2 ISSISSauGa File: "B" 019/15 WARDS COMMITTEE OF ADJUSTMENT IN THE MATTER OF SECTION 50(3) AND/OR (5) of The Planning Act R.S.O. 1990, c.p.13, as amended - and - IN THE MATTER OF AN APPLICATION BY BCIMC REAL TY CORPORATION on Thursday April 23, 2015 BCIMC Realty Corporation is the owner of part of Lot 17, Concession 4, EHS, located and known as 6325, 6345 & 6375 Dixie Road, 1535 Meyerside Drive, 1550 Courtneypark Drive East and 1495 & 1555 Bonhill Road, zoned E2 & E3 - Employment. The applicant requests the consent of the Committee to the conveyance of a parcel of land having a frontage of approximately m ( ft.) and an area of approximately ha (6.04 ac). The effect of the application is to create a new lot for employment purposes together with the creation of easements for vehicular and pedestrian access, parking aisles and site servicing. The lands are also the subject to Minor Variance files "A"203/15, "A"204/15 & "A"205/15. Mr. M. Crabtree, authorized agent, attended and presented the application to convey a parcel of land for the creation of a new property for employment puwoses. Mr. Crabtree advised the Committee that the subject property was fully developed with employment buildings and that his client wished to separate the properties to be legally independent to facilitate any future transactions. He noted that no new development would occur and that private easements would need to be created to allow for the existing drive aisles to remain legally valid subsequent to the consent. Mr. Crabtree confirmed that relief to the Zoning By-law would be required to allow for shared drive aisles and for a reduction in parking spaces for persons with disabilities. Mr. Crabtree confirmed that the properties had been developed under a former Zoning By-law that had a reduced zoning requirement for such parking spaces. He suggested that it was appropriate to maintain the existing site conditions. The Committee reviewed the information submitted with the application. The Committee received comments and recommendations from the following agencies: City of Mississauga, Planning and Building Department (April 23, 2015), City of Mississauga, Transportation and Works Department (April 17, 2015), City of Mississauga, Community Services Department, Park Planning (April 17, 2015), Region of Peel, Environment, Transportation and Planning Services (April 20, 2015), No other persons expressed any interest in the application. The Secretary-Treasurer reviewed the recommended conditions for the Committee's consideration should the application be approved. Mr. Crabtree consented to the imposition of the proposed conditions. 3 File: "B" 019/15 WARDS There was some discussion with respect to the provision of accessible parking on the subject property. The Committee indicated that its concerns with this matter would be dealt with through the associated Minor Variance applications. The Committee, after considering the submissions put forward by Mr. Crabtree, the comments received and the recommended conditions, is satisfied that a plan of subdivision is not necessary for the proper and orderly development of the municipality. The Committee, having regard to those matters under subsection 51(24) of the Planning Act R.S.O. 1990, c. P.13., as amended, resolves to grant provisional consent subject to the following conditions being fulfilled: 1. Approval of the draft reference plan(s), as applicable, shall be obtained at the Committee of Adjustment office, and; the required number of prints of the resultant deposited reference plan(s) shall be received. 2. An application amendment letter shall be received from the applicant or authorized agent confirming that the conveyed land shall be together with and/or subject to services easement(s) and/or right(s)-of-way, if necessary, in a location and width as determined by the Secretary-Treasurer based on written advice from the agencies having jurisdiction for any service or right for which the easement or right-of-way is required; alternatively, a letter shall be received from the applicant or authorized agent confirming that no services easement(s) and/or right(s)-of-way, are necessary. 3. A letter shall be received from the City of Mississauga, Manager of Zoning Plan Examination, indicating that the conveyed land and retained lands comply with the provisions of the Zoning By-law, or alternatively; that any variances are approved by the appropriate authorities and that such approval is final and binding. 6 2.0 BACKGROUND Mississauga Official Plan Character Area: Designation: M Northeast Employment Area Business Employment File: "A" 203/15 WARDS Zoning By-law Zoning: "E2", Employment 3.0 OTHER APPLICATIONS No other applications currently in process. 4.0 COMMENTS It is our understanding that the purpose of the Consent application is to create a new lot for employment purposes with the creation of easements for vehicular and pedestrian access, parking aisles and site servicing. The subject lands contain office and employment buildings, and the severance would not affect the functioning of the property as it currently exists. Therefore, we have no objection to the Consent application, provided that the severed and retained lands comply with the provision of Zoning By-law , as amended, or alternatively, that any minor variance(s) is approved, final and binding and/or the demolition of any existing building(s) is complete. We advise that based on discussions with the authorized agent, variance #2 for 'A' 203/15 should be amended to indicate four parking spaces for persons with disabilities being provided instead of two as written in the notice. For the minor variance applications, in regards to the requests for shared driveways and aisles, we have no objection to the requested variances as the functioning of the site will remain as it currently exists. In regards to the requests for deficient number of accessible parking spaces, based on the discussions with the authorized agent, we note that the site was developed in 1987 and at the time, met the required Zoning By-law standards for accessible parking spaces. In addition, it is our understanding that the subject property currently has a surplus of parking on-site. Notwithstanding