 2016 in the Lower Level Boardroom (LL-C), at 7:00 PM, Regional Headquarters, 605 Rossland Road East, Whitby.
