4 CONSTITUTION of the Africa Scout Region CHAPTER 1 TITLE, MEMBERSHIP, ORGANS AND PURPOSE OF THE AFRICA SCOUT REGION ARTICLE I Title 1. Pursuant to the Constitution of the World Organization of the Scout Movement, the Africa Scout Region is hereby established. Membership Organs 2. Membership in the Africa Scout Region is open to each National Scout Organization, whether a single association or a federation, in Africa south of the Sahara and the islands (herein after called the Africa Region) which is a recognized member of the World Organization of the Scout Movement and duly registered with the World Scout Bureau. The Africa Scout Region shall be composed of the following organs: a). The Africa Scout Conference (hereinafter called the Africa Conference) comprising all the members of the Africa Scout Region. b). The Africa Scout Committee hereinafter called the Africa Scout Committee), duly elected by the Africa Scout Conference. c). The Africa Regional Office of the World Scout Bureau (hereinafter called the Africa Regional Office) directed by a Regional Director. d). The Africa Scout Foundation as an independent body accumulating funds for the development of Scouting in Africa. Purpose 4. The purpose of the Africa Scout Region is to assist the World Organization in fostering the Scout Movement in the Africa Region in accordance with the purpose, principles and method of the Scout Movement as defined by the Constitution of the World Organization. 1

5 CONSTITUTION de la Région Afrique du Scoutisme CHAPTER 1 DENOMINATION, MEMBRES, ORGANES ET BUT DE LA RÉGION AFRIQUE DU SCOUTISME ARTICLE I Dénomination 1. Conformément à la Constitution de l Organisation Mondiale du Mouvement Scout, la Région Afrique du Scoutisme est établie par la présente Constitution. Membres Organes But Peut devenir Membre de la Région Afrique du Scoutisme toute organisation scoute nationale, association unique ou fédération, de l Afrique au Sud du Sahara et des îles avoisinantes (appelée ci-dessous la Région Afrique), qui est Membre reconnu de l Organisation Mondiale du Mouvement Scout et dûment inscrite au Bureau Mondial du Scoutisme. La Région Afrique du Scoutisme comprendra les organes suivants : a). La Conférence Africaine du Scoutisme (appelée ci-dessous la Conférence africaine) composée de tous les Membres de la Région Afrique du Scoutisme. b). Le Comité Africain du Scoutisme (appelé ci-dessous le Comité africain), dûment élu par la Conférence Africaine du Scoutisme. c). Le Bureau Régional Afrique du Bureau Mondial du Scoutisme (appelé ci-dessous le Bureau Régional Afrique) dirigé par un Directeur Régional. d). La Fondation Africaine du Scoutisme est une entité indépendante qui recherche des fonds pour le développement du Scoutisme en Afrique. La Région Afrique du Scoutisme a pour but d assister l Organisation mondiale dans la promotion du Mouvement Scout au sein de la Région Afrique conformément aux but, principes et méthode du Mouvement scout tels qu ils ont été définis par la Constitution de l Organisation mondiale. 2

6 CHAPTER 2 THE AFRICA SCOUT CONFERENCE ARTICLE II Composition 1. Each Member Organization of the Africa Scout Region is entitled to send to the Africa Conference not more than six delegates and a number of observers to be determined in agreement with the organizing committee Each National Scout Organization in the Africa Region which is not recognized as a member of the World Organization of the Scout Movement, but which has been granted the status of an Accredited National Scout Organization by the World Committee in accordance with Article V, paragraphs 7 and 8 of the Constitution of the World Organization, may be represented at the Africa Conference by a maximum of two delegates and two observers with the right of voice but not of vote. Accredited National Scout Organizations will have the rights and obligations determined by the World Scout Conference and the World Scout Committee. Each branch Scout Organization in the Africa Region of a recognized member of the World Organization in another region may be invited by the Africa Scout Committee to send observers to the meetings of the Africa Conference. a). A branch Scout Organization in the Africa Region of a recognized member of the World Organization in another region may be granted associate membership status in the Africa Conference by the Africa Scout Committee in agreement with the World Scout Bureau. 3

7 CHAPTER 2 THE AFRICA SCOUT CONFERENCE ARTICLE II Composition 1. Chaque Organisation Membre de la Région Afrique du Scoutisme peut envoyer au maximum six délégués aux réunions de la Conférence Africaine ainsi que des observateurs dont le nombre sera fixé en accord avec le comité d organisation Chaque Organisation Scoute Nationale de la Région Afrique n ayant pas la qualité de Membre de l Organisation Mondiale du Mouvement Scout mais à laquelle le Comité Mondial a accordé le statut d Organisation Scoute Nationale Accréditée conformément à l article V, paragraphes 7 et 8 de la Constitution de l organisation mondiale peut être représentée à la Conférence Africaine par un maximum de 2 délégués et 2 observateurs qui auront le droit d expression mais pas le droit de vote. Les Organisations Scoutes Nationales Accréditées auront les droits et obligations définis par la Conférence Mondiale du Scoutisme et le Comité Mondial du Scoutisme. Le Comité Africain peut inviter chaque Organisation Membre potentiel et chaque Association Scoute affiliée, dans la Région Afrique, d un membre reconnu de l Organisation Mondiale dans une autre région à envoyer des observateurs aux réunions de la Conférence Africaine. a). Le Comité Africain peut, avec l accord du Bureau Mondial du Scoutisme, accorder le statut de membre associé de la Conférence Africaine à une Association Scoute affiliée, dans la Région Afrique, d un membre reconnu de l Organisation Mondiale dans une autre région. 4

