8 I. Background Introduction This is a pioneer research of its sort in Pakistan that specifically investigates legislative oversight of police in National Assembly and Provincial Assembly Punjab. This research examines Legislative oversight of police by looking specifically at the question hour sessions of both National Assembly and Provincial Assembly Punjab. The year in focus is the first parliamentary year of the current government. The questions that have been included in the research analysis are only those that require an oral response. 1 The research is important because policing is strongly connected to life, liberty and property rights of the citizenry and assessing the focus of legislative branch of government towards policing is the important first step to bring any substantial reform in the system. Question hour provides parliamentarian an adequate opportunity to hold police department and the concerned ministry/department accountable. While the Legislative branch - comprising elected assembly members - needs to keep an oversight of police, the citizens need to keep a watchful eye over the performance of their representatives in the assemblies. Proceedings of question hour sessions, available freely on National Assembly and Provincial Assembly Punjb s websites, is a valuable instrument for the people to gauge the performance of the parliamentarians. This study is a simplified analysis that scrutinizes the Legislative branch through a microscopic focus; by looking at the nature and scope of such questions to see whether their representative talks about the issues that are of high priority for the citizens. Purpose of this research is to analyze the trends of questions that are raised in these assemblies regarding police. Not only is such analysis required to gauge the magnitude of Parliamentarians focus of these two assemblies towards policing issues, but also to determine the weaknesses in policing and subsequently, in the long run, to include the identified problem areas into future advocacy initiatives for police reform. Moreover, the inefficient mechanism of assembly, which hinders timely response to questions by the parliamentarians, is brought to limelight. II. Methodology Data of questions for oral responses in both the National Assembly and Provincial Assembly Punjab were recorded on excel and coded as to research requirements. Analysis is quantitative in nature and is carried out solely on excel. Except for categorizing the nature of questions 2 through personal Judgment, all the rest of the data has been collected from either National Assembly or Provincial Assembly Punjab s websites. 1 In the National Assembly, questions that require oral response are called questions for oral response while those requiring an oral reply in Provincial Assembly Punjab are called starred questions. 2 Classification into categories such as administrative, development, reform, general information etc

9 III. Importance of question hour session Question hour sessions are an important tool for the legislative branch of the government to scrutinize the performance of the executive branch of government. Opposition parties benefit from questioning the treasury benches by scrutinizing the various dimensions of their performance, development plans, and problems in the system. Question hour is important because it attracts media attention and the probability of betterment in the system becomes more once media focuses upon any specific issue. Question hour is also an important instrument with the members of the assemblies to portray their association with a cause or even to please the voter bank by asking questions pertinent to issues faced by their constituency. IV. Structure of the report The report is structurally divided into two chapters and a section for annexure. The first chapter analyses the questions for oral response during the first parliamentary year in the National assembly. The second chapter conducts a similar analysis of starred questions (requiring an oral response) in the Provincial Assembly Punjab. Complete detail of questions requiring oral response (called starred questions in the Provincial Assembly Punjab) is presented in annexure.

10 Analysis of question hour in the National Assembly (First Parliamentary year: June 1, 2013 May 31, 2014) 1.1 Question hour in the National Assembly 3 The Rules of Procedure and Conduct of Business in the National Assembly, 2007 provide that the first hour of every sitting after the recitation from the Holy Quran, shall be available for asking and answering questions. The question can be asked to obtain information on a matter of public concern within the special cognizance of the Minister to whom it is addressed. Members may ask different questions of public importance in written relating to the functions and working of different Ministries Divisions. A separate notice for each question shall be given in writing to the Secretary and shall specify the official designation of the Minister whom it is addressed. The Concerned Ministry gave answer in writing to the National Assembly and these answers will be placed before the Assembly on specific day. 1.2 Composition of National Assembly Composition of National Assembly has been carried out under two categories, Provincial/geographical representation and Party-wise representation. 1.2a Provincial/geographical representation The National Assembly has a total of 342 members, including 60 seats reserved for women and 10 for non-muslims, as per Article 51. The seats in the National Assembly are allocated to each Province, the Federally Administered Tribal Areas (FATA) and the Federal Capital on the basis of population, as officially published in the last preceding census. 11 1.2b Party-wise representation When we look at the party-wise composition of National Assembly, we see PML (N) leading with 189 seats, followed by PPPP with 46 seats and PTI with 33 seats. The detailed party wise composition of NA is provided in the table below. Of these 2,703 (31.2%) were answered. 5 There were a total of 58 questions related to policing that were scheduled to be answered during the first parliamentary year. Of the 58 questions, only 39 were unique/first timers, while the rest were repeated once, twice, thrice or even four times to get response, we would refer to such questions as repeat questions. During the parliamentary year 35 questions (89.74%) were answered out of the 39 unique questions. 12 question by a parliamentarian when repeated once would appear as two questions, while actually it would only be the same question. 1.3a Response pattern for the oral questions When we analyse at what stage (unique v/s repeat) was the response for question received, we find out that 16/23 questions responded to were unique (69.5%), while the response rate for repeat questions was 4/8 (50%) of the first-time repeat questions, 2/2 (100%) of the second time repeat questions, 1/1(100%) of the third time repeat questions and none of the fourth time repeat questions were responded. Note: It is considered important to mention that there were seven questions that had to be repeated, not once, but twice, thrice or even four times in one case before four of the seven received a reply from the concerned ministry/department. 1.3b Nature of unique questions 6 for oral responses The highest number of parliamentarians questions during the first parliamentary year pertained to police administration (12), followed by 10 questions seeking general information and six question touching areas of police reform/ legal framework. It should be noted that there were quite a few questions that touched more than one category as those questions carried sub-components (more than one questions), in all such cases where multiple a single question touched more than one category, values were fed into all the categories the question corresponded to. 6 Unique questions (or first-timers) as those that have not been brought to the assembly floor for response before.

