3 THE THE SASKATCHEWAN GAZETTE, JANUARY DECEMBER 18, 21, THE SASKATCHEWAN GAZETTE, DECEMBER 21, 2012 REVISED REGULATIONS OF SASKATCHEWAN 951 SASKATCHEWAN REGULATIONS 88/2012 The Municipal Employees Pension Act Sections 2 and 57 Order in Council 680/2012, dated December 12, 2012 (Filed December 12, 2012) Title 1 These regulations may be cited as The Municipal Employees Pension Amendment Regulations, R.R.S. c.m-26 Reg 1 amended 2 The Municipal Employees Pension Regulations are amended in the manner set forth in these regulations. Section 5.1 amended 3(1) Subsection 5.1(1) is amended: (a) by striking out and after clause (c); (b) in clause (d) by adding and ending on December 31, 2012 after January 1, 2011 ; (c) by adding and after clause (d); and (d) by adding the following clause after clause (d): (e) for the period beginning on January 1, 2013, an amount equal to 8.15% of the member s salary. (2) Subsection 5.1(2) is amended: (a) by striking out and after clause (b); (b) in clause (c) by adding and ending on December 31, 2012 after January 1, 2011 ; and (c) by adding the following after clause (c): (d) for the period beginning on January 1, 2013 and ending on December 31, 2014, an amount equal to 11.35% of the employee s salary; and (e) for the period beginning on January 1, 2015, an amount equal to 9% of the employee s salary.

Landing Regional Water Pipeline Utility after Saskatchewan League of Educational Administrators, Directors and Superintendents ; (ii) by adding Southwest Waste Management Authority before Touchwood Hills Regional Landfill Inc. ; and (iii) by adding Yorkville Public Utility Board after Yorkton Housing Authority ; and (b) in Column 2 by adding the entry January 1, 2013 opposite the entries in Column 1 added by subclauses (a)(i) to (iii). Coming into force 5(1) Subject to subsection (2), these regulations come into force on January 1, (2) If these regulations are filed with the Registrar of Regulations after January 1, 2013, these regulations come into force on the day on which they are filed with the Registrar of Regulations.

5 THE SASKATCHEWAN GAZETTE, DECEMBER 21, SASKATCHEWAN REGULATIONS 89/2012 The Fisheries Act (Saskatchewan), 1994 Section 37 Order in Council 681/2012, dated December 12, 2012 (Filed December 12, 2012) Title 1 These regulations may be cited as The Fisheries Amendment Regulations, 2012 (No. 2). R.R.S. c.f-16.1 Reg 1 amended 2 The Fisheries Regulations are amended in the manner set forth in these regulations. Section 2 amended 3 Section 2 is amended: (a) by adding the following clause after clause (d): (d.1) barbless hook means a hook without barbs or one that has its barbs completely compressed against the shaft of the hook so that the barbs are not functional, except those barbs on the shank of the hook that are intended for holding bait ; (b) by adding the following clause before clause (k): (j.1) derby means a competitive fishing event where fish are caught and killed ; (c) by adding the following clause after clause (p): (p.1) Indian means an Indian as defined in the Indian Act (Canada) who has an existing Aboriginal or Treaty right to fish for food in Saskatchewan waters ; (d) by adding the following clause after clause (r): (r.1) Métis means a person, other than an Indian, who has an existing Aboriginal right to fish for food in Saskatchewan waters ; and (e) by adding the following clause after clause (bb): (bb.1) tournament means a competitive fishing event where fish are caught and released. New sections 11.1 and Section 11.1 is repealed and the following substituted: Licence or requirements for competitive fishing event 11.1 No person shall conduct a competitive fishing event unless: (a) the person holds a competitive fishing event licence; or (b) the competitive fishing event meets the requirements set out in Table 11.

