Goewermentskennisgewing Government Notice DEPARTEMENT VAN OWERHEIDSAKE DEPARTMENT OF GOVERNMENTAL AFFAIRS No. 126 No. 126 AFKONDIGING VAN WET VAN NASIONALE VERGADERING PROMULGATION OF ACT OF NATIONAL ASSEMBLY Die volgende Wet, wat ingevolge die Proklamasie op die Instelling van Wetgewende en Uitvoerende Gesag vir Suidwes-Afrika, 1985 (Proklamasie R.l01 van 1985), deur die Nasionale Vergadering aangeneem en deur die Administrateur-generaal onderteken is, word hierby afgekondig ingevolge artikel 18 van daardie Pro klamasie:- No. 12 van : Wysigingswet op Nasionale Onderwys,. The following Act, which has been adopted by the National Assembly and signed by the Administrator-General in terms of the South West Africa Legislative and Executive Authority Establishment Proclamation, 1985 (Proclamation R.l01 of 1985), is hereby published in terms of section 18 of that Proclamation: - No. 12 of : National Education Amendment Act,.

WET Tot wysiging van die Wet op Nasionale Onderwys, 1980, ten einde die bevoegdhede van die Kabinet om s!cole te sluit of die instelling daarvan in te trek, verder te reel; om voorsiening te maak vir die toelating en hertoelating van persone tot staatskole en koshuise daaraan verbonde; om voorsiening te maak vir die heffing van gelde ten opsigte van die toelating of hertoelating van persone tot staatskole en koshuise daaraan verbonde; om sekere handelinge geldig te verklaar; en om voorsiening te maak vir aangeleenthede wat daarmee in veru band staan. (Afrikaanse teks deur die Administrateur-generaal onderteken op 21 Julie ) DAAR WORD BEPAAL deur die Nasionale Vergadering, soos volg:- Wysiging van anikel 6 van Wet 30 van Artikel 6 van die Wet op Nasionale Onderwys, 1980 (hierna die Hoofwet genoem), word hierby gewysig deur subartikel (4) deur die volgende subartikel te vervang: " ( 4) Die [Administrateur-generaal] Kabinet kan 'n skoal, sentrum, klas, koshuis, skoolkliniek of toebehore wat kragtens subartikel (1) ingestel is of geag word aldus ingestel te wees, te eniger tyd vir die tydperk wal!!l nodig ag of vir 'n onbepaalde tydperk sluit of die instelling daarvan intrek: Met dien verstande dat die [Administrateur-generaal] Kabinet voordat hy 'n skool waarvoor 'n skoolkomitee of 'n adviesraad ingestel is, [aldus sluit) die instelling daarvan intrek, aan bedoelde skoolkomitee of adviesraad kennis moet gee van sy voorneme om dit te doen en aan bedoelde skoolkomitee of adviesraad die geleentheid moet bied om op die wyse wat die [Adm i nist ra tc! ur-g t~ ne rn al] Kabinet bepaal vertoe in verband d;.,rrmee tot die [Admlnistrate\lr-generaal] K~Nt_lC:~ te rig.".

3 No Official Gazette Extraordinary 26 July 3 NATIONAL EDUCATION AMENDMENT ACT, Act No. 12, EXPLANATORY NOTE: Words underlined with solid line indicate insertions proposed. Words in bold type in square brackets indicate omissions proposed. ACT To amend the National Education Act, 1980, so as to further regulate the powers of the Cabinet to close or disestablish schools; to provide for the admission and readmission of persons to government schools or hostels attached thereto; to provide for the levy of fees in respect of the admission or readmission of persons to government schools or hostels attached thereto; to validate certain acts; and to provide for matters incidental thereto. (Afrikaans text signed by the Administrator-General on 21 July ) BE IT ENACTED by the National Assembly, as fol lows:- 1. Section 6 of the National Education Act, 1980 (hereinafter referred to as the principal Act), is hereby amended by the substitution for subsection (4) of the following subsection: Amendment of section 6 of Act 30 of " (4) The [Administrator-General] Cabinet may at any time, for the period it deems necessary or for an indefinite period close or disestablish any school, centre, class, hostel, school clinic or accessories established or deemed to have been established under subsection (1): Provided that the [Administrator-General] Cabinet shall, before [so closing] disestablishing any school for which a school committee or advisory board has been established, notify such school committee or advisory board of [his] its intention to do so and afford such school committee, or advisory board the opportunity of making representations with regard thereto to the [Administrator-General] Cabinet in such manner as the [Administrator-General] Cabinet may determine.".