8 5. 6. b). An associate Member Organization shall be entitled to send not more than six delegates to the meetings of the Africa Conference and shall have all the rights and privileges accorded to Member Organizations, except the right to nominate candidates or to have its members nominated to the Africa Scout Committee. Each delegate or observer shall be a recognized member of good standing in the Scout Organization to which he belongs, and be duly certified in such capacity, by the responsible Scout Committee or Scout official of his organization. Other organizations may be invited by the Africa Scout Committee to send guests to the meetings of the Africa Conference where their participation is judged to be of benefit to the objectives of the Conference ARTICLE III Functions 1. The functions of the Africa Conference shall be: To further the Scout Movement within the Africa Region by promoting the spirit of brotherhood, cooperation and mutual assistance amongst Scout Organizations in the Africa Region. 2. To ensure the proper implementation of the decisions and policies of the World Organization which affect the Africa Region. To exercise such other functions as are provided for in this Constitution. ARTICLE IV Meetings and Procedure 1. The Africa Conference shall be held every three years at such time and place as may be designated or arranged by the Conference itself during its sessions or by the Africa Scout Committee. 2. An extraordinary meeting of the Conference may be called on the decision of the Africa Scout Committee or at the request of not less than one third of the Member Organizations. 5

Une organisation membre associé a le droit d envoyer un nombre maximum de six délégués aux réunions de la Conférence Africaine et jouit de tous les droits et les privilèges accordés aux organisations membres, hormis le droit de nommer des candidats et de présenter ses membres pour l élection au Comité Africain. Tout délégué ou observateur doit être un membre reconnu occupant une position importante au sein de l organisation scoute à laquelle il appartient, position dont attestera le comité scout compétent ou le responsable scout de son organisation Des représentants d autres organisations de jeunesse reconnues pourront êtres invités à envoyer des observateurs à la Conférence Africaine. ARTICLE III Fonctions 1. Les fonctions de la Conférence Africaine seront: De développer le mouvement scout dans la Région africaine en encourageant l esprit de fraternité mondiale, la coopération et l assistance mutuelle entre les organisations scoutes au sein de la Région Afrique. 2. D assurer la bonne exécution des décisions et directives de l Organisation Mondiale ayant trait à la Région. D exercer les autres fonctions résultant de la présente Constitution ARTICLE IV Réunions et Procédure 1. La Conférence Africaine se tiendra tous les trois ans aux lieu et date qui pourront êtres fixés par la conférence même au cours de ses réunions ou par le Comité Africain. 2. Une réunion extraordinaire peut être convoquée sur décision du Comité Africain ou à la requête d au moins un tiers des organisations membres. 6

10 The presence of half of the total number of Member Organizations of the Africa Scout Region shall constitute a quorum for any meeting of the Africa Scout Conference. Voting at any meeting of the Africa Conference shall be by Member Organizations each having six votes. Except as provided for under Article XI, paragraph2, of this Constitution, resolutions shall be taken by a simple majority of the votes cast. A Member Organization which forfeits the right to vote at a meeting of the World Scout Conference under Article XI, paragraph 5, of the Constitution of the World Organization shall also be excluded from voting at the Africa Scout Conference. The procedure applied within the Africa Scout Conference is set out in the Rules of Procedure. ARTICLE V Programme, Organization and Conference Fee 1. The Africa Scout Conference programme shall be prepared by the Africa Scout Committee giving consideration to suggestions from Member Organizations and the World Scout Committee. 2. An organizing Committee and a secretariat for the Africa Scout Conference shall be formed jointly by the host Member Organization and the Africa Regional Office, and shall assist the Africa Scout Committee in promoting and carrying out the Conference. The secretariat shall perform the administrative work for the Conference such as the general correspondence, physical arrangements, programme management, recording and documentation of Conference proceedings and promotion. 7