6 954 THE SASKATCHEWAN GAZETTE, DECEMBER 21, 2012 Information required for competitive fishing event 11.2(1) Every organizer of a competitive fishing event shall provide the minister with 30 days written notice before the competitive fishing event of all of the following: (a) the event name, date, time and body of water; (b) the name and phone number of the event organizer; (c) the expected number of participants; (d) whether the competitive fishing event is a derby or a tournament; (e) the species of fish targeted. (2) Within 30 days after completion of a competitive fishing event, every organizer shall provide the minister with a written summary of the event s results, including all of the following: (a) (b) (c) (d) (e) (f) (g) the event name, date, time and body of water; the name and phone number of the event organizer; the number of participants; whether the competitive fishing event was a derby or a tournament; the species of fish targeted; the total number of fish weighed or measured by species; the total number of fish killed or judged to be dead by species. Section 14 amended 5(1) Subsection 14(1) is amended: (a) by striking out and after clause (b); and (b) by adding the following after clause (c): (d) designate the gear restrictions for angling in any body of water, portion of any body of water or zone; and (e) designate any body of water, portion of any body of water or zone as closed to competitive fishing events. (2) Subsection 14(2) is amended by striking out or closed time and substituting, closed time, gear restriction or body of water, portion of any body of water or zone closed to competitive fishing events. New section The following section is added after section 19: Importing and selling frozen freshwater fish used as bait 19.1(1) In this section, regulated jurisdiction means a jurisdiction listed in Table 12 of the Appendix.

7 THE SASKATCHEWAN GAZETTE, DECEMBER 21, (2) No person shall, for the purposes of angling with frozen freshwater fish used as bait, do any of the following unless the person can provide proof satisfactory to an officer that the frozen freshwater fish is free of any infection with Viral Hemorrhagic Septicemia Virus Genotype IVb: (a) import into Saskatchewan, or attempt to import into Saskatchewan, frozen freshwater fish from a regulated jurisdiction; (b) use, buy or sell or attempt to use, buy, or sell frozen freshwater fish from a regulated jurisdiction; (c) transport frozen freshwater fish from a regulated jurisdiction; (d) introduce into Saskatchewan waters or dispose of frozen freshwater fish from a regulated jurisdiction. (3) No person shall fail to keep evidence of the origin of all frozen freshwater fish intended to be used as bait that is imported into Saskatchewan. New section 21 7 Section 21 is repealed and the following substituted: Fish taken by angling 21(1) Subject to subsection (2), no person shall market any fish taken by angling. (2) Subsection (1) does not apply with respect to any fish that has been: (a) (b) taken by angling pursuant to these regulations; and preserved through the process of taxidermy. Section 28 amended 8(1) The following subsection is added after subsection 28(1): (1.1) The director may vary any body of water, commercial fishing limit, net mesh size or closed time designated pursuant to subsection (1). (2) Subsection 28(2) is amended by adding or an order by the director pursuant to subsection (1.1) after subsection (1). Section 29 amended 9 Subsection 29(2) is amended: (a) in clause (a) by adding, or is expected to be taken at the time of closure, after has been taken ; and (b) in clause (b) by adding, or is expected to be taken at the time of closure, after has been taken. Section 49 amended 10 Clause 49(b) is repealed and the following substituted: (b) a source outside Saskatchewan if the aquaculturist has a Live Fish Import Permit issued pursuant to the Fish Health Protection Regulations, C.R.C., c.812, or the Health of Animals Regulations, C.R.C., c.296.

8 956 THE SASKATCHEWAN GAZETTE, DECEMBER 21, 2012 Section 50 amended 11 Clause 50(2)(b) is repealed and the following substituted: (b) a certificate of registration issued pursuant to the Fish Inspection Regulations, C.R.C., c.802. Section 61 amended 12 Subsection 61(5) is repealed. Section 64 amended 13 Clause 64(3)(a) is repealed and the following substituted: (a) the holder of a certificate of registration issued pursuant to the Fish Inspection Regulations, C.R.C., c.802. Section 90 amended 14 Subclause 90(1)(n)(iii) is repealed and the following substituted: (iii) any other buoy, stake or other identification: (A) that is specified as a condition of a licence; or (B) in the case of any fishing conducted pursuant to these regulations without a licence, that may be specified by an officer. New sections 91.1 and The following sections are added after section 91: Possession of fish by Indian or Métis 91.1(1) Subject to subsection (2), no person other than an Indian or a Métis shall accept or have in his or her possession fish that has been taken by an Indian or a Métis for food pursuant to Aboriginal or Treaty rights. (2) A non-indian or a non-métis may possess fish that has been taken for food pursuant to Aboriginal or Treaty rights by an Indian or a Métis who is a father, mother, grandfather, grandmother, brother, sister, child, spouse or common-law spouse of the non-indian or non-métis. Fishing by Indian or Métis 91.2(1) Subject to subsection (2), no person other than an Indian or a Métis may assist or aid any Indian or Métis fishing for food pursuant to Aboriginal or Treaty rights. (2) A non-indian or a non-métis may assist or aid an Indian or a Métis who: (a) is a father, mother, grandfather, grandmother, brother, sister, child, spouse or common-law spouse of the non-indian or non-métis; and (b) is fishing for food pursuant to Aboriginal or Treaty rights. (3) If a non-indian or a non-métis is providing assistance or aid pursuant to subsection (2), the non-indian or the non-métis may only fish in accordance with the Act and these regulations. Appendix amended 16(1) The Appendix is amended in the manner set forth in this section. (2) Subclause (a)(iii) of item 4 of Table 1 is repealed.

