3 Intelligence, security and privacy May I am delighted to learn from my associates at The Canadian Ditchley Foundation that you are able to attend the conference we are organising in May, in partnership with the American Ditchley Foundation, to consider `Intelligence, security and privacy'. The conference will be chaired by Sir John Scarlett, the former Chief of the British Secret Intelligence Service. The context and main aims of the conference are explained below. A combination of renewed terrorism threats and the Assange and Snowden revelations have put the intelligence debate back in political minds and on front pages: how can governments achieve the right balance between gathering enough information to keep their citizens safe, without those same citizens feeling that their privacy is being unreasonably invaded? Even in the most open and democratic societies, people can have widely differing views. Some believe that saving lives and preserving national security is manifestly a top priority, that governments are only fulfilling their basic responsibility, and that ordinary people have nothing to fear from checks designed only to root out those with something to hide. Others believe Chat this is a slippery slope, that it is against their rights for their government to 'spy' on them, and that governments, even democratic ones, cannot be trusted not toi abuse their powers and the information they collect. Were Snowden and Assange whistle-blowers who should be hailed for their outings of government wrongdoings or traitors who deserve punishment for putting national security and the safety of intelligence officers at risk, as well as diplomatic relations? Democratic countries have evolved different ways of trying to ensure that their intelligence agencies are fully under democratic control. Which laws and safeguards work most effectively, and which practices might be of universal application? And who can be relied on to watch the watchers? In particular what is the role of the press in this area? Some secrets have to remain secret if agencies are to carry out their responsibilities properly, but who is to decide what can legitimately be revealed, and if agencies are abusing their positions, and how? One question which has been posed in acute form concerns the rules and assurnptions about friends and allies spying on each other. For example, was Germany right to be angered by the US behaviour revealed by Snowden, or was the Berlin reaction a mixture of naivety and hypocrisy? Is the only real rule in this area not to get caught? z

4 It is also legitimate to ask whether governments and their agencies really pose a bigger threat to individual privacy than the private sector. Are people really aware of how much information about themselves they are volunteering when they use their smart phones; buy things via Pay Pal on ebay; tell the world their personal details on Facebook; comment on events on Twitter; and reveal their likes and dislikes via Google searches? These sites collect more `intelligence' on people than even the most invasive government, yet there are fewer calis to stop or control them and how this data should be used. Moreover, how far is there an obligation on the companies concerned to cooperate with governments seeking information for security purposes, and how transparent should this cooperation be? This conference will aim to bring together a wide range of actors and thinkers from the intelligence community, as well as journalists, academics, diplomats, think tankers, politicians and policy influencers from around the world to assess how best, in a democratic society, to strike the right intelligence, security and privacy balance. The conference starts at 4pm on Thursday May 14 and ends at lunchtime on Saturday May 16. Participants are requested to commit themselves for the conference as a whole, since the aim is an interactive debate that runs from the opening to the closing session. The Friday programme creates time for discussion in smaller groups, as well as an opportunity to visit Oxford or one of the stately homes nearby. Ail those invited are guests of the Foundation during their stay, although we cannot cover travel costs other than in exceptional circumstances. Accommodation is provided at Ditchley for the two nights of the conference and we will make ail the necessary arrangements for guests to be met on arrivai by air and to be transported back to the airport on departure. We will send you the papers for the discussion, together with a List of participants and a detailed programme, six to eight weeks before the start of the conference. There is no requirement to present anything in writing or to make any other special préparation for the event. As you may recall, around forty participants from a wide variety of countries and backgrounds normally attend. The discussions are informai and subject to the Chatham House Rule - no participant may attributably quote anything heard at the conference to anyone outside - but my Director's Note on the broad thrust of the proceedings is publiciy availabie, and the discussions may be written about freely afterwards. 1 much look forward to welcoming you back to Ditchiey. Those travelling by air should arrange flights to Heathrow arriving no later than 2pm on the Thursday and departing no earlier than 4.30pm on the Saturday. Visas: Participants who will need a visa in order to travel ta the United Kingdom are requested to contact me as eariy as possible to obtain a letter in support of their visa application. Please allow ample time to appiy for your visa: participants have on occasion had to cancel their journey to Ditchley because they did not obtain their visa in time. Dress code: Dress at Ditchley is informai ('business casuai'), except for dinner on Friday, which is formai. For the men, black tie (dinner jacket) or national dress is preferred - buta dark business suit is perfectly acceptable. Far ladies, a formai dress, skirt, trouser suit or national dress are ail apprapriate.