11 La présence de la moitié du nombre total des organisations membres de la Région Africaine du Scoutisme constitue le quorum requis pour toute réunion de la Conférence Africaine du Scoutisme. Le vote à toute réunion de la Conférence Africaine sera effectué par les organisations membres, chacune ayant six voix. Sous réserve des dispositions de l Article XI, paragraphe 2, de cette Constitution, les résolutions seront adoptées à la majorité simple des voix émises. Une organisation membre qui perd le droit de vote à une réunion de la Conférence Mondiale du Scoutisme, en application de l Article XI, paragraphe 5, de la Constitution de l Organisation Mondiale sera également exclue du vote à la Conférence Africaine du Scoutisme. La procédure appliquée au sein de la Conférence Africaine du Scoutisme est énoncée dans les Règles de Procédure. ARTICLE V Programme, Organisation et Droits de Participation 1. Le programme de la Conférence Africaine du Scoutisme sera établi par le Comité Africain, en tenant compte des suggestions faites par les organisations membres et le Comité Mondial du Scoutisme. 2. Un comité d organisation et un secrétariat de la Conférence Africaine du Scoutisme seront constitués conjointement par l organisation membre hôte et le Bureau Régional Afrique et assisteront le Comité Africain du Scoutisme dans la promotion et le déroulement de la conférence. Le Secrétariat accomplira toutes les tâches administratives de la conférence telles que correspondance générale, aménagement, gestion du programme, documentation, promotion et procès-verbaux des séances de la conférence. 8

12 4. The host Member Organization shall, through the organizing committee, charge a conference fee to each delegate or observer to cover expenses for the Conference. CHAPTER 3 THE AFRICA SCOUT COMMITTEE ARTICLE VI Composition 1. a). The Africa Scout Committee shall consist of eight persons from recognized Member Organizations in the Africa Region who shall be elected by the Africa Scout Conference by secret ballot and shall hold office for a term of six years or up to the respective conference. b). Under no circumstances shall more than one member from the same National Scout Organization serve on the committee at any period of time. c). A retiring member of the Africa Scout Committee may only be eligible for re-election after a lapse of three years. This restriction shall not apply to a member who has been elected or co-opted to fill a vacancy and who may be eligible for immediate re- election. d). To become a member of the Africa Scout Committee: The candidate must have been nominated by his National Scout Organization. The National Scout Organization nominating a candidate for election to the committee must be in order with its annual membership fee in its entirety. 9

L organisation membre hôte, par l intermédiaire du comité d organisation, demandera à chaque délégué ou observateur de s acquitter des droits de participation destinés à couvrir les frais d organisation de la conférence. CHAPTER 3 LE COMITE AFRICAIN DU SCOUTISME ARTICLE VI Composition 1. a). Le Comité Africain du Scoutisme sera composé de 8 personnes appartenant à des organisations membres reconnues dans la Région africaine, élues par la Conférence Africaine du Scoutisme, au scrutin secret, qui seront en fonction pour une durée de 6 ans ou jusqu à la prochaine conférence équivalente. b). En aucun cas et en aucun moment ne pourra siéger simultanément au Comité Africain plus d un membre d une même Organisation Scoute Nationale. c). Les membres sortants du Comité Africain du Scoutisme ne seront rééligibles qu après un intervalle de trois ans. Cette restriction ne s appliquera pas aux membres élus ou cooptés pour pourvoir à une vacance et qui pourront être réélus immédiatement. d). Pour être membre du Comité Africain du Scoutisme: Le candidat doit avoir été désigné par son Organisation Scoute Nationale. L Organisation Scoute Nationale qui présente un candidat pour élection au Comité Africain doit au préalable s acquitter intégralement de ses cotisations annuelles. 10

14 Term of Office 2. a). Four members of the Africa Scout Committee shall retire at each Africa Conference and they shall be replaced by four other members. b). In the interval between the meetings of the Africa Scout Conference, in case of death or resignation of one or many members, the Africa Scout Committee may (accept resignations and) fill vacancies in its membership until the next meeting of the Africa Conference. c). A candidate who was the runner-up in the last election may be co-opted as a result of the death, resignation or suspension of a member of the committee or for any other motive, to complete the mandate and term to be served by the said member. However, this co-optation does not prevent the co-opted member to run for election at the end of his term. d). The committee may suspend a member who is absent for two consecutive meetings without valid reasons acceptable to the committee or when he is no longer a member of a recognized Member Organization. The next conference shall decide on the suspension. Election of Members a). The Africa Regional Office shall notify all Member Organizations of the Africa Scout Region of the expiration of the term of office of members concerned and shall invite each Member Organization to submit its nominations for membership in the Africa Scout Committee six months before each meeting of the Africa Scout Conference. 11

15 Durée de Mandat 2. a). Le mandat de quatre membres du Comité Africain du Scoutisme prendra fin lors de chaque réunion de la Conférence Africaine du Scoutisme et quatre autres membres viendront les remplacer. b). Dans l intervalle entre deux réunions de la Conférence Africaine du Scoutisme, s il survient le décès ou la démission d un ou plusieurs membres, le Comité Africain du Scoutisme pourra (accepter des démissions et) pourvoir aux vacances survenant parmi ses membres jusqu à la prochaine réunion de la Conférence Africaine. c). Un candidat qui a été le premier en nombre de votes des non-élus pendant la dernière élection peut être coopté par la suite de décès, de démission ou de suspension d un membre du comité ou pour tout autre motif, pour compléter le mandat et la période devant être servis par ledit membre. Toutefois, cette cooptation n empêche pas le membre coopté de se présenter aux élections à la fin du dit mandat. d). Le Comité Africain peut suspendre un membre qui est absent à deux réunions consécutives sans motif valable acceptable pour le Comité Africain ou quand il cesse d appartenir à une organisation membre. La prochaine conférence devra se prononcer sur la suspension. Election des Membres a). Le Bureau Régional Afrique notifiera toutes les organisations membres de la Région Afrique du Scoutisme de l expiration du mandat des membres sortants et invitera chaque organisation membre à présenter ses candidats pour l élection au Comité Africain six mois avant chaque réunion de la Conférence Africaine du Scoutisme. 12