the above information, we are not- satisfied that sufficient justification has been provided for the requested reduction, in particular for variance #2 under 'A' 204/15. Based on the preceding information, we recommend that minor variance applications 'A' 203/15 and 'A' 204/15 be deferred. " The City of Mississauga Transportation and Works Department commented as follows (April 16, 2015): "We are noting for Committee's information that any Transportation and Works Department concerns/requirements for this property will be addressed under Consent Application 'B' 19/15.". The Region of Peel, Environment, Transportation and Planning Services, commented as follows (April 20, 2015): "This property is within the vicinity of Ambler-Courtney, which is a private landfill site. It is an inactive landfill located northeast of Dixie and Courtney Park Dr.. The exact boundaries are unknown. No further information is available." No other persons expressed any interest in the application. Page 2 of 4

7 File: "A" 203/15 WARDS The Committee suggested that an increase in parking spaces for persons with disabilities would be appropriate. They indicated that the proposed provision of just 2 spaces would be insufficient for the functionality of the property. ' Mr. Crabtree upon hearing the comments of the Committee and the Planning and Building Department, requested that the application be amended in accordance with their recommendations. The Committee consented to the request and, after considering the submissions put forward by Mr. Cr_abtree and having reviewed the plans and comments received, is satisfied that the amended request is desirable for the appropriate further development of the subject property. The Committee is satisfied that the general intent and purpose of the Zoning By-law and the Official Plan will be maintained in this instance. The Committee is of the opinion that the amended request is minor in nature in this instance. Page 3 of 4

Therefore, we have no objection to the Consent application, provided that the severed and retained lands comply with the provision of Zoning By-law , as amended, or alternatively, that any minor variance(s) is approved, final and binding and/or the demolition of any existing building(s) is complete, We advise that based on discussions with the authorized agent, variance #2 for 'A' 203/15 should be amended to indicate four parking spaces for persons with disabilities being provided instead of two as written in the notice. For the minor variance applications, in regards to the requests for shared driveways and aisles, we have no objection to the requested variances as the functioning of the site will remain _as it currently exists. In regards to the requests for deficient number of accessible parking spaces, based on the discussions with the authorized agent, we note that the site was developed in 1987 and at the time, met the required Zoning By-law standards for accessible parking spaces. The Region of Peel, Environment, Transportation and Planning Services, commented as follows (April 20, 201S): "Please note the Region relies on the. environmental expertise of the Credit Valley Conservation (CVC) staff for the review of development applications located within, or adjacent to the Greenlands Systems in Peel and their potential impacts on the natural environment. The Region recommends that the City of Mississauga consider comments from the eve and incorporate any of their conditions of approval appropriately." Credit Valley Region Conservation commented as follows (April 21, 201S): Credit Valley Conservation (CVC) has had the opportunity to review the above-noted application and the following comments are provided for your consideration: SITE CHARACTERISTICS: The subject property is adjacent to Cooksville Creek and its associated erosion hazard. It is the policy of CVC and the Province of Ontario to conserve and protect the significant physical, hydrological and biological features associated with the functions of the above noted characteristics and to recommend that no development be permitted which would adversely affect the natural features or ecological functions of these areas. As you may be aware, the subject property is adjacent to the City of Mississauga Natural Area Survey (NAS) designated as H06. ONTARIO REGULATION 160/06: This property is subject to the Development, Interference with Wetlands, and Alterations to Shorelines & Watercourses Regulation (Ontario Regulation 160/06). This regulation prohibits altering a watercourse, wetland or shoreline and prohibits development in areas adjacent to the Lake Ontario shoreline, river and stream valleys, hazardous lands and wetlands, without the prior written approval of Credit Valley Conservation (CVC) (i.e. the issuance of a permit). PROPOSAL: The applicants request the Committee to authorize a minor variance to permit the construction of a new pool within the rear yard of the subject property proposing a setback of l.som (4.92 ft.) to the adjacent Gl-Greenbelt zone; whereas By-law 022S-2007, as amended, requires a minimum setback of S.OOm (16.40 ft.) from a pool to a Gl - Greenbelt zone in this instance. COMMENTS: It is suggested that the setback of Sm be maintained to act as a buffer to watercourse and its valley system to the proposed development. However, recognizing that the proposed pool is outside of the erosion hazard, there is existing infrastructure (trail) that is beyond the subject property, and the proposed pool does not extent closer to the creek than the existing pool on the property, eve has no objection to the approval of the application by the Committee at this time. The applicant is to note that the pool drainage is to be directed towards the front of the property and not towards the adjacent watercourse. A CVC permit is required for the proposed development. Masek, a resident of 1423 Rometown Drive, attended and expressed his objection to the subject application. Mr. Masek advised the Committee the proposed dwelling would be incompatible with the smaller dwellings along Rometown Drive. Mr. J. Lee, a Planner for the Planning and Building Department, attended and confirmed that the property had been subject to extensive development review.