13 *The categorization of the questions under these eight categories has been done by the author on his personal judgment. Detail of the categorization is presented in Annex: c. Nature of questions raised in PAP When we look at the nature of questions raised in PAP, we find that the focus of the members was highest towards Administrative details (for e.g. number of police stations and their staff) and crime (mostly quantitative figures on crime at a particular location) and criminals (8 each). Followed by the two categories as the most focused upon, questions on police capability and performance and general information scored equally (6 each). Further details are present in the graph.

14 Note: A single question of member comprised 2-3 questions in general. The categorization of questions, as in the NA case, has been done by the author on his own judgment. 1.3d Gender-wise number of questions for oral response A total number of 58 questions for oral responses came up on floor of National Assembly during the first parliamentary year. Out of these 58 questions, 33 were asked by female parliamentarians and 25 by male parliamentarians. It is important to note here that out of these 58 questions; only 39 were unique/first-timers (answered as per the answering schedule / not repeated). 19 questions for oral responses of female parliamentarians were unique as compared to 20 unique questions for oral responses of the male members. Of the 35 out of 58 questions responded to, 18 were asked by female parliamentarians and 17 by male parliamentarians. 1.3e Gender-wise unique v/s repeat questions For the female parliamentarians 19 of the 33 questions, i.e 57.57% were unique, while for male parliamentarians, 20 of the 25 questions, 80%, were unique. The difference in the response percentage of male and female parliamentarians is 22.43%, which is quite significant.

15 Only female parliamentarians fell in the category where questions had to be repeated even three and four times to get answer, while no male parliamentarian reached to that level of questiuon repetition. But to be sure of this trend, of gender discrimnation in question hour, an anylsis of complete question hour sessions, and not merely related to policing issues, must be conducted. There also lies a possibility that this issue of gender discrimination is ministry/department specific; perhaps, questions posed by female parliamentarians are not be taken seriously where they pertain to the internal security issues and law and order environment.

16 1.3f Member-wise unique v/s repeat questions for oral response It is pertinent to repeat that out of the 35 questions that were responded, 23 were unique. From the rest, eight questions had to be repeated once, two questions had to be repeated twice and one question each had to be repeated thrice and four times to get response. The member wise question categorization of unique v/s repeat is presented in table hereunder. 17 1.3e Party-wise number of questions responded v/s not responded PPPP s parliamentarians submitted 19 questions out of which 10 (52.6%) were answered. PML (N) s parliamentarians submitted 15 questions out of which 10 (66.6%) were answered, while MQM s parliamentarians submitted 14 questions out of which six (42.85%) were responded.

18 1.3f Party-wise unique v/s repeat questions When we look at the party-wise distribution of unique (first-timer) v/s repeat questions, we find that eight 7 (57.1%) of the MQM Parliamentarians 14 questions were repeat questions, with one question having to be repeated four times (Repeat 4) to get a response (details of questions repeated more than once will come later on in the report). Seven (36.84%) out of the PPPP Parliamentarians 19 questions were repeat questions, while for PML (N) only three (20%) of the 15 questions were repeat questions. 7 Eight (8) =Four questions repeated once + two questions repeated twice + one question repeated thrice + one question repeated for the fourth time.

19 1.3g Repeat questions worst examples The following table provides the name of members, their parties, question asked and how many times it had to be repeated on the floor of the house. 20 Analysis of question hour in Provincial Assembly Punjab 2.1 Composition of PAP (First Parliamentary year: June 1, 2013 May 30, 2014) Provincial Assembly of the Punjab consists of 371 members: 297 general seats, 66 seats reserved for women and 8 seats reserved for non-muslims. 8 When we look at the party-wise composition of Provincial Assembly Punjab, we see PML (N) leading with 312 seats, followed by PTI with 30 seats and both PPPP and PML with eight seats each. The detailed party wise composition of PAP composition is provided in the table below. A total of 19 starred questions pertaining to policing were brought on floor of the house, of which 16 (84.2%) were responded. 2.2a Gauging efficiency of response to question hour starred questions It is important to note that the average total time required to get response to the oral questions in the Provincial Assembly Punjab was 269 days (38 weeks/ nine months). It is important to state here that questions directly associated with police have strong implications on law and order in the country and should, therefore, be addressed on urgent priority. However, the process to get response to questions was observed to be extremely slow. Details are provided in the table. 8 The Constitution of the Islamic Republic of Pakistan, Article 106(1).

These three questions belonged to two female parliamentarians who belonged to PML (N). 2.3c Party-wise and member-wise response pattern of starred questions A total of 16 questions pertaining to policing issues were responded by the home department in a single sitting during the parliamentary year on 7 March Six questions of PML (N), six of PTI, three of PML, one of JI and one of independent candidate were responded.