16 b). The nomination of a candidate for election to the Africa Scout Committee shall be made or endorsed by his own Member Organization. Nominations for candidates to the Africa Scout Committee shall reach the Africa Regional Office in writing not later than eight weeks before the opening date of the Africa Scout Conference, by which date the list of nominations shall be closed. c). The list of candidates shall be sent by the Africa Regional Office to every Member Organization before the Africa Scout Conference. ARTICLE VII Functions The Africa Scout Committee shall have the following functions: 1. To promote Scouting in the Africa Region To implement the resolutions of the World Scout Conference, the World Scout Committee and the Africa Scout Conference, and to act on behalf of the Africa Scout Conference in between its meetings. To act as an advisory body to the World Committee. To act as an advisory body to Member Organizations requiring advice and assistance. To serve as a steering committee for the Africa Scout Conference or other regional gatherings approved by the World Committee. To promote cooperation and mutual assistance among Member Organizations in the region. To promote good relations in the Africa Region with other youth-focused organizations. 13

17 b). La désignation d un candidat à l élection au Comité Africain devra être effectuée ou confirmée par sa propre organisation membre. Les candidatures pour le Comité Africain du Scoutisme devront parvenir par écrit au Bureau Régional Afrique au moins 8 semaines avant la date d ouverture de la Conférence Africaine du Scoutisme, date à laquelle la liste des candidatures sera close. c). Le Bureau Régional Afrique enverra la liste des candidats à toutes les Organisations Membres avant la Conférence africaine du Scoutisme. ARTICLE VII Fonctions Les fonctions du Comité Africain du Scoutisme seront les suivantes: Promouvoir le Scoutisme dans la Région Afrique. Mettre à exécution les résolutions de la Conférence Mondiale du Scoutisme, du Comité Mondial du Scoutisme et de la Conférence Africaine du Scoutisme, et agir au nom de la Conférence Africaine du Scoutisme dans l intervalle de ses réunions. Faire office d organe consultatif du Comité Mondial. Conseiller les organisations membres qui lui demandent aide et conseil. Faire office de Comité d Orientation pour la Conférence Africaine du Scoutisme ou d autres rencontres régionales approuvées par le Comité Mondial. Promouvoir la coopération et l assistance mutuelle entre les Organisations Membres au sein de la Région. Encourager les bonnes relations au sein de la Région Afrique avec d autres organisations qui s occupent de la jeunesse. 14

18 Develop strategies to increase the financial resources of the Africa Scout Region. Adopt plans and programmes that may help the development and the promotion of Scouting in Africa. To help resolve conflicts in National Scout Organizations. To exercise such other functions as are provided for in this Constitution. ARTICLE VIII Meetings and Procedure 1. a). The Africa Scout Committee shall meet at least twice a year at such time and place as the committee may decide. A review of the achievements for the period and the report of the Regional Director shall be presented to the meeting. 2. b). All notices of the meetings of the Africa Scout Committee shall be mailed or sent through other appropriate means of communication so as to be received by members of the committee, under ordinary conditions, at least three months before the set time. The notice shall include the tentative agenda for the meeting. The presence of four members of the Africa Scout Committee together with the Regional Director or his authorized representative shall constitute a quorum for meetings of the c ommittee. a). Each member of the Africa Scout Committee shall have one vote and resolutions shall be taken by a simple majority of the members present or represented and voting. b). Members of the Africa Scout Committee may vote at a committee meeting by a proxy given to another member of the committee but no member may accept more than one proxy. 15

Exercer les autres fonctions résultant de la présente Constitution. ARTICLE VIII Réunions et Procédure 1. a). Le Comité Africain du Scoutisme se réunira au moins deux fois l an au lieu et date choisis par le Comité. Un bilan des réalisations pour la période écoulée et le rapport du Directeur Régional seront présentés à la réunion. 2. b). Toutes les lettres d invitation aux réunions du Comité Africain du Scoutisme seront envoyées par voie postale ou autres voies de communication appropriées de façon à parvenir aux membres du comité, dans des circonstances normales, au moins trois mois avant la date fixée. L ordre du jour provisoire de la réunion sera inclus dans la lettre d invitation. La présence de quatre membres ayant le droit de vote du Comité Africain du Scoutisme et du Directeur Régional ou de son représentant autorisé constituera le quorum requis pour les réunions du comité. a). Chaque membre élu du Comité Africain du Scoutisme aura une voix et les résolutions seront adoptées à la majorité simple des membres votants, présents ou représentés b). Les membres du Comité Africain du Scoutisme pourront voter à une réunion du Comité par procuration accordée à un autre membre du comité ; toutefois aucun membre ne pourra être porteur de plus d une procuration. 16

