7 INCREASING RISK OF CORPORATE CRIMINAL LIABILITY Supreme Court Regulation No. 13/2016 CONTEXT The most problematic factor in preventing corruption is business person not considering corruption as important issue to be addressed. FOCUS 1. The company benefits from a crime committed on behalf of the company 2. The company has ignored the corrupt practices 3. The company does not prevent corruption IMPACT 1. The company has failed to get business profits because competitors are paying bribery. 2. The affected public sectors are licences, procurement, and trade. 3. The Affected business sectors are water, banking, and electricity.

8 STRONG AND FOCUSSED NATIONAL STRATEGY ON PREVENTING CORRUPTION Presidential Decree No. 54/2018 CONTEXT Stronger collaboration among stakeholder for the prevention of corruption. FOCUS Corruption prevention in government priority sectors includes Licensing and Commerce, State Finance, and Law Enforcement and Bureaucratic Reform. IMPACT Strengthening efforts to prevent corruption in the private sector which includes: a. strengthening the management of database of business actors in various strategic actors at the central and regional levels; b. the application of strict sanctions for business actors who violate the laws and regulations; c. development of communication and advocacy strategies for prevention of corruption management in the business world; and D. developing a culture of integrity for business people.

9 INCREASED BENEFICIAL OWNERSHIP TRANSPARENCY DEMANDS Presidential Decree No. 13/2018 CONTEXT Corporations are often used by perpetrators of crimes to conceal and disguise the identity of the perpetrators and the proceeds of crime. FOCUS Build arrangements and mechanisms for recognizing the beneficial owners of a corporation in order to obtain information about the beneficial owners accurately, up to date and publicly available IMPACT Reducing the risk of criminal acts of money laundering can threaten the stability and integrity of the economic system and financial system, and endanger the joints of life in society, nation and state