9 THE SASKATCHEWAN GAZETTE, DECEMBER 21, (3) Table 6 is amended: (a) in item 2 by striking out, cesspool, ; and (b) in clause (b) of item 9 by striking out not more than two and substituting zero. (4) Table 8 is amended: (a) in item 2 by adding and mountain sucker, Catostomus platyrhynchus after cyprinellus ; (b) by repealing item 6; and (c) in item 7 by adding lake whitefish, Coregonus clupeformis and after except. (5) The following Tables are added after Table 10: TABLE 11 [Section 11.1] Competitive Fishing Event Requirements 1 Derby events may be conducted only for northern pike, yellow perch, burbot, lake whitefish, goldeye, lake trout, cisco or rough fish. 2 Tournament events may be conducted only for walleye, sauger, saugeye, largemouth bass, northern pike, yellow perch, burbot or rough fish. 3 Catch and Release Type 1 waters are to be restricted to tournament events. 4 Competitive fishing events are not to be conducted on Catch and Release Type 2 and Type 3 waters or on any other water specified by the minister. 5 Tournaments are not to be conducted for walleye, sauger and saugeye from July 1 to August 31 inclusive unless: (a) the tournament is one of the following tournaments that has operated every year since the angling season: (b) (i) Fish for Freedom Tournament; (ii) Tobin Lake Walleye Tournament; (iii) Saskatchewan Landing Walleye Tournament; (iv) Saskatchewan Premier s Walleye Cup; and the tournament rules either: (i) limit the number of retained fish to three or fewer per boat; or (ii) require the measurement of fish length or fish weight at the point of capture. 6 Competitive fishing events are not to be conducted for lake trout from September 15 to November 15 inclusive.

12 960 THE SASKATCHEWAN GAZETTE, DECEMBER 21, 2012 SASKATCHEWAN REGULATIONS 90/2012 The Education Act, 1995 Section 3 Minister s Order, dated December 17, 2012 (Filed December 17, 2012) Title 1 These regulations may be cited as The Teacher Certification and Classification Amendment Regulations, R.R.S. c.e-0.2 Reg 11 amended 2 The Teacher Certification and Classification Regulations, 2002 are amended in the manner set forth in these regulations. New section The following section is added after section 4: Appeal re certification 4.1(1) If the certifying official refuses to issue a teacher s certificate, the applicant may appeal the decision to the Teacher Education, Certification and Classification Board by submitting to the secretary of that board, within 60 days after the date of the certifying official s decision: (a) a written notice of appeal; and (b) any written submissions and materials in support of the appeal. (2) The appeals committee of the Teacher Education, Certification and Classification Board shall hear the appeal in accordance with clause 274(1)(a) of The Education Act, 1995 and section 59.7 of The Education Regulations, 1986 and make a recommendation to the certifying official respecting the applicant s certification as a teacher. (3) Within 30 days after receiving the recommendation of the appeals committee, the certifying official shall: (a) review the recommendation; (b) make a decision with respect to the applicant s certification; and (c) provide the applicant and the appeals committee with a copy of the certifying official s decision. (4) The decision of the certifying official made pursuant to subsection (3) is final.