20 4 The Africa Scout Committee may establish such subsidiary committees or other organs as it deems necessary for the performance of its functions. ARTICLE IX Chairperson, Vice-Chairperson, Secretary 1. a). After each triennial election of members, the Africa Scout Committee shall elect from among its members a chairperson and a vice-chairperson, who shall serve for a term of three years. b). Meetings of the committee shall be presided over by the chairperson. In case the latter is not available, they will be presided over by the vice-chairperson. c). If the chairperson and vice-chairperson are unable to attend any meeting, the Africa Scout Committee may also elect from its members a presiding officer who shall act pro tempore for these absentee officers. d). After each triennial election of members, the Africa Scout Committee shall elect a Treasurer from outside its members who shall serve for a term of three years and may be re-elected, without term limits. The nomination of the Regional Treasurer shall be approved by the World Treasurer. Once elected the Treasurer becomes a member of the Africa Scout Committee without vote with the responsibility of advising both the Committee and the Regional Office on finance matters. e). The Regional Director shall serve as Executive Secretary to the Africa Scout Committee without vote. 17

21 4. Le Comité Africain du Scoutisme pourra constituer tout comité subsidiaire ou autre organe qu il estimera nécessaire à l exécution de ses fonctions. ARTICLE IX Président, Vice-Président, Secrétaire 1. a). Après chaque élection triennale de membres, le Comité Africain du Scoutisme élira, parmi ses membres, un Président et un Vice-Président qui seront en fonction pendant trois ans. b). Les réunions du comité sont présidées par le président. En cas d empêchement de celui-ci, elles seront présidées par le vice-président. c). Si le Président et le Vice-Président ne peuvent participer à aucune des réunions, le Comité Africain du Scoutisme pourra élire, parmi ses membres, un Président par intérim. d). Après chaque élection triennale de membres, le Comité Africain du Scoutisme nommera, en dehors de ses membres, un Trésorier qui sera en fonction pendant trois ans et qui peux être reconduis sans limite de nombre de mandats. Le trésorier mondial devra approuver la nomination du trésorier régional. Une fois nommé, le Trésorier devient membre du Comité Africain du Scoutisme, sans droit de vote, avec pour responsabilité de conseiller et le comité et le Bureau Régional sur des questions financières. e). Le Directeur Régional exercera les fonctions de Secrétaire Exécutif auprès du Comité Africain du Scoutisme sans droit de vote. 18

22 CHAPTER 4 THE AFRICA REGIONAL OFFICE OF THE WORLD SCOUT BUREAU ARTICLE X The Africa Regional Office of the World Scout Bureau 1. a). The Africa Regional Office is a branch of the World Scout Bureau in accordance with Articles XVII, paragraph 2 and XX, paragraph 2.c, of the Constitution of the World Organization of the Scout Movement. The Africa Regional Office shall be directed by the Regional Director and shall comprise such other staff as may be required. b). The Regional Director is appointed by the World Scout Bureau in agreement with the Africa Scout Committee, shall be paid by the World Scout Bureau and shall report to the Secretary-General of the World Organization to whom he shall be responsible and to the Africa Scout Committee. Functions 2. The functions of the Africa Regional Office are: a). To serve as a secretariat of the Africa Scout Region. b). To serve as a secretariat of the World Organization in matters relating to the Africa Region. c). To provide the services necessary for the promotion of the Scout Movement in the Africa Region and to maintain relations with Member Organizations and assist them in the development of Scouting. Financing The financing of the Africa Regional Office shall be determined by the World Scout Committee in consultation with the Africa Scout Committee. The Africa Scout Committee shall endeavour to initiate schemes and plans as needed for financing projects and activities to supplement the budgetary allocation from the World Scout Bureau to the Africa Regional Office. 19

23 CHAPTER 4 LE BUREAU REGIONAL AFRIQUE DU BUREAU MONDIAL DU SCOUTISME ARTICLE X Le Bureau Régional Afrique du Bureau Mondial du Scoutisme 1. a). Le Bureau Régional Afrique constitue une branche du Bureau Mondial du Scoutisme, conformément aux Articles XVII, paragraphe 2, et XX, paragraphe 2.c, de la Constitution de l Organisation Mondiale du Mouvement Scout. Le Bureau Régional Afrique sera dirigé par le Directeur Régional et comprendra en outre le personnel nécessaire à son fonctionnement. b). Le Directeur Régional est nommé par le Secrétaire Général en accord avec le Comité régional. Il est payé par le Bureau Mondial du Scoutisme et fait rapport au Secrétaire Général envers lequel il est responsable, et au Comité Africain du Scoutisme. Fonctions 2. Lesfonctions du Bureau Régional Afrique sont : a). De faire office de secrétariat pour la Région Afrique du Scoutisme. b). 24 CHAPTER 5 MISCELLANEOUS PROVISIONS ARTICLE XI Languages Amendments Interpretation The official languages of the Africa Scout Region are English and French. In the event of a conflict arising out of the interpretation of this Constitution or other official documents of the Africa Scout Region, the English text shall prevail. This Constitution may be amended by the Africa Conference at any of its meetings by a two-thirds majority of the votes cast. Texts of proposed amendments shall be communicated by the Africa Regional Office to all Member Organizations in the Africa Region, and members of the Africa Scout Committee, at least three months before the time of the meeting of the Africa Conference. Amendments so carried by the Africa Conference shall become effective upon approval by the World Scout Committee. In the event of a conflict between obligations resulting from the Constitution of the World Organization and obligations resulting from this Constitution, the obligations resulting from the Constitution of the World Organization shall prevail. 21