Die volgende artikel word hierby in die Hoofwet na artikel 7 ingevoeg: "Toelating en hertoelating van persone tot staatskole of koshuise daaraan verbonde. 7 A 1 Ondanks andersluidende be in hierdie Wet - (a) moet iemand, wat verlang dat onderrig of losies aan hom verskaf word in, by of aan enige staatskool of koshuis daaraan verbonde, aansoek doen om toelating tot daardie skool of koshuis; (b) moet elke leerling van 'n staatskool en elke inwoner van 'n koshuis verbonde aan enige staatskool jaarliks aansoek doen om toelating tot daardie staatskool of koshuis. (2) Die Kabinet kan te eniger tyd nadat 'n staatskool of koshuis daaraan verbonde kragtens artikel 6(4) gesluit is, vereis dat iemand wat 'n leerling of inwoner van daardie staatskool of koshuis was toe dit aldus gesluit is en verlang dat onderwys of losies in, by of aan daardie skool of koshuis aan hom verskaf of voortgesit word, opnuut aansoek moet doen om toelating tot sodanige skool of koshuis. (3) (a) Die Kabinet kan, ondanks andersluidende bepalings in hierdie Wet, na goeddunke 'n aansoek om die toelating van enigiemand tot enige staatskool of koshuis daaraan verbonde, toestaan of weier. (b) By die toestaan van 'n aansoek ingevolge hierdie subartikel, kan die Kabinet die voorwaardes ople wat hy in elke geval of in die algemeen bepaal. (4) (a) Die Kabinet kan, ondanks andersluidende bepalings in hierdie Wet, te eniger tyd. om redes wat hy voldoende ag die toelating van enige persoon of enige kategorie van persane of persone in die algemeen aan wie onderwys of losies verskaf word in, by of aan enige staatskool of koslntis daaraan verbonde, intrek.

The following section is hereby inserted in the principle Act after section 7: Act No. 12, Insertion of section 7 A in Act 30 of "Admission and readmission of persons to government schools or hostels attached thereto. 7 A 1 Notwithstandin to the contrary contained in this Act - (a) any person desiring that education or boarding be provided to him in, at or by any government school or hostel attached thereto, shall apply for admission to that school or hostel; (b) every pupil of any government school and every resident of any hostel attached to any government school, shall apply annually for admission to that government school or hostel. (2) The Cabinet may at any time after any government school or hostel attached thereto has been closed under section 6(4), require that any person who was a pupil or resident of that government school or hostel when it was so closed and who desires that education or boarding in, at or by that school or hostel be provided to him or be continued, shall apply afresh for admission to such school or hostel. (3) (a) The Cabinet may, notwithstanding anything to the contrary contained in this Act, in its discretion, grant or refuse any application for the admission of any person to any government school or hostel attached thereto. (b) In granting any application in terms of this subsection, the Cabinet may impose the conditions determined by it in every case or generally. (4) (a) The Cabinet may, notwithstanding anything to the contrary contained in this Act, at any time, for the reasons it deems sufficient, withdraw the admission of any person or any category of persons or persons generally to whom education or boarding is provided in, at or by any government school or hostel attached thereto.