13 THE SASKATCHEWAN GAZETTE, DECEMBER 21, RÈGLEMENT DE LA SASKATCHEWAN 90/2012 Loi de 1995 sur l éducation Article 3 Arrêté ministériel en date du 17 décembre 2012 (Déposé le 17 décembre 2012) Titre 1 Règlement de 2012 modifiant le Règlement de 2002 sur l attribution des brevets aux enseignants et la classification des enseignants. Modification du Règl. 11 des R.R.S. ch. E Le Règlement de 2002 sur l attribution des brevets aux enseignants et la classification des enseignants est modifié de la manière énoncée dans le présent règlement. Nouvel article L article qui suit est inséré après l article 4 : «Appel portant sur l attribution d un brevet 4.1(1) Si l agent d attribution des brevets refuse de délivrer un brevet d enseignement, le demandeur peut interjeter appel de la décision à la commission appelée Teacher Education, Certification and Classification Board en remettant au secrétaire de la commission, dans les 60 jours qui suivent la date de la décision : a) un avis d appel écrit; b) tout mémoire et tout autre document qu elle souhaite présenter à l appui de l appel. (2) Le comité d appel de la commission appelée Teacher Education, Certification and Classification Board entend l appel conformément à l alinéa 274(1)a) de la Loi de 1995 sur l éducation et à l article 59.7 du règlement intitulé The Education Regulations, 1986 et fait à l agent d attribution des brevets une recommandation concernant l attribution au demandeur d un brevet d enseignement. (3) Dans les 30 jours qui suivent la réception de la recommandation du comité d appel, l agent d attribution des brevets : a) étudie la recommandation; b) rend une décision concernant l attribution d un brevet d enseignement au demandeur; c) remet une copie de sa décision au demandeur et au comité d appel. (4) La décision de l agent d attribution des brevets rendue en application du paragraphe (3) est définitive».

14 962 THE SASKATCHEWAN GAZETTE, DECEMBER 21, 2012 Section 15 amended 4 Subsections 15(3) and (4) are repealed and the following substituted: (3) It is the responsibility of the teacher to furnish the board of education or conseil scolaire, as the case may be, with evidence of his or her qualifications within the greater of the following periods: (a) 120 days after the day on which the teacher has met the requirements for reclassification; and (b) 120 days after the day on which the teacher commences his or her duties with the board of education or conseil scolaire. (4) If a written notice of appeal respecting the classification of a teacher is submitted to the Teacher Education, Certification and Classification Board within six months after the date of issue of the first salary cheque based on the classification granted by the employing board of education or conseil scolaire, the effective date of the reclassification determined by the appeals committee of the Teacher Education, Certification and Classification Board is the date determined pursuant to subsection (1). (4.1) If a written notice of appeal respecting the classification of a teacher is submitted to the Teacher Education, Certification and Classification Board after the expiration of the six-month period mentioned in subsection (4), the effective date of the reclassification determined by the appeals committee of the Teacher Education, Certification and Classification Board is the date on which the notice of appeal was received by the secretary of the Teacher Education, Certification and Classification Board. Coming into force 5(1) Subject to subsection (2), these regulations come into force on the day on which section 1 of The Education Amendment Act, 2012 comes into force. (2) If these regulations are filed with the Registrar of Regulations after the day on which section 1 of The Education Amendment Act, 2012 comes into force, these regulations come into force on the day on which they are filed with the Registrar of Regulations.

15 THE SASKATCHEWAN GAZETTE, DECEMBER 21, Modification de l article 15 4 Les paragraphes 15(3) et (4) sont abrogés et remplacés par ce qui suit : «(3) Il incombe à l enseignant de fournir à la commission scolaire ou au conseil scolaire, selon le cas, la preuve de ses qualités dans la plus longue des périodes suivantes : a) 120 jours après le jour où l enseignant a rempli les conditions de reclassification; b) 120 jours après le jour où l enseignant est entré en fonctions à la commission scolaire ou au conseil scolaire. «(4) Dans le cas où un avis d appel écrit concernant la classification d un enseignant est remis à la commission appelée Teacher Education, Certification and Classification Board dans les six mois de la date de délivrance du premier chèque de paie en fonction de la classification accordée par la commission scolaire employeur ou le conseil scolaire employeur, la date de prise d effet de la reclassification fixée par le comité d appel de la commission appelée Teacher Education, Certification and Classification Board est la date fixée en vertu du paragraphe (1). «(4.1) Dans le cas où un avis d appel écrit concernant la classification d un enseignant est remis à la commission appelée Teacher Education, Certification and Classification Board après la période de six mois mentionnée au paragraphe (4), la date de prise d effet de la reclassification fixée par le comité d appel de la commission appelée Teacher Education, Certification and Classification Board est la date de réception de l avis d appel par le secrétaire de la commission appelée Teacher Education, Certification and Classification Board».