25 CHAPTER 5 DISPOSITIONS DIVERSES ARTICLE XI Langues Amendements Interprétation Les langues officielles de la Région Afrique du Scoutisme sont l anglais et le français. En cas de conflit survenant de l interprétation de cette Constitution ou de tout autre document officiel de la Région Afrique du Scoutisme le texte anglais prévaudra. La présente Constitution pourra être modifié par la Conférence Africaine, à l une quelconque de ses réunions par un vote acquis à la majorité des deux tiers des voix émises. Le texte des amendements proposés devra être communiqué par le Bureau Régional Afrique à toutes les organisations membres dans la Région africaine, ainsi qu aux membres du Comité Africain du Scoutisme, au moins trois mois avant la date de la réunion de la Conférence Africaine. Les amendements adoptés par la Conférence Africaine entreront en vigueur après ratification par le Comité Mondial du Scoutisme. En cas de conflit entre les obligations résultant de la Constitution de l Organisation Mondiale et les obligations résultant de la présente Constitution, les obligations résultant de la Constitution de l Organisation Mondiale prévaudront. 22

26 CHAPTER 6 RULES OF PROCEDURE FOR THE AFRICA SCOUT CONFERENCE The purpose and principles of the Africa Scout Conference and the general conduct of its meetings are specified in the Constitution, and the Africa Scout Committee has the duty of drawing up the regulations and programme of the Africa Scout Conference. In order that these meetings may be dealt with expeditiously and that there may be no misunderstanding as to the methods adopted, the following rules are published for guidance. PRESIDING OFFICER/CHAIRMAN QUORUM DELEGATES AND OBSERVERS The presiding officer or chairman for each session of the Africa Scout Conference shall be designated by the Africa Scout Committee. The chairman s ruling shall be final. The presence of half of the total number of Member Organizations of the Africa Scout Region shall constitute a quorum for any meeting of the Africa Scout Conference. The rule of precedence of delegations is by alphabetical arrangement of Member Countries represented. 4. Conference delegates and observers shall wear the appropriate uniform they wear in their home countries or as prescribed by their respective Scout Organizations. MEETINGS LANGUAGES PROGRAMME Under ordinary circumstances, the business sessions of the Conference shall be started and ended within the specified time limit. English and French shall be the official languages of the Africa Scout Conference. Other languages may be used if necessary, provided suitable translations are made available. The Conference programme shall include the following essential features: reports, study papers, discussion groups, election of the Africa Scout Committee and their investiture, and fellowship activities. 23

27 CHAPTER 6 REGLES DE PROCEDURE POUR LA CONFERENCE AFRICAINE DE SCOUTISME Les buts et principes de la Conférence Africaine du Scoutisme ainsi que son organisation générale sont définis dans la Constitution. Le Comité Africain du Scoutisme a la responsabilité d établir les règles de procédure et le programme de la Conférence Africaine du Scoutisme. Afin que ces réunions puissent se tenir sans perte de temps et qu il n y ait pas de malentendu quant aux méthodes adoptées, nous publions ci-dessous les règles de procédure à suivre. PRESIDENCE QUORUM DELEGUES ET OBSERVATEURS Le Comité Africain du Scoutisme nomme un président pour chaque session de la Conférence Africaine du Scoutisme. La présence de la moitié du nombre total des organisations membres de la Région Afrique du Scoutisme constitue le quorum requis pour toute réunion de la Conférence Africaine du Scoutisme. L ordre de préséance entre les délégations suit l ordre alphabétique des pays membres représentés. 4. Les délégués et observateurs à la conférence doivent se présenter dans l uniforme scout qu ils portent dans leur pays ou qui est prescrit par leurs Organisations Scoutes Nationales. REUNIONS LANGUES ADOPTEES PROGRAMME Dans des circonstances normales, les séances de travail de la conférence commenceront et se termineront dans les délais prescrits à l avance. Les langues officielles de la Conférence Africaine du Scoutisme sont l anglais et le français. D autres langues peuvent éventuellement être utilisées sous réserve de possibilités de traduction et d interprétation adéquate. Le programme de la conférence doit comporter les points suivants : rapports, mémoires, groupes de travail, élection et investiture des membres du Comité Africain du Scoutisme, ainsi que réunions amicales. 24