Wysiging van artikel 29 van Wet 30 van Artikel 29 van die Hoofwet word hierby gewysig (a) deur na subartikel (1) die volgende subartikel in te voeg: a Die Kabinet kan behoudens die be a- lings van paragrawe (b), (c) en (d), van tyd tot tyd die gelde ten opsigte van die toelating of hertoelating van persone tot skole of koshuise in artikel 7 A beoog, bepaal. (b) Die Kabinet kan wanneer hy die gel de in paragraaf (a) beoog, bepaal, en sonder om afbreuk te doen aan die algemeenheid van bedoelde bepaling, in besonder of in die algemeen die koste vir die instandhouding van, of herstel van skade aan 'n betrokke skool of koshuis, voor of na die inwerkingtreding van die Wysigingswet op Nasionale Onderwys,, aangegaan of bepaal, in aanmerking neem. (c) Iemand wat aansoek doen om toelating of hertoelating, of die persoon wat vir die onderhoud van so iemand verantwoordelik is, moet die gelde in paragraaf (a) bedoel, op die tyd, plek en wyse wat die Sekretaris bepaal, betaal. (d) Gelde kragtens hierdie subartikel bepaal - (i) moet op 'n opvallende plek by die betrokke skool of koshuis vertoon word; (ii) is betaalbaar benewens en nie ter vervanging nie van enige ander gelde betaalbaar ingevolge hierdie artikel.".

7 No Official Gazette Extraordinary 26 July 7 NATIONAL EDUCATION AMENDMENT ACT, Act No. 12, (b) Any person whose admission is withdrawn under this subsection, shall apply afresh for admission thereto if he desires that education or boarding be provided to him in, at or by any government school or hostel attached thereto. (c) The provisions of subsection (3) shall mutatis mutandis apply in relation to any application referred to in paragraph (b). ". 3. Section 29 of the principal Act is hereby amended - Amendment of section 29 of Act 30 of (a) by the insertion after subsection (1) of the following subsection: "(1bis) (a) The Cabinet may, subject to the provisions of paragraphs (b), (c) and (d), from time to time determine the fees in respect of the admission or readmission of persons to schools or hostels contemplated in section 7A. (b) The Cabinet may, when it determines the fees contemplated in paragraph (a), and without derogating from the generality of the said determination, take into account, in particular or generally, the expenditure incurred or determined prior or after the commencement of the National Education Amendment Act,, for the maintenance of or the reparation of damage to any school or hostel concerned. l (c) Any person who applies for admission or readmission, or the person responsible for the maintenance of such person, shall pay the fees referred to in paragraph (a), at the time, place and in the manner determined by the Secretary. (d) Fees determined under this subsection (i) shall be displayed at any prominent place at the school or hostel concerned; (ii) shall be payable in addition to and not in substitution for any other fees payable in terms of this section.".

Geldigvcrklaring van sekere handelinge. Kort titc l. 4. Enigiets wat voor die inwerkingtreding van hierdie Wet deur die Kabinet kragtens enige bepaling van die Hoofwet of die regulasies daarkragtens uitgevaardig, gedoen heet te wees, en wat kragtens 'n bepaling van die Hoofwet soos gewysig deur hierdie Wet, aldus gedoen sou kon word, en wat nie by die inwerkingtreding van hierdie Wet reeds in 'n geregshof tersyde gestel is nie, word vir alle doeleindes geag ooreenkomstig die bepalings van die Hoofwet soos kragtens hierdie Wet gewysig, gedoen te gewees het. 5. Hierdie Wet heet die Wysigingswet op Nasionale Onderwys,.

9 No Official Gazette Extraordinary 26 July 9 NATIONAL EDUC~TION AMENDMENT ACT, Act No. 12, (b) by the substitution for subsection (6) of the following subsection: " (6) Different fees may be determined in respect of - (a) different schools contemplated in subsection (lbis); [a]@ different courses of study in which tuition contemplated m subsection (2)(a) is provided; [b)~ different centres or classes contemplated in subsection (3) or different courses provided in, at or by such centres or classes; [c)@ different persons or categories of persons to whom education or boarding contemplated in this section is provided; [d)~ different hostels or categories of hostels in which boarding contemplated in this section is provided.". 4. Anything purporting to have been done by the Cabinet prior to the commencement of this Act under any provision of the principal Act or the regulations promulgated thereunder and which could have been so done under any provision of the principal Act as amended by this Act, and which has not already been set aside by a court of law at the commencement of this Act, shall for all be purposes deemed to have been done in accordance with the provisions of the principal Act as amended under this Act. 5. This Act shall be called the National Education Amendment Act,. Validation of certain acts. Short title.