Draft copies of the Conference programme shall be sent to Member and Associate Member Scout Organizations, members of the Africa Scout Committee and all others concerned, at least six months before the start of the Conference, for their information and suggestions VOTE 9. Delegates of Member and Associate Member Organizations of the Africa Scout Region shall have the right to vote at all business sessions of the Conference Voting at any meeting of the Conference shall be by Member Organizations, each organization having a maximum of six votes. Observers shall be allowed to participate in the deliberations but they shall not take part in the voting. Voting shall be by ballot or by show of hands as the situation may require. In elections nothing may be entered on the ballot or voting paper except the number of votes cast. The voting paper shall not be signed. Three tellers shall be appointed by the Africa Scout Committee to count the number of votes cast and to announce the results of any vote taken. If any member country wishes to abstain from voting, the paper must be returned marked ABSTAIN and any such action shall have no significance in determining the results of the ballot. All voting papers must be returned to the tellers. After the announcement of all election results, the ballot papers shall be destroyed by the tellers who are bound to secrecy, and the number of votes shall not be announced. 25

Un avant-projet du programme de la conférence sera communiqué pour information et avis aux organisations scoutes membres et membres associés de la Région Afrique du Scoutisme, aux membres du Comité Africain du Scoutisme et à tous les intéressés, au moins six mois avant le début de la conférence. VOTE 9. Les délégués des organisations membres ou membres associés de la Région Afrique du Scoutisme ont le droit de voter lors de toutes les séances de travail de la conférence Le vote à toute réunion de la conférence sera effectué par les organisations membres, chaque organisation ayant au maximum six voix. Les observateurs peuvent prendre part aux débats, mais ne prennent pas part au vote. Selon les cas, il est procédé à un scrutin ou à un simple vote à main levée. Pour être valides, les bulletins de vote doivent comporter exclusivement le nombre de suffrages exprimés. Un bulletin de vote ne doit pas être signé. Le Comité Africain du Scoutisme désigne trois scrutateurs qui dépouillent le scrutin et annoncent le résultat des votes. Dans le cas où une organisation membre souhaiterait ne pas prendre part au vote, elle doit inscrire sur son bulletin «ABSTENTION», l abstention n affecte pas le résultat du scrutin. Tous les bulletins de vote doivent être retournés aux scrutateurs. À l issue de la proclamation des résultats des élections, les scrutateurs, qui sont liés par le secret, détruisent les bulletins. Le nombre de voix obtenues n est pas annoncé. 26

30 STUDY PAPERS DISCUSSION GROUPS In order to afford delegates an opportunity of being informed beforehand by their Member Organizations, the Member Organization opening any important subject for discussion is required to submit the study paper in English or French so as to reach the Africa Regional Office of the World Scout Bureau not later than two months before the opening date of the Conference. If the study is not so received the subject may be dropped from the agenda. Discussion groups composed of at least three delegates from different Member Organizations shall be organized during the first day of the Africa Scout Conference by the Africa Scout Committee Each discussion group shall meet separately at such time and place as may be designated by the Conference chairman. Each discussion group shall be identified by a certain numeral topic and shall be under the charge of the group chairman and a rapporteur. Specific topics or subjects shall be discussed by each group and report on the results of the study meeting shall subsequently be submitted at the designated session of the Conference by the group chairman or the group rapporteur. Observers may attend and take part in the discussion groups of their choice. REMARKS AND SPEECHES 22. In order to give ample opportunity to all who wish to speak on any specific subject, remarks or speeches on the floor shall, except when they relate to study papers, be limited to five minutes for each speaker inclusive of the time taken for translation. 27

31 MEMOIRES GROUPES DE TRAVAIL Afin de permettre aux organisations membres d informer à l avance les membres de leurs délégations, toute organisation membre demandant l inscription d un sujet important à l ordre du jour doit envoyer un mémoire, soit en anglais soit en français, de sorte que celui-ci parvienne au Bureau Mondial du Scoutisme deux mois au plus tard avant la date d ouverture de la conférence. Si le mémoire ne parvient pas au Bureau Régional dans les délais indiqués, ce sujet peut être rayé de l ordre du jour. Le Comité Africain du Scoutisme établit selon le besoin, au cours du premier jour de la Conférence Africaine du Scoutisme, des groupes de travail. Chaque groupe est composé de trois délégués au moins appartenant à différentes organisations membres Chaque groupe de travail se réunit séparément en des lieux et dates qui sont indiqués par le président de la conférence. Chaque groupe de travail est identifié par un numéro ou un sujet d étude particulier. Un président et un rapporteur assurent la bonne marche du groupe de travail. Chaque groupe de travail examine certaines questions ou sujets d études particulières. Le président et le rapporteur du groupe font ensuite rapport à la conférence lors de la séance prévue à cet effet. Les observateurs peuvent assister aux groupes de travail de leur choix, ils peuvent également prendre part à la discussion. BSERVATIONS ET DISCOURS 22. Afin de permettre, à tous ceux qui le désirent, de prendre la parole sur un sujet déterminé, le temps accordé à chaque orateur pour formuler ses observations ou faire un discours est limité à cinq minutes, y compris le temps nécessaire à l interprétation. Cette disposition ne s applique pas aux interventions portant sur les mémoires. 28

32 2 Speakers shall give their names and the names of their Member Organizations every time they speak. RESOLUTIONS 24. Prior to the opening of the Conference, the Africa Scout Committee shall appoint a resolutions committee consisting of at least five members coming from different Member Organizations All resolutions that are to be presented to the Conference shall first be submitted to the resolutions committee, which shall arrange for their drafting in proper form and for their translation and shall present them at the appropriate session of the Conference. Before any resolution or amendment can be put to the Conference, it must be formally proposed and seconded. Both the proposer and the seconder shall not come from the same Member Organization. Resolutions shall be adopted by a simple majority of votes cast; except for resolutions relating to the amendment of the Constitution (Article XI, paragraph 2 of the Constitution). The number of votes shall not be announced, but may be given if it is the general wish of the Conference except in the case of elections and other voting affecting personalities. If an equal number of votes are given for and against a resolution or amendment, the resolution or amendment shall be defeated. When an amendment is made to a resolution, the amendment shall first be put to the Conference for voting before the original resolution. If the amendment is lost, the resolution shall then be put to the Conference for voting. If the amendment is passed then the resolution shall be amended accordingly before it is put to the Conference. 29

Avant l ouverture de la conférence, le Comité Africain du Scoutisme nomme un Comité de Résolutions qui sera composé d au moins cinq membres appartenant à différentes organisations membres Toutes les résolutions présentées à la conférence sont examinées par le Comité des Résolutions. Celui-ci veille à ce que les résolutions soient rédigées dans les formes adéquates, traduites et présentées lors de la séance appropriée de la conférence. Une résolution ou un amendement doit être officiellement proposé et appuyé avant d être présenté à la Conférence. L auteur et le co-auteur ne peuvent être membres d une même organisation membre. Les résolutions seront adoptées à la majorité simple des voix émises, exception faite des résolutions portant sur l amendement de la Constitution (Article XI, paragraphe 2 de la Constitution). Le nombre des voix obtenues ne sera pas annoncé ; il peut cependant être communiqué si la conférence le souhaite, sauf dans le cas d élection ou tout autre vote concernant des personnes. En cas de partage égal des voix lors du vote sur une résolution ou un amendement, la résolution ou l amendement est rejeté. Quand un amendement est proposé à une résolution, c est l amendement qui est d abord soumis au vote de la conférence, avant le texte original de la résolution. Si l amendement est rejeté, la conférence se prononce alors sur le texte de la résolution. Si l amendement est accepté, la résolution ainsi amendée est mise au vote. 30

34 Resolutions of courtesy, congratulations and condolence shall be initiated by the resolutions committee without prejudice to any delegation presenting resolutions of this nature. Should any Member Organization desire to place a resolution before the Conference, particularly one affecting or interpreting policy, precept or principle, a draft shall be forwarded to the Africa Regional Office of the World Scout Bureau and the Africa Scout Committee, at least two months before the opening date of the Conference in order that the subject may be considered by the World Scout Committee and other Member Organizations. 3 a). All resolutions adopted or approved by the Africa Scout Conference regarding matters involving policy, precept or principle shall be forwarded to the World Scout Committee and the World Scout Conference for appropriate action. b). All resolutions adopted by the Africa Scout Conference on matters other than those covered in a) shall be implemented by the Africa Scout Committee with the help of the Africa Regional Office of the World Scout Bureau. 31

35 Le Comité des Résolutions prend l initiative de présenter les résolutions de courtoisie, de félicitations et de condoléances. Cela ne doit pas empêcher une délégation qui le désire de présenter des résolutions de cette nature. Si une Organisation Membre désire présenter une résolution devant la Conférence Africaine, et plus particulièrement une résolution concernant l interprétation de la politique suivie, les préceptes et les principes, elle doit faire parvenir un projet de résolution au Bureau Régional Afrique deux mois au moins avant la date d ouverture de la conférence, de sorte que le Comité Mondial du Scoutisme, le Comité Africain du Scoutisme et les autres organisations membres puissent examiner cette proposition. a). Toutes les résolutions adoptées ou approuvées par la Conférence Africaine du Scoutisme dans les domaines concernant la politique, les préceptes ou les principes sont transmises au Comité Mondial du Scoutisme et à la Conférence Mondiale du Scoutisme qui prendront les mesures appropriées. b). Toutes les résolutions adoptées par la Conférence Africaine du Scoutisme sur des sujets autres que ceux énoncés au paragraphe a) sont mises à exécution par le Comité Africain du Scoutisme aidé dans cette tâche par le Bureau Régional Afrique du Bureau Mondial du Scoutisme.. 32
